Chesapeake collected the June 9,2010, water samples before drilling any Marcellus gas wells on its Morrc well pad, which lies approximately I120 feet west of NIs. Pepper's spring and rvell. 19 Between July 23,2010, end August 14,2010, Chesspeake d(ilted the 5H well on ils Morse pad. Hydraulic fracturing ofthat well commenced on October 19, 2010, and was completed on October 26, 2010. 20 Between August 17,2010, and Septcmbet 25,20201, Chesapeake drilled the 3H lvell on ils Morse pad. On May 19, 2012, the Depanment received a complaint rclating to the water supply of a resided living approxirnatsly 4,000 feet ftom Pepper's rcsidence. 24. Alice well pad. The issrrc relorted in connection with that May 19,2012, complaint was water overflowing the top ofa drinking water well. 26. The Departnent rcsponded to that complai and commenced its investigation the following day, May 20, 2012. 27. On May 23, 2012, in connection with the invesligstion of Ms. Pepper's neighbol's water supply complaint, Chesapeske obtained additionsl water samples from Ms. Pepper's cistern/spring and sepomte bam weli, 28. Documetrts submitted to the Depadment in lhe coursc of Chesapeaks's efforts to obtain water sarnples from Ms. Pepper's water supply sources noted that, when collecting lhose samplss, the "owners stated that if the water is run ior too long that they will run o1lt ofwater for days; tho most that h8s been run at one time is a bath tub amount," 4 4f,-,l\ l. oerczuors, \*/ 29. Approximately fifteer (15) minutes 8fter r€cciving that Yoicemail, a V. 1. 1 30. member of the Depaltmenl's emerg€rcy rcsponse team rcsponded with a letum phone calt. 31. On Monday December 23,2013, the Depa ment sttempted to respond to that complsint and left a voicemait rvith Ms. Pepper requ€sting that she retum the Departmelt's call. Or January 3, 2014, after receiving no response from either Ms' Knapp or OP EN _S OU RC E 32. Ms. Popper to the voicemail left on December 23,2013' the D€partment closed the water supply complaint assigned number 301927 without issui4 33. aoy determil]atioD lettcr. On Friday Febluary ?, 2014, the Depsrtment received frorn Ms' Knapp, on behalf of Ms. Pcpper amther watet supply complaint which again Plated solely to the spring/oistem in Ms, Pepper's pasture' 35. The issues Eported at that time were e pedodic loss of water, water that was brown in color, and w8tet that bumed or initated Ms' Pepper's facial skin. 5 h 36. Th€ Dcpartment assigtrsd number 302587 to the February 7,2014, water supply complaint. 3'7 - On Tuesday February investigation ll, 2014, the Department commenced its of wate! supply complaint aumbcr 302587 by collecting 38. V. 1. 1 watel samplss from the spring/cistcm in Ms, Pepper's pasture. The Department's investigation ofwater supply comptaint number 302587 encompassed the geology of the area, the activities conducted well pad, waters samples collected Chesapeake's Morse film on Ms. Pepper's spdng/cistcrn, and additiooal uiater samples from potentially rglevant sources. The Departmenl's memorandum dated March 10, 2014, docume[ts the OP EN _S OU RC E 39. Department's investigation 40. of{ater supply aomplaint numbel 302587. The purposes ofthat memorandum include, but are not necessatily limited to: l) summadzing and discussing the backgrouud data and infonnatjon gathered in thc course ofthe investigation; 2) applying relevant, generally- accepted scientific principles to that data; 3) applying the legal stardards govemiDg Depa(ment investigations of $,ater supply complaints; and 4) expressing the gounds for h.is rccornmcndation that the spring/cistem source of Ms. Pepper's l,atct supply had not been impacted by nearby gas drilling activities. 41. As stated in the Departnent's March 14,2014 Memorandum, "[s]everal time fiames for the onset of the leld issues with the water supply were rclayed to Depnrlmert staff. Duing subsequent conversations with Department staff, [Ms. Pepper aDd Ms. Knappl have provided inconsistent informatioo with tegard to the wat€r supply's yicld; stati[g at separate times that the problcm staned in 2010, days since they had been without V. 1. 1 2012, and in an email deted 211412014, [Ms. Knapp] slated it hsd been 9 nater. On a scparate occasiorl it was also mentioned that they nevc. experienced any prior yield issucs, Field notcs collected by 3d paty environmental consultants in May of 2Ol2 indicate that the homeowners described the dug well/spring as being low yielding." On March 20, 2014, the Department received fiom Ms, Knapp a complaint OP EN _S OU RC E 42. that oil and ga$ rclated aotivity had impaoted a differcnt water supply source otr Ms. Pepper's property, this one beilg a well located in the bam on her property south of Southside Road. 43. The Department assigned number 303243 to the March 20, 2014, water supply corDplaint, 44. The issue reported at tbat time was water with an odor. 45. A Depadment memorandum dated May 13, 2014, documents the Depa(ment's invesligation of complaint ouEber 303543, aDd explaim the OP EN _S OU RC E basis for the Depsrtment's determination that oil and gas activities had not impaeted Ms. Popper's bam well. 51. On May 16, 2014, the Depafiment sodt to M& Pepper aod Ms. Knapp, via ceflified mail return leceipt rcquested, a lcner informing them that rhe water quality in the bam well "relsted to backgound and bactedal activity and not the result of 52. oil and gas activities." Ms, Pepper received the May 16, 2014 determination letter on May 16, 2014. 