THE WEATHER CONDITIONS AT THE TIME OF THE ACCIDENT WERE WARM AND IT WAS VERY WINDY. ACCORDING TO WITNESSES, VEHICLE H1 TRAVELING RPPROXIMATELY 30 TO 85 MPH IN THE RIGHT LANE. Upon approaching the scene of the accident, I was diverted to a secondary accident that had occurred during a freeway closure related to the initial accident. Upon being relieved at the secondary accident, I responded to the scene of the original accident. Upon arriving on scene, I con?rmed that there was one fatal subject as a result of the accident, and that a second occupant had been transported by helicopter from the scene. I conducted a thorough investigation on scene with assistance from other Troopers before conducting follow up investigation over the foiiowing clays. INITIAL CALL AND RESPONSE: On April 22, 2016 at approximately 1613 hours, I was contacted by Sgt. Ryan Bauer and advised that there was an injurilr accident on I-15 near MP 48 and that I was needed to reopond from my home to assist. I was in the process of getting my vehicle preDared at the time of the call, so I hurried to respond. I was then contacted by Cedar Dispatch at approximately 1616 hours and asked to respond to the same accident. I advised them that I could be en route in approximately 2 to 3 minutes time. I responded from my residence in Parowan, and while on my way to the aucident, I began monitoring radio traf?c about the incident. I heard traf?c advising that there Was a male patient that was believed to be a law enforcement officer who was likelyr deceased. I heard that there was also a female occupant from the which had injuries requiring that life ?ight respond to the scene. As 1 got closer to the accident, I was advised that life flight was in the area, and'that they were going to be shutting Northbound 1-15 down to make room for the helicopter to land. I advised Deputy Wade Lee who was staged near the scene for traf?c control that as soon as I got there! would assist with the closure. However, beforel arrived on scene the command was given from officers on scene to close the lanes down so that the helicopter could land. A few moments later, I overheard radio traf?c that there had been a secondary accident in the backup from closing the interstate down. I responded to the secondary accident first to assess the situation and provide service to due to lack of resources at that location. Upon stabilizing that incident, I was relieved of my duties and allowed to proceed to the original accident involving the ON SCENE OBSERVATI DNS: I arrived on scene of the accident at approximately 17'14 hours. I made contact with with Lt. Steve Espiin who had responded to the incident due to its nature, and Trooper Alan Jensen who had witnessed the accident while traveling through the area. I was advised that there was one male on scene who medical personnel had determined to be deceased. I was advised that the male was also a Millard County Sheriffs Deputy. I advised Lt. Espiin that I would handle the investigation since I was the ?rst area Trooper to arrive at the scene. Lt. Espiin advised me that the males face appeared to have made contact with a deiineator post during the accident. He stated that the male had a firearm near him when he arrived on scene. Lt. Espiin advised me that he had secured the firearm inside of his vehicle. I retrieved my camera and began walking through the scene of the accident photographing evidence. I observed that there were black tire marks in the emergency lane where the had left the road. The marks were not consistent with a skid, but appeared more likely to be from a deflated tire slapping the roads surface. Near where the tire marks left the roadway, 1 observed a gouge in the asphalt consistent with the right foot peg on the impacting the surface. On the shoulder of the road, I observed intermittent disturbances in the grass and dirt leading to a dark colored Harley Davidson There was personal items and vehicle debris scattered along the shoulder from near where the exited the pavement all the way to the right of way fence in front of the I observed that there was a body which was covered with a white sheet laying on the shoulder of the road. I observed a deiineator post which was partly bent over and appeared to have a small amount of blood near the reflector plate at the top of the post. I observed a red helmet sitting on the shoulder of the road to the North of the deceased male. I was advised that the female passenger on the had come to rest at that location. The female patient who had been transported from the scene by helicopter was identi?ed with a Utah concealed ?rearm permit as Angela K. Nielson 12-02-1961 2. I marked items necessary for the investigation with orange paint to ensure that perishable evidence was not lost before a total station survey of the scene could be completed. Detective Michael Bleak with Cedar City PD was contacted to respond to the scene as a Medical Examiner! and Southern Utah Mortuary was Contacted to respond to the scene to take possession of Mr. Nielson's body. Bradshaw Towing responded to the scene to recover the 3. I did a visual inspection of the and found that the front tire was still inflated and appeared to be in good condition. When I inspected the rear tire, I observed that the sidewall on the right side of the tire was blown out and that the tread appeared to have numerous cracks and signs of separation. Upon observing the condition of the rear tire, I noted that the marks on the road were consistent with tire slap from a tire that had gone ?at or blown out. I observed that there was considerable damage to the