Tasteful Selections 58-KER-17 REPORT TYPE ll1l NARRATIVE CONTINUATION INV-15-20170803-055 D SUPPLEMENTAL REPORT COUNTY OF OCCURRENCE Kern 58 DATE OF OCCURRENCE 8/2/2017 D OTHER REPORT: REMARKS SUMMARY On 8/2/2017, the Kern County Department of Agriculture and Measurement Standards received a call from the Kern County Fire Department(KCFD) regarding a possible pesticide drift involving a crew harvesting garlic in Tasteful Selections, Restricted Materials Permit 1505059, garlic site FUGITT?. The KCFD had set up a triage station and decontaminated 14 fieldworkers. There were 167 fieldworkers harvesting garlic; 92 fieldworkers who exhibited symptoms of pesticide exposure, 69 had no symptoms, and 6 who could not be interviewed. Of the 92 who exhibited symptoms, 2 were transported to the hospital and another 2 sought medical treatment later. The 3 crews that were working in the field were hired by Valley Garlic who contracts with Tasteful Selections LLC to grow the garlic. There was one application occurring at the time of the incident by Agra Fly Inc., Pest Control Business license 31825, to an alfalfa field¾ of a mile to the Southwest. Agra Fly Inc. was applying chlorpyrifos to alfalfa site 2A for A.T. Banducci Farms, Restricted Materials Permit 1504619. There was one other application that took place on 8/1/2017 to the field just East of where the crews were working. The application was to another Tasteful Selections LLC field, site FUGITT9. The product applied was Vapam HL and was applied by Crop Production Services Inc., Pest Control Business license 37378. There were 2 clothing samples and a five point gradient sample sent to the USDA Anaheim residue laboratory. No violations of pesticide laws and regulations were found with the application by Crop Production Services Inc. or with the post application field monitoring/post application water seals including the mitigation for off-site movement by Tasteful Selections. Several factors led the Kern County Department of Agriculture and Measurement Standards to conclude that offsite movement of the metam sodium occurred due to off gassing. INVESTIGATION On 8/2/2017 at 7:13 a.m. Cerise Montanio, Agricultural Biologist IV for the Kern County Department of Agriculture and Measurement Standards received a call regarding a possible pesticide drift in the area of Gosford Rd. and Taft Hwy from the Kern County Fire Department(KCFD). The call stated that there were possibly 100 workers in what could be an almond orchard exposed to an unknown pesticide. Cerise called Brian Gatza, Agriculture Biologist Ill for the Kern County Department of Agriculture and Measurement Standards and informed him of the incident. Upon arrival at the office at 8 a.m. Brian contacted the KCFD for more information regarding the incident and did not receive any additional details at that time. The incident took place in garlic site FUGITT? in Section 04 Township 31 S Range 27E. The site belongs to Tasteful Selections, Restricted Materials Permit 1505059. There was one application taking place during the time of the incident. Anna Fankhauser was informed of this application by Kevin Beahm, Land, Water, and Housing Supervisor for the Kern County Department of Environmental Health. Anna spoke with Mr. Beahm at 8:20 am on the morning of 8/2/2017. The application was an aerial application by helicopter to alfalfa site 2A located in Section 08 Township 31 S Range 27E. The site belongs to A.T. Banducci Farms, Restricted Materials Permit 1504619. The application was being made by Agra Fly Inc., Pest Control Business license number 31825. The material being applied was Vulcan, EPA registration 66222-233-AA. There was no Notice of Intent submitted to the Kern County Department of Agriculture and Measurement Standards for this application. The application was also taking place within ¼ mile of a designated residential area. See the map in attachment 2. There was another application which had taken place the previous day on 8/1/2017 at 1:00 a.m. to Tasteful Selections LLC site FUGITT9 by Crop Production Services Inc., Pest Control Business license number 37378. This was an application of Vapam HL, EPA registration number 5481-468-AA. The application was done using a shank injection with a 1 a.m. start time and 2 water seals. The label and permit conditions require a 25 foot worker buffer zone around the application site. There were signs posting at all points of entry to the field stating that the field had been fumigated and the reentry interval. The Posting signs were in compliance and had all the required information correctly displayed See attachment 4.The supervising certified applicator for the job was Eric Eyraud, QAC 143725. The notice of intent(NOI) for this application was submitted on 7/27/2017 with the intended application date being 8/1/2017 and received by Brian Gatza. The Fumigant Management Plan(FMP)(attachment 2) was given to me on 8/2/2017 by Ron Medrano of Crop Production Services Inc. The Fumigant Management Plan is complete and no noncompliances were found in it. The Kern County Department of Agriculture and Measurement Standards received the Notice of Intent on 7/27/2017 for the metam application on 8/1/2017. This meets the requirements for a 72 hour Notice of Intent. The field fumigation method for the application was 1455, 1AM. Start/Nontarpaulin/Shallow/Broadcast or Bed/Two Water Treatments. The use report and fumigant management plan all show that the 1 a.m. start time and the 2 water treatments were both completed. The application was also in compliance with the good agricultural practices in the pesticide label. The task was later passed to Monica Siemens who finished the search history of all pesticide applications. There was one other application of chlorpyrifos that took place within 1 mile of FUGITT?. It was done by Lakeland Aviation, PCO license number 31852 , to site 10 on Mario Buoni & Sons, Restricted Materials Permit 1500706. The application took place on 7/12/2017 and is ¾ of a mile from where Agra Fly Inc. was applying and ¾ mile from FUGITT?