This case was  filed three  years and 54  days  after the cyber­theft that forms  the basis for  I  I  the lawsuit. Petitioner McCaleb filed his Motion for Summary Judgment Based on the Statute  I  the subject  of this Petition.  McCaleb intends to seek a stay  of all further proceedings in the trial  I  I  I  I  I  I  I  I  I  I  I  I  I  of  Limitations  on  June  30,  2016.  The  trial  court  granted  the  Raggios'  request  for  discovery  to  respond to  the  motion.  The trial  court has now entered  an Order denying the  motion,  which is  court upon the filing  of this Petition. Counsel is unaware  of any other cases or petitions presently  pending  before  the  Mississippi  Supreme  Court  or Mississippi  Court of Appeals  addressing  the  issue presented by this Petition or related in any way to this case.  STATEMENT AS TO WHY THIS PETITION IS TIMELY  The order was signed on November  16,  2017  and  entered on November 17,  2017.  This  Petition  is  being  filed  within 21  days  of entry  of the  order  and  is,  therefore,  timely. Miss.  R.  App. P. 5(a).  The order is attached as Exhibit A.  QUESTION PRESENTED  Does the  statute of limitations bar a claim which was filed three years and 54  days after  the cyber­theft forming the basis for the lawsuit when that cyber­theft was immediately known to  the plaintiffs?  STATEMENT OF RELEVANT FACTS  This petition provides a set  of undisputed facts, the likes  of which are rare in Mississippi.  The facts are part Wall Street speculation, part cyber­science­fiction, and part old­fashioned bank  robbery.  It  involves the alleged theft  of bitcoins.  A bitcoin is a form  of digital currency that can  be used to purchase goods and services and  is traded online much like stocks.  A bitcoin  is not a  physical  coin­it  only exists electronically.  Because  of its recent meteoric rise in value, bitcoin  has been widely reported on in the national media.  See,  e.g., Business Insider, "What is Bitcoin?  1  I  I  I  I  I  I  I  I  I  I  I  I  I  I  I  I l 1 OOO­hitting­latest­all­time­high/#7b4dd7086ae6.  Petitioners,  Jed  McCaleb  and  Code  Collective,  LLC  (collectively  "McCaleb"  or  "Petitioners") created and owned the MTGOX bitcoin exchange, which allowed users to buy and  sell  bitcoins.  McCaleb  is  a  California­based  software  designer.  Currently,  McCaleb  is  the  Founder and Chief Technology  Officer  of Stellar,  a nonprofit organization with the mission "to  connect  people  to  low­cost  financial  services  to  fight  poverty  and  maximize  individual  potential," with corporate donors such as BlackRock and Google.  See, e.g.,  Bio of Jed McCaleb,  accessible  online  at  https://www.stellar.org/about/jed­mccaleb/;  see  also  Stellar  Basics,  accessible  online  at  https://www.stellar.org/how­it­works/stellar­basics/;  Stellar  Development  Foundation Mandate, accessible online at https://www.stellar.org/about/mandate/.  Drs.  Donald and  Chris  Raggio  ("the  Raggios"  or "Respondents") created an  account on  the  MTGOX  exchange  in  2010  and  deposited  $5,000.  There  was  no  written  contract  or  user  terms involved in setting up  the  account.  The Raggios began trading bitcoins with other users,  including placing orders  in "the dark pool."  See,  Relevant E­mails, attached as Exhibit  B, at p.  4­6.  The  purchased  bitcoins  were  placed  in  the  Raggios'  MTGOX  account.  See,  Affidavit of  Chris Raggio, attached as Exhibit  C.  The Raggios allege that on January 9,  2011,  a hacker stole approximately 9,400 bitcoins  from their MTGOX account. See Complaint, attached as Exhibit  D.  To be clear, the Raggios do  not allege that the hacker stole the bitcoins from MTGOX by compromising its security; instead,  someone  accessed  their  MTGOX  account  using  their password  and  transferred  the  bitcoins  to  2  I  I  I  I  I  another  MTGOX  account.  $3,100 ($0.33  per bitcoin). I  I  I  I  I  I  I  I  I  I  I  I  1  See  Affidavit  of Jed Mccaleb, attached as  Exhibit  E.  The Raggios  immediately discovered the  theft  and  informed  McCaleb.  See  Exhibit  B,  at  p.  6­7.  McCaleb  responded, asking how someone might have gotten their password:  Oh jeez that's bad.  I  would  go  to  IRC  channel  #bitcoin­dev  and talk to  theymos.  He  wrote a block explorer that you can use to possibly track where the  coins went.  Any idea how someone got your password?  I  I  At  the  time,  the  value  of  the  stolen  bitcoins  was  approximately  See  Exhibit B, at  p. 7.  The Raggios had "no idea" how someone got their password.  At McCaleb's suggestion, the Raggios enlisted the help  Id.  of "Theymos" to trace the bitcoin  theft and electronic movement  of the bitcoins.  On February 10, 2011  (one month after the theft),  the  Raggios  thanked  McCaleb  for  recommending  Theymos  and  said  they  "would  reward  him  [Theymos]  and you [McCaleb]  with BTC [bitcoin]  for recovering the stolen BTC."  See  Exhibit  B,  at  p.  14.  In  other  words,  one  month  after  the  theft,  the  Raggios  were  offering  McCaleb  a  reward  if  the  bitcoins  were  recovered.  In  the  same  e­mail,  the  Raggios  also  told  McCaleb,  "[t]hanks for  creating such a cool platform."  Id.  The Raggios worked with Theymos for several  months trying to  catch the thief,  exchanging approximately ten e­mails.  See  Exhibit B,  at  p.  24­ 25, 28­31.  In  the  meantime,  the  Raggios  liquidated  their  MTGOX  account  and  requested  that  McCaleb  seize  the  stolen  bitcoins  in  the  MTGOX  account  appeared the bitcoins had been transferred.  of  another  customer  to  which  it  See  Exhibit B, at  p.  7­11.  McCaleb worked with the  Raggios  investigating  the  theft  in  an  attempt  to  help  the  Raggios  recover  the  stolen  bitcoins.  1  At  the  time of this  writing,  bitcoin  is  trading  at  approximately  $15,000  per  coin.  Of  course,  if the  Raggios  were  successful  in their claim (which  Petitioners dispute  on numerous  grounds), their damages  would be  based on the value  of the  bitcoins at the time  of the theft ($0.33  per bitcoin),  not the  value  of  bitcoins today.  3  I  I  I  I  I  I  I  I  I  I  I  I  I  I  I  I  I  I  I  During the months that followed  the  theft,  they exchanged  approximately  65  e­mails  as  part of  the investigation.  See generally  Exhibit  B.  McCaleb eventually identified a user who  went by  the name "Baron" who  he  suspected to  be the thief.  See  Exhibit B,  at p.  25, 28.  McCaleb froze  Baron's account,  but stated "[I]  want to  make  sure  I'm  right before I do  anything."  Id.  Baron  denied stealing the Raggios' bitcoins.  