On June 1, 2015, the Court heard argument from 2 the parties to address these matters. 3 The Court's April 23, 2015, Order sets forth the Court's reasoning regarding 4 granting Plaintiffs' Motion to Compel. The common denominator of most of plaintiffs' proposed discovery is that it will enable the plaintiffs to conduct investigation on their own while the case is otherwise on hold. The defendants already have the information, and the ability to follow-up on it if they so choose. An order requiring them to share it with the plaintiffs therefore will help to preserve an equal playing field. 5 6 7 8 The Court agrees with the plaintiffs that information about other G159 tire claims and related decision-making is reasonably calculated to lead to the discovery of admissible evidence concerning damages. 9 10 One of the discovery requests which Goodyear was compelled to address was 11 whether it would waive the protective orders it had entered in other G159 cases. 12 Goodyear has now made clear that it will not waive the protective orders, effectively 13 defeating Plaintiffs' ability to communicate with witnesses about information relevant 14 to the Plaintiffs' claims. During the June 1, 2015 hearing, the Court specifically 15 ordered that this issue should be brought by way of separate motion. This Motion 16 satisfies the Court's requirement. 17 During the same hearing, Plaintiffs advised the Court that although Goodyear 18 had been compelled to produce the Schalmo trial transcript from Florida, Goodyear 19 had produced only a redacted version, deleting approximately 250 pages of 20 testimony. The Court's June 1, 2015, Order addressed the redacted transcript and 21 directed that issues related to transcript redactions should also be addressed in this 22 Motion. 23 The remaining portion of this Motion addresses deficiencies with Goodyear's 24 other discovery responses. 25 II. BACKGROUND: 26 Plaintiffs set forth this background with supporting exhibits to provide 27 foundation for the serious issues before the Court. A~er review of the Schalmo trial 28 transcript, even in its redacted form, and considering other available evidence, it is GK_DOCS-#4903237-Vl-Motion_Re_G159_Protectlve_Order.Doc - 2 - 1 apparent that Goodyear is using protective orders it demanded and the unknowing 2 accommodation of the judicial system to conceal from the public, G159 victims and 3 this Court crucial information relating to the public hazards associate with the G159. 4 The Complaint in this action sets forth detailed assertions regarding the acts 5 and omissions of Goodyear relating to a conspiracy to conceal crucial liability 6 evidence in the form of test data in G159 cases around the country and in particular, 7 in the matter of Haeger v. Goodyear Tire & Rubber Company, which was filed in the 8 United States District Court, for the District of Arizona in 2005, and which was 9 settled in 2010. Subsequent to the resolution of that case, the Haegers discovered 10 that Goodyear had concealed extensive test data requested during discovery, that 11 Goodyear's 30(b)(6) witness, Richard Olsen, lied about available test data and 12 counsel had misled the Court and the Haegers about existing tests. These 13 discoveries resulted in extensive sanction proceedings over a year-and-a-half, 14 including an evidentiary hearing and additional discovery of internal documents and 15 attorney client communications. The culmination of this extensive process was a 16 66-page Order issued by Judge Roslyn Silver. Amongst Judge Silver's findings, was 17 that Goodyear had a history of engaging in serious discovery misconduct in every 18 G159 case brought to the Court's attention. Haeger v. Goodyear Tire and Rubber 19 Co., 906 F. Supp. 2d 938, 981 (D. Ariz. 2012). 20 After entering its Order sanctioning Goodyear, the Court denied Plaintiffs' 21 request to reopen the case and instructed the Plaintiffs to file a new and separate 22 action for fraud and related claims. Id. at 973. This is that action filed in compliance 23 with the District Court's Order. 