Following discussion, Mr. Lockwood moved that $75,000.00 be paid from the Road Fund and that $6,957.15 be paid from the general fund. Mike Wagner provided support and the motion passed by a ?ll vote. Mr. Lockwood advised the Board that Carolyn Sorenson, daughter of Mary Smith, which had been cited for violations of the Ellington Township Blight Ordinance, had contacted him and indicated that her mother had been in an accident, and that the blight problem will be remedied by the end of May 2014. Mr. Howell, our attorney has been contacted and the violation will not be perused unless the entire blight is not removed by May 30, The next item of business relates to a resolution regarding the establishment of elected township of?cer?s salaries. It was noted that the cost of living and the responsibilities have increased, and that the salary levels for the Supervisor, Trustees and Clerk had not increased since 2007, and the salary of the Treasurer had not been increased since 2010. Following discussion Duane Lockwood offered the following resolution which was supported by Mike Wagner. Whereas, MCL 41.95 authorizes the township board of Ellington Township to determine the salaries for the of?ces of Supervisor, Clerk, Treasurer and Trustees for the ?scal year of 2014 2015, by adopting a resolution for each of?ce at least 30 days prior to the township annual meeting of the electors, and Whereas, the township board deems that an adjustment in the salary of the elected of?cers is warranted in consideration of cost of living or additional responsibilities taken on by those of?cers, since the township board members salaries were last adjusted, now be it resolved, that as of April 1, 2014, the annual salaries of the following of?ces shall be adjusted upward by the maximum following percent. Supervisor 10% Clerk 15% Treasurer 15% Trustee 10% Be it also resolved, that this resolution shall be submitted to the electors at the annual meeting to be held on March 29, 2014, at which time the electors may modify these amounts. Pursuant to MCL 4195(7), such modi?cations that may be made by the. electors cannot result in a reduction of salary during an of?cial?s term of of?ce unless the responsibilities and requirements of that of?ce are diminished, and the of?cial agrees in writing to that reduction. In the event that the electors fail to act on this resolution, the of?cers shall be entitled to the salary as established in this resolution, in accordance with state law. Be it further resolved that this resolution, adopted January 14, 2014, is properly adopted by the Ellington Township Board at least 30m days prior to the annual meeting, as required by law. The supervisor declared the resolution adopted Following a short discussion, Duane Lockwood moved that the Annual Meeting be held on. March 29, 2014 at 1:30 PM at the Ellington Township Hall. Support was. provided by Fred Bardwell and the motion passed by a full vote. Mr. Lockwood has made several contacts with Gary Howell regarding the potential new refuse contract. Currently the Township has been advised that a noti?cation to Emterra had to be sent no less than 120 days prior to March 31, 2013. This clause was not realized and the township missed the deadline. Mr. Lockwood has made contact. with a. representative of Emterra and he will be present at the next regular meeting. Discussion and questions followed, but no decision was made at this time, as to which party to source the service with. A short discussion regarding the 2014 2015 ?re contract with the City of Caro resulted in no decision. Duane advised the Board that he had received a Thank You Card from the Rushlo family. Diane Wilder noted that the General Fund Saving account has been inactive for approximately one year, and following discussion, Fred Bardwell moved that $10.00 be transferred from the General Fund Checking to the General Fund Savings account. In summary, the cost ranged between $13.79 to $14.63 per household, during the contract. Following the discussion with the board, Mr. was to contact the company owners and see if any other adjustments were in order. He is to contact Duane Lockwood when a decision was made. 1 Mr. Lockwood advised the board that the Tuscola County Road Commission needed a letter by March 31, 2014 regarding potential road work. It was noted that the actual list may not be available until after the annual meeting on March 29, 2014. It appears that all of the allowances remain in place. Mr. Gary Varisto, representing Emterra, discussed the revised ?ve year road side refuse contract, which had been revised to $13.00 per household per month for the period of 1 April 2014 through March 