53. To lhis date no appeal to thc Envilcnmental Hear.ing Board has been filed from the Department's determinatioo letter dated May 16, 2014, in which the Departmert concluded that Peppcr's bam well. 8 oil ard gas aativities did not impact Ms. 6,q 54. On Septernber 3,2014, the Department sewed Ms. Pepper with the "Depefiment's Filst Set of hte[ogatories aod Reqlcst for Production U/ of Documents." 55 On October 7,2014, rhe Departrnent rcceivcd Ms. Pcpper's responses to V. 1. 1 thc "Department's !'irst Set of lntenogato(ies and Request for Production ofDocuments." 56 lntenogatory number 11 requested Ms. Pepper to "lp]lease identi$ ail documents lhat you intcnd to introduce at the hearing in this casc." 51 Ms, Pepper's :rsponse, as of October 3,2014, to interogatory number 1l was that "[a]ll documents I cu(ently intend to introduce at the healirg arc all in possession of the DEP and I havc not compiled a list ofall of these OP EN _S OU RC E documents as I believed that thc DEP was knowledgeable of them." 58 Aside from the documents filed in corneclion with Ms. Peppcr's prehearing memorandum, Ms. Pepper has not provided any documents 10 the Departmeot. Complaint #301927 was closed on 1/3/2014 because the Depa*r[ent's call lo the property owler/resident was never retumed. On 21712014, Complainant #1 contacted the Depadment on behalfofher daughter agaiD, to file another upset and that Deparlmeflt staff should have no conlact with Complairant #2 but rather, conespond through h€r. Kosmer, P.G., Caleb woolever, Matthelv Nuss, and Brendon Logau) conducted an intewiev lvith Complainants # l&2 at the residence, and collected water quality samplos lrom the spri g/dug $ell. Duriig the irteruiew, th€ Complainants stated that th€ problem has been ongoing sirrce 2010 and they Nere unsure ofthe construction ofthe water supply, but believed it to b€ approximat€ly l0 feet in deplh. Kosnrer, P.G V. 1. 1 Department representatives William Kosmer, Caleb Woolever, MattNuss, and Brendon Logan met Clu istine Pepper and Carolyn Knapp onsite, Mr. Logan and Mr. Kosmer attempted to gather background information about the water supplies onsite (bam rvell and spring). The complainants were not able to provide much information on the construotion ofeither supply, other than they though the spring had been in use for over 40 years. They also stated that the barn well was frozen and we would not be able to obtain samples from the supply, The spring was located approximately 660 feet to the south of the tesidence (uphill) and I 120 feet to the east of Chesapeake Energy's (CHK) Morse Well pad. It was located in a pasture that was actively beiog used by livestock (ho$es). Inmediately adjacent and donnslope ofthe spring was an oYal depression lhat appeared to contail minor amounts ofwate! which appeared to have a yellow tint (water could be seen in slushy snow in the bottom). Snow cover (aprox. lft) made detailed inspection ofthis area difficult. The complainants relayed this area is a"wet spot" rather than a pond, OP EN _S OU RC E Samples werc obtain€d from the spring which colsisted ofa concrete "bell" shaped pipe that extended approximately 5 - 6 feet below glad and appeared to be open hole beyond that point (approx. l -2 f€et). Roots were seen at the base ofthe pipe extending into the stalding water. Approximately 6-8 hrches ofstanding water were present in base ofthe hole and a muddy bottom was present. Water samples werc obtaiued by dipping a I Liter' Nalgene bottle attached to a sampling pole inlo the water and transferring the water from the lL container to the approp ate sampling bottle ware. Samples were collected for the Depattment's SAC 946, Med/Ett! DWVOA, DWSVOA, Nihates, Nitrites, BOD, Ammonia, Total Phosphate, THP, Fe and S reducing bacteria, Upon returning to the office, the samples werc shipped to the DepaftDent's labomtory with propcr chain of custody for analysis. The home was_also screened for rhe presence/absence ofcombustible gas wilh a calibrated MSA AItair 5X combustible gas meter. The basement and ioth floors ofthe norre were screened by Mr. Logan, and no combustible gas was detecled. William also told us that we could make a determination within 45 days but it would a premature and ilaccumte determination and one not made with full investigation, In other words it would be a (shed determinatioll, We would like to make it perfectly clear that we do not want to be forced to make a quick and inaccurate determinatiol; a full investigation should and needs to be done We want to determine what caused this diminution.
