Th is document outl ines the follow ing : o The subm i ss i on process for d ig ital dev i ces for SSE k i osk forens i c exam i nat io n (LEVEL 1 ); HOW and WHEN to escalate to a Level 2 (Digi tal Hub ) or/and Level 3 (DCC Central Laborato ry) forensic examination for d igital dev ices (see F igure 1 and 1 . 1 refers ) o Best practice to be adopted to around the se izure of d ig ital dev ices requ iring forensic examination o Gu i dance to Pol ice Off icers and SSE k i osk exam i ners on acti ons to be taken o n complet ion of a SSE k iosk forens ic examinat io n 1 .2 In add it ion to the above , this Local Working Instruct ion (LWI) will enable a cons istent and lawful method of process i ng the personal data obta i ned from d ig ital dev i ces during the course of and invest igat ion . Th is LWI aims to ensure our processes are compl iant with our obl igat ions under leg islation such as Cr iminal P rocedures and Invest igat ion Act 1996 (CPIA ), Data P rotection Act 1998 (DPA ), Human R ights Act 1998 (HRA ) and als o the Management of Pol ice Informat ion Code of pract ice 2010 (MOPI). 2. Introduction and Current Positio n 2 . 1 The SSEs2 are located through out the Boroughs w ith in the Metropol itan Pol ice boundaries. Each SSE w ill have a nom inated S ingle Po int of Contact (SPOC). The SPOC w ill ass ist the DCC , Forens ic Serv ices, in the management and compl iance of the SSE fac i lities, those act iv ities will include : o Locat ion of SSEs and log istical support (e.g . access to an Aware, pri nter and phone ) o Prov ision of secure exh ibits storag e o Poi nt of l iaison between DCC and accred ited SSE k iosk users o Ensure that prov i s i ons are i n place around consumables (e .g . Scope & Environment 3 . 1 Whereby d igital dev ices are se ized during th e course of an invest igat ion the capab ility is ava i lable to conduct a forens i c exam i nati on us ing the SSE k iosks by tra i ned and accred ited kiosk users . SSE k iosks must not be used for the exam i nation of exh ib its seized during covert i nvest igat ions , when there may be legal , jou rn alistic or confidentia l personal informat ion on the dev ice. If in doubt seek advice form the one of the DCC digital hubs or DCC central laborato ry. 3 .2 Submitting d irectly to DCC d ig ital hub or DCC central laboratory Subm ission of exhibits directly for a level 2 or/and level 3 forens ic exami nation w ill be accepted in cases where : 1 ). The exh ib its for exam ination are contam inated w ith b iolog ical/chem ical hazard s (warn ing labels should be clearly v isible on packag ing ) 2). Voicema il is requ ired 3) Digital dev ice has been attempted on the SSE kiosk, and is not supported , or th e acqu is i t i on of data has not been successful on the SSE ki os k 4). Examination has been attempted on the SSE k iosk and add itional spec ialist exam ination is requ ired 5). Followi ng a chargi ng dec is ion where a not gu ilty plea is entered , an exhibit requires further evidential analys is if the SSE kiosk ev idential product (i .e. the SSE kiosk exam iner , OIC statements and exh ibited report/sect ion of the report) is relevant an d disputed When i t is KNOWN that the dev i ce i s secur ity locked upon se izure , and unlock ing 6). is not supported by the SSE k iosk , can be escalated to DCC d ig ital hub or DCC centra l laborato ry. Head of DCC. 12 Month s Lawfully Obtaining Digitally Held Data 5 . 1 Officers and staff are rem inded that only data conta ined w ithi n the dev ice is retrievabl e using PACE . Any add itional act ions unde rtaken by off icers or staff to obta in data held o n servers or platforms that may be access i ble us i ng the dev i ce w i ll be treated as unauthorised unlawful access and w ill be formally investigated . This will include vo icema il that has not been pushed to the dev ice and held in an aud io file where the requ i red leg i slat ion and or consent has not been obta i ned pri or to access . It i s , therefore , important that officers and staff follow th is gu idance fully and refer to DCC for fu rther gu idance or spec ialist adv ice. 5 .2 The lawful process in obta in ing d igitally held data from personal dev ices sl ightly d iffers depend ing upon the invest igat ive status of the subject . Suspects : An officer can exercise h is/her powers under PACE in obta in ing material wh ich is relevant to an invest igation . Victims and Witness : Where a device has been prov ided to pol ice, either by a v ictim or witness , i n order to i dent i fy data that may be relevant to an i nvesti gat ion or ev idence of an offence the Form 107 (found on the forms webs ite) must be completed and "explicit consent" obtained prior to the exam inat ion taking place . 