McCaleb  sold the  MTGOX exchange on February  11,  2011  to  Tibanne  KK,  a Japanese  company owned by Mark Karpeles.  See  Exhibit  E.  The Raggios began corresponding with the  new owner,  Karpeles,  regarding  the  recovery of their allegedly  stolen bitcoins.  See  Exhibit  C.  The Raggios told Theymos that Karpeles had taken over the investigation and "[i]t's up  to Mark  [Karpeles] to see ifwe  are able to recover the stolen BTC."  See  Exhibit  B, at p. 28­29.  For a few months after the sale ofMTGOX, McCaleb continued to communicate with the  Raggios  about the  investigation,  but  eventually  he  informed  them  that  he  would no  longer be  involved and that they would need to deal directly with Karpeles.  See  Exhibit B, at p. 33­34.  On  May 30, 2011, the Raggios told McCaleb:  I  am  glad  you  did  what  you  could  to  take  action  against  this  scammer.  Hopefully this  will  work and  I will  get the  coins  back.  And  if for  some  reason that  doesn't work out maybe  bitcoin  will  hit 1000 and what (sic) we will have more than enough regardless.  See  Exhibit  B,  at  p.  40.  And,  on December 21,  2011,  the  Raggios  e­mailed McCaleb,  updating  him on the investigation and acknowledging McCaleb was not responsible for "mak[ing]  things  right":  I'm  not asking you to intervene on my or my father's behalf. Mark  is the owner of Mt Gox now. It's his call whether he wants to make  things  right  with  us  as  he  did  with  Bitomat.  My  father  and  I  appreciate  everything  you  did  to  investigate  and  pursue  the  thief.  You didn't have to  go to  the lengths you went to  for us.  We thank  you.  4  I  I  I  I  I  I  I  I  I  I  I  I  I  I  I  I  I  I  I  See  Exhibit B, at p.  38­39.  The Raggios corresponded with McCaleb well into 2012  (including  an in­person  meeting  in  August  2011),  discussing  wide­ranging  topics  including  philosophical  issues related to technology, hopes for the future  of bitcoin, ideas for future development, and the  status  of the  bitcoin theft.  See  generally Exhibit  B,  also  at p.  15­22,  38­40.  On occasion the  Raggios  would  update  McCaleb  on  the  matter  of  the  stolen  bitcoins,  and  McCaleb  would  typically express his belief that the Raggios would eventually get their bitcoins back.  Exhibit B, at  17. ("I'll ask [Karpeles]  again what is happening to the baron money.  See,  e.g.,  I'm  sure he  will  eventually  give  it  to  you.").  Throughout this  time,  the  Raggios  were  unwavering  in their  gratitude to  McCaleb  for  his  efforts,  never once  suggesting that he  had engaged in  any  sort of  breach of any obligation to them or was responsible for recovering their bitcoins.  Meanwhile,  the  Raggios  continued  to  correspond  with  MTGOX's  owner,  Karpeles.  According  to  the  Raggios,  Karpeles  allegedly  informed  them  in  March  2012  that  he  was  not  responsible  for  recovering their bitcoins because  he  only purchased the  MTGOX assets,  not its  liabilities.  See,  Alleged  Karpeles  Letter,  attached  as  Exhibit  F  (letter  never  translated  from  Japanese  to  English).  Nothing  further  happened  with  the  matter  until  February  2014,  when  MTGOX and its new owner, Mr.  Karpeles, filed for bankruptcy in Japan.  See, Reuters, "Mt. Gox  files  for  bankruptcy,  hit  with  lawsuit",  February  28,  2014,  accessible  online  at  https://www.reuters.com/article/us­bitcoin­mtgox­bankruptcy/mt­gox­files­for­bankruptcy­hit­ with­lawsuit­idUSBREA1ROFX20140228.  MTGOX  also  filed  a  companion  bankruptcy  proceeding in Texas.  The Raggios never filed  a proof  of claim in the MTGOX bankruptcy.  By  the time  of the MTGOX bankruptcy, more than three years had passed since the alleged theft.  In  the months that followed,  the  MTGOX bankruptcy and fraud  allegations against Karpeles  were  widely  reported.  See,  e.g.,  New  York  Times,  "Mark  Karpeles,  Chief  of  Bankrupt  Bitcoin  Exchange,  Is  Arrested  m  Tokyo",  5  available  online  at  I  I  I  I  I  I  I  I  I  I  I  I  I  I  I  I  I  I  I  https ://www.nytimes.com/2015/0 8/02/business/ dealbook/mark­karpeles­mt­gox­bi tcoin­ arrested.html.  The Raggios filed  suit on March  5, 2014­three  years and 54  days after the theft.  They  sued  eight  defendants  but only  served two,  McCaleb  and  his  company,  Code  Collective,  LLC.  See  Exhibit  D.  Despite  spending  most  of 2011  expressing  "appreciation"  for  "the  lengths  he  went"  to  recover  their  bitcoins,  the  MTGOX  bankruptcy­and  the  rise  in  bitcoin's  value­ apparently led the Raggios to change their tune and blame McCaleb for their loss. The Complaint  alleges  claims  for  breach  of  the  Mississippi  Uniform  Commercial  Code  (though  no  specific  provision is alleged), breach  of contract, conspiracy, account stated, negligence, conversion, and  specific performance  of an  unidentified,  unwritten contract.  See  Exhibit  D.  Importantly, there  are no material facts in dispute that prevent summary judgment on all claims.  On June 30,  2016, McCaleb filed  a Motion for  Summary Judgment based on the  statute  of limitations.  See,  Trial  Court Docket #29.  At the hearing on this motion in August 2016, the  Raggios  sought  additional  time  to  conduct  discovery  on  the  statute of  limitations  issue  under  Rule  56(f),  and  the  trial  court  allowed  discovery  "related  to  the  statute  of  limitations  issue  ONLY."  See,  Trial Court Docket  #41  (emphasis in original).  Between the time this motion was  filed  and the time the trial court ruled on it, the Raggios have engaged in exhaustive discovery,  filing  eight  sets  of  requests  for  admission  (with  243  requests  in  total),  three  sets  of  interrogatories,  two  sets  of  requests  for  production,  a  motion  to  re­open  Jed  McCaleb's  deposition,  a  motion  for  sanctions  (including  a  request  for  the  death  penalty  for  discovery  violations),  several  motions  to  compel,  several  motions  for  protective  order,  a  subpoena  to  JP  Morgan  Chase  for  McCaleb's  bank records,  a  subpoena to  Google  for  McCaleb's  emails,  and  there are currently nine discovery­related motions awaiting decision. The discovery, purportedly  limited to the statute  of limitations issues, seemingly knows no bounds in scope or costs.  6  I  I  On April  18, 2017, Petitioners' Motion for Summary Judgment was argued a second time  I  I  there  are  genuine  issues  of fact  for jury  determination"  with no  identification  of any  issues  of  I  ARGUMENT  I  I  I  I  I  I  I  I  I  I  I  I  I  I  before the trial court.  