(see map in attachment 2) There were 3 different crews working on garlic site FUGITT? the morning of 8/2/2017 with a total of 167 crew members harvesting garlic. The three Farm Labor Contractors(FLC) were : Ag Star Harvesting, Inc., FLC Lie FLC000167218, Pacific Farm Management Inc., FLC Lie FLC000181922 , and Harvest Kings LLC, FLC Lie FLC000212553. There were 92 fieldworkers who complained of having symptoms, 69 who had no symptoms, and 6 that could not be reached for interviews. The Bakersfield Police Department in conjunction with the California Highway Patrol closed down the section of Gosford Road from Taft Highway to Houghton Road. When the Kern County Department of Agriculture and Measurement Standards arrived on scene the crew that was left was split into two groups; people that refused decontamination and those that were going to be or had already been decontaminated . There were 14 fieldworkers that had been decontaminated. Environmental Health was already finished conducting their interviews. After decontamination, the workers were put into Tyvek coveralls. Kern County Department of Agriculture and Measurement Standards vehicles were brought alongside Kern County Department of Environmental Health vehicles within 5 minutes after being asked to place the fieldworkers in air conditioning and interviews were conducted inside the air conditioned vehicles. The Kern County Fire Department decontaminated 14 of the fieldworkers, of the 14 that were decontaminated, 2 were transported to the hospital. The two were and • • • • • 8/2/2017 was the first day on the job for both of them. They were transported to Adventist Health Bakersfield. It was later learned that two other workers from the same Farm Labor Contractor went to Adventist Health to seek medical treatment. on 8/3/2017 and 8/4/2017 and respectively. The Kern County Fire Department incident report was received on 8/9/2017. The report states that after arriving on scene, crews were still working in the field harvesting garlic. The report estimates that 25 workers were staged in a parking area near the triage location while 60 to 70 workers continued working in the field. Many of the workers reported that after seeing the fire department, they left the area and moved to another site to continue harvesting. Medical . On 8/15/2017, Cecilia Escalera of Harvest Kings LLC stated that changed mind about visiting Central Valley Occupational Medical Group. The nearest California Irrigation Management Information System weather station is approximately 15 miles East-southeast of site FUGITT?. The weather recorded for the morning of 8/2/2017 states that it was between moderately out of range to far out of normal range. The air temperature for the morning of 8/2/2017 did not fall below 82 degrees Fahrenheit. See attachment 16 for the hourly breakdown of the weather that morning . According to the CIMIS weather breakdown, soil temperatures at a depth of 6 inches never dropped below 90 degrees Fahrenheit on 8/1/2017. The fumigant management plan from Crop Production Services Inc. states that the highest recorded soil temperature at the application site was 89 .5 degrees Fahrenheit. The soil temperature for the entirety of the application never fell below 88 degrees Fahrenheit according to the fumigant management plan. The soil temperature readings are in compliance with permit conditions and label requirements. On the morning of 8/2/2017, Jackie Bressler spoke with the applicator, Eric Eyraud , the following is a summary of her interview with him: My name is Eric Eyraud. I have a Qualified Applicator Certificate and was the supervisor on site for the metam sodium application conducted on August 1, 2017 beginning at 1:00 am for Tasteful Selections. There were two crew members besides myself present. The mix/loader was Anastasio Nava and the application rig driver was Guillermo Gutierrez. We made a shank injection application. There are 27 shanks on the rig with three nozzles per shank. The nozzles are at three, six and nine inches deep. We started on the west end of the field and worked our way east with north/south passes. The application rig also pulled a ring roller to help seal the application. There were two water seals put on by the grower following the application, and I think more after that. We injected nine sprinkler lines worth of ground, one sprinkler set. Then we waited until the water seal was started before moving on to the next set. I think there were three sets, but am not certain. It was 27 acres. We finished at 7:00 am. We started the application at 1 a.m. and we finished the first half by 3 a.m. the irrigators had the water going by 3:30 a.m. The Farm Labor