Recovery Connections Community should preserve the data integrity of the ?les following one of the following procedures: duplication of responsive ?les in the ?le system (119., creating a forensic copy, including a bit image copy, of the ?le system or pertinent portion), performing a routine cepy of the ?les While preserving Meta-Data (including, but not limited to, creation date and time), and/or using reasonable measures to prevent a ?le from being, or indicate that a ?le has been, modi?ed, either intentionally or unintentionally, since the collection or production date of the ?les. If Recovery Connections Community desires to redact the contents of a Native File for privilege, trade secret, or other purposes (including, but not limited to, Meta?Data), there should be an accompanying statement indicating that the ?le has been redacted, the reason for redaction, and an original, unmodi?ed ?le should be retained at least during the pendency of the inquiry. All electronic productions are to be organized by custodian and furnished to the Division along with a summary. Tagged Imaged File Format (TIFF) with Corresponding Load Files: Recovery Connections Community should collect and produce the foregoing electronic information in single-page Tagged Imaged File Format (TIFF). The Division requires that the production must contain four components: 1) an image ?le; 2) delimited text ?le; 3) optical character recognition text; and 4) IPRO cross-reference ?le. Any electronic production must be compatible with Concordance 2007, version 9.58 (?Concordance?) and IPRO 8.6 and can be delivered to the Division on a CD or DVD. Each CD or DVD must be self contained with images and corresponding Concordance loadable .dat ?le and an loadable .lfp ?le with appropriate document boundaries. All electronic productions are to be organized by custodian and furnished to the Division along with a summary. The summary shall describe the number of records, images, e-mails and attachments in the production. In addition, the description must contain sufficient detail to permit the Division to verify that the production is complete. If the images on a CD or DVD exist in a proprietary meta-data environment and an export to a Concordance loadable format is not possible, then it is required that a working copy of proprietary software, together with any user manuals or help ?les and the search engine used to search for and retrieve the data, must be provided on each CD or DVD. In addition, when the data text (regardless of format), it is required that the documents be before production. 1 1. The following information was provided: - While Wooten was a resident/client of RCC, he handled the in-kind donation department at RCC. Wooten stated "Jennifer" put him to working in the office doing scheduling, handling in-kind donations, and Wooten was assisting RCC obtain 501(c)(3) status. - Wooten stated that there were suspicious activities in the solicitations for in-kind contributions. Wooten stated that he would not get on the phone and lie to donors; however, Wooten stated that some people working there would call donors and tell them they would get a 100% tax deduction for contributions. Wooten stated that the workers were not directly told to tell potential donors that they would get a tax deduction, but it was strongly hinted at from Jennifer and Phillip. Wooten stated that Jennifer and Phillip would tell workers to "tell them whatever you have to to get donation." 0 Wooten stated that there was some handling/misuse of information processing on clients' forms for food stamps. When clients come into the program, they complete an application for food stamps. Each client's food stamp allocation is put all on one card for RCC. Food stamps were not used for the group home. Clients could not report wrong use because they would be punished with being assigned 20+ hour work days. - Wooten stated that RCC did receive in-kind donations from businesses, hotels, food, clothing, personal hygiene. Wooten stated and example is that they would solicit contributions of soft drinks from soft drink companies. Clients were not allowed to drink soft drinks; the soft drinks that were received would sometimes go to Jennifer's house for her personal consumption. - Wooten called Jennifer and Phillip a "cult" because they have things to hold over the clients' heads (such as threaten that the clients would he sent back to prison). 