The trial court issued its ruling denying Petitioners'  motion "inasmuch as  fact.  See  Exhibit  A.  Despite  the  sensational,  almost  fantastical  facts,  the  legal  issue  presented  is  simple:  whether the  Raggios'  claims  are  time­barred  when the  complaint was  filed  three  years  and  54  days after the theft.  The Raggios acknowledge that they knew about the theft when it occurred.  There is no dispute about the amount  of time that passed between the theft and suit being filed.  The Raggios contend the claims are not time­barred because the statute  of limitations did  not begin to  run at the time  of the theft,  but only at some later date when the bitcoins were not  "re­delivered" (their words)  afterward.  Alternatively, they contend that several tolling doctrines  apply, such as equitable estoppel, fraudulent concealment, the discovery rule, and the continuing  tort  doctrine.  The  trial  court  denied  summary  judgment  on  the  statute  of  limitations  defense  finding  genuine  fact  issues  exist for jury determination, but without specifying what fact  issues  exist.  Mississippi  law  is  clear  that  the  statute  of  limitations  begins  to  run  at the  time  of the  theft­not  upon the failure to get the stolen thing back.  Furthermore, where a party knows  of its  injury ( as  is unquestionably the case here), the various tolling doctrines cited  by the Raggios do  not apply.  The trial court's ruling contravenes Mississippi law and, therefore, a substantial basis  exists for a difference  of opinion.  Miss.  R. App.  P.  5(a).  Review by this Court would meet all  of  the  Rule  5 policy objectives.  Miss.  R.  App.  P.  5(a)(l)­(3).  Accordingly,  McCaleb respectfully  requests that the Court grant permission to appeal the interlocutory order attached as Exhibit  7  A.  I  I  I  I  I  I  I  I  I  I  I  I  I  I  I  I  I  I  I  I.  The Raggios' Claims are Barred  by  the Statute  of Limitations.  a.  The applicable statute of/imitations is three years.  A three­year statute  of limitations applies to the  Raggios'  claims for  breach  of contract,  conversion,  negligence,  conspiracy,  and  account  stated.  See,  e.g.,  Miss.  Code  Ann.  §  15­1­49  (three­year catch­all statute  of limitations);  see  also, Wallace v.  Greenville Pub.  Sch.  Dist.,  142  So.3d  1104,  1106 (Miss.Ct.App.  2014)  (breach of contract statute  of limitations  is three years);  Smith  v.  DiMa  Homes,  Inc.,  74  So.3d  377,  378  (Miss.Ct.App.  2011)  (negligence  statute  of  limitations is three  years);  WW,  Inc.  v.  Rainbow  Casino­Vicksburg P'ship,  L.P.,  68  So.3d  1290  (Miss.  2011)  (conversion  statute  of  limitations  is  three  years);  Carter  v.  Citigroup  Inc.,  938  So.2d  809,  817  (Miss.  2006)  (conspiracy  is  contingent on other claims  and  is,  therefore,  three  years); Miss. Code  Ann.§  15­1­29 (account stated  is three years).  Because it is derivative  of the  breach  of  contract  claim,  the  specific  performance  claim  is  also  governed  by  the  three­year  statute  of limitations.  See,  e.g., McKenzie  v.  Mississippi  Mun. Serv.  Co., 2016  WL 3044732, at  *3  (Miss.Ct.App.  2016).  The  limitation  period  for  the  Raggios'  claim  for  breach  of  the  Mississippi UCC is also three years under Mississippi's general catch­all statute oflimitations. 2  b.  The  Raggios'  claims  sound  in  conversion  and  negligence.  and  the  statute  of  limitations analysis  for these claims controls.  The  Raggios'  claims  are  conversion and negligence  claims.  Their complaint is  that the  bitcoins  in  their  account  were  stolen.  All  of  the  Raggios'  attempts  to  frame  the  issues  as  "failures to  deliver" or "failures to  return" the  bitcoins are  simply attempts to  plead around the  2  The  Raggios  claim a six­year statute  of limitations applies to their UCC  claim.  The  Raggios have  not  identified­in  their complaint or in  their briefing  in the  trial  court­any  specific  provision  of the  UCC  that  has  allegedly  been  violated.  Regardless,  bitcoins  are  not  a  "good"  under  the  Mississippi  UCC.  "B itcoin ...  can be used to purchase goods or services, [  and is]  a currency or form  of money."  Securities  and Exchange  Commission  v.  Shavers,  2013  WL  4028182,  *2  (E.D.Tex.  2013).  The  UCC  excludes  "money", "securities", and "things  in  action" from  the definition  of "goods."  Miss.  Code Ann.  §  75­2­ 105.  Any  UCC  claim that  does  not  relate  to  a  "good"  is  governed  by  Mississippi's  general  three­year  statute  of  limitations.  See,  e.g.,  Peavey  Elecs.  Corp. v.  Baan  U.S.A.,  Inc.,  10  So.3d  945  (Miss.Ct.App.  2009).  8  I  I  I  I  I  I  I  I  I  I  I  I  I  I  I  I  I  I  I  running  of the  statute of limitations from  the  date  of the  theft.  The undisputed facts  make this  clear­the  Raggios  identify  no  contract  and,  despite  claiming  a  failure  to  deliver  the  bitcoins  upon  payment,  Chris  Raggio  admits  that  the  bitcoins  were  placed  in  his  account  after  he  purchased them on the MTGOX exchange.  See Exhibit  C.  This  Court  has  consistently  rejected  parties'  attempts  to  creatively  plead  around  the  statute  of limitations,  and  when  the  nature of a  claim  is  evident  this  Court  will  not  indulge  a  party's attempt to  recast its  claim to  avoid  being time­barred.  See,  e.g.,  Howard v.  Wilson, 62  So.3d 955, 956 (Miss.  2011);  see also,  Sanderson Farms, Inc.  v.  McCullough,  212 So.3d 69, 74­ 75, 80 (Miss.  2017);  Sharkey v.  Barber,  188 So.3d  1245,  1247 (Miss.Ct.App. 2016).  Yet this is  precisely  what  the  Raggios  have  done  here  in  making  claims  for  breach of contract,  specific  performance, breach  of the  Mississippi UCC,  account stated,  conspiracy,  and constructive trust.  Therefore,  the  proper  statute of limitations  analysis  for  this  case  must  center on Mississippi's  treatment  of the statute of limitations for conversion and negligence claims.  c.  The bitcoins at issue were stolen on January  9.  2011.  and this  is when the statute  off imitations began to run.  The Raggios knew that their bitcoins had been stolen on January  9, 2011.  See  Exhibit E.  Mississippi  law  is  clear  that  the  statute  of  limitations  began  to  run  on  the  negligence  and  conversion  claims  when  the  Raggios  knew  of  their  injury.  See,  Covington  County  Bank v.  Magee,  177  So.3d  826,  829  (Miss.  2015)  ("a  conversion  claim  accrues  at  the  time  when  the  property  is  stolen");  see,  e.g.,  Angle v.  