Contractors are hired by Valley Garlic to harvest the garlic. Tasteful Selections LLC is contracted with Valley Garlic to grow the garlic. The garlic field where they were working had not been treated in the 30 days prior to the incident, therefore pesticide training for fieldworkers was not required. The Harvest Kings LLC FLC had one crew harvesting in the field on 8/2/2017. Ag Star Harvesting, Inc. and Pacific Farm Management Inc. each had 2 crews harvesting on that day. There were 2 clothing samples taken and sent to California Department of Food and Agriculture Anaheim Residue Laboratory. The samples were taken from and who were both transported to the hospital after being decontaminated. There was a 5 point gradient sample that was taken from the garlic field where the crew was working towards the alfalfa field that had been sprayed by Agra Fly Inc. with chlorpyrifos. The 5 point gradient sample of foliage was taken by myself and Anna Fankhauser in accordance with the California Department of Pesticide Regulation Investigation Procedures. The samples were sent via FedEx to the California Department of Food and Agriculture Anaheim Residue Laboratory on 8/21/2017 to be tested for chlorpyrifos residue. A map of the points where samples were taken can be seen in attachment 1. On 8/15/2017, Kelly Kuball sent me an illustration showing the start and end times of the application and the water seals(attachment 7). On 8/21/2017 I spoke with Mr. Kuball who explained the illustration further. The following is a summary of his statement: The application started in the West and moved east, they made North-South passes with the tractor. As they moved East in the field they would fire up the sprinkler lines to start the water seal. Our nozzles allow us to put out 0. 18 inches of water per hour. The West half was run for a total of four hours followed by the East half for 4 hours. Once the application and initial water seal was complete, a 2 hour water seal was put on the West half of the field then the East half. After the second water seal was done, an additional water seal was put down in the same pattern of West then East. All of the 3 initial water seals were completed on 8/112017. There was an additional water seal put down on 8/2/2017 as per our protocol it was started around 6:30 a.m. and was finished at 12:30 p.m. Effrain Carrillo is the one who told the irrigators to put it on. On that field, we ran all the irrigation lines at once at 0. 18 acre inch of water. On 8/2/2017 when we put down the water, we ran it for over 2. 5 hours, then each half was given an additional 1. 75 hours of water at 0. 18 acre inch of water which would be 0.50 acre inch in water. When the weather is supposed to be warm, an additional water seal is put on the field as per our protocol. The soil out in that field is a sandy loam. *The last water seal applied by Tasteful Selections LLC on 8/02/2017 is what our office considers to be the mitigation of off-site movement requirement on the Metam Sodium/Metam Potassium Kern County Permit Conditions. It appears to have met the 0.5 acre inch of water to be applied immediately and completed within 4 hours. From 8/3/2017 until 8/12/2017 interviews were conducted with fieldworkers both in person and over the phone. On 8/16/2017, Jackie Bressler and I went to Crop Production Services Inc. to complete a Pest Control Headquarters inspection. The pesticide handler, training records, and respirator training for all 3 applicators was reviewed . Metam stewardship training was also verified for the applicators. No violations were found during the course of the inspection. Because of the width of the implement on the tractor, only one pass could be made on the far West side, the pass was done as close to the irrigation lines as possible. This leaves an extra bit of buffer from the edge of the field. On the day of 8/212017 when I arrived at the incident, I noticed that many of the harvesters were still in the field harvesting even affer the emergency responders had arrived. On 8/23/2017, Jackie Bressler and I went to Tasteful Selections LLC for a Production Agriculture Headquarters inspection. The irrigators that were part of the water sealing for the application on 8/1/2017 and the Post Application Monitor were all interviewed. There was 1 violation found during the course of the inspection. The violation was regarding notice of application CCR 6618 . Prior to the headquarters inspection on 8/23/2017, the irrigators for the metam application were brought in for interviews. One of them was Prisciliano Silva Lopez. I carry all of the required PPE with me in case of an emergency, but I do not enter the buffer zone for the monitoring. If I have to enter the buffer zone, I put on all the required PPE; coveralls, chemical resistant boots, chemical resistant gloves, and a full face respirator. I drive around the field, check the wind direction, check the air temperature, check for a smell in the air, and then look at the field to see if there is enough water on it. I like to have the irrigators apply more water than required to prevent anything from happening. I did not smell anything on Tuesday or on Wednesday. On 8/29/2017, Nuvia Maldonado and I went to Crop Production Services Inc. to interview Anastacio Nava and Guillermo Gutierrez. The following is a summary of my interview with Mr. Nava: My