The following information was provided in the phone conversation: Ms. Langeland was on probation, but her probation was dropped after one of the directors, identified as Phillip Warren, of Recovery Connections Community made a sexual advance toward her. Ms. Langeland stated that she moved out of Recovery Connections Community program on September 6, 2012. Ms. Langeland stated that from October, 2011 to January, 2012, she worked in the office of Recovery Connections Community doing donations. She stated during that time, she made solicitation calls to businesses for donations for RCC's residents for Christmas. Ms. Langeland was told when she was making solicitation calls that RCC had obtained 501(c)(3) status. Ms. Langeland stated that during that time RCC received several donations over $1,000.00. She was told to put that RCC was a 501(c)(3) organization on the thank you letter for both monetary contributions and in-kind donations. Ms. Langeland stated that she learned RCC sent off for its 501(c)(3) in December, 2012. Ms. Langeland stated that she was part of the group that put information together for CSL's first records request to RCC. Investigator Ricks asked Ms. Langeland if callers were given a script to use in making solicitation phone calls. Ms. Langeland stated that most of the callers came to RCC from RVC where they had a script to read when calling. Ms. Langeland stated that at RVC they weren?t allowed to vary from the script. Ms. Langeland stated that Phillip Warren instructed the callers to say about the same thing as they said when making calls for RVC. There was no written script. ?j Ms. Langeland stated that they were told in September, 2011 that a donation was made via a check, involving a church, that was intended and used for paying the 501(c)(3) application fee. They were told to tell potential donors that 501(c)(3) status was pending that it had been applied for. She stated that Stacia Harvey witnessed Phillip Warren removing the statement about 501(c)(3) from the solicitation letters of Bridgette Cain from September, October, and November, 2011. Ms. Langeland stated that the donations that were received by RCC for Christmas went to Jennifer Hollowell?s Chestnut House where 4 adults and children reside who are not participants in program. Ms. Langeland stated that there was an in?kind donation of approximately $15,000 worth of clothing, including hoodies, received by RCC from World of Clothing in Hendersonville, NC. Ms. Langeland stated that the donations went straight to Chestnut House before being given to the participants in program, for whom the donation was intended. Ms. Langeland stated that the residents of Chestnut House (Jennifer Hollowell, her 4 children, Phillip Warren, his 2 children, Kelly Brady, her child, and Angie Huddy) were seen wearing the hoodies. Ms. Harvey stated that there were no hard-eopy letters saved in files at RCC. - Ms. Harvey stated that Jennifer Hollowell, Angie Huddy, and Kelly Brady would use donations that were intended for the residents in RCC's program. Ms. Harvey presented an example of Jennifer Hollowell using services donated by a salon. The salon (Ms. Harvey stated she believed it was Anada in Asheville) donated hair color. Stacia Harvey put the amount on a thank you letter. Jennifer Hollowell took the letter to the salon. Personnel at the salon discovered that Jennifer Hollowell was the Director of RCC and was ?livid.? Stacia Harvey stated that personnel at RCC would instruct her to obtain donations of dinners from restaurants that would be used by RCC personnel for personal consumption. Ms. Harvey stated that RCC personnel would go to a considerable number of conferences where she would solicit donations for dinners for personal use. Ms. Harvey stated that she wasn?t paid for her work at RCC because she was a resident in their program. Ms. Harvey stated that she left the program early because of the wrong doings of RCC personnel with regards to solicitations for donations. Ms. Harvey stated that in soliciting via telephone, there were no prescribed phone scripts for callers to use. She stated that the callers would identify RCC as a 501(c)(3) non-pro?t, 2 year program for people with substance abuse problems. She said the callers would identify what they were soliciting and why. Ms. Harvey stated that Brooks Brothers would donate a lot of clothes on occasion to RCC. Ms. Harvey stated that Phillip Warren, Kelly Brady, and Jennifer Hollowell would go through the donations before they were given to residents in their program. Ms. Harvey stated that they would remove items of clothing that they would keep for their own personal use. Ms. Harvey stated that at Christmas, RCC would receive donations of toys that were intended to be given to the residents to provide gifts for their children. Ms. Harvey stated that they would remove the toys that they wanted for their own children; thus, they kept those toys for