0 Wooten stated he was in prison now. 0 Wooten stated he has been in a lot of trouble. - Wooten denied any firsthand knowledge of RCC personnel calling businesses and telling that they were calling from RVC or that they were in any way affiliated with RVC. Wooten said that he would not be surprised ifthey were doing this, though. - Wooten stated that the in-kind donations would not always go to the clients of RCC. Some would be given to people affiliated with RCC such as employees. Some would be used by Jennifer or given to Kelly Brady. While still a client of RVC and Hollowell, Dee and Hollowell began a personal relationship, which the Board alleges, and Hol lowell denies, involved ?sexual activity? or ?sexual contact" as those terms are defined in 21 NCAC 68.0101(33) and 7. RVC also supports itself through contributions either made directly, or after solicitation by clients working for RVC in their in~kind contribution program. Beginning as early as 2004, and continuing thereafter, Hollowell had clients of RVC provide personal services at her residence, such as cleaning her residence: cooking for her and her 2 family; babysitting her children; landscaping; making home repairs and improvements; taking care of her numerous animals (including, variously, dogs, cats, birds, lizards, and goats: and run personal errands, such as picking up groceries, driving her children around, changing the tires on her car, and color coordinating her closet. 14. Hollowell did not pay for the personal services rendered by her clients, except, perhaps, on an irregular basis; and continued to use client labor for personal services after repeated warnings that the conduct was unacceptable. 15. In spite of the?warning of the Board, and the instructions of 5 Board, Hollowell continued to have clients perform personal services at her residence. including babysitting her children, cooking, cleaning, landscaping, animal care and home improvement work. 16. Hollowell's use of client labor for personal services was a serious misuse of her professional relationship for personal advantage. Hollowell's use of clients' labor for her own benefit denied those clients the full benefit of the programs at RVC, and could have reduced the clients chances of completing the program, and could actively cause harm to the clients. 18. That Hollowell interfered with the investigation of the Board, by encouraging potential witnesses to give false statements to the Board. e. That Hollowell. in a general sense, while at RVC, failed to maintain apprOpriate boundaries between herself and her clients in ways that.have negatively'impacted their'progress in treatment; has used and exploited her clients for her personal benefit;.has abused and otherwise treated clients in a way not primarily for the benefit of the clients, and in many cases to their immediate and actual detriment; has exposed clients to environments harmful to them; all in violation of her obligations of the rules and regulations of the Board. BASED UPON THE FOREGOING FINDINGS OF FACT, THE BOARD CONCLUDES AS A MATTER OF LAW: 1. 21 NCAC 68.0509 provides that ?[t]he professional shall avoid dual relationships that could impair professional judgment or increase the risk of exploitation of a client.? 2. 21 NCAC 68.0509 (-2) provides that (tlhe substance abuse professional shall not engage in or solicit sexual activity or sensual contact with a former client for five years after the termination of the counseling or consulting relationship." [At the time Doe graduated from the program, the prohibition only extended for two years after termination of the counseling or consulting relationship, and that two year prohibition is applicable in this case.] 3. 21 NCAC 68.0509(d) provides that ?[t]he substance abuse professional shall not misuse his or her professional relationship for sexual, financial, or other personal advantage. 4. Whenl arrived at RCC on July 30, 201 1, the only two employees were Jennifer Howell and Phillip Warren. When I left RCC on April 19, 2012, Ms. Howell and Mr. Warren were still RCC employees as well as Kelly Brady, Angie Huddy, Charlene Workman, and Richard Stuart. 4. While an RCC resident, Ms. Howell assigned me to work in the in-kind donation department of RCC performing scheduling functions, handling in-kind donations on behalf of RCC, and assisting RCC with obtaining IRS 501(c)(3) tax exempt public charity status. 5 . I engaged in these work activities at RCC from July 30, 2011 until approximately January 19, 2012 and observed other persons soliciting contributions on behalf of RCC throughout this time period. 6. I engaged in these work activities including charitable solicitations at Ms. Howell?s home, 65 Chestnut Hill, Black Mountain, North Carolina and the RCC of?ce on Old US Highway 70, Black Mountain, North Carolina. 7. The following RCC residents ran the RCC off ce and made charitable solicitation phone calls. Jared Rhinesmith, Stuart Langeland, Ashley Barger, Stacia Harvey, Christopher Cobern, James Anthony Robinson, Corey Joines, and myself. 8. RCC residents soliciting contributions on the organization?s behalf called mostly commercial businesses and some individuals. individuals that were solicited were RCC residents? friends and family members or persons with past affiliation with Ms. Howell. 