24 This action addresses 15 years of fraud and deception by Goodyear. In broad 25 strokes, the G159 is a medium commercial truck tire, which was originally designed 26 for regional pick up and delivery service. Because it also fit motorhomes, it was 27 subsequently sold in that application. The operating environments in these differing 28 applications are vastly dissimilar. In an intercity application the tire stops and starts GK_DOCS-#4903237-V1-Motion_Re_G159_Protective_Order.Doc - 3- 1 regularly and operates at lower speeds, all of which reduce heat generated by the 2 tire. In a high speed highway application, like motorhomes, the tire generates far 3 greater continuous heat and temperatures that make it prone to tread separations. In the underlying Haeger case, Goodyear disclosed only those tests which 4 5 reflected temperatures for the tire when operated at speeds of 89 MPH or greater. It 6 concealed all the test results which revealed temperatures when operated at lawful 7 highway speeds. During the sanctions proceedings, Goodyear was ultimately 8 compelled to disclose this previously concealed test data. Those tests showed the 9 tire was generating between 229 °F to 260 °F at speeds between 53 MPH and 71 10 MPH. Each of those tests was performed in 1996. 11 Goodyear's in-house expert and 30(b)(6) witness, Olsen, was fully aware that 12 such test results had been concealed when he was deposed in 2007. Id. at 979. 13 Therefore, as to the Haegers, as long as the tests remained concealed his admission 14 that the G159 was prone to tread separations if exposed to prolonged temperatures 15 greater than 200 °F, seemed harmless. Id. at 962. After all, Goodyear's 16 independent expert, James Gardner, had admitted the same thing and the Haegers 17 had unearthed a Goodyear publication which indicated the tire was only designed to 18 endure 194 °F. Id. While the other test results remained concealed, there was no 19 direct evidence that the tire was running too hot in highway use.' 20 Goodyear knew that it could, and did, declare these Moreover, damaging admissions 21 "confidential" under the terms of the Haeger protective order. 22 23 24 25 26 27 28 1 Olsen's 30(b)(6) testimony in September 2007, was precise. Goodyear admitted that exposure to prolonged temperatures greater than 200 ° F can lead to separation of the tire's structure. Exposure above 250 ° F threatens the capability of the tire to stay together much longer. Stresses on the tire at certain temperatures are critical and temperatures for operation on public highways are, if possible, to be kept under 200 ° F. Goodyear's expert, James Gardner, testified in 2007, that when a tire exceeds 200 °F, most are going to experience diminishing properties that can lead to tread separation. He admitted that he could not identify a single commercial truck tire where temperatures over 200 °F were not a problem. He stated that the G159, when properly pressurized, should run at 140-150 °F at 75 MPH. Olsen agreed. GK_DOCS-#4903237-Vl-Motion_Re_G159_Protective_Order.Doc - 4 - 1 During the sanction proceeding, voluminous evidence was disclosed which 2 revealed that Goodyear had adopted a national practice of objecting to all requests 3 for disclosure of test data in all the G159 cases. In fact, the only time Goodyear 4 ever disclosed requested test data was if it was compelled to do so. 2 Schalmo was a case where Goodyear was compelled to and did disclose the 5 6 tests in 2008. 3 In that case, Goodyear attempted to evade liability by using a new 7 expert employee, Jim Stroble. Alter the admissions in Haeger, Olsen was never used 8 again by Goodyear. Although Stroble had the 30(b)(6) deposition of Olsen and 9 Gardner's deposition from the Haeger case and knew they had testified the tire was 10 prone to failure if exposed to temperatures greater than 200 °F, those admissions 11 were never disclosed to the Schalmo family or the Schalmo Court. Id. at 969. The little evidence we have access to suggests that in Schalmo, Goodyear 12 13 represented, through Stroble, that the tire was designed to endure temperatures 14 vastly in excess of 200 ° F and appears to have testified the tire could endure 300 ° 15 350° F before it would begin to break down, while concealing Goodyear's prior 16 admissions regarding the G159 200 ° F temperature limitations. 