Koppers,  Inc., 42  So.3d 1,  5­7 (Miss.  2010)  (negligence  action  accrues  upon  discovery  of injury).  No  matter  how  many  ways  the  Raggios  attempt to  frame the nature  of their cause  of action in this case, the injury shared by all theoretical causes  of  action  is the  same­the  loss  of their bitcoins.  This  injury occurred on January  9,  2011  and,  as  such, the Raggios' claims are time­barred.  9  I  I  I  I  I  I  I  I  I  I  I  I  I  I  I  I  I  I  I  d.  Even  if the  Court lends credence  to the  Raggios' other claims.  the Raggios knew  of their iniury. and the claims are time­barred.  Even if the other claims in the Raggios'  complaint are not treated as disguised conversion  and negligence claims,  Mississippi law still establishes that the  statute  of limitations has  run in  this  case  as  to  all  claims.  The  breach  of  contract,  specific  performance,  account  stated,  constructive  trust,  and  Mississippi  UCC  claims  are  premised on the  Raggios'  alleged  payment  for bitcoins and McCaleb's alleged failure to subsequently "deliver" the bitcoins.  See  Exhibit  B.  These  claims  cannot  succeed  because,  by  the  Raggios  own  admission,  the  bitcoins  were  delivered.  But  even if the  claims  had  merit,  the  statute of limitations  started  to  run  when the  alleged  breaches  occurred.  See,  e.g.,  Johnson  v.  Crisler,  125  So.  724,  724­25  (Miss.  1930)  (breach of contract action accrues at time  of breach).  Shortly  after  the  theft­and  by  no  later  than  February  10,  2011­the  Raggios  asked  McCaleb to  seize the bitcoins,  offered a reward  for  recovery  of the bitcoins,  and liquidated the  remaining holdings in their MTGOX account without receiving the value  of the stolen bitcoins.  See  Exhibit  B, at  p.  6­14.  All of these  alleged breaches occurred more than three years prior to  the  filing  of the  Raggios'  Complaint  and,  as  such,  the  claims  based  on  that  conduct  are  time­ barred.  II.  None  of the Tolling Doctrines Cited by the Raggios are Applicable Here.  To rebut McCaleb's statute  of limitations argument, the Raggios claim that the statute  of  limitations  was  tolled  until  they  purportedly  received  a letter sent by  or  on  behalf of MTGOX  owner Mark Karpel es  in  March 2012  that disclaimed responsibility  for  the  stolen bitcoins.  See  Exhibit  F.  This  contention  is  contrary  to  Mississippi  law,  as  the  cases  cited  above  and  below  make clear.  Furthermore, this letter is written entirely  in Japanese and the Raggios have offered  no  translation  of  the  letter.  Instead,  the  Raggios  simply  asked  the  trial  court  to  accept  their  10  I  I  I  I  I  I  I  I  I  I  I  I  I  I  I  I  I  I  I  explanation  as to  the  content of the  letter as  valid summary judgment evidence.  See  Trial Court  Docket  #77.  Nevertheless,  the  law  does  not  support  the  Raggios'  arguments  that  various  doctrines tolled the running  of the  statute of limitations until the  letter was  sent.  None  of those  doctrines­­­equitable  estoppel,  fraudulent  concealment,  the  discovery  rule,  and  the  continuing  tort doctrine­apply  here and their claims therefore are time­barred.  a.  Equitable estoppel does not apply.  A  plaintiff  invoking  equitable  estoppel  to  overcomethe  statute  of  limitations  must  establish that the defendant induced it not to file  its complaint sooner, resulting in its claim being  barred  by the  statute of limitations.  Peavey,  10  So.3d at  953.  According to  the  Raggios'  own  argument  in  the  trial  court,  they  knew  in  March  2012  that  the  bitcoins  were  not  going  to  be  returned.  At that time, there was one year and 10 months remaining on the statute  of limitations,  but they did not file during that time. The Raggios' failure to file their claim within the statute  of  limitations  did  not  "result"  in  any  way  from  conduct  by  McCaleb  or  any  other  party.  See,  Townes v.  Rusty Ellis Builder,  Inc.,  98 So.3d 1046,  1056 (Miss. 2012). For the same reasons, the  Raggios were not "induced" to wait to file their complaint past the statute  of limitations deadline.  Equitable estoppel cannot save their claim.  b.  The discovery rule and fraudulent concealment do not apply.  To toll the statute  of limitations pursuant to the discovery rule or fraudulent concealment,  the Raggios must demonstrate that something prevented them from discovering their injury.  See,  National  Union  Fire Ins.  Co.  of Pittsburgh,  PA  v.  Blasio,  2008  WL  2224886, *4  (N.D.  Miss.  2008)  (fraudulent  concealment  requires  act  ''which  did  prevent  discovery  of  the  claim");  Peavey,  10  So.3d at  951  (citing  PPG Architectural Finishes,  Inc.  v.  Lowery,  909  So.2d 47,  50  (Miss.  2005))  (latent  injury  required  for  application  of  discovery  rule).  Here,  the  Raggios  indisputably knew  of their injury on January 9,  2011.  Therefore, neither the  discovery rule  nor  11  I  I  I  I  I  I  I  I  I  I  I  I  I  I  I  I  I  I  I  of limitations.  See,  Townes, 98  So.3d at  1056;  fraudulent concealment applies to toll the  statute  see also,  Peavey, 10 So.3d at 962.  c.  The continuing tort doctrine does not apply.  Finally, the continuing tort doctrine requires  "repeated acts  of wrongful  conduct" to  toll  the  statute  of limitations;  "[w]here the  tortious  conduct  has  been completed  ...  the  period  of  limitations will not be extended on the ground  (quoting  Stevens  v.  Lake,  615  of a continuing wrong."  Peavey,  IO  So.3d at 955  So.2d  1177,  1183  (Miss.  "[C]ontinual ill effects from an original violation" do not trigger the continuing tort doctrine.  1993)).  Id.  Here,  the  injury­­­­deprivation  of the  use  and  benefit  of  bitcoins­occurred  from  one  original  violation­the  January  2011  theft.  A  continued  deprivation  of property  due  to  theft  does  not  trigger the  continuing tort  doctrine.  See,  Sporn  v.  MCA  Records,  Inc., 448 N.E.2d  1324,  1326  (N.Y.  Ct.  App.  1983). Like in  Peavey,  alleged misrepresentations  after  the original violation are  not relevant to  a continuing tort analysis.  Id.  ("If  Baan fraudulently induced Peavey to  purchase  defective software, the tort was completed with the purchase.  Baan's  subsequent denials that the  software it tendered was defective, even  if false,  do not transform this into a 'continuing' tort.").  As such, the continuing tort doctrine does not apply here.  III.  The Trial Court Erroneously Concluded a Fact Issue Exists.  