their own personal use. Recovery Connections Community is a long-term residential substance abuse treatment program for adults located in Black Mountain, North Carolina. In November 201 1, I began soliciting charitable contributions on behalf of RCC and was given the title ?Donations Department Head?. I continuously solicited charitable contributions on behalf of RCC from November 2011 until I left the program on July 28, 2012. I was not paid for my work soliciting contributions on behalf of RCC because I was a resident participating in the substance abuse treatment program throughout this time period. In November 2011, RCC staff member Phillip Warren instructed me to state that RCC is a 501(c)(3) tax exempt organization on written correspondence and during phone calls soliciting charitable contributions. Mr. Warren further stated that RCC had already applied for 501(c)(3) tax exempt status and the application was pending. While I served as ?Donations Department Head?, I supervised other RCC residents who made solicitation phone calls. RCCImanagement did not provide a written script to use when making charitable solicitation calls on behalf of RCC. When making charitable solicitation calls, the callers stated RCC was a 501(c)(3) non- profit organization that provided a two~year treatment program for substance abuse. The callers would also identify the item they were soliciting and state the charitable purpose for which it was to be used. After RCC received records request dated May 7, 2012, Phillip Warren told me that he had n_ot instructed me to state that RCC is a 501(c)(3) organization in written correspondence and phone solicitations of contributions because tax exempt status had been applied for and was pending at that time. After RCC received records requested dated May 7, 2012, Phillip Warren instructed me verbally to remove the language regarding RCC being a 501(c)(3) Page 1 of 4 10. ll. 12. 13. organization from the solicitation letters that were saved in the RCC computer system. I also personally witnessed RCC staff member Phillip 'Warren removing the statement that RCC had 501(c)(3) tax exempt status from the solicitation letters created by RCC resident Bridgette Cain from September, October, and November, 2011. To the best of my knowledge, RCC did not maintain paper ?les of solicitation letters that were saved in the RCC computer system. RCC staff members Kelly Brady, Jennifer Hollowell, Angie Huddy, and Phillip Warren converted charitable contributions that were donated for the charitable purpose of solely being used by RCC residents participating in the substance abuse treatment program to RCC for their personal use. Contributions intended for use by RCC residents that were instead used by these individual persons included clothing, salon services, Christmas toys, meals, and movie tickets. Jennifer Hollowell informed me that on one occasion she took a contribution thank you letter that included a dollar amount of hair color services donated by Ananda Hair Studio, a local hair salon and attempted to use it to pay for hair color service for herself. Ms. Hollowell also informed me that salon personnel who discovered that she was the Director of RCC and not a program participant were very unhappy that this incident had occurred. Ms. Hollowell subsequently instructed me that RCC would not accept any more contributions from Ananda Hair Studio. RCC staff members Kelly Brady, Jennifer Hollowell and Phillip Warren instructed me to solicit local restaurants for contributions of dinners. I made solicitation phone calls and sent donation letters to these restaurants stating that these contributions would be for the benefit of RCC residents participating in the substance abuse treatment program. Instead, these donations were utilized by RCC staff members Kelly Brady, Jennifer Hollowell, and Phillip Warren for personal benefit. RCC staff members Kelly Brady, Jennifer Hollowell and Phillip Warren instructed me to solicit restaurants in cities Where they were attending educational conferences for contributions of dinners. I made solicitation phone calls and sent donation letters to restaurants stating that these contributions would be for the bene?t of RCC residents participating in a substance abuse treatment program. Dinner donations that I secured were later utilized by RCC staff members Kelly Brady, Jennifer Hollowell, and Phillip Warren for personal benefit. Carolina Cinemas in Asheville donated movie tickets intended for use by RCC residents. Instead, RCC staff members Kelly Brady, Jennifer Hollowell and Phillip Warren utilized these tickets for personal bene?t. Page 2 of 4 14. On at least one occasion, Brooks Brothers donated a large amount of clothes to RCC for use by its residents. RCC staff members Kelly Brady, Jennifer Hollowell, and Phillip Warren selectively removed items of clothing from these donations taking them for their personal use before remaining items were distributed to RCC residents for the intended charitable purpose. 