4 17 Following the evidentiary hearing regarding discovery fraud, Judge Silver 18 compelled Goodyear to disclose information which finally revealed how Goodyear was 19 concealing test data during the last 15 years. The evidence established that 20 commencing in 1998, Goodyear was misrepresenting to motorhome manufacturers, 21 22 2 24 3 26 4 Even in that setting, Goodyear failed to comply with Court orders compelling such disclosure, including in the Haeger case during the sanction proceedings and the Bogaert 23 case, which was filed in the Maricopa County Superior Court in 2005. Id. at 957-958, 961, 964. Plaintiffs now have discovered evidence that suggests that although Goodyear disclosed 26 tests in Scha/mo that it was also compelled to disclose tests in Woods v. Goodyear, and in 25 that case, identified 31 tests. Plaintiffs have not seen the exact tests in either case as they claimed to be "confidential" under the protective orders. Almost all of Stroble's testimony from the Schalmo trial has been redacted. We do know that Stroble denied that 194 °F was a Goodyear heat standard and that it could be 27 completely disregarded [Exhibit 1]; we also know that Stroble testified as Goodyear's 30(b)(6) witness in Moore v. Goodyear, and claimed the tire's temperature limitation was 28 vastly higher than 200 °F. [Exhibit 2, filed under seal.] GK_DOCS-#4903237-Vl-Motion_Re_G159_Protect!ve_Order.Doc - 5- 1 what it knew about the G159. Goodyear was misrepresenting the operational 2 temperature of the G159 at freeway speeds suggesting that it achieved a 3 temperature of only 185 °F at 75 Goodyear knew that the tire was generating MPH. 4 temperatures vastly in excess of that at 75 mph when it made that representation. 5 Rather than disclose test data, Goodyear blamed the tread separations involving 6 Fleetwood motorhomes upon operators and concealed its own publication, which 7 revealed the temperature limitations of the tire, in its communications with 8 Fleetwood. Goodyear did the same thing during 2000, when communicating with 9 Monaco about tread separations involving those motorhomes. Again, Goodyear 10 blamed the failures on the motorhome operators. 11 In 1995, the national speed limit was 55 mph. 12 mph when first produced in February 1996. The G159 was rated for 65 By the summer of 1996, states were 13 allowed to, and many did, increase their speed limits to 75 mph. In response, 14 Goodyear increased the speed rating of the G159 to 75 MPH, 15 1998. MPH, from 65 in June Goodyear claimed this decision was made after it evaluated its test results. 16 Goodyear's test data actually revealed that that if Goodyear approved an increase in 17 the speed rating of the tire to 75 MPH, the tire would generate temperatures well 18 beyond the design capacity of the tire, producing predictable tread separations, with 19 resultant death and injury. Though the test results make clear that higher speeds 20 would produce lethal failures, Goodyear approved the increased speed limit. 21 Recently disclosed lawsuits and bodily injury claims reveal just how lethal that 22 decision was. 23 In the underlying Haeger case, Goodyear had disclosed its warranty returns 24 (adjustments), where customers had experienced a tread separation and asked that 25 Goodyear replace the failed tires. Goodyear represented to the Haegers and the 26 United States District Court that there were no further warranty return tread 27 separations after 2002. [Exhibit 3, filed under seal.] 28 GK_DOCS-#4903237-Vl-Motion_Re_G159_Protective_Drder.Doc - 6 - 1 This Court compelled Goodyear to disclose property damage and bodily injury 2 claims involving the G159 and G159 lawsuits. 3 lawsuits. Goodyear has recently identified 41 It has now, for the first time, also disclosed 614 tread separations, which 4 produced property damage beyond damage to the tire itself and/or personal injuries, 5 including death, as a result of G159 tread separations. 6 from 1996 to 2014. [Exhibit 4] The claims span 35 of those involved Arizona claimants. [Exhibit 5] These 7 disclosures are telling evidence of the defective nature of the G159. 589 of the 614 8 property damage and bodily injury claims occurred after 1998, when Goodyear 9 approved the tire for 75 MPH highway use. A cascade of injury and death claims followed. 