2019. Following an agreement by Mr. Varisto to modify the contract language to allow the Township to cancel the contract with a 30 day noti?cation, if there is a breach of service; Duane Lockwood moved that the contract be approved. Mr. Mark Trumbauer of Nextera and Mr. David Hollander of Atwell presented their wind turbine proposal to the Board and answered questions regarding the upcoming conditional zoning request to place a Met tower in section 6 of Ellington Township, on a parcel owned by Brent Robinson. The tower would be 198 feet tall and they anticipate the request for wind turbine permits to be made in 2015 for completion in 2016. They provided a site plan drawing which will be made part of the Met tower conditional request. The current plan anticipates at least six turbines located in sections Ellington Township. They will work with Mr. Lockwood and our attorney to schedule a Planning Commission meeting to review the upcoming request. Diane Wilder noted that there were 57 parcels which were delinquent for summer taxes and 84 parcels which were delinquent for winter taxes. Mr. Lockwood noted that there were eleven complaints ?led with the Board of Review, two disabled veteran?s requests, and four poverty exemption requests. Mn; Lockwood then suggested that the BOR be paid at $15.00 per hour and following discussion, Mr. Bardwell moved that the BOR rate be adjusted to $15.00 per hour. Support was provided by Diane Wilder and following a tie vote, Mr. Lockwood voted in favor of the motion and the motion passed by a majority vote of three to two. Susan Jensen, township assessor, addressed the board in regards to the state audit performed on portions of the township records in each township of Tuscola County, by an outside ?rm hired, by the state. The audit was done very quickly and it appears that no one in the state has passed the audit. In several cases the requested data was available 1 but not in the area which the outside ?rm reviewed. There are no written state guidelines as to where to store the data. Ellington had ?ve areas of non compliance. Ellington drafted a response letter to the state which indicated, per Walt, at the Equalization Department, we will attempt to be compliant. We requested the state provide written guidelines. Susan read the letter and following discussion, Fred Bardwell moved the letter be sent as drafted. Support was provided by Diane Wilder and the motion passed by a full vote. Mr. Lockwood indicated to the board that the Township did not receive the entire allowance on the Gerou Road project because the entire mile was not worked on. Mr. Lockwood also indicated that the estimate for asphalt work for Orr Road had came in as $84,006.50 from Albrecht. Following a discussion regarding the blight problem with the Smith property across from the township hall, it was noted that the township had allowed until May 1, 2014 for the premises to be cleaned up. Diane Wilder advised the board that a single property in section 19 which was foreclosed upon and available for township purchase. Diane Wilder suggested that the July news letter include a section regarding the re?ise policy clause which allowed a township resident to take one load of roo?ng material to Emterra per month at no charge. In addition it was suggested to include a section on the blight ordinance. Mike Wagner requested his new cell number be listed in the letter. Mr. Bardwell will accommodate the request. Mr. Lockwood inquired from the audience if there were any issues which should be brought to the attention of the board. Mrs. Zmierski noted that she had concerns regarding the Ellington Township Wind Turbine Ordinance and suggested that the township review the Huron County Ordinance, which she indicates is more restrictive. Their ordinance is four times longer than Ellington?s and she feels that the setback should be reviewed. Copies of the ordinance were left for review and it was noted that the next Planning Commission meeting is scheduled for June 17, 2014 at 7:30 PM at the township Hall. Diane Wilder noted that there are instances where the balances in the Township accounts exceed the FDIC insurance levels. Following discussion, Diane was to investigate the issue further. Following a discussion regarding the blight problem with the Smith property across from the township hall, it was noted that the township had allowed until May 1, 2014 for the premises to be cleaned up. Craig Sorenson, a son in law had contacted Duane and indicated that Bartnik should be removing the Semi Trailers and that the logs should be removed shortly. The township attorney is pursuing the matter. Mr. Lockwood also noted that the City of Caro