Defendants. : Civil Action No. 2:17-cv-04214 : : : : : : : : : : : : : : : : MOTION FOR PARTIAL SUMMARY JUDGMENT AND IMMEDIATE ACCESS TO AND POSSESSION OF THE EASEMENTS CONDEMNED FOR CONSTRUCTION OF MVP PROJECT Pursuant to its power of eminent domain as authorized by the Natural Gas Act, 15 U.S.C. §§ 717-717(z) and Federal Rule of Civil Procedure 71.1, Mountain Valley Pipeline, L.L.C. (“MVP”) condemned property interests necessary for the construction, operation, and maintenance of an interstate pipeline and associated appurtenances necessary for its operation (the “MVP Project”) across properties in the counties of Nicholas, Greenbrier, Monroe, Summers, Braxton, Harrison, Lewis, Webster, and Wetzel, West Virginia owned by the defendants identified in the Complaint and Unknown Persons and Interested Parties (the “Landowners”). MVP is authorized to exercise eminent domain and condemn easements across the Landowners’ properties because it has a Federal Energy Regulatory Commission (“FERC”) Certificate of Public Convenience and Necessity for the MVP Project, the easements condemned Case 2:17-cv-04214 Document 6 Filed 10/27/17 Page 2 of 16 PageID #: 377 are necessary for the MVP Project, and the Landowners and MVP have been unable to reach agreements to acquire those easements. Pursuant to Federal Rule of Civil Procedure 65, MVP moves for immediate access to and possession of the easements condemned on the Landowners’ properties by February 1, 2018, to safely and effectively construct the MVP Project, which seeks to help meet the public’s demand for natural gas in the Northeast, Mid-Atlantic, and Southeast regions of the United States by providing transportation of natural gas from the Marcellus and Utica Shale Formations in central Appalachia. Granting MVP’s motion for partial summary judgment and immediate access to the easements condemned on the Landowners’ properties is in the public interest and will not affect the Landowners’ rights to receive just compensation for the property interests taken. Delaying MVP’s access to the easements condemned will cause irreparable harm to the public, to MVP, and to its customers. In support, MVP states: 1. MVP initiated the condemnation action pursuant to the Natural Gas Act, 15 U.S.C. § 717f(h), and Federal Rule of Civil Procedure 71.1. 2. The MVP Project includes approximately 303 miles of new 42-inch-diameter natural gas pipeline from Wetzel County, West Virginia to Pittsylvania County, Virginia, three new compressor stations, four new meter and regulation stations and interconnections, and other appurtenances. 3. Pursuant to Section 7(h) of the Natural Gas Act, 15 U.S.C. § 717f(h), MVP has the right to acquire the necessary property interests described specifically in the Complaint to construct, operate, and maintain the MVP Project. 4. To condemn property interests under Section 7(h), MVP must demonstrate that it holds a FERC Certificate of Public Convenience and Necessity, the property interests are -2- Case 2:17-cv-04214 Document 6 Filed 10/27/17 Page 3 of 16 PageID #: 378 necessary to the MVP Project certificated by FERC, and it has been unable to acquire the necessary property interests by agreement. MVP has met these elements and is entitled to exercise its eminent domain power. 5. MVP holds the required FERC Certificate of Public Convenience and Necessity for the construction, operation, and maintenance of the MVP Project. See 161 FERC ¶ 61,043, attached to the Complaint as Exhibit B. Pursuant to that FERC certificate, MVP is authorized to construct, operate, and maintain approximately 303 miles of new 42-inch-diameter natural gas pipeline from Wetzel County, West Virginia to Pittsylvania County, Virginia, three new compressor stations, four new meter and regulation stations and interconnections, and other appurtenances. 6. The easements condemned by MVP are necessary to safely construct, operate, and maintain the MVP Project as certificated by FERC. See Complaint, Exh. B; Declaration of Robert J. Cooper, ¶ 10, attached as Exhibit 1. 7. MVP made offers to acquire the necessary easements, but has been unable to acquire all of the property rights by agreement from the Landowners. See Exhibit 1 at ¶ 8. 8. The easements condemned are depicted on the maps attached as Exhibit C to the Complaint. The easements condemned are (1) permanent and exclusive rights-of-way with the right to construct, operate, maintain, replace, repair, remove or abandon the pipeline, as appropriate for each property, and appurtenant equipment, with ingress to and egress from the rights-of-way by means of existing or future roads or other reasonable routes on the premises and on the Landowners’ adjoining lands, and (2) temporary construction rights-of-way for the construction of the pipelines and appurtenant natural gas facilities, (3) temporary workspace -3- Case 2:17-cv-04214 Document 6 Filed 10/27/17 Page 4 of 16 PageID #: 379 rights-of-way for the construction of the pipelines and appurtenant natural gas facilities, and (4) access road rights-of-way. See Exhibit 1 at ¶ 11. 