5 In response, Goodyear ceased 10 11 manufacture of the tire in 2003, but decided not to recall the tire. Rather, it 12 assigned National Coordinating Counsel to settle claims, one at a time, under the 13 14 15 16 17 5 Statistics from the Firestone recall provide a gauge for the Court to reference in understanding the defective nature of the G159. A tire is deemed defective if it is subject to a significant number of failures in normal operation. Such a determination may be based exclusively on the performance record of the tire. United States v. General Motors Corp., 518 F.2d 430, 432 (D.C. Cir. 1975)(A "significant" number of failures is determined by the failure rate of the tire, failure rates of comparable tires and the importance of the components for the safe operation of the vehicle). Id. at 438, fn. 84. "The number of failures need not be and normally will not be a substantial percentage of the total number of components produced." Id. The recalled tires, deemed defective by Firestone as they contained a defect related to 18 motor vehicle safety, were evaluated for claims rates based on a "parts per million" basis (ppm). The four models of recalled tires had claim rates of 700.5 ppm, 253.5 p., 93.2 ppm 19 and 35.5 ppm. [Exhibit 6] The average claim rate for the recalled tires was 270.6 ppm. A Firestone "claim" was considered any claim for property damage in excess of value of the tire, 20 or personal injury or a lawsuit. Id. Using the same definition of a "claim," the claims arising out of G159 failures provide a stunning contrast. Goodyear just disclosed its list of claims for property damage beyond damage to the tire itself and including bodily injury claims. There were 614 claims. 22 Goodyear separately identified 41 lawsuits. They relate to 35 accidents as there are six subrogation suits seeking additional damages for insured motorhomes in the 35 accidents. 23 The lawsuit claimants are not included in the list of 614 claims. 21 There were 160,683 G159 tires manufactured between 1996 and 2003. The ppm 24 claim failure rate was 4039 ppm. The G159 claim failure rate is 14.92 times worse than the average claim rate for the tires Firestone deemed defective and which 25 were recalled. Perhaps more instructive are the failure rates for Goodyear tires which were considered 26 "peer tires" when NHTSA was deciding whether Firestone tires other than those which were recalled contained a safety-related defect. [Exhibit 6] NHTSA studied 15 Goodyear peer 27 tires. They had claim rates between 0 ppm and 10.2 ppm. The average claim rate for these Goodyear tires was 1.2 ppm. The G159 ppm claim rate is 3365 times worse than these 28 Goodyear peer tires studied by NHTSA. GK_DOCS-#4903237-Vl-Motion_Re_G159_Protective_Order.Doc - 7- 1 cloak of protective orders which prohibited victims from sharing any information 2 Goodyear wanted to keep confidential and out of public sight. 3 Although Plaintiffs are in the process of attempting to calculate the total 4 number of death and injury claims, 6 Plaintiffs thus far have been able to identify 63 5 death and injury claims from G159 tread separations. Moreover, although Goodyear 6 had disclosed warranty return claims, which it suggested ceased in 2002, the newly 7 disclosed property damage and bodily injury claim list reveals several hundred 8 property damage and bodily injury claims arising out of tread separations after 2002. 9 If one assumes that Goodyear's disclosures are honest, then the only conclusion is 10 that there were no more warranty returns after 2002, but rather, the tire only 11 catastrophically separated during operation producing damages far beyond the tire 12 itself, including injury and death. 7 13 Goodyear also had an obligation to timely disclose bodily injury claims to 14 NHTSA on a quarterly basis, including identification of all bodily injury and death 15 claims from 1999 to date. 49 CFR 579.26. Goodyear misrepresented the extent of 16 those claims to the Government, identifying only one death and 13 injuries in Early 17 Warning Reporting as opposed to disclosing the 63 injury and death claims, which 18 the Plaintiffs have already identified. [Exhibit 7] 8 The sole purpose of Early Warning 19 Report is "to assist NHTSA to promptly identify defects related to motor vehicle 20 safety." 49 USC 30166(m)(3). Goodyear's concealment of the totality of injury and 21 6 Goodyear did not provide copies of the complaints in the 41 separate lawsuits, so we have 22 to separately acquire them to quantify death and injury claims. Similarly, although Goodyear was compelled to separately identify bodily injury claims, it did not specify whether they were 23 merely injury claims or if the list of injury disclosures included death claims, which were not the subject of separate lawsuits, but rather were confidentially resolved without litigation. 