9. RCC residents were told to make as many as 50?100 solicitation phone calls per day. I made 20-500 phone calls per day. 10. At one time, Phillip Warren and Kelly Brady were involved in the solicitation of contributions. Ms. Howell did not personally solicit contributions at any time. 11. 12. 13. 14. 15. 16. 17. 18. I observed other persons soliciting contributions via phone on behalf of RCC mislead potential donors on many occasions that their contributions were eligible for a one-hundred percent (100%) tax deduction. However, I did not make this statement to any potential donor at any time. When potential donors asked for a tax ID number, I would reply that RCC was a ?non?profit.? When I informed potential donors that RCC did not have a tax ID number, they would often refuse to make any contribution. During my time as an RCC client, the organization received in?kind donations in varying amounts from various businesses including food, clothing, and personal hygiene items. I estimate that RCC received worth of in?kind contributions while I worked in the of?ce. Monetary contributions were rare. Although RCC residents were not allowed to drink soft drinks, I am aware of instances wherein RCC solicited and received free soft drinks that were taken to Ms. Howell?s home for her personal consumption. I am aware of instances wherein contributions intended for use by RCC residents of gift cards for haircuts and massages were utilized by RCC employees including Ms. Howell or Kelly Brady. New clients entering the RCC program completed food stamp applications. All clients? food stamp allocations were placed on one Electronic Bene?t Transfer (EBT) card in the name of RCC. However, food purchased with the RCC card was not consumed by RCC residents. RCC clients were informed they would. be assigned twenty plus hour work days if they reported allegations of food stamp misuse to government authorities. I am not aware of any persons soliciting contributions on behalf of RCC that told potential donors they were soliciting contributions on behalf of Recovery Ventures Corporation, another residential substance abuse treatment center in Black Mountain, North Carolina. RCC obtained their initial charitable solicitation license on August 8, 2011. 6. RCC currently holds a charitable solicitation license that is set to expire on October 15, 2012.- 2012 CSL 07683 PageZ . 7. On February 29, 2012, CSL Investigator Jason L. Ricks received an electronic mail message from David F. Martin, Executive Director/CFO of Recovery Ventures Corporation alleging - that RCC has contacted potential donors for charitable contributions representing themselves as Recovery Ventures Corporation. Mr. Martin also forwarded in this message a copy of a thank you letter to an RCC donor stating that the contribution was ?tax deductible.? 8. In order to obtain additional information concerning allegations regarding RCC, CSL sent the organization a records request on May 7, 2012 pursuant to NCGS ?131F-23(a) concerning their charitable solicitations and expenditure of charitable contributions. More Speci?cally, CSL requested the following information: a. Number of ?persons? solicited, directly or indirectly, by RCC between April 12, 2011 and May 7, 2012; b. Copies of printed charitable solicitation materials sent to all persons by or on behalf of RCC between April 12, 2011 and May 7, 2012; (3. Copies of all written con?rmations, receipts or reminders of contributions sent to persons by or on behalf of RCC between April 12, 2011 and May 7, 2012; d. Date received and amount of all contributions received by RCC between April 12, 2011 and May 7, 2012; e. Names and contact information of all persons that made contributions to RCC between April 12, 2011 and May 7, 2012; f. Total of all contributions received by RCC between April 12, 2011 and May 7, 2012; g. RCC provided the following reports for April 12, 2011 through May 7, 2012: ?Pro?t and Loss?, ?Expenses by Vendor Detail?, ?Daily Donation Request Log?, and ?Daily Donation Log?. RCC also included copies of solicitation letters sent between October 2011 and April 2012. The ?Pro?t and Loss? report submitted by RCC indicated that RCC received revenues totaling $214,955.66 and expenditures totaling $210,886.30 between April 12, 2011 and May 7, 2012. More speci?cally, this report indicated that RCC received $5,832.50 in ?Undesignated Support? from churches, individuals, businesses, and civic clubs, $207,727.56. in contract and program revenue, and $1,395.60 in other revenues. The ?Daily Donation Log? report submitted by RCC indicated receipt of in?kind contributions and some ?Unknown? contributions valued at $15,094.14 between April 12, 2011 and May 7, 2012. The ?Expenses by Vendor Detail? report submitted by RCC indicated expenditures of $171,788.84 between April 12, 2011 and May 7, 2012. The solicitation letters included in records request response include contribution . requests to entities in several cities throughout the United States for multiple hotel stays on various