Re: Notice of Non-Compliance, Level 1
Dear Ms. Rhodes-Polk:
I am writing to inform you that Edgar P. Harney Spirit of Excellence Academy is considered at this time to be noncompliant with its contractual obligations regarding responsiveness to OPSB requests for information.
On October 3rd, OPSB sent a letter requesting additional information on matters related to financial management
and to inform school leadership of additional monitoring and oversight over the course of this school year. As
stated in the letter, the requested information was due to OPSB by October 13th and an additional grace period
was offered via email on October 16th. To date, none of the requested documents have yet been submitted.
Per the Charter Operating Agreement, charter operators are required to respond to information requested by OPSB
in a timely manner. The email sent on October 16th included a submission deadline of 3 business days, unless a time
adjustment was requested by the school. To date, no request for additional time to submit the documents has be
received.
It is critically important that Edgar P. Harney Spirit of Excellence Academy comply with expectations set forth in its
charter contract immediately. To return to good standing, please submit the following by Friday, October 27th, 2017:
 Documentation detailing the percentage of ownership by Brent Washington for any contract of a firm for
which he has been named as owner or partner
 Current Accounting Policies and Procedures Manual inclusive of audit recommendations
 Evidence of the implementation of a credit card authorization process for purchases
Failure to meet a third deadline will result in escalated consequences, including but not limited to a Tier 2 Notice of
Non-Compliance. We hope you will comply with our requests based upon the timelines stated.