Fire meeting is scheduled for June 14, 2014 at 7:00 Pm and that the Township Planning Commission meeting is scheduled for 7:30 PM on June 17, 2014. Rob Eggers, representing Spicer Industries will be attending to explain the functions which his ?rm has been providing to the neighboring townships in regard to the Wind Turbines Mr. Lockwood led a discussion regarding the painting of the township hall porch and the potential replacement of the side door and removal and bricking of the back door of the township hall. Duane IS to contact Raymond Spaulding. Following discussion regarding the FDIC coverage of the township ?mds, it was decided to table the item until next month, so that further information can be obtained and understood. Mr. Lockwood advised the board that Brent Robinson is in the process of constructing four barns, a calf barn and a tool shed on the property behind the Rockwell property. Brent has discussed the construction with the Rockwell?s. The structures will use a straw pack system for manure handling. There will be no manure lagoon. The front of the building will be approximately 300 feet from the road and each barn will be approximately 104 60 feet. There will be no milking facility. Duane has been working on a split in section 14 for the old Kutey property. The owner was informed that a survey was required. Mr. Ronald Cybalski inquired as to the reason why Ellington was using 22A gravel versus line stone. Mr. Lockwood noted that the limestone was more costly and that once it was used, you normally needed to continue to use the same material. 2 Diane Wilder noted that the trees on Akron Road are growing back. Duane will discuss the situation with Mr. Kappen. This situation was expected. The first roadside cutting by Roadside Maintenance was completed and following discussion of the $4,100.00 invoice, a motion for payment was made by Fred Bardwell and supported by Diane Wilder to pay the document from the Road Fund. Mr. Lockwood reviewed the $1,800.00 Spicer Engineering proposal to oversee the Wind Turbine project within Ellington Township. Their first item is to review the Zoning Ordinance and make suggestions. Mr. Lockwood introduced Brian and Betsy McHugh which provided a general review of their potential plans to operate a greater than seven beds foster care home at 2945 Deckerville Road. They have over 30 years of experience and currently Operate a foster care facility in the Kingston area. They would like to expand to approximately 24 beds. They provided the majority of the items which would be needed for a site plan review by the Planning Commission. It was also noted that several buildings on the proposed site were constructed without zoning or building permits and that that issue needed to be resolved. The board explained that the McHugh?s needed to request a site plan review and that they were to contact Stacy Campbell to start the process. Mr. Bardwell inquired as to the status of the water pumps at the cemetery and Mr. Lockwood indicated he would check with the contractor. The current fees are net covering the expenses incurred and it has been determined that the. surrounding townships charge much more than Ellington. Lockwood advised the board that the wind tower leases are wrapping up and that the met tower was erected a week ago. Mr. Zimrski advised the board that the "brush and trees near the corner of Colwood and MC Gregoty need to be retrieved. Township of Ellington Minutes September 9, 2014 Meeting called to order by Supervisor Duane Lockwood at 7:30 pm on September 9, 2014. We are processing with lawyer on the tax tribunal at this time they recommended we do this then go after them on the permits issue. Susan?s paperwork for tribunal had to be in by the 19th of September, as it was. Duane reported that we had an extra fee with The Wilkinson Co for an extra application of brine on Gerou, Metcalf due to the new gravel for a total of $825.50. The gravel for the township has all been done and the second application of brine also applied. Duane reported on the William Putnam poll building that had been brought to the attention of the board by Jerry Peters that it is on Mr. Peter?s property not all on Mr. Putnam?s. Duane told him that we are turning this over to the county building codes, and if there are more questions he needed to have the property surveyed for correct boundaries. Duane brought up that we will have a Planning Committee meeting September 16, 2014 at the township hall at 7:30. Rob Eggers from Spicer, David from Nexteer will possibly be there along with Brian from the attorney?s, 8: Susan Jensen. Fred Bardwell brought up the increase in minimum wage, and that we