In  the  trial  court's November  16,  2017  order denying  Petitioners'  motion for  summary  judgment, it stated: "[T]he Court having considered the briefing and oral argument  of the parties,  finds  the  Motion  should  be  denied,  inasmuch  as  there  are  genuine  issues  of  fact  for  jury  determination."  See  Exhibit  A.  There  is  no  explanation for  what  specific  fact  issues  exist or  whether they are material.  Nevertheless,  the  only  matter  in  dispute  here  is  whether  the  above­referenced  tolling  doctrines  apply  to  the  Raggios'  claims.  These  are  questions  of law that,  when  applied  to  the  12  I  I  I  I  I  I  I  I  I  I  I  I  I  I  I  I  I  I  I  facts  ( even resolving  all  ambiguities  and  drawing  all  permissible  factual  inferences  in favor  the  Raggios),  establish  that  the  Raggios'  claims  are  time­barred. IV.  This Court Should Grant Permission for Interlocutory Appeal.  Mississippi Rule  of Appellate Procedure 5(a) sets out three scenarios where a Petition for  Interlocutory  Appeal  should  be  granted:  (1)  where  resolution  will  "materially  advance  the  termination  of the  litigation and avoid exceptional expense;" (2) where resolution will "protect a  party from  substantial and irreparable injury;" and, (3) where this Court can "resolve an issue  general importance in the administration  of  of justice."  This case presents all three.  First and  foremost,  resolution  of the  questions  of law set forth  above  will terminate the  litigation  at  the  summary  judgment  phase  and  spare  the  parties  further  expense  in  what  has  already  proven to  be an expensive and time­intensive litigation.  Though other parties have been  named, only Jed McCaleb and Code Collective, LLC have been served and brought into the case.  The parties to  this appeal are the only parties to this litigation and summary  judgment  as  to the  claims against Petitioners will terminate the litigation.  In  addition,  resolution  of  the  questions  of  law  set  forth  above  will  clarify  issues  pertaining  to  the  tolling  doctrines  above,  which  is  important  justice  in  the  state.  Clear,  unequivocal  statements  to  the  general  administration  of  of  the  law  on  these  issues  would  permit  expeditious resolution  of future cases and spare  parties­including  Mccaleb  for the remainder  of  this  litigation­the  intrusive  and could use it like any other card. In essence It wouldn't be much different than using the visa  or mastercard you already  have in Madrid.  By no means would this fix everything for users.  There are many other issues to resolve such  as  volatility (this might be mitigated  With options trading; increased aggregate market value will help over time).  It  would  still be a good place to start  if it were possible.  I  I  I  Of course to make this work you would like to have a financial Institution to partner with.  These guys said that they  had a strong with relationship with a bank down there and that they were already talking to the bank about making this  happen.  I said that sounded great.  I had never imagined that  anyfinancial institution would be interested  in doing  this. They said that they owned a bank or at least was talking to one that was interested.  As you already know banks are subject  lo  regulations.  They are not well regulated but are very tightly regulated.  That  means the regulators crack down hard on small stuff like bitcoin and totally miss colossally important things like MF  Global or Lehman brothers that can crash the whole system  In a few hours.  I  As much as I wanted to believe these guys I knew that ii would be tough to do this because  no commercial bank  would want to be associated with bitcoin.  Credit unions or community banks would be equally uninterested.  I thought  maybe an offshore bank would consider it but the rates they would charge for doing something like that would be  exorbitant.  These guys actually told me that they were talking about a commercial bank based  in the US.  I  I've been playing around with some ideas.  There can't be a single point  of failure.  It needs to  be decentralized like  P2P (as exemplified  by eDonkey) and the internet itself. The nodes  andthe edges in the graph will be attacked.  Any  link between the conventional system and the cryptocurrency system is what an adversary is going  to try to sever.  So  one thing that would help with this would be to have a whole lot a keylogger. You made a good point when you said most people who spy with those wouldn't know about Mt. Gox but  I  ran  I couldn't think of any other possibility and thought maybe they learned about Mt. Gox through the keylogger.  several products but nothing malignant was detected. One of those products  is called Spyshelter premium.  The other  possibility is that thief through a keylogger  of other means was able to access my gmail account but  I didn't  detect  any intrusion there based  on  the IP log.  I should have picked a different username based  on a psuedonym not one  so closely related to the email account name.  On Mt. Gox I'll set up a  new  account under different name for future  use.  That's as much Information as I have.  If I think  of anything else I'll let you know.  If you have any advice  regarding  on  security or could refer me somewhere I'd love  to hear it  Like what secure e­mail providers to use.  Strong password generators.  Protection against phishing, keyloggers.  Etc.  Maybe this would be a good thing for all  users to read  so  they can do their part to protect themselves and Mt. Gox from scammers.  Please let me how  you 15.  On  December 21,  2011,  I  emailed Defendant  McCaleb  informing  him as  to  communications  with  Mark  Karpeles  concerning  the  bitcoins.  my  recent  On  December  27,  2011,  I  I  I  I After I retained Japanese counsel to investigate this matter in January  of 2012, Defendant  Tibanne K.K. made a representation in March  of 2012 that they only inherited the assets related  to  the  bitcoin  exchange  and  never  inherited  the  debt  that  Defendant  McCaleb  had  incurred.  Furthermore, Defendant Tibanne  K.K.  disavowed any responsibility.  No Japanese judgment was Defendant MTGOX, on information and belief, was a sole proprietorship  originally created, owned and operated by Defendant Jed McCaleb.  MTGOX conducted  business throughout Mississippi and the United States.  3.)  Defendant Jed McCaleb is an adult resident citizen  of New York and on  information and belief, he may be served with process  of this court at 286 Union  #lA,  Brooklyn,  NY 11211.  Jed McCaleb, at the relevant times herein was doing business in the State  of  Mississippi and the United States.  