9. MVP requires access to commence tree clearing and construction activities by February 1, 2018, to the permanent and exclusive rights-of-way, access road rights-of-way, temporary construction rights-of-way, and temporary workspace rights-of-way across the properties in the counties of Nicholas, Greenbrier, Monroe, Summers, Braxton, Harrison, Lewis, Webster, and Wetzel, West Virginia, to safely and effectively accomplish the MVP Project. See id. at ¶ 12. 10. Starting in February 2018, MVP will begin mobilizing its construction crews across eleven segments of the MVP Project, each of which is approximately 30 miles long and will be cleared and constructed simultaneously. See id. at ¶¶ 14, 15. MVP and its contractors will first fell and clear trees from properties used for service facilities and access roads, and those properties impacted by endangered species. See id. at ¶ 16. 11. MVP and its contractors will then work in a continuous straight line down the path of the pipeline and rights-of-way, clearing and grading the rights-of-way, ditching the line, and moving the pipe from the laydown yard to the right-of-way. See id. at ¶ 17. 12. By mid-April to early May 2018, MVP and its contractors are scheduled to be welding pipe in each of the eleven segments of the MVP Project. See id. at ¶ 18. After welding is complete, MVP and its contractors will test the welds, lower the pipe into the trench, cover and grade the surface over the pipeline, work on crossings and tie-ins to the pipeline, clean and dry the pipeline, and finally put gas into the pipeline. See id. at ¶ 19. 13. This construction is planned to be complete along the full length of the pipeline by winter 2018, with meters being placed in late November or December 2018. See id. at ¶ 20. -4- Case 2:17-cv-04214 Document 6 Filed 10/27/17 Page 5 of 16 PageID #: 380 14. The planned in-service date of the pipeline is December 2018. See id. at ¶ 13. 15. Delaying the MVP Project will unnecessarily postpone the public benefits that the pipeline will provide and unnecessarily increase the costs of completing the work and result in the loss of substantial revenue to MVP. See id. at ¶ 28; see also Complaint, Exh. B. There is a public interest in transporting natural gas to the commercial, domestic, and industrial users in the Northeast, Mid-Atlantic, and Southeast regions of the United States, who will be served by the pipeline. See Exhibit 1 at ¶ 27. 16. Delaying MVP’s tree clearing and construction will further harm the public because it will have environmental consequences. See id. at ¶¶ 21-23. MVP’s construction schedule is designed to protect a number of environmentally sensitive species of bats and migratory birds along dozens of miles of the pipeline’s path. See id. at ¶ 21. Tree clearing must be completed in compliance with environmental restrictions, specifically prior to March 31, 2018 for locations with protected bats, and prior to May 31, 2018 for locations with protected migratory birds. See id. at ¶ 22. 17. MVP will suffer irreparable harm if it is unable to begin the tree clearing and construction activities of the MVP Project on the Landowners’ properties by February 1, 2018, because a delay in its construction schedule will delay the entire MVP Project. See id. at ¶ 12. 18. In addition, any delay in the construction of the MVP Project would negatively impact MVP’s ability to meet both its contractual requirements to begin clearing activities in February 2018, and its regulatory obligations pursuant to administrative agency approvals and permits, which require that clearing be complete by March 31, 2018, and that construction of roads be complete by March 31, 2018. See id. at ¶¶ 24-25. 19. MVP also has agreements in place to begin shipping gas in 2018. See id. at ¶ 26. -5- Case 2:17-cv-04214 Document 6 Filed 10/27/17 Page 6 of 16 PageID #: 381 20. In contrast, the Landowners will not suffer any harm by the grant of immediate access to and possession of the easements. See id. at ¶¶ 29-31. The Landowners may fully use and enjoy the premises so long as such use and enjoyment does not interfere with or obstruct MVP’s rights-of-way. See id. at ¶ 29. 21. In any event, granting immediate access will not affect the Landowners’ rights to receive just compensation. See id. at ¶ 30. 22. MVP is prepared to post a bond equal to its estimate of the just compensation due to the Landowners. See id. at ¶ 31. WHEREFORE, for the reasons set forth in this Motion and the accompanying Memorandum of Law in Support, MVP moves for entry of the attached Order granting partial summary judgment as to its authority to condemn and immediate access to and possession of the property interests held by the Landowners and condemned in this action.