presently had 3 people under that wage. Cemetery labor, Deputy Clerk 8: Deputy Treasurer. It was discussed and Duane Lockwood made the motion to raise the 2 deputy?s and Sara Skinner?s wages to $8.25, and Robert Skinner (head of cemetery) to $9.25. Seconded by Fred Bardwell. Duane Lockwood made motion to accept the applications with Diane Wilder seconding. Motion passed with full vote. David Bellingar discussed the insurance policy for the township. Duane Lockwood made motion to accept insurance policy with the change of $10,000.00 for inland Marine coverage. Diane Wilder second. Motion passed with full vote. Diane Wilder discussed the audit that was completed. The only thing found was the Segregation of Duties. Joddy Ehrenberg brought up with the passing of Fred Bardwell should another audit be completed. Since the audit was just completed Joddy Ehrenberg was confident another one would not need to be completed. Duane Lockwood discussed the position of Sexton for the cemetery and Diane Traster would like to volunteer for the position, which was tabled. Pat Price and Mike Wagner thought that the position should be posted in the papers of Cass City and Advertiser for 2 weeks with a resume required. The board will go over the resumes at the next meeting. Duane Lockwood will take care of the posting. Duane Lockwood made motion to appoint Joddy Ehrenberg to replace Fred Bardwell for the Planning Commission Board with Mike Wagner seconding. Motion passed with full vote. Discussion of Fred Bardwell?s last check and Joddy Ehrenberg?s payroll. Mike Wagner made the motion to pay full amount for Fred Bardwell?s last check and Joddy Ehrenberg will receive $800.00 per month for the remaining 7 months through April 2015. Duane Lockwood second the motion and the motion was passed while Joddy Ehrenberg abstained. Adjusting the budget was tabled. Discussed setting the garbage amount before the 2014 winter tax bill went out. it was discussed to lower the amount by $10.00 which would make the yearly payment of$140.00. Duane Lockwood made the motion to accept the Election Inspectors as follows; Kay Chandler being the Chairperson, Iris Kappen, Karen Smale, Randy Beth Skinner and Suzy Rockwell with Mike Wagner seconding. Mary Smith still has not removed the trailers so this will be pursued and going court. Michelle, from the road commission, sent to Duane Lockwood the updated list of the roads. There were a couple of roads, Jacob Rd-Tomlinson Rd to Gerou Rd, Jacob Rd-Tomlinson Rd to Dutcher Rd and Plain Rd-Deckerville Rd to Gilford Rd, which were the oldest that needed graveled for next year. Diane Wilder second and motion passed with full vote. Hartel?s tribunal case has been withdrawn. There will be a fire meeting on December 10, 2014 7:00 in the municipal building the fire hall. We have not been able to get into Fred Bardwell?s computer, so Duane Lockwood and Diane Wilder talked and checked to see if anybody can get into it. Pro-Tech can do it within an hour $75.00 but thought he could do it in a V2 hour, which would be $37.50, and put the information on a flash drive. Duane Lockwood made the motion to have Pro-Tech do this and Pat Price second. Motion passed with full vote. Duane Lockwood opened the meeting up for public comment. Dave Spiers had questions regarding his property taxes. Duane Lockwood mentioned the Board of Review Class in Caro and recommended and hope to have the full board attend. He will be putting on the application to the Road Commission for the following: Gravel work for Plain Road from Deckerville to Gilford Roads and Gilford Road (1/4 mile stretch est. from Dodge Road West) and the Asphalt work for Jacob Road from Tomlinson to Gerou Roads and for Jacob Road from Gerou to Dutcher Roads. Road Commission bill that was tabled from last month was questioned and explained that matching funds were taken away to balance the budget from everybody. We do owe the $28,509.75. RE: Pole Building Setback Dear Mr. Peters and Mr. Putman: It is my understanding that a concern has been raised regarding the setback distance of the pole building recently constructed on Parcel No. 008- 026~000?0800?02, commonly known as 4001 E. Deckerville Road. In the Residential Zoning District the mandatory side-yard setback is 25 feet from the property line. According to the application submitted by Kacie Putman on October 29, 2018, it is represented that the side?yard setback of the building will be 30 feet. Based on the application and the applicable zoning restrictions, the Ellington Township Zoning Administrator issued a zoning permit indicating that the proposed building would meet zoning requirements. In Tuscola County, building