24 7 Goodyear's representations to the Haeger court of ever diminishing warranty returns between 1999 and 2002 are highly suspect. It seems unlikely that there were zero warranty 25 returns in 2003, when there were 74 property damage and bodily injury claims that year. A similar curious pattern continued each of the following years. 8 There are 22 highlighted Bodily Injury Claims on the list produced by Goodyear. [See Exhibit 5.] There are 34 additional injury and seven deaths specified in the complaints we 27 currently possess. The Arizona cases include, the Haeger case, which involved four injuries, Bogaert, which involved two fatalities and three injuries, and Haley, which involved one 28 fatality and two injuries, each from a tread separation on a motorhome. 26 GK_DOCS-#4903237-V1-Motion_Re_G159_Protective_Order.Doc - 8 - 1 death claims defeated NHTSA's capacity to promptly identify the defective nature of 2 the G159. It allowed Goodyear to try to "run out" the tire by secretly settling claims 3 for death and injury as they occurred, while evading mandated disclosure to the 4 government. By acquiring protective orders which prohibited sharing information 5 Goodyear claimed to be "confidential," Goodyear was able to contain the damage 6 done by any admission or disclosure in each case. This is exactly how Goodyear was 7 able to present one set of facts to the Haeger court regarding temperature 8 limitations of the tire and an entirely different set of facts to the Schalmo court and 9 jury. 10 Plaintiffs have provided the Court with this brief overview of some of the 11 issues raised in this case as they relate directly to the need to lift the protective 12 orders in the G159 cases to allow Plaintiffs to unearth the complete truth about this 13 defective tire and the scope of a national fraud. 14 III. PLAINTIFFS' REQUEST REGARDING THE PROTECTIVE ORDERS: 15 During the course of the sanction proceedings, it was discovered that 16 Goodyear insisted upon and acquired a protective order in each of the litigated G159 17 cases. Moreover, Goodyear was insistent that each protective order contain a non- 18 sharing provision, which would prohibit plaintiffs from sharing information with other 19 victims of G159 tread separations without liability exposure. 9 20 This Court compelled Goodyear to disclose lawsuits, property damage and 21 bodily injury claimant contact information to allow Plaintiffs to continue with their 22 investigation while this case remained stayed so that they could get on "equal 23 footing" with Goodyear. 24 25 9 Plaintiffs discovered in the underlying Haeger case that a 30(b)(6) witness of Goodyear had 26 testified that the G159 was defective in motorhome applications. Judge Silver authorized discovery regarding this issue. When Goodyear was advised that the Haegers had been 27 informed of this circumstance, it promptly sued the plaintiff's attorney in that case for violating Goodyear's protective orders by disclosing information Goodyear claimed to be 28 confidential. GK_DOCS-#4903237-V1-Motion_Re_G159_Protective_Order.Doc - 9 - 1 In the discovery this Court authorized Goodyear was specifically asked: 2 Confirm whether Goodyear will waive the terms of any applicable protective order or confidentiality agreement to allow counsel for the Haeger family to contact counsel, parties, claimants and other G159 victims in order to discuss documents and testimony before any further loss of relevant evidence occurs. 3 4 5 10 Response: Goodyear objects to this interrogatory to the extent implies that documents and information covered by a protective order or confidentiality agreement are relevant or necessary for contact or discussion with counsel, parties or other persons alleged to be involved in matters arising from incidents alleged to arise from the use of G159 tires as defined in the Preliminary Statement. Without waiving this objection, Goodyear states that at this stage of the proceedings, where the underlying case on appeal, motion to dismiss all claims is pending and the scope of discovery has not been set by the Court, it declines to waive the terms of any protective orders and confidentiality agreements entered in other matters. 11 In order to avoid filing this motion, Plaintiffs sought to reach an agreement 6 7 8 9 12 with Goodyear, whereby Goodyear could simply file a stipulation in each of the cases 13 where there was a protective order, which allowed the parties and experts to disclose 14 information otherwise declared confidential in each of those cases to the Haeger 15 Plaintiffs and which also allowed parties and witnesses subject to the protective 16 orders to communicate with the Haeger representatives without restriction. 