dates and meals or gift cards for restaurants. These letters also include solicitations for gift cards for personal services at salons and spas including massages and pedicures, and in-kind donations of clothing, bedding, hygiene items, guinea pig cages, and toys. Some solicitation letters stated that the requests for hotel stays in various cities were for RCC clients to visit family, attend weddings, or attend educational classes. Some solicitation letters stated that requests for restaurant meals and gift cards were for clients traveling to specific destinations for a non-?speci?ed purpose or visiting family. ?Daily Donation Request Log? includes requests for donated items in the following categories: clothing, movie tickets, hotel rooms, beach house, laundry detergent, shoes, event tickets, mini~fridge, of?ce supplies, gift certi?cates for restaurant meals, guinea pig cages, massages, pedicures, pet food and supplies, shampoo, medicine, hygiene items, gift bags, bedding, mattresses, furniture, wrapping paper, scarves, make-up, garden supplies, and softball equipment. CSL has a copy of a message board entry posted by ?Recovery Connections? on April 24, 2012 at 11:48am on the Carolina NSA Womens? This posting also includes the following statement: ?We are a 501 non-pro?t and your donation will be 100% tax This message board entry is located at 1335282491.htm1. RCC provided copies of solicitation letters dated April 30, 2012 that were sent to the Carolina Panthers and Charlotte Motor Speedway. These solicitation letters included the following language: ?Your donation would be %100 tax-deductible.? RCC failed to provide any information or documentation regarding their current IRS status and whether they have been granted or applied for 501(c)(3) tax exempt status. Based upon a preponderance of the evidence cited in this Notice, the Department through CSL has concluded that there is a substantial likelihood that RCC employed in solicitations devices or schemes to defraud or to obtain a contribution by means of any deception, false pretense, misrepresentation, or false promise in violation of N.C.G.S. Recovery Connections Community is a long-term residential substance abuse treatment program for adults located in Black Mountain, North Carolina. 2. When I arrived at RCC, there were approximately twenty (20) residents. When I left RCC, there Were approximately thirty?five (35) residents. 3. When I arrived at RCC on July 30, 2011, the only two employees were Jennifer Howell and Phillip Warren. When I left RCC on April 19, 2012, Ms. Howell and Mr. Warren were still RCC employees as well as Kelly Brady, Angie Huddy, Charlene Workman, and Richard Stuart. 4. While an RCC resident, Ms. Howell assigned me to work in the in~kind donation department of RCC performing scheduling functions, handling in?kind donations on behalf of RCC, and assisting RCC with obtaining IRS 501(c)(3) tax exempt public charity status. 5. I engaged in these work activities at RCC from July 30, 2011 until approximately January 19, 2012 and observed other persons soliciting contributions on behalf of RCC throughout this time period. 6. I engaged in these work activities including charitable solicitations at Ms. Howell?s home, 65 Chestnut Hill, Black Mountain, North Carolina and the RCC of?ce on Old US Highway 70, Black Mountain, North Carolina. 7. The following RCC residents ran the RCC of?ce and made charitable solicitation phone calls: Jared Rhinesmith, Stuart Langeland, Ashley Barger, Stacia Harvey, Christopher Cobern, James Anthony Robinson, Korey Joines, Bridget Cain, and myself.- 8. RCC residents soliciting contributions on the organization?s behalf called mostly commercial businesses and some individuals. Individuals that were solicited were RCC residents? friends and family members or persons with past af?liation with Ms. Howell. 9. RCC residents were told to make as many as 50?100 solicitation phone calls per day. I made 20-500 phone calls per day. 10. However, I did not make this statement to any potential donor at any time. When potential donors asked for a tax ID number, I would reply that RCC was a When I informed potential donors that RCC did not have a tax ID number, they would often refuse to make any contribution. During my time as an RCC client, the organization received in?kind donations in varying amounts from various businesses including food, clothing, and personal hygiene items. I estimate that RCC received worth of contributions while I worked in the of?ce. Monetary contributions were rare. Although RCC residents were not allowed to drink soft drinks, I am aware of instances wherein RCC solicited and received free soft drinks that were taken to Ms. Howell?s home for her personal consumption. I am aware of instances wherein contributions intended for use by RCC residents of gift cards for haircuts and massages were utilized by RCC employees including Ms. Howell or