permits and inspections are handled by the county rather than the townships. It is not the township?s responsibility or practice to get involved in building construction issues once the County Building Department has taken charge of the project. If there are concerns about setback complilance, the issue should be addressed to the county. The Township will have no further involvement in this issue. Attorneys sent letter to Mr. Peters. Mr. Peters hired Drillock law office out of Mariette for survey. Duane Lockwood discussed bidding of the roads. Duane Lockwood proposed that we do all of them and made the motion to accept the bid of Albrecht for the road work, a copy of 2015 local road projects is attached with the minutes and Mike Wagner seconding. Motion passed with full vote. Diane Wilder said the (315 are up and Ellington is completed and online. Thorn Bardwell presented to the board the proposals for the Ellington Twp. Cemetery Software; a copy of the proposals is attached with the minutes. Diane Wilder made motion to purchase CIMS Light Database Software and Mike Wagner seconding. Motion passed with full vote. Duane Lockwood opened the meeting to the public; brought to our attention that Paramount is going to fast on Dutcher Rd and making it to dusty. They brought to our attention that you have been disposing of needles and syringes in your garbage bags. Under Michigan law it is illegal for a person to dispose of these types of objects in your garbage bag. They must be placed in a container purchased from a pharmacy and then it can be mailed to the company that disposes of these types of objects properly. Emterra has advised us that they will discontinue picking up your garbage if they find more needles and syringes. These can be harmful to the workers if they are punctured while putting the bags in the truck. Please contact me to let me know that you have discontinued putting the needles and syringes in the garbage bags and I will let Emterra know that it is safe for their workers to continue picking up your garbage. Although expensive to incorporate the mapping, if there is any desire to include mapping, the time to integrate the mapping would be in the conversion. provides both a paper map as well as the capability to print maps. It is also a relatively intuitive software to use. Pontem also includes mapping howeverthe computer screen from an aerial picture. GIS Mapping is available at a comparable expense to BS A?s Cemetery Management is also a database. This is not a leading BS A product and is not as user friendly as other software. BS 8: A rely on training as you can see in the proposal. In comparison to the other software?s, tech support provides the guidance when questions arise in the use of the software. BS A was the slowest to respond to my request for cemetery management software. Ellington Township Cemetery Software Proposals Con?t: Most all are web based and have yearly maintenance /support/ update fees. Light, and are not web based. The proposals for each of these companies are available for review and comprise a file that is too large to scan and attache. With that said, I?ll provide the ?le to you at your request for review. Jeffery Wood from Spicer came to the cemetery to meet with Thom Bardwell, Duane Lockwood and Joddy Ehrenberg to discuss a bid on mapping and plotting the cemetery. Garner Attorney to discuss the new rules for Freedom of Information Act. FIRE CONTRACT This agreement made this First day of July, 2015 by and between the City of Caro, a municipal corporation of the County of Tuscola, State of Michigan, hereafter referred to as the CITY, and the Township of Ellington, a governmental subdivision of the County of Tuscola, State of Michigan, hereinafter referred to as the TOWNSHIP. Whereas, the TOWNSHIP has requested the CITY provide ?re protection by the City of Caro Fire Department to certain portions of the TOWNSHIP and it is in the common interest for the parties to? enter into this agreement, the CITY and TOWNSHIP agree and contract as follows: 1. 4. COVERAGE AREA. The township areas covered by this agreement are as follows: 22 Sections: The SW 1/4 of Sec. 3: the 1/2 of Sec. 10 and the 1/2 ofthe SE 1A ofSec. 10: the V2 ofthe NW ofSec. 