15. RCC solicited donations of toys that were intended to be used by residents to provide gifts for their children during the 2011 Christmas season. RCC staff members Kelly Brady, and Jennifer Hollowell, and Phillip Warren selectively removed toys from these donations taking them for their personal use before remaining items were distributed to RCC residents as intended. 16. While I served as ?Donations Department Head?, 1 supervised other RCC residents who made solicitation phone calls. RCC management did not provide a written script to use when making charitable solicitation calls on behalf of RCC. When making charitable solicitation calls, the callers stated RCC was a 501(c)(3) non- pro?t organization that provided a two-year treatment program for substance abuse. The callers would also identify the item they were soliciting and state the charitable purpose for which it was to be used. After RCC received records request dated May 7, 2012, Phillip Warren told me that he had n_ot instructed me to state that RCC is a 501(c)(3) organization in written cbrrespondence and phone solicitations of contributions because tax exempt status had been applied for and was pending at that time. RCC staff members Kelly Brady, Jennifer Hollowell, Angie Huddy, and Phillip Warren converted charitable contributions that were donated for the charitable purpose of solely being used by RCC residents participating in the substance abuse treatment program to RCC for their personal use. Contributions intended for use by RCC residents that were instead used by these individual persons included clothing, salon services, Christmas toys, meals, and movie tickets. Jennifer Hollowell informed me that on one occasion she took a contribution thank you letter that included a dollar amount of hair color services donated by Amanda Hair Studio, a local hair salon and attempted to use it to pay for hair color service for herself. Ms. Hollowell also informed me that salon personnel who discovered that she was the Director of RCC and not a program participant were very unhappy that this incident had occurred. Ms. Hollowell subsequently instructed me that RCC would not accept any more contributions from Ananda Hair Studio. RCC staff members Kelly Brady, Jennifer Hollowell and Phillip Warren instructed me to solicit local restaurants for contributions of dinners. I made solicitation phone calls and sent donation letters to these restaurants stating that these contributions would be for the bene?t of RCC residents participating in the substance abuse treatment program. When I left RCC on April 19, 2012, Ms. Howell and Mr. Warren were still RCC employees as well as Kelly Brady, Angie Huddy, Charlene Workman, and Richard Stuart. While an RCC resident, Ms. Howell assigned me to work in the in-kind donation department of RCC performing scheduling functions, handling in?kind donations on behalf of RCC, and assisting RCC with obtaining IRS 501(c)(3) tax exempt public charity status. I engaged in these work activities at RCC from July 30, 2011 until approximately January 19, 2012 and observed other persons soliciting contributions on behalf of RCC throughout this time period. I engaged in these work activities including charitable solicitations at Ms. Howell?s home, 65 Chestnut Hill, Black Mountain, North Carolina and the RCC of?ce on Old US Highway 70, Black Mountain, North Carolina. The following RCC residents ran the RCC office and made charitable solicitation phone calls: Jared Rhinesmith, Stuart Langeland, Ashley Barger, Stacia Harvey, Christopher Cobern, James Anthony Robinson, Korey oines, Bridget Cain, and myself. RCC residents soliciting contributions on the organization?s behalf called mostly commercial businesses and some individuals. Individuals that were solicited were RCC residents? friends and family members or persons with past af?liation with Ms. Howell. RCC residents were told to make as many as 50-100 solicitation phone calls per day. I made 20-500 phone calls per day. However, I did not make this statement to any potential donor at any time. When potential donors asked for a tax ID number, I would reply that RCC was a ?non?profit.? When I informed potential donors that RCC did not have a tax ID number, they would often refuse to make any contribution. During my time as an RCC client, the organization received in?kind donations in varying amounts from various businesses including food, clothing, and personal hygiene items. I estimate that RCC received worth of in?kind contributions while I worked in the of?ce. Monetary contributions were rare. Although RCC residents were not allowed to drink soft drinks, I am aware of instances wherein RCC solicited and received free soft drinks that were taken to Ms. Howell?s home for her personal consumption. I am aware of instances wherein contributions intended for use by RCC residents of