Dear Mr. Sulton:

I am writing to inform you that this office has decided not to criminally prosecute
any civil rights offenses stemming from the interaction between your client, Daniel
Black, Sheriff David Clarke, and Sheriff? 3 Department personnel on January 15, 2017.
Our decision is not meant to af?rm the wisdom or propriety of what occurred. It re?ects
only our belief that it would be dif?cult or impossible to prove a violation of the only
federal statute likely available to us, 18 U.S.C. 242, beyond a reasonable doubt.

This decision is made on the basis of material we have acquired as well as
additional interviews conducted. Of course, the decision could change if additional
information came to light.