14: the 1/2 ofthe 1/2 of Sec. 34; and all of Sections and 33. FIRE SERVICES. The CITY covenants and will provide the same degree of ?re department services within the designated portions of the TOWNSHIP as is furnished to those within the CITY subject to the conditions and limitations listed in this agreement. RESPONSE AND FIRE RESPONSE covenants and agrees that it will respond to ?re alarms; ?re calls, hazardous materials incidents; incidents where extrication of victims is required; calls where assistance is required due to natural or manmade disasters and any other incident where ?re department equipment, personnel or expertise are required. Provided the ?re department is not otherwise engaged in an incident within the CITY limits which requires use of all apparatus and personnel. In the event that the Chief of the ?re department or his representative or the Mayor of the City shall in his discretion determine that such an emergency exists within the limits of the CITY that the use of apparatus and/or personnel would materially interfere with the adequate protection of life and property within the limits of the CITY, the CITY shall be relieved from all obligations under this contract to furnish protection outlined above to the designated portions of the TOWNSHIP. If, while engaged in an incident in said designated City limits, the Fire Chief or his representative shall have full authority in his discretion to respond thereto with such equipment and personnel, as in his opinion may be spared therefore, or he may in his discretion respond with all the equipment and personnel, and for this, neither the TOWNSHIP nor any property owner in said designated portion of the TOWNSHIP shall have or make any claim against the CITY by reason of damage to or loss of property. If such case arises, the Fire Chief or his representative will request mutual aid ?om ?re departments with whom an agreement is in place. FEES. The TOWNSHIP shall pay for services under this agreement as follows: A. For ?re services, the TOWNSHIP shall pay $14,412.37 payable in full by June 30, 2015. B. The township shall not be responsible for fees involving hazardous materials incidents. PERIOD OF AGREEMENT. The parties to this agreement are aware that this agreement for ?re services is for a term commencing July 1, 2015 and termination June 30, 2016. EQUIPMENT TO BE SUPPLIES. The equipment utilized for service under this agreement is limited to mobile ?re ?ghting apparatus, and any other equipment deemed necessary for use by the ?re chief or his representative. Ownership of all said equipment, all personal and real property associated with the City ?re department is at all times vested with the City. COVERAGE BY AGENTS OR AID CONFLICTS. It is understood that the CITY may enter into contracts similar to this contract with the County of Tuscola or other townships adjacent to the CITY for ?re protection to such townships or portions thereof. The parties hereto agree that in the event emergencies shall arise or exist in two or more places to which the CITY shall have thus and has hereby contracted to render ?re protection service, then in such event the place to which said ?re department shall apply its resources shall be the sole discretion of the Fire Chief or his representative. In determining which resources will be committed under this agreement, the Fire Chief or his representative will keep in mind the nature of the incidents, threat to life and property; real or potential. The CITY shall be relieved from reasonable obligation to the TOWNSHIP under this agreement as to such circumstances. The ?rst party agrees to furnish unto the second party ?re protection services comparable to that now furnished by the ?rst party for its own townshiphsubj ect only to the limitations and conditions hereinafter set forth. This determination shall be required in the event of simultaneous ?res in different locations. 3. It is understood and agreed by the parties hereto that the purpose of the agreement is to suppress the spread of ?r and subsequent loss of property within the designated portions of? the municipath of the second party, and that such service is being supplied by the ?rst party in its governmental capacity only and not in a proprietary nature. Joddy Ehrenberg Ellington Township Clerk Proposal to Map Ellington Township Cemetery August 12, 2015 1 Map the cemetery blocks (8) and plots (about 680) as shown on the 1964 cemetery map using ESRI ArcG is software. 2 Map the grave spaces (about 3400+?) using information provided by the township. 3 Label the mapped blocks, plots, and spaces with information provided by the township. 4 Map roads and fences. 5 Map building. 6 Provide preliminary map and data to the township for review. 7 Make corrections based on the township's review. 8 Deliver final product to the township to include: a Mapped Blocks and Plots in and printed booklet format, to include overall cemetery plan with key to detail maps of plots on additional pages. (This allows the township to print additional booklets at any time.) Mapped Blocks, Plots, and Spaces in three formats.
