Your request, from January 9, 2017, to the present, was for: . . . copies of all records created or received by any employee of the Of?ce of the Governor on Con?de, or any other instant messaging application that automatically deletes messages, including, but not limited to, Signal or WhatsApp. . . . copies of all records reflecting any pemiission, clearance, or approval granted to employees of the Of?ce of the Governor to conduct of?cial business using Con?de, or any other instant messaging application that automatically deletes messages, including. but not limited to, Signal or WhatsApp. . copies of all records regarding efforts by employees of the Of?ce of the Governor or the Of?ce of the Attorney General to retrieve, recover, or retain records created or received by state employees using Con?de, or any other instant messaging application that automatically deletes messages, including, but not limited to, Signal or WhatsApp. The Of?ce of the Governor does not have any responsive records to provide pursuant to Chapter 109 applicable records retention schedules and 610.010(6) We would note that the Missouri Sunshine Law does not require a public governmental body to create a new record upon request, but only to provide access to existing records held or maintained by the governmental body.