4.)  Defendant Code Collective, LLC is a New York limited liability company who  may be served with process  of this court through its registered agent, New York Department  of  State and at its New York office located at 286  Union#  IA, Brooklyn, NY 11211.  Defendant  Code Collective, LLC conducted business throughout Mississippi and the United States.  5.)  Defendant MTGOX, Inc.  is a Delaware corporation.  It is believed that this  corporation was formed in 2013 and may be served with process  of this court through its agent  for service of process, National Corporate Research, LTD located at 615 S Dupont Hwy, Dover,  DE 19901.  MTGOX, Inc. 's principal place  of business is located at Level  15­F, Cerulean  Tower, 26­1  Sakuragaoka­cho, Shibuya­ku, Tokyo, Japan 150­8512.  6.)  Defendant Mutum Sigillum, LLC is a Delaware limited liability company with its operated by Mark Karpales and Jed Mccaleb, with its current principal place  of business located  at Level 15­F, Cerulean Tower,  26­1 Sakuragaoka­cho, Shibuya­ku, Tokyo, Japan 150­8512.  MT.GOX KK conducts business throughout Mississippi and the United States.  On information  and belief, MT.GOX KK is the parent  ofMTGOX,  Inc. and conducts business in the United  States and Mississippi directly and by and through MTGOX, Inc.  and Mutum Sigillum, LLC.  8.)  Defendant Tibanne KK is a Japanes corporation with its principal place  of  business located at Level  15­F, Cerulean Tower, 26­1  Sakuragaoka­cho, Shibuya­ku, Tokyo,  Japan 150­8512.  Tibanne KK conducts business throughout Mississippi and the United States.  On information and belief, Tibanne KK is a parent  of MTGOX KK and conducts its business  in  the United States directly and through MTGOX, Inc. and through Mutum Sigillum, LLC.  9.)  Defendant Mark Karpeles serves as the ChiefExective Officer  of Mutum  Sigillum, LLC;  MtGox, Inc.; Mt. Gox  KK and Tibanne KK.  On information and belief,  Defendant Karpeles  is the majority and/or sole shareholder  of these companies.  JURISDICTION AND VENUE  10.)  This Court has personal jurisdiction and venue over Defendants because they  conducted business in this District and the unlawful conduct alleged in the Complaint occurred  in, was directed to and/or emanated from this district.  Venue is proper in this district because a  substantial part of the events or omissions giving rise to the unlawful conduct alleged in the  complaint occurred in,  was directed to and/or emanated from this district.  Page 3 of 14  I  I  I  I In 2010, the Raggios began doing business with Defendant Jed McCaleb directly  and through said defendant's companies, MTGOX and Code Collective, LLC.  At all relevant  times, all transactions were either initiated in Hinds County, Mississippi  or terminated in Hinds  County, Mississippi.  12.)  The nature  of the business relationship between the Raggios and Defendant  McCaleb was the sale  of goods from Defendant McCaleb and his companies  to the Raggios.  The  goods being purchased by the Raggios were an electronic currency known as Bitcoins.  13.)  To purchase the Bitcoins from Defendant McCaleb and his companies, the  Raggios would wire transfer funds directly to the personal account  of Defendant McCaleb.  Defendant McCaleb would credit the Raggio's account on the exchange that Defendant McCaleb  had created;  MTGOX.  When bitcoins were purchased with the funds,  Defendant McCaleb,  through MTGOX would credit the Raggios MTGOX to reflect the bitcoins and the cash.  14.)  Upon purchase  of bitcoins, the Raggios would routinely transfer all bitcoins to  their own personal wallets and have them removed from the MTGOX exchange utilizing the  system set up by Defendant McCaleb.  When purchasing a large number  of bitcoins, Defendant  McCaleb would not allow transfers  of the bitcoin to all go at once and forced the Raggios to  leave some bitcoin on Defendant McCaleb's MTGOX exchange.  When transferring cash to the  Raggios, Defendant McCaleb would wire transfer U.S. dollars through his New York company,  Code Collective, LLC.  15.)  Many transactions went through without a problem.  However, in January 2011,  the Raggio's placed an order for approximately 9,400 bitcoins.  Page  4 of 14 MTGOX secured the goods and the Raggios paid McCaleb and MTGOX the full cost  of the  bitcoins and a fee for their service.  Prior to delivering said bitcoins, defendant McCaleb and  MTGOX had the bitcoins stolen through a hacker(s) while they resided  on said defendants  servers for safekeeping.  16.)  Defendants Jed McCaleb and MTGOX were notified  of the missing bitcoins on the  same date that the Raggio's learned  of it which was on or about January 9, 2011.  McCaleb and MTGOX immediately started working to discover the location  Defendants  of the stolen goods.  Defendant  Mccaleb  was able to determine the MTGOX account  of the hacker which contained  stolen bitcoin and U.S. dollars.  Defendant McCaleb blocked the account and represented to the  Raggios that he would replace the 9,400 stolen bitcoin from the hacker's account.  The hacker  became known on the electronic message boards as "Baron", his moniker for these forums.  17.)  Prior to returning the Raggio's 9,400 bitcoins, Defendant  Mccaleb  entered into an  agreement to sell the majority  of MTGOX to Mark Karpel es.  Mark Karpel es purchased  MTGOX on or about March 6, 2011.  As part  of the sale, Mark Karpeles was informed  of the  blocked Baron account and agreed to make sure that the Raggio's bitcoins were restored to them.  On information and belief, Jed McCaleb retained 12.5%  of MTGOX in the transaction, but  represented to all outside sources that MTGOX was sold in its entirety to Mark Kapeles and  Defendant Karpele's companies.  18.)  Mark Karpeles continued to run the MTGOX exchange.  On information and  belief, Mark Karpeles operated the purchased exchange as MTGOX, MT.GOX KK, MTGOX,  Inc., Mutum Sugillum, LLC all under the umbrella  of Tibanne KK.  Corporate John Does  1­3 are  other companies through which Mark Karpeles operated the MTGOX exchange.  All the  Page 5 of14  I  I  I  I  I  I  I  I  I  I  I  I  I  I  I  I  I  I  I  Case: 25Cll:14­cv­00071­TTG  Document#: 1  Filed: 03/05/2014  Karpeles companies and Karpeles as an individual are hereafter referred to  Page 6 of 14  as the "Defendants  Karpeles  & Companies".  19.)  Defendants Karpeles and Companies moved the MTGOX exchange headquarters  to Japan, but the servers remained in the United States.  On information and belief, those servers  are located in Massachusetts.  20.)  