gift cards for haircuts and massages were utilized by RCC employees including Ms. Howell or Kelly Brady. New clients entering the RCC program completed food stamp applications. All clients? food stamp allocations were placed on one Electronic Bene?t Transfer (EBT) card in the name of RCC. However, food purchased with the RCC card was not consumed by RCC residents. I observed that RCC clients who reported allegations of food stamp misuse to government authorities were subsequently assigned longer workdays than usual by RCC staff. I am not aware of any persons soliciting contributions on behalf of RCC that told potential donors they were soliciting contributions on behalf of Recovery Ventures Corporation, another residential substance abuse treatment center in Black Mountain, North Carolina. I was a resident/client of Recovery Connections Community (hereinafter referred to as from July 30, 2011 until April 19, 2012. Recovery Connections Community is a long-term residential substance abuse treatment program for adults located in Black Mountain, North Carolina. When I arrived at RCC, there were approximately twenty (20) residents. When I left RCC, there were approximately thirty??ve (3 5) residents. When I arrived at RCC on July 30, 2011, the only two employees were Jennifer Howell and Phillip Warren. When I left RCC on April 19, 2012, Ms. Howell and Mr. Warren were still RCC employees as well as Kelly Brady, Angie Huddy, Charlene Workman, and Richard Stuart. While an RCC resident, Ms. Howell assigned me to work in the in?kind donation department of RCC performing scheduling functions, handling in-kind donations on behalf of RCC, and assisting RCC with obtaining IRS 501(c)(3) tax exempt public charity status. I engaged in these work activities at RCC from July 30, 2011 until approximately January 19, 2012 and observed other persons soliciting contributions on behalf of RCC throughout this time period. I engaged in these work activities including charitable solicitations at Ms. Howell?s home, 65 Chestnut Hill, Black Mountain, North Carolina and the RCC of?ce on Old US Highway 70, Black Mountain, North Carolina. The following RCC residents ran the RCC of?ce and made charitable solicitation phone calls: Jared Rhinesmith, Stuart Langeland, Ashley Barger, Stacia Harvey, Christopher Cobern, James Anthony Robinson, Korey Joines, Bridget Cain, and myself. RCC residents soliciting contributions on the organization?s behalf called mostly commercial businesses and some individuals. Individuals that were solicited were RCC residents? friends and family members or persons with past af?liation with Ms. Howell. RCC residents were told to make as many as 50?100 solicitation phone calls per day. I made 20-500 phone calls per day. At one time, Phillip Warren and Kelly Brady were involved in the solicitation of contributions. Ms. Howell did not personally solicit contributions at any time. 11. 12. 13. I4. 15. 16. 17. 18. Ms. Howell and Phillip Warren instructed me and other persons soliciting contributions to ?tell them whatever you have to to get a donation.? I observed other persons soliciting contributions via phone on behalf of RCC mislead potential donors on many occasions that their contributions were eligible for a one~hundred percent (100%) tax deduction. However, I did not make this statement to any potential donor at any time. When potential donors asked for a tax ID number, I would reply that RCC was a When I informed potential donors that RCC did not have a tax ID number, they would often refuse to make any contribution. During my time as an RCC client, the organization received in?kind donations in varying amounts from various businesses including food, clothing, and personal hygiene items. I estimate that RCC received worth of in-kind contributions while I worked in the of?ce. Monetary contributions were rare. Although RCC residents were not allowed to drink soft drinks, I am aware of instances wherein RCC solicited and received ?ee soft drinks that were taken to Ms. Howell? home for her personal consumption. I am aware of instances wherein contributions intended for use by RCC residents of gift cards for haircuts and massages were utilized by RCC employees including Ms. Howell or Kelly Brady. New clients entering the RCC program completed food stamp applications. All clients? food stamp allocations were placed on one Electronic Bene?t Transfer (EBT) card in the name of RCC. However, food purchased with the RCC card was not consumed by RCC residents. I observed that RCC clients who reported allegations of food stamp misuse to government authorities were subsequently assigned longer workdays than usual by RCC staff. I am not aware of any persons soliciting contributions on behalf of RCC that told potential donors they were soliciting contributions on behalf of Recovery Ventures Corporation, another residential substance abuse treatment center in Black Mountain, North Carolina.