5 .3 Where consent is not prov ided, and the invest igation necess itates the need for the MP S to access certain informat ion held on that dev ice (i n order to prevent or detect a crime o r apprehend an offender ), an offi cer may cons ider exerc is ing hi s / her powers to obta in the requ ired informat ion . In such c ircumstances , full justificat ions must be recorded o n the CRIS system . Where a leg itimate power does not ex ist, the officer w ill not, unde r and c i rcumstances , attempt to obta in mater i al from the dev i ce i n quest i on . 5 .4 In cases where the acqu is it ion of data from the dev ice fa ils and the dev ice has to be subm itted or escalated then a copy of the Form 107 must accompany the subm i ss i on to ensure that data is not acqu ired if consent has not been g iven to its acqu is it ion . Seizure & Packagin g 6.1 Seizure: When recoveri ng a mob i le devi ce where a forens i c exam i nati on i s requ i red , se izing officers, where practical are use to use the Form 106, which is ava ilable v ia forms o n the internet. The form prov ides full guidance in relat ion to th e se izure and correct packag ing of mobi le dev i ces for the packag ing of mob i le dev i ces for forens ic exam ination ; it includes prov is ion a round DNA and Fingerpri nt presentat ion . 6 .2 Packaging : The integrity around packag ing of exh ibits, is based around the acceptance of r isk, but ANY subm ission that could involve dual exam ination MUST be boxed to g ive the best chance of ma intai n ing the forens ic i ntegrity of the dev ice for fingerprints or/and DNA. A deta iled descri pti on of some of those subm i ss i on processes are covered in this gu idance document . 7 . 2 Throughout the subm iss ion process commun i cati on between the i nvesti gat ing offi cer and the SSE kiosk exam i ner should be encourages so that resources and t ime are managed effect ively and dec isions managed to avo id delays to the investigation and to ach ieve the best poss i ble outcome . 8. Considerations when submitting for a Level 1 (SSE) , Level 2 (Digital Hubs) , Level 3 (Central Laborato ry) 8 . 1 Where practical and suppo rted , in the f irst instance , th e invest igat ing officer is to use the SSE k iosk fac il ity for the forens ic exam inat ion of d ig i tal dev i ces (where not reference back to Paragraph 2 of th is document ) . 8 . 2 DCC D igi tal hubs can be tasked d i rect , however they w ill pr iori t i se on a case by case basis, whether SCO or TP Tasking , subm ission criteria will be based on : o Life at risk o Those subm iss ions whereby the suspect or suspects are in custody and th e exam ination w ill ass ist a charg ing dec is ion o Those subm iss ions whereby vulnerable w itness and /or victims have been identified o Those subm iss ions wh ich involve a short ba il to retu rn timescale and th e exam i nat ion w i ll ass ist in a charg i ng dec i s ion or ass i st i n the i nvest i gat i o n o Those subm iss ions whereby data (such as CCTV footage ) will be lost or it time sens itiv e o Those subm i ss ions whereby data i s requ i red for cou rt wi th very sho rt t imescales 8 .2 There will be c ircumstances whereby a subm iss ion may not be su itable for a Level 1 type examination us ing the SSE k iosk; some of those reasons are l isted below : Security locked device s If the OIC i s unable to obta i n the handset secur ity code from the owner /user and there i s sti ll a requ irement for th is exh ibit to be exam ined , the tr iage p rocess is as follows : o Through the `Dev ice Fi nder' appl ication ava ilable on the SSE kiosk; searches of suppo rted makes and model of mob i le dev ices and appl icat ions can be made and also prov ides informat ion whether a pa rticular d igital dev ice can be `unlocked' by the SSE kios k o Where pract i cable , seek adv i ce from one of the d ig i tal hubs , it may be that the dev i ce can be subm itted d i rectly to the d igi tal hub or escalated to DCC central laborato ry Page 10 of 27 pages Sel f- Servi ce Equ i pment K iosk Loca l Wor k ing Inst ructi ons Vers i on 1 .1 NOT PROTECTIVELY MARKE D Self-Service Equipment Kiosk Local Working Instructions Version 1 . 1 Not Suppo rted by D ig i tal Hu b The examination cannot be completed using the forensic tools available at the digital hub . Specialist Examination (fu rther work required ) If review of the repo rt generated from e ither the k iosk or/and the DDC d ig ital hub forens ic exami nation identifies specific data requested (e.g . non standard messag ing appl icat ion or med ia f iles) that has not been acqu ired by those processes , and th is informat ion is st ill is requ ired to suppo rt the investigat ion can be escalated by the invest igation officer to the DCC central laborato ry. The exh ibit can be subm itted to DCC central laboratory for spec ialist examinat ion us ing the eMGFSP subm iss ion process . Advice from the d igital hub should be included in the subm iss ion and w ill be subject to a further assessment for proportional i ty and rat i onal ity. The SSE K iosks can be used for IloC subm issions ; however, the dev i ce (s) may need to be escalated to DCC us i ng the eMGSFP subm i ss i on process4 whereby advance extract ion or/and provenance may be requ ired . The SSE ki osk has encrypti on enabled , whereby the extract ion p rocess and subsequent output from the SSE k iosk is protected and can only be v iewed or access w ith a password The SSE k iosk exam iner also has the ab i lity to exclude the extract ion of spec ifi c data -sets dur i ng the course of a forens ic exam i nat ion and only fi lter out the informat ion as spec ifi ed or requested i n the subm itted documentat i on . On NO circumstances is IIoC material to be viewed on the AWARE system . 