I was on patrol and came into contact with the defendant, Andrew Joseph Oswalt. on the Southside of Bean Hall. He was wearing a mask over his face and was with 2 other people who also had scarfs around their necks and one person was holding a later. Oswalt told me he had a knife in his pocket. In his right pants pocket I found a 5 to 7 inch dirk or dagger styled knife that was completely concealed from my view. The knife itself looked like a stiletto or only I was unable to replicate the winging motion. It did however unfold into a fixed position. The blade was sharpened on one end but came to a narrow and sharp point like a dirk or dagger. Narratlve Source of Activity: On 07-29-17 at around 2303 hours, I was on patrol of the of owned Bean Residence Hall in Eugene. I drove a marked police car that was equipped with an in-car video system. I woremy department issued uniform, badge and body camera. Officer's Observations Investigation: I saw four people, later identified as Andrew Joseph Oswalt David Thomas Woods Justin Anthony Marbury and James Larry Marr on the south side of Bean near Moss St. Oswalt, Woods and Marbury were walking eastbound towards a white pickup (66SJXZ) which was parked on the north side of 15th Ave. west of Moss St. I briefly looked into the car and the driver looked like Marr. I knew Marr from years past where he was an active member in the Pacifica Forum. The Pacifica Forum spoke on campus several times around 2009 under their founder and retired of professor Orval Etter. The content of their speech cauSed large protests involving multiple students and . community members. I worked multiple uniformed law enforcement assignments to provide security services during the event I later discovered in March of 2009 the Registered Guard reperted the Pacifica Forum was placed on the ?hate group? list by the Southern Poverty Law Center in 2008. . Oswalt, Woods and Marbury were acting extremely suspicious. They were dressed in dark clothing, were wearing gloves (except for Marbury) and had scarf made masks on though Oswalt was the only one with it hiding his face. Oswalt was holding a silver object in one hand which was later determined to be a stapler - and Woods was carrying a ladder. The group was walking along a chain?link fence which separated the construction zone from the sidewalk. I was concerned they may be searching the for vulnerabilities or areas where they could use the ladder to gain access into the site. I know construction companies tend to leave their tools inside the work site. Furthermore, I assisted another officer with a broken window at another construction site a few weeks earlier. The site was a block or so away and a window was found forced open and access could have only been made with a ladder. I activated my emergency lights and stopped Oswalt, Woods and Marbury in the area for the suspicion of criminal trespassing among other things. In response to my lights they stopped as if they had seen a ghost. Sergeant Kostiuk briefly spoke to Marr and then Marr drove away. I introduced myself to Oswalt, Woods and Marbury, admonished them of my body camera and explained the reasons why they were being stopped. At some point Woods said he reserved the right to remain silent. Oswalt refused to remove his mask and Marbury was recording me via a chest mounted GoPro camera. While I was talking to Oswalt, Woods and Marbury, dispatch said they received a call for service which may be related to my stop. The complainant, Mark Gailey, called and wanted to report that a group of people were recently at the Market of Choice (1960 Franklin Blvd) being rude and yelling racial slurs. They got into a white pickup that was described as a Toyota bearing ?556" as the first characters of the license plate. The pickup drove to 15th Ave. and Villard St. and let some people out. The people were loud and continued shouting racial slurs. Gailey told dispatch his ethnicity was white and the group yelled some slurs directed toward him. Dispatch only got Gailey?s first and last name and phone number. He told them he did not want further police contact. Officer Phillips and myself did attempt to call Gailey in hopes of obtaining a statement or offering of counseling services but the call went to voicemail both times. I removed the knife and. patted him down for other weapons finding nothing else dangerous. Officer Phillips located a collapsible ASP styled baton in a sheath "on Marbury' 5 hip. I patted him down and found nothing else dangerous. Marbury confirmed they were at 'the Market of Choice earlier but denied saying any racial slurs. . I asked Oswalt if he had any weapons and he said he had a knife in his pocket. I conducted a pat down of his clothing and felt a long cylindrical knife in his right pants pocket: that was completely concealed from my View. I recognized the shape as a stiletto knife which is primarily meant for stabbing rather than cutting. These types of knives are a similar instrument to a dirk or dagger by the use of- which injury could be inflicted upon the person or property of any other person. A video on a website that sells these or similar knives said they are great for self?defense and a stiletto is meant for stabbing more than cutting [Doug Marchant - Thus, having such a knife concealed is a violation of EGM 4.887 and ORS 166.240. I removed the knife and confirmed it was a restricted weapon The body of the knife was around 9" long and the blade just over The blade was sharpened on one side and came to a narrow point. It was inscribed "Kriegar" and ?rrest Custody: I handcuffed Oswalt checking the handcuffs for proper fit and double locked them.-I advised him of Miranda and asked if he understood to which he didn't reply. I explained he was going to be lodged at the jail and asked for his name which he previously refused to give to Officer Phillips. He told me his name and I confirmed his identity via his Oregon DMV photo. - I consulted with Sergeant Kostiuk and released Woods and Marbury with a warning. I photographed a series of flyers that Marbury had hanging out of his pocket and gave them back to him. The pictures of the flyers are attached to this report.
