Background Although MC/IDD, PD, and SA populations continue to grow, housing and care options have been reduced under the Obama Administration as a result of two significant changes . First , revised HUD legislation, under the Frank Melville Supportive Housing Investment Act of 2010, placed a 25 percent limit on the aggregate number of units in a multifamily project for people with disabilities, thereby significantly reducing housing available and increasing costs to build housing for this vulnerable population. Second, as a result of the Obama Administration's misinterpretation of the 1999 Olmstead vs. LC Supreme Court Decision and government over-reach to mandate what the definition of a "community" must be for people with disabilities receiving government funding, the Administration: • Changed the CMSregulations in 2014 to limit the ability of states to provide large, disability-specific congregate care settings funded by Home and Community Based (HCBS)waivers. • Allowed class action lawsuits to be brought by the Department of Justice and Protection & Advocacy agencies, against the intent and true meaning of Olmstead, as cited by the Supreme Court Justices. The goal of the litigation was to close the approximately 300,000 HHS-funded Intermediate Care Facilitie s (ICFs) operating in every state that are a "tota l care" way oflife for those with I/DD. The combination of these policies has resulted in forcing more and more MC/IDD, PD, and SA individuals into medically and socially inappropriate group homes of no more than four people, with a barrage of bureaucratic government rules dictating their living requirements. Across the country, thousands of well-documented cases of individuals who were rushed into these small, inadequate group homes without proper supports, have shown neglect, abuse, and even death. It is frankly, inhuman e. A secondary result of the policy has been to give priority of newly built housing units to those displaced by ICF closures, rather than to those on the over 500,000 person housing HUD-17-0236-A-000006 list who have already been waiting 5-10 years, including the 2 5 percent being taken care of at home by family members over 60. Pushing out residents already successfully placed in housing based upon an unfounded "ideology" of a few radical elitists has been exorbitantly costly, wasteful and reckless. The Need: Housing As Health We believe that "one size , does not fit all", and that for people to live in dignity, and have quality oflife, a more integrated medically-based care continuum is required to address the needs of MC/IDD, PD, and SA individuals with comorbid conditions involving multiple body systems. These individuals have the most unmet healthcare needs, represent the fastest growing cost, most hospitalizations and have an enormous impa ct on our healthcare system overall. We propose HUD and CMSallow for further development and strengthening of ICF and Intentional Communities to crea te "Centers of Excellence" that incorporate not only "bricks and mortar" housing, but recognizes "Housing as Health": physical environment, social economic factors, health behaviors, and health care. This expanded approach includes removing health barriers through holistic medical supports in Medical Homes; provides Person-Centered Care within the context of a larger care delivery system ; best practices such as Palliative Care, Johns Hopkins' "Hospital at Home"®, the Mary Naylor, PhD, RN, FAAN,"Transitional Care Model", and telehealth; ongoing intensive outpatient coordinated care; technology and programs integrated with hospitals, workforce, educational and social systems; programs for medically-appropriate serv ices that can be scaled up or down based upon individuals' current medical needs; and a model that recognizes that an "out lier" daily funding rate is needed to care for more complex MC/IDD, PD, SA individuals and keep them out of inappropr iate placements such as hospitals, rehab centers and nursing homes designed for the elderly. We need new financing models that engage healthcare payors to invest in Housing as Health, the expansion ofLow-Income Housing Tax Credits, more HUD Section 811 Supportive Housing vouchers, and fast-track approval of HCBS1915 (c) waivers. Also needed is the development of targeted cross-agency HHS, HUD, DOL,DOE,NIH CM/IDD, PD & SA Inno vation Funding Programs to stimulate collaborations between disability service and workforce development providers, health centers, hospitals, universities, and private businesses to produce and scale-up new models of care that are more cost-effective for this growing population. The Result: Cost Savings Finally, we believe there are areas where there can be tremendous cost savings . First, federally funded DOJand Protection & Advocacy litigation wastes millions of dollars and only serves to remove and limit care options for our most fragile citizens. Second, allowing the existing ICFs to remain intact and renovating and filling vacant ICFs will reduce the demand for housing. Third, the HCBSSettings Rule requiring "Heightened Scrutiny" of HCBSsettings in each state is bureaucratic and costly . Fourth, under-utilized and outdated federal advocacy and research programs can be elim inated or revamped, saving more than $150 million. Fifth, launch ing new programs such as the now stalled Pace Inno vation Act for younger people with multiple chronic conditions and disabilities will save money . This HUD-17-0236-A-000007 model adapts the PACEmodel to provide disability competent, coordinated and highly person-centered care to enable people under 55 with disabilities to live successfully in the community . Finally, allowing the over 17,000 government -funded nonprofit disabilityrelated organizations that have expenses of $94 billion to buy goods and services using the "government's purchasing rate" could take $1 to $2 billion of cost out of the system annually. As a well-respected Neurosurgeon, you have lived by the well-established concept of "primum non nocere", first do no harm. Current eligibili ty includes a 25% cap on the number of disabled residents in public and private homes. The cap in the Frank