17 Haegers offered to treat all such The information received, that was previously 18 designated as confidential under any of those protective orders, as confidential, until 19 Goodyear had an opportunity to present its proposed protective order in this case for 20 the Court's consideration and resolution. The Plaintiffs made a similar proposal 21 regarding the Schalmo transcript. [Exhibit 8] 22 Goodyear rejected Plaintiffs' proposed accommodation, necessitating this 23 Motion. [Exhibit 9] 24 Goodyear's conduct in this matter is consistent with its historical actions, 25 which were the subject of Judge Silver's criticism. Goodyear is simply engaged in "a 26 game of hide and seek." Id. at 973. Like the underlying Haeger case, Goodyear 27 continues to make this case more complicated than necessary and hopes to, once 28 GK_DOCS- # 4903237-Vl -M otion_Re_G159_Protective_ Order. Doc - 10 - 1 again, require the Plaintiffs to make "absurd expenditures of resources," as 2 previously occurred. Id. at 972. Plaintiffs' proposal is simple. 3 The Court has already made discoverability 4 determinations regarding what occurred in these other G159 cases in granting 5 Plaintiffs' Motion to Compel. As Goodyear seeks sanctuary behind protective orders 6 it crafted and insisted be adopted by courts across the country, it is appropriate that 7 Goodyear incur the expense necessary to lift those protective orders. 8 In order to make sure that the courts handling these G159 cases understand 9 the scope of these proceedings and this Court's prior determinations, the Plaintiffs 10 have crafted a form of an order, which they request this Court enter and be attached 11 as an exhibit to each motion and/or stipulation to be filed by Goodyear seeking relief 12 from the protective orders in other G159 cases. 13 most expeditious way to deal with [Exhibit 10] This approach is the prior protective orders and this Court's 14 determinations regarding relevance and Goodyear's discovery obligations. Moreover, 15 without regard to the Court's Order regarding the Motion to Compel, Goodyear would 16 otherwise be required to disclose information from each of these cases in order to 17 comply with its disclosure obligations in this matter. Thus the request that Goodyear 18 address and resolve these matters is timely made to avoid future foreseeable delays 19 following resolution of the appeal now pending before the Ninth Circuit. 20 IV. PLAINTIFFS' PROPOSAL REGARDING THE SCHALMO TRANSCRIPT: 21 This Court entered its Order compelling Goodyear to disclose the Schalmo 22 transcript in conjunction with the Motion to Compel. Although Goodyear never 23 disclosed to the Court during the hearing that it had found a way to redact the 24 transcript regarding a public trial after the fact, it now asserts that it is prohibited 25 from disclosing its evidentiary presentation in that case as a result of a Court order 26 drafted by Goodyear. 27 Following the trial, Goodyear sought to have evidence presented in that public 28 forum declared confidential and to seal certain matters. G K_DOCS- # 490323 7-Vl -Motion_Re_Gl 59_Protective_ 0 rd er. Doc - 11 - The Court declined that 1 Motion on July 21, 2010, and stated that all such information would be deemed 2 public within 45 days (September 4, 2010). [Exhibit 11] 3 Goodyear became frantic. Its decade long quest to keep the public, victims, 4 and regulators from discovering the truth about the tire, Goodyear's dissimilar 5 disclosures, misrepresentations and regulatory deceptions were all threatened. 6 Goodyear filed an Emergency Motion for Reconsideration. Denied. [Exhibit 12 7 /Schalmo Docket.] Goodyear filed an Emergency Motion to Stay the July 21 Order. 8 Denied. Id. Goodyear filed an Ore Tenus Motion for Enlargement of Time Before 9 Execution of the Court's July 21, Order. Denied. Id. 10 Finally, Goodyear filed an Emergency Motion for Review and Motion to Stay 11 with the Second District Court of Appeals. The stay was temporarily granted. Id. 12 Before the Court of Appeals could rule on the public hazard issues associated with 13 the trial evidence, Goodyear was granted a continuation for scheduled oral argument 14 and then, following settlement, voluntarily dismissed the appeal. Id. 15 What happened in the interim is difficult to comprehend, when looking solely 16 to the Court's record. Separately, Schalmo's counsel advised Plaintiffs that Goodyear 17 required, as part of post verdict settlement discussions, that it be allowed to redact, 18 without restriction, the trial transcript to remove any and all portions it wanted to 19 keep confidential. The Court was advised of this requirement. 