8 .2 If a subm ission involves a large number of dev ices, or/and is complex in nature, or/and is an ongo ing i nvest igat ion then the invest igation officer should seek gu idance and adv ice from the reg ional Digital Strategy Advisor (DSA) . Submission process - guidance for Police Officers and SSE examiners 9 . 1 Subm ission to the SSE k iosk will be v ia a Form 105, the subm ission process to the DCC d ig ital hub and DCC central laborato ry will be v ia a Form 105 or eMGFSP 6 depend ing on the forens ic service requested . 9 .2 Both the eMGFSP and Form 105 process requ ires the investigat ing off icer to document the rationale for the spec ific informat ion requ ired form the dev ice to assist in the invest igation , g iv ing due cons ideration to the proportional ity and legality of the request. 9 .3 The eMGFSP is the ma in forens ic subm ission form that is submitted trough the Goddard system . The Form 105 was a form used for the Terr itorial Policing mobile phone exam ination project and is now used to undertake forens ic exam inations on the SSE kiosk . Both methods of subm ission w ill be used in the medium term until the del i very of a new case management system . 9 . 4 Where voicema il retri eval has been requested and the exh i b i t belongs to a v ict im , ` expli c it consent' has to be obta i ned pri or to the exam i nat ion tak ing place . In o ther circumstances `d irected surve illance authority' has to be obta ined prior to the exam ination tak ing place . 9 .5 If the exh ibit has been se ized from a suspect or defendant then the i nvest igat ing officer must prov ide a custody or CAD reference for that exh ibit sized : fai lure to provide this informat ion w ill result in th e submission be i ng rejected . 9 .6 Rejected Submissions : A SSE ki osk exam iner wi ll reject exam i nat i on requests where the follow i ng requ i rements are not met: o Exh ibits have not been packaged in accordance w ith best practice o Relevant information has not been prov ided on the request form If a subm ission is rejected by the SSE k iosk exam iner the invest igating officer w ill be not ified by the k iosk exam iner . Examinations may be terminated for the following reasons : Locked Handsets The exam inat ion process may reveal the exh ibit is PIN or handset locked . If PIN or handset security codes are not recorded on the request form , the exami ner will not be able to proceed with the exam ination . Exam ination of th e exhib it will be term inated , th e Book 105 updated and the exh ibit retu rned to the OIC/secure storage . The kiosk exam iner w ill notify the OIC and complete the relevant PIN /PUK or Handset Lock informat ion request form . It is the respons i b il ity of th e OIC to request the PIN informat ion from the owner /user or, if unava i lable , the PUK informat ion from the CIU . On rece i pt of the PIN or PUK code the OIC must update the request form and resubm it the exh ibit for exami nation . It is the respons i bil ity of the OIC to obta in any handset security codes from the owner in the first instance . If the OIC is unable to obta in the handset secur i ty code from the owner and there is sti ll a requ irement for the exh i b it to be exam ined it can be subm itted to DCC us i ng the eMGFSP subm iss ion process . Non-suppo rted Handsets ; There may be occas ion where an e xhibit subm itted for exam ination is not able to be exam ined us ing the SSE kiosk . If an exami nation is not supported by the SSE kiosk the process w ill be term inated and escalated to one of the reg ional DCC d igital hub central . The Book 105 should be updated and the exh i b i t retu rn ed to the OIC/secure storage . The kiosk exam iner wi ll notify the OIC . C. Illicit Images of Children : The SSE K iosk can be used for Ill icit Images of ch ildren (IloC) subm issions ; however, where a subm ission is not related to IloC, due d il igence should be carried out by both the OIC and the K i osk exam i ner to IloC be ing di scovered dur i ng the forens i c exam ination process . The SSE kiosk exam iner has the opt ion to term inate the process, sub -report without exporting the IloC med ia. If expo rted the SSE kiosk exam iner is to follow local pol icy around IloC and retu rn the or ig inal exh i b i t to the OIC . Please note that the SSE Kiosk will only do a log ical' only extract ions , so if deleted data or fu rther provenance is requ ired a fu rther subm iss ion can be made to DCC us ing the eMGFSP process. 