Name is Anastacio Nava, I work for Crop Production Services Inc. My supervisor is Alex Aguilar. I have been with the company for 5 years and I have been with this branch for 2 ½ years. For the application on 8/112017 I was loading the tractor. I was wearing a full face respirator, coveralls, a chemical resistant apron, chemical resistant gloves, and chemical resistant boots. I received metam training in January 2017. I remember the weather on 81112017 being calm, it was mid 70's low 80's. I did not smell anything that night. I do not take the soil temperatures, but the soil temperatures are taken from the area of the field where the metam has not yet been applied. I remember when the application was done, I saw crews coming to the garlic field. The irrigators took a little longer than normal to get the water going on the first irrigation set, but we did not continue the application until they got the water going. Nuvia Maldonado interviewed Guillermo Gutierrez and translated the interview from Spanish. The following is a summary of her interview with Mr. Gutierrez: I work for CPS as an applicator for about 15 years. My supervisor is Alex Aguilar. On August 1, 2017, I was the applicator. I drive the tractor and control the application. I have had training through CPS that covers what we need to wear to protect ourselves from the pesticides or what to do in the case of an emergency. I also went to the training for Metam and Te/one. I get that training once a year around January. In my tractor I carry everything I need to protect myself, coveralls, my chemical resistant boots and gloves, an apron, a full face respirator, eye wash, towels, soap, and water. While the application is taking place I am actually wearing my coveralls, and chemical resistant boots. I wear a full face respirator only when I exit the tractor. It was normal weather not too hot or cold. The only people out there were the irrigators, and I never noticed any odor. I left at 7:30 in the morning and no one else was out there, no crews. There was a gas pipe that ran diagonal in the south east comer of the field, every time I crossed the pipe I would stop the tractor and had to lift the shank bar go over the pipe and then start the application again. The application was completed in two sets. My crews started working in the garlic field on 7/2912017. My crews took Sunday, 7130/2017 off and came back to work on Monday 7/31/2017. I never received any notices about pesticide applications taking place near my crews. When I was told that some of my workers were not feeling well, I had the bosses pull the crews from the field. That is our standard procedure, if something happens, they call me first and pull the crews. From there if someone isn't feeling well I generally take them to the doctor. On 8/31/2017, I spoke with Jose Torres, the owner of Harvest Kings LLC. The following is a summary of my conversation with Mr. Torres: My Name is Jose Torres, I am the owner of Harvest Kings, LLC. I believe my crews started working on Saturday 7129/2017. I never received a notice of any pesticide applications taking place nearby. When my crews felt ill, I had them move to a different portion of the field. I thought that it was 'stiff neck' in the garlic that was causing an issue. 'stiff neck' is when the garlic has been sitting out for too long needing to be harvested and then when it's cut it gives off a lot of odors and can irritate you more. I moved the crew because I knew that field had a problem with 'stiff neck'. A little while later my crew told me about the signs for the application that occurred in the neighboring field and I pulled the crews out when I knew that it could be a pesticide that was causing problems. On 9/5/2017, I spoke with David Anderson of Valley Garlic on the phone. The following is a summary of my interview with Mr. Anderson: My name is David Anderson, I am Tasteful Selections LLC contact here and I deal directly with them. When I call, I generally work with Ralph Reyna. I was never informed about the metam job that took place in the field next to where the crews were working. On 812/2017 I was notified by phone around 5:05 a.m. that one of the crews was having an issue and told them to move the crew. My assistant, Luis Martinez is the one that originally told me about the issue. From after the first call until around 5:30 a.m. I did not hear anything back from the crews as I attempted to contact them. When I did hear back, I was informed about the postings in the field next to the crews and asked for them to send me a picture. I received the picture around 6:30 a.m. and promptly pulled the crews from the field. On 9/8/2017, Nuvia Maldonado interviewed Luis Martinez of Valley Garlic in Spanish on the phone. The following is a summary of her interview with Mr. Martinez: My name is Luis Martinez, I am Heladio Lustre's assistant, I was in the garlic field on 812/2017. I was in the Southeast portion of the field when the crew closest to the East side complained they weren't feeling well. It was around 5:00 a.m. when the first crew complained and the crew was moved towards the center of the field. I called Heladio to Jet him know. The second crew that complained was just west of where the first crew was before we moved them. By the time the third crew complained it was about 7 a.m. and all 3 of the crews on the East side pulled