Box 822 Rarotonga, Cook Islands Re: Donsbach Dynasty Subtrust B/Kurt and Marilyn Donsbach Dear Adrian: Further to our telephone discussion on December 2, 2014, I am writing to provide certain background information regarding Kurt W. Donsbach and the formation of the Donsbach Dynasty Trust and associated sub-trusts. As I mentioned, Mr. Donsbach was charged in the San Diego County, State of California Superior Court in April 9, 2009 on various charges centered chie?y on allegations of his unauthorized practice of medicine. The initial charges stemmed from an investigation into Mr. Donsbach by the San Diego County District Attomey?s Office. The investigatory phase of the case included the arrest of Mr. Donsbach and subsequent seizure of various ?les, records and cash from his residence and of?ce. On December 13, 2010, Mr. Donsbach pleadcd guilty to 13 felony charges, including ?ve counts of practicing medicine without a license, ?ve counts of selling/distributing misbranded drugs, and one count each of attempted grand theft, grand theft, and being a felon in possession of a ?rearm. The Court sentenced Mr. Donsbach to one year in jail, followed by 10 years of probation. He also was ordered to pay restitution to the victims in the amount of $250,786.00. A portion of the cash seized at Mr. Donsbach?s residence was allocated toward the restitution payment that he was ordered to make. Importantly, no forfeiture order was associated with the adjudication of this matter. As part of his sentencing, Mr. Donsbach was also ordered by the Court not to have any control, ownership or bene?t from a ?health related business.? In order to meet his obligations in this respect, the sub-trusts were created, and all of the stock in Health Advances USA, Inc. was sold, on a promissory note, from sub-trust A to sub-trust B. Donsbaeh?s wife, Marilyn Taxon Donsbach, passed away suddenly, and our of?ce is handling the administration of her estate and the various trusts involved, including the Donsbach Dynasty Trust and associated sub-trusts. We are currently working to effectuate a sale of the llealth Advances USA, Inc., stock and/or business assets, as well as the real property where the corporation conducts its business operations, which property is owned by a domestic revocable trust previously settled by Mrs. Donsbach. New ?nancing is being obtained for the real property, which is expected to close in the coming days. Upon closing ofthc new ?nancing, full payment will be made on the $209,494.00 that remains outstanding on Mr. Donsbaeh?s restitution order. Based on our knowledge of the case, our history in working with Mr. Donsbach?s criminal counsel, Charles Sevilla, and the disposition of the case, we are of the opinion that the assets of the Donsbach Dynasty Trust and associated sub-trusts do not result from the proceeds of any criminal activity and the assets are good clean assets.