left front corner of the and that there were scrapes on the left side storage box suggesting that the had slid on its left side at some point during the accident. I observed that the right side storage box had been thrown from the and that the rear storage trunk had been smashed and broken apart. Laying past the near the fence, I located numerous personal items scattered on the ground including a brown backpack which contained women's items and a small Taurus pistol. The backpack and a cell phone case that was located on the ground were secured inside of Lt. Esplin's car temporarily until I secured the items inside of my vehicle at a later time. 4. Once Southern Utah Mortuary personnel and Detective Bleak arrived on scene. I assisted them with the medical examiners on scene investigation. I noted that Mr. Nielsen was wearing an open faced helmet. gloves. and various pieces of protective leather clothing. I observed the the left side of Mr. Nielsen?s face had signi?cant trauma consistent with impacting the deiineator post near his body. At the conclusion of the on scene examination, Mr. Nielsen?s body was secured by Southern Utah Mortuary and transported from the scene. 5. Agent Cole Douglas with State Bureau of Investigation arrived on scene that evening and assisted Trooper Bale and myself with a total station diagram of the accident scene to assist in our investigation of the accident. Part way through the total station process, the sun set and light conditions did not allow us to ?nish up the on scene survey of the accident. ACCIDENT FOLLOW UP AND INVESTIGATION 7. Later that evening, I transported the items that! had secured at the scene along with the items that Lt. Esplin had turned over to me, to the UHP Section 11 Office where] secured them inside of an evidence locker for safe keeping until they could be returned to a family member. 8. At approximately 0148 hours, I made contact with staff at Dixie Regional Medical Center to check on the condition of Mrs. Nielsen. While talking with a floor supervisor, i was advised that Mrs. Nieison was stable, but that she had a C2 vertebrate fracture. fractured ribs, fractured femur, and injuries to her hips and pelvis. I left my contact information with the nurse that! spoke to and asked her to give it to Mrs. Nielson and her family so that they could contact me if they had any questions. 9. {in the morning of April 23, 2016 I was contacted at approximately 0945 hours by a male who Identi?ed himself as cw. Brown and stated that he Was Angela?s father. Mr. Brown was concerned about the location of some ?rearms that Mr. and Mrs. Nielsen had in their possession at the time of the accident. I advised Mr. Brown that I had the firearms along with a variety of other personal items in my possession. He asked if he could get the items turned over to him so that he could return them to his daughter. He went on to advise me that he was a valid concealed firearm permit holder and was legal to be in possession of the firearms that I had secured. I advised Mr. Brown thatl would be able to meet with him later that day to turn the items over to him. 10. At approximately 1115 hours on April 23, 20161 returned to the scene of the accident wherel met Agent Douglas and ?nished the total station survey of the scene. 11. At approximately 1330 hours on April 23, 2016] returned to the UHP Section 11 Of?ce where] met with our Evidence Technician Janaiee Jensen. Ms. Jen5en retrieved the items that I had locked up inside of the evidence locker for me. I did a full Inventory on the items that I had retained before transporting them to a parking lot off of exit 27 on I-15 Northbound to turn them over to Mr. Brown. I turned all of the items over to Mr. Brown and gave him a copy of the inventory after having him show me his driver license and concealed ?rearm permit. Mr. Brown signed my copy of the inventory and thanked me for getting the items to him in a timely manner. 12. At approximately 1427 hours on April 23, 2016 I contacted an Individual by the name of Barkley Christensen on the phone. I had been advised by a Trooper in Washington County that Mr. Christensen had witnessed the accident, and that he wanted to speak with me regarding what he had seen. While talking with Mr. Christensen, he advised me that he had been traveling behind Mr. Nielsons at the time of the accident. He advised me that the had just changed lanes from the left lane to the right lane when the began to wobble side to side. He stated that it looked like the driver of the was trying to slow as he started pulling over into the emergency lane. He further advised me that the ran off of the road to the right, and that the rolled over throwing the occupants from it. He advised me that as this was happening, that he moved to the left to ensure that he did not hit the in the event that it veered back toward the roadway. 13. On April 25, 2016 at approximately 1745 hours, I contacted Dixie Regional Medical Center in an attempt to speak with Mrs. Nielsen. was advised by the staff member thatI talked with that they did not have a patient in their hospital by the Name of Angela Nielson. After receiving this information, I contacted Mrs. Nielsen's father, C.W. Brown, once again to follow up on her condition. He advised me that Mrs. Nieison had been in surgery most of the day to repair the injuries to her lower extremities, and that she likely would not be physically capable of speaking with me for at least a week. I asked Mr. Brown to relay to Mrs. Nielson that! would like to speak with her when she was capable of talking about her recollection of the accident.