out. I am not sure who called 911. Pacific Farm Management Inc. and Harvest Kings LLC each had 2 crews each left on the West side of the field who did not feel any symptoms and kept working until about 9:00 a.m. The fire department came and asked if they were feeling ill and they said they were okay. The crews started working in that field on 7129/2017 and the crews usually start around 4:00 - 4: 30 a. m. I never noticed any applications or tractors going on nearby between 7129/2017 and 8/212017. I called Luis the supervisor for the company that hired us at five (5) in the morning when people started complaining about their eyes. It was maybe six thirty (6:30) when we started removing people from the field, as soon as they told me they were feeling sick I stopped them. I didn't know an application was being done. The following is a summarization of our interviews with them: 69 fieldworkers were harvesting garlic the morning of 8/2/2017. None of the fieldworkers reported exhibiting any that day or any of the days following the incident. A few reported unusual smells on that day. Some of them reported seeing or hearing a pesticide application taking place. There were 6 workers who we were not able to contact. Many had phone numbers that were out of country or were no longer connected. Several attempts were made to contact those with contact information. There were 3 farm labor contractors who had crews harvesting garlic. There was one application going on at the time of the incident by Agra Fly lnc., Pest Control Business license 31825, to an alfalfa field of a mile to the Southwest. Agra Fly Inc. was applying chlorpyrifos to alfalfa site 2A for A.T. Banducci Farms, Restricted Materials Permit 1504619. There was one other application that took place on 8/1/2017 to the field just East of where the crews were working. The application was to another Tasteful Selections LLC field, site The product applied was Vapam HL and was applied by Crop Production Services Inc., Pest Control Business license 37378. There were 2 clothing samples and 1, 5 point gradient sample sent to the USDA Anaheim residue laboratory. The results of the clothing and foliage samples do show that offsite movement of chlorpyrifos did occur, however it did not reach the fieldworkers according to the samples and it did not make the fieldworkers ill. Where the fieldworkers were located the sample results came back negative for both the clothing and the foliage samples. No violations of pesticide laws and regulations were found by our department with the application of Vapam HL by Crop Production Services Inc. or the post application field monitoring/post application water seals by Tasteful Selections. Several factors led our department to conclude that offsite movement of the metam sodium did occur through off gassing. The off gassing occurred after the completion of the application, post application monitoring, and water seals, which were found to be completed in compliance with pesticide laws and regulations. When off gassing occurred, proper mitigation measures were taken by Tasteful Selections LLC including a water seal at 0.5 acre inch of water starting immediately over the field and completed in 4 hours. VIOLATIONS Violation Agra Fly Inc. was found to be in violation of Food and Agricultural Code 12973 for violating Kern County General Permit Conditions by applying a California Restricted Material within mile ofa residential area by air. Agra Fly Inc. was found to be in violation of California Code of Regulations(CCR) 6739(a)(e)(p) for not having a written respiratory protection program and not having fit test records for respiratory protection. During the headquarters inspection it was found that no written respiratory protection program was in place and no fit tests were ever performed or recorded. Violation ll Edgar Bolt Jr. was found to be in violation of Food and Agricultural Code 12003(f) for writing a recommendation that violated Kern County permit conditions. Kern County permit conditions do not allow for applications of restricted materials to be made within mile of a residential area by air. Mr. Bolt wrote a recommendation for an aerial application that did not leave a buffer zone for the residential area within mile of AT. Banducci Farms site 2A. This residential area was a known hazard that existed that the pest control adviser failed to warn of on the recommendation. Violation Tasteful Selections LLC was found to be in violation of CCR 6618(3) for failing to give prior notification to fieldworkers of an application taking place within 1A mile of where fieldworkers were working. Tasteful Selections LLC was found to be in violation of 6619 for failing to assure that notice of completed application information was given to fieldworkers when they are working within 1A mile of a treated field. Tasteful Selections LLC had fieldworkers that were working within 1A mile of a field that was being treated on 8/1/2017 and then had them work in the same field on 8/2/2017 without notifying them that they were working within 1A mile of a field that had been treated. Violation IV All three farm labor contractors, Ag Star Harvesting, lnc., Harvest Kings LLC., and Pacific Farm Management Inc., were found to be in violation of California Code of Regulation 6766(c). for failing to ensure their employees were taken for emergency medical care.