Kelly Brady. New clients entering the RCC program completed food stamp applications. All clients? food stamp allocations were placed on one Electronic Bene?t Transfer (EBT) card in the name of RCC. However, food purchased with the RCC card was not consumed by RCC residents. I observed that RCC clients who reported allegations of food stamp misuse to government authorities were subsequently assigned longer workdays than usual by RCC staff. I am not aware of any persons soliciting contributions on behalf of RCC that told potential donors they were soliciting contributions on behalf of Recovery Ventures Corporation, another residential substance abuse treatment center in Black Mountain, North Carolina. I was a resident/client of Recovery Connections Community (hereinafter referred to as from July 30, 2011 until April 19, 2012. Recovery Connections Community is a long-term residential substance abuse treatment program for adults located in Black Mountain, North Carolina. 2. When I arrived at RCC, there were approximately twenty (20) residents. When I left RCC, there were approximately thirty?five (35) residents. 3. When I arrived at RCC on July 30, 201 1, the only two employees were Jennifer Howell and Phillip Warren. When I left RCC on April 19, 2012, Ms. Howell and Mr._ Warren were still RCC employees as well as Kelly Brady, Angie Huddy, Charlene Workman, and Richard Stuart. 4. While an RCC resident, Ms. Howell assigned me to work in the in-kind donation department of RCC performing scheduling functions, handling in-kind donations on behalf of RCC, and assisting RCC with obtaining IRS 501(c)(3) tax exempt public charity status. 5. I I engaged in these work activities at RCC from July 30, 2011 until approximately January 19, 2012 and observed other persons soliciting contributions on behalf of RCC throughout this time period. 6. I engaged in these work activities including charitable solicitations at Ms. Howell?s home, 65 Chestnut Hill, Black Mountain, North Carolina and the RCC of?ce on Old US Highway 70, Black Mountain, North Carolina. 7. The following RCC residents ran the RCC office and made charitable solicitation phone calls: Jared Rhinesmith, Stuart Langeland, Ashley Barger, Stacia Harvey, Christopher Cobern, James Anthony Robinson, Korey oines, Bridget Cain, and myself. 8. RCC residents soliciting contributions on the organization?s behalf called mostly commercial businesses and some individuals. Individuals that were solicited were RCC residents? friends and family members or persons with past af?liation with Ms. Howell. 9. RCC residents were told to make as many as 50-100 solicitation phone calls per day. I made 20-500 phone calls per day. 10. At one time, Phillip Warren and Kelly Brady were involved in the solicitation of contributions. Ms. Howell did not personally solicit contributions at any time. 11. 12. 13. 1.4. 15. 16. 17. 18. Ms. Howell and Phillip Warren instructed me and other persons soliciting in~kind contributions to ?tell them whatever you have to to get a donation.? I observed other persons soliciting contributions Via phone on behalf of RCC mislead potential donors on many occasions that their contributions were eligible for a one-hundred percent (100%) tax . deduction. However, I did not make this statement to any potential donor at any time. When potential donors asked for a tax ID number, I would reply that RCC was a When I informed potential donors that RCC did not have a tax ID number, they would often refuse to make any contribution. During my time as an RCC client, the organization received in-kind donations in varying amounts from various businesses including food, clothing, and personal hygiene items. I estimate that RCC received worth of in?kind contributions while I worked in the of?ce. Monetary contributions were rare. Although RCC residents were not allowed to drink soft drinks, I am aware of instances wherein RCC solicited and received ?ee soft drinks that were taken to Ms. Howell?s home for her personal consumption. I am aware of instances wherein contributions intended for use by RCC residents of gift cards for haircuts and massages were utilized by RCC employees including Ms. Howell or Kelly Brady. New clients entering the RCC program completed food stamp applications. All clients? food stamp allocations were placed on one Electronic Bene?t Transfer (EBT) card in the name of RCC. However, food purchased with the RCC card was not consumed by RCC residents. I observed that RCC clients who reported allegations of food stamp misuse to government authorities were subsequently assigned longer workdays than usual by RCC staff. I am not aware of any persons soliciting contributions on behalf of RCC that told potential donors they were soliciting contributions on behalf of Recovery Ventures Corporation, another residential substance abuse treatment center in Black Mountain, North Carolina. - Further, the affiant sayeth not.