Defendants Karpeles and Companies acknowledged responsibility to restore the  Raggio's 9,400 bitcoin repeatedly and represented to the Raggios that he was going  to restore  their 9,400 bitcoin.  Defendants Karpeles and Companies lied to the Raggios concerning his  efforts and intentions to restore the 9,400 bitcoins, including representing that he had filed a legal  action in Japan that would authorize him to restore the 9,400 bitcoins.  21.)  After Defendants Karpeles and Companies took over, Chris Raggio continually  monitored the address  of the 9,400 bitcoins that had been stolen and alerted Defendants Karpel es  and Companies when those coins were actually moved back to the MTGOX exchange.  Defendants Karpeles and Companies continued to assure the Raggios that he was working on  restoring their 9,400 bitcoins.  22.)  After repeated delays in receiving the return  of their bitcoins, the Raggios retained  a Japanese law firm to make formal demand for the return  of their 9,400 bitcoins which were still  locked up in the frozen Baron account.  By letter dated on or about March 13, 2012, the Japanese  lawyers made demand by letter to Defendants Karpeles and Companies to return the Raggio's  9,400 bitcoins.  Shortly thereafter the Raggios were stunned by Defendants Karpeles and  Companies response which stated that he had only purchased the assets  of the MTGOX  exchange from Jed McCaleb and not the liabilities.  Page  6 of  14  I  I  I  I  I  I  I  I of their 9,400 bitcoins which have yet to be delivered  Defendants John Does 1­5 are the individuals that assisted  all the defendants and  or directly caused the loss  of the  Raggio's  9,400 bitcoins.  All defendants  individually and in solido were aware  of the Baron  hacker's  account,  took  steps to freeze the  9,400 bitcoin (and other assets  of the hacker's)  yet failed to return the Raggios their bitcoins.  information and belief, those bitcoins are still under the care and control  On  of the defendants yet  they still fail to release the Plaintiffs' bitcoins to them.  Cause  of Action  I.  I  I  Filed: 03/05/2014  Defendants Corporate John Does 4 & 5 are the companies used by Mark Karpeles  I  I  I  Document#: 1  Breach  of the Mississippi Uniform Commercial Code  24.  Defendants, and all  of them individually  and  in concert, have breach the  Mississippi Uniform Commercial Code  by not delivering the 9,400 bitcoins that were ordered  and paid for in full  by the Raggios. Defendants have, through the commission  of wrongful acts  and omission  of properly conducted transactions have breach the Mississippi Uniform  Commercial Code and cause the Raggio the loss  of their 9,400 bitcoins.  Cause  of Action  II.  Breach  of Contract  25.  Defendants, and all  of them individually  and  in concert have created multiple  written and implied contracts in dealing with the Raggios.  The  Raggios acted in good faith by  paying defendants U.S. Dollars for 9,400 bitcoin, but defendants have breach their contracts with  Raggios to deliver said bitcoins.  Page 7 of 14  I  I  I  I  I  I  I  I  I  I  I  I  I  I  I  I  I of them individually and in concert agreed, among other things, to  do each  of  the following with respect  to any monies deposited by Plaintiffs with MTGOX:  a.  to accept monies from Plaintiffs, in the form  of bitcoins or United States Dollars,  which Plaintiffs may deposit from time to time;  b.  to keep said monies in a safe ad secure manner, consistent with fiduciary  obligations commonly imposed upon financial services providers;  c.  to comply with instructions that Plaintiffs may provide from time to time  concerning the transfer, investment and disposition  of said monies; and  d.  to permit Plaintiffs to withdraw their monies and bitcoin at any time.  Plaintiffs allege that the legal effect  of these agreements was to create legally binding  obligations on the part  of Defendants, and all  of them individually and in concert.  27.  Plaintiffs have performed all conditions, covenants and promises required  of them  by said agreements, and in accordance with the terms and conditions thereof.  28.  Defendants, and all  of them individually and  in concert breached the agreements  by, among other things: refusing to comply with Plaintiffs' instructions for withdrawing the  entirety of their bitcoins; permitting the withdrawal  of their bitcoins by Baron and by failing  to knowingly and willfully conspired and agreed upon themselves to hinder, delay and deprive the  Raggios of their rights with respect to their 9,400 bitcoins.  30.  Plaintiffs are further informed and believe, and thereon allege, that said  Defendants, and all  of them individually and in concert, did the acts and things alleged herein  pursuant to, and in furtherance of, the conspiracy and their own agreements with one another ,  and/or furthered the conspiracy cooperating with, lending aid to, encouraging, ratifying or  adopting those acts.  31.  Plaintiffs are informed and believe, and thereon allege, that there is not yet any  last overt act in furtherance  of said conspiracy, in that Defendants, and all  of them individually  and in concert are continuing to hinder delay and deprive the Raggios  of their rights with respect  to said bitcoins.  32.  Plaintiffs are informed and believe, and thereon allege, that Defendants acted  willfully and with the intent to cause injury to Plaintiffs, and that Defendants are therefore guilty  of malice, oppression and/or fraud in conscious disregard  of the Plaintiffs' rights, thereby  warranting  an assessment  of punitive damages in an amount appropriate to punish said  Defendants and deter others from engaging in similar misconduct.  Cause  of Action IV.  Account Stated  33.  Plaintiffs reallege and adopted all proceding paragraphs 1­32 and incorporate Within the past three years, accounts were stated in writing between the Plaintiffs  on the one hand, and Defendants, and all  of them individually and in concert on the other hand.  Although defendants have acknowledged and veriefied the total amount  of bitcoins it has not  delivered the 9,400 bitcoins purchased and paid for by Plaintiffs.  The remaining unreturned  portions of said accounts, according to the reords  of Defenants and Plaintiffs, total approximately  9,400 bitcoins as  of the date  of this complaint, which  is now due and owing and which  defendants should pay.  35.  Defendants, and all  of them individually and in concert have failed and refused  and continue to fail and refuse to return the remainder  of the bitcoins, despite Plaintiffs' demands  that they do so.  Thus, they owe the remaining due, owing and unpaid the above 9,400 bitcoins  and prejudgment and post judgment interest thereon at the maximum legal  rate.  36.  