20 prepared orders that were presented to the Court. Goodyear then The orders were executed the 21 same day. [Exhibit 13]1° 22 Those very orders redacted hundreds of pages of transcript testimony and 23 sealed certain exhibits, all as requested by Goodyear as a precondition to the 24 settlement of the action. Goodyear now relies upon these orders by the Florida 25 26 10 Plaintiffs asked Goodyear's current counsel to verify that Goodyear prepared the orders which were thereafter simply signed by the Court. Ms. Okun advised, "We weren't counsel in 27 the Schalmo case, so I don't know the answer to your question. Judge Hannah allowed you to conduct limited 'preservation discovery.' Your inquiry goes beyond that scope." 28 [Exhibit 14] GK_DOCS-# 4903237-Vl -Mo ti on_Re_ Gl 59 _Protective_Order. OTHER DEFICIENT DISCOVERY RESPONSES: 13 This Court ordered Goodyear to produce a complete list of lawsuits filed 14 regarding the G159 tire, identifying all parties and counsel contact information. 15 Goodyear responded that it "conducted a reasonable search" and attached a list of 16 lawsuits. Plaintiffs request the Court compel Goodyear to verify that the list is 17 complete as it is not possible to know what "a reasonable search" means, but 18 complete disclosure has already been compelled by this Court. 19 Goodyear was also compelled to produce a complete list of all property 20 damage and bodily injury claims made to Goodyear arising out of the failure of the 21 G159 tires, which includes pertinent contact information. Goodyear responded that 22 it conducted "a reasonable search" concerning the identification of such information. 23 Plaintiffs request the Court to compel Goodyear to verify that its response is 24 complete. 25 Goodyear was further compelled to produce a complete list of all protective 26 orders or confidentiality agreements for cases involving the G159. Again, Goodyear 27 claims it conducted "a reasonable search" concerning protective orders. Plaintiffs 28 request the Court order Goodyear to completely respond and identify all such cases. Certainly, Plaintiffs would expect that any such 7 resolutions would have a confidentiality agreement as part of the settlement. 8 Plaintiffs require identification of those matters so that Goodyear can separately be 9 compelled to instruct the parties to such agreements that they are free to 10 communicate with Haeger representatives as they continue informal trial preparation 11 while the stay remains in place. 12 Finally, the Court compelled Goodyear to produce a list of all former Goodyear 13 employees involved in communicating with NHTSA regarding Goodyear's purported 14 compliance with the Early Warning Reporting requirements identifying death and 15 injury claims as more specifically set forth in 49 C.F.R. 579 et seq. Goodyear 16 responded as follows: 17 18 19 20 21 Goodyear objects to this request because the term "all" and the phrase "involved in communicating with NHTSA regarding Goodyear's compliance . . . " are not limited in any manner and are therefore overbroad, not limited to incidents involving the G159 tire as defined in the Preliminary Statement, and seek irrelevant information not reasonable calculated to lead to the discovery of admissible evidence. Subject to and without waiving this request, Goodyear identifies Sim Ford, then manager of Goodyear's Government and Customer Compliance, who may have been involved in communicating with NHTSA regarding Early Warning Reporting requirements. 22 23 Plaintiffs request that Goodyear comply with the Court's Order and identify the 24 former employees who were involved in such communications. Suggesting that 25 Mr. Ford "may have been involved" is distant from the kind of response the Court 26 compelled. CONCLUSION: 4 Plaintiffs strongly believe that the proposed orders, or a similar version are 5 necessary to facilitate cooperation from those courts that have entered protective 6 orders in the G159 cases.