9 .8 Completed Examinations : The exam inat ion output from each exh ibit us ing a SSE kiosk wi ll be produced a Master Copy output . A Work ing Copy can be expo rted on d ifferent storage med ia includ ing , USB med ia and external storage on the SSE kiosk. The Master Copy i s the SSE ki osk exam iners exh i b i t and w i ll be sealed and exh i b i ted (local pol icy appl ies) and retu rn ed to the OIC on completion of the forens ic exam ination . The master copy must be reta ined for d isclosure in the event it is requ ired by a defence expe rt. Data Retention - Guidance for Police Officers and SSE kiosk examiners 10 .1 Retention or destructio n During the i nvesti gat ive or tr i al process the data w ill be rev iewed i n order to asce rta in if it should be retained in fu rtherance of our pol icing purposes . For example , if a photograph on a `w itness ' mobile phone is relevant , because it shows an offence be ing comm itted , then the kiosk will acqu ire al l photographs on that phone , rather than just the photographs of the offence . If text messages to a v ictim of harassment are requ i red to investigate the harassment allegations , then k iosk will acquire all text messages on that phone , rather than just th e relevant ind ividual messages or text conversations . Th is collateral irrelevant data is inextricably l inked to relevant data at th e time it is obtained. As much of th is collatera l irrelevant data wi ll amount to personal data of the v ictims , witnesses and suspects that it was obta i ned fro m, the MPS must ensure that work i ng pract ices do not i nfringe on th e privacy rights of the ind iv iduals whom the data was obta ined from . Those r ights are protected by the Human R ights Act 1998 and the Data Protect ion Act 1998 . o o o o 11 . The follow ing paragraphs set out the requ irements for deal ing w ith this type of collateral irrelevant inextricably l inked data : When a SSE ki osk i s used to acqu i re data from a mob i le dev i ce, a copy of that data w ill be stored as an exh ibit copy on a CD/DVD and another copy w ill be stored as a work ing copy on a storage med ia As the exh i b i t wi ll only be accessed and used to establ i sh the provenance of the evidence conta ined on it , there is only a m in imal engagement of the right to privacy i n respect of any collateral data conta ined on that exh ibit CD. That m inimal engagement of the r ight to privacy w ill not amount to a breach of the HRA or DPA because it is necessa ry to prove the i ntegr ity of the ev i dence obta i ned from the mob i le dev i ce The work ing copy of the master copy is where the most care must be taken . Whi lst i rrelevant data may be inextricably l inked to relevant ev idence , it is likely that it w ill be poss i ble to separate the collateral i rrelevant data from the data that is cons i dered to be relevant . This wi ll enable the invest igator to review and delete informat ion duri ng / at the conclus ion of th e invest igative / or jud ic ial process Thi s process w ill allow the organ isati on to avo i d i nadvertently breach ing the HRA and DPA because irrelevant personal data that can be , wi ll be separated from other material and appropriately dealt w ith at the earl iest possible stag e Disc Handling and Using Repo rts 11 .1 Creation of Disc s Following a successful forens ic exam ination on a SSE k iosk , the default opt ion for the SSE kiosk when exported a Master Copy w ill always be a d isc. Any documents13 created by the OIC in the course of the investigation e .g . exerts of reports from the original output, must be stored w ithin th is shared dr ive. 11 .3 If there is a requ irement for the data to be stored `out of Informat ion Managers off ic e hours ' (e.g . where an exert of the repo rt i s requ ired for an urgent charg ing dec is ion ) then it may be temporarily stored by the OIC to a personal folder . The OIC MUST, at the same t ime ema il the Informat ion Manager request ing shared folder creat ion an d access . On notif ication f rom the IM that the shared folder is created , the OIC MUS T IMMEDIATLEY f iles all the documents into the shared folder and deletes the copy stored in the personal folder . It is the respons ibi lity of the OIC to adhere to th is lawful order . Once the data has been cop ied to from the d isc to the shared dr ive, it should b e reta i ned i n accordance w ith the MPS Rev i ew , Retent i on and D isposal Schedule w i th in the MPS Records Management Manual . 11 .4 Using reports Content of the repo rt can be used dur ing the interview process , subm itted to suppo rt a charg ing dec ision and used as ev idence when accompan ied by a statement from th e kiosk exam iner and invest igating officer .