Defendants, and all  of them individually and in concert have acted in an  unreasonable manner causing much distress to the Plaintiffs and forcing Plaintiffs to hire  attorneys in Japan and the United States to recover their 9,400 bitcoins.  The misconduct  of the  Defendants, and all  of them individually and in concert warrants a reimbursement  of the funds  lost due to this litigation including all expenses, costs  of collection and attorney fees.  Cause of Action V.  Negligence  37.  Plaintiffs incorporate by reference paragraphs 1­36 above  of this complaint.  38.  At all releveant times, Defendants, and all  of them individually and in concert had  bitcoins belonging to Plaintiffs in their possession, custody and/or control, and therefore owed Plaintiffs are informed and believe, and thereon allege, that Defendants, and all  of  them individually and  in concert breached their duties to Plaintiffs by negligently performing  their obligations, including but not limited to failing to utilize all reasonable and practical  safeguards to protect the bitcoins  of Plaintiffs and other customers by using an unsalted MD5  protocol for security.  40.  Plaintiffs suffered certain  general, special, incidental and consequential damages  as a direct and proximate result  of said negligence, including, among other thins:  the loss of  bitcoins; the loss  of use of said value  of the bitcoins while the present action is pending; changes  in the value of said bitcoins due to the fluctuating exchange rate; etc. all in amounts to  be proven  at trial.  Cause  of Action VI.  Conversion  41.  Plaintiffs incorporate by reference paragraphs 1­40  of this complaint.  42.  At all relevant times, Plaintiffs were, and are, the lawful owners  of certain  bitcoins deposited with Defendants and all  of them individually and in concert as alleged herein.  As between Plaintiffs and Defendants, plaintiffs are entitled to possession  of the bitcoins once  they provide instructions to Defendants to deliver them, which Plaintiffs have done.  43.  Plaintiffs are informed and believe and theron allege that:  upon receiving concert intentionally, willfully and in flagrant disregard for Plaintiffs' right refused to deliver the  bitcoins purchased by plaintiffs.  44.  Plaintiffs have suffered certain general, special, incidental and consequential  damages as a direct and proximate result  of said negligence, including, among other things: the  loss of the bitcoins themselves; the loss  of use of said bitcoins while the present action is  pending; changes in the value  of said bitcions due to fluctuating exchange rates; etc., all in  amounts to be proven at trial;  45.  Plaintiffs are informed and believe, and thereon allege: that the aforementioned  actions and omissions by Defendants, and all  of them individually and in concert were  intentional or so grossly wanton and willful that they show a conscious disregard for the rights  Plaintiffs.  Defendants, and all  of them individually and in concert and their conduct  is  despicable, and subjected Plaintiffs to a cruel and unusual hardship in conscious disregard  of  their rights, all Plaintiffs pray that this court will hear their cause as the facts herein have been  plead with specificity and allow plaintiffs recovery  of their bitcoin and all damages generally and  specifically under all applicable theories  of recovery whether at law or equity.  48.  On information and belief, the 9,400 bitcoins are lodged with the MTGOX  accounts and noted on recently discovered "Crisis Strategy Draft" as the "­80,208 BTC From  banned or suspicious accounts".  Plaintiffs request that this court freeze said account so that these  bitcoins cannot be distributed until such time as plaintiffs have had an opportunity  to be heard  and to lay proper claim to their bitcoin.  Plaintiffs hereby assert a constructive trust over and with  regard to the bitcoins contained in the banned or suspicious accounts.  Cause  of Action VIII.  Specific Performance  49.  Plaintiffs reallege all prior paragraphs 1­48 herein.  50.  Plaintiffs paid for 9,400 bitcoins with U.S. Dollars. Defendants, and all  of them  individually and in concert have represented that they will deliver said 9,400 bitcoins.  Plaintiffs  request a judgment  of and from Defendants, and all  of them individually and in concert for all My name is Jed McCaleb.  I  ,am over 18 years old.  I understand the nature  of an  oath and I  am otherwise competent to testify to the matters stated in this affidavit.  I have  personal knowledge  of the facts set forth in this affidavit and,  if called to testify, I could and  would competently testify to the facts set forth herein.  2.  I am the creator and former owner  of the business MTGOX.  MTGOX was  created as  an exchange which allowed users to purchase bitcoins from each other and redeem the  contents of their accounts when desired.  I was also the managing member  of Code Collective,  LLC, through which wire transfers were made.  3.  In 2010, the Raggios opened an account on the MTGOX exchange, and began The Raggios wire transferred funds  to an account held by Code Collective, some  of which was then used to purchase bitcoins for their MTGOX account from other MTGOX  users.  5.  The Raggios did not sign any contracts or agree  to any terms of service in any way  with me, individually or doing business  as MTGOX, or with Code Collective, LLC.  6.  The Raggios purchased approximately 9,400 bitcoins from other MTGOX users in  January of 2011.  The 9,400 bitcoins were placed into Plaintiffs' account  on the MTGOX  exchange.  The value of 9,400 bitcoins was approximately $3,100.00 at the time.  7.  On January 9, 2011, Chris Raggio informed me that he believed someone had  hacked the Raggios' MTGOX account and stolen 9,400 bitcoins.  8.  On February  11, 2011, I sold the MTGOX business to Tibanne K.K.  9.  The Raggios were aware I had sold the MTGOX business and had no authority or  control over the business.  A copy of an email from Chris Raggio to me dated December 21,  2011, evidencing this is attached  as Exhibit 1 to this Affidavit.  10.  The Raggios were aware that I had no knowledge  of what was occurring with  regard to the alleged theft  of their bitcoins after the sale  of the business, except for the  information that was passed from the Raggios to me.  A copy of an email from Don Raggio to  me  dated May 30, 2011, explaining "about the situation with Baron [the suspected thief]" and  promising to "keep [me] posted on the outcome"  of the theft is attached as Exhibit 2 to this  Affidavit.  r