Melville Supportive Housing and Investment Act of 2010 has had an adverse effect on f undi ng by scaring away large scale private philanthropy to fund specialized group homes for those with developmental disabilities. DOJ recently removed the litigation enfo rcement threat on this matter . This cap should be removed to perm it 100% of the resident s to be disabled so that they can receive specialized care in a more affordable fashion. The changes will increase choice to the families and care givers to individuals with disabilities. The HUD funding so far under current regulations has been $240 million over the past few years but the eligibility rules have broad effect on private philant hropy. Background Although MC/IDD,PD,and SApopulations continue to grow, housing and care options have been reduced under the Obama Administration as a result of two significant changes. First, revised HUDlegislation, under the Frank MelvilleSupportive Housing Investment Act of 2010, placed a 25 percent limit on the aggregate number of units in a multifamily project for people with disabilities, thereby significantly reducing housing available and increasing costs to build housing for this vulnerable population. Second, as a result of the Obama Administration's misinterpretation of the 1999 Olmstead vs. LCSupreme Court Decision and government over-reach to mandate what the definition of a "community" must be for people with disabilities receiving government funding, the Administration: o Changed the CMSregulations in 2014 to limit the ability of states to provide large, disability-specific congregate care settings funded by Home and Community Based (HCBS)waivers. o Allowed class action lawsuits to be brought by the Department of Justice and Protection & Advocacy agencies, against the intent and true meaning of Olmstead, as cited by the Supreme Court Justices. The goal of the litigation was to close the approximately 300,000 HHS-fundedIntermediate Care Facilities (ICFs) operating in every state that are a "total care" way of life for those with I/DD. The combination of these policies has resulted in forcing more and more MC/IDD,PD,and SAindividuals into medically and socially inappropriate group homes of no more than four people, with a barrage of bureaucratic government rules dictating their living requirements. Across the country, thousands of well-documented cases of individuals who were rushed into these small, inadequate group homes without proper supports, have shown neglect, abuse, and even death. It is frankly, inhumane. A secondary result of the policy has been to give priority of newly built housing units to those displaced by !CFclosures, rather than to those on the over 500,000 person housing HUD-17-0236-B-000015 list who have already been waiting 5-10 years, including the 25 percent being taken care of at home by family members over 60. Pushing out residents already successfully placed in housing based upon an unfounded "ideology" of a few radical elitists has been exorbitantly costly, wasteful and reckless. The Need: Housing As Health We believe that "one size, does not fit all", and that for people to live in dignity, and have quality oflife, a more integrated medically-based care continuum is required to address the needs of MC/IDD, PD,and SA individuals with comorbid conditions involving multiple body systems. These individuals have the most unmet healthcare needs, represent the fastest growing cost, most hospitalizations and have an enormous impact on our healthcare system overall. We propose HUDand CMSallow for further development and strengthening of !CFand Intentional Communities to create "Centers of Excellence" that incorporate not only "bricks and mortar" housing, but recognizes "Housing as Health": physical environment, social economic factors, health behaviors, and health care. This expanded approach includes removing health barriers through holistic medical supports in Medical Homes; provides Person-Centered Care within the context of a larger care delivery system; best practices such as Palliative Care, Johns Hopkins' "Hospital at Home"(R), the Mary Naylor, PhD, RN, FAAN,"Transitional Care Model", and telehealth; ongoing intensive outpatient coordinated care; technology and programs integrated with hospitals, workforce, educational and social systems; programs for medically-appropriate services that can be scaled up or down based upon individuals' current medical needs; and a model that recognizes that an "outlier" daily funding rate is needed to care for more complex MC/IDD,PD, SA individuals and keep them out of inappropriate placements such as hospitals, rehab centers and nursing homes designed for the elderly. We need new financing models that engage healthcare payors to invest in Housing as Health, the expansion of Low-Income Housing Tax Credits, more HUDSection 811 Supportive Housing vouchers, and fast-track approval of HCBS1915 (c) waivers. Also needed is the development of targeted cross-agency HHS,HUD,DOL,DOE,NIH CM/IDD, PD & SA Innovation Funding Programs to stimulate collaborations between disability service and workforce development providers, health centers, hospitals, universities, and private businesses to produce and scale-up new models of care that are more cost-effective for this growing population. The Result: Cost Savings Finally, we believe there are areas where there can be tremendous cost savings. First, federally funded DOJand Protection & Advocacy litigation wastes millions of dollars and only serves to remove and limit care options for our most fragile citizens. Second, allowing the existing JCFsto remain intact and renovating and filling vacant JCFswill reduce the demand for housing. Third, the HCBSSettings Rule requiring "Heightened Scrutiny" of HCBSsettings in each state is bureaucratic and costly. Fourth, under-utilized and outdated federal advocacy and research programs can be eliminated or revamped, saving more than $150 million. Fifth, launching new programs such as the now stalled Pace Innovation Act for younger people with multiple chronic conditions and disabilities will save money. This HUD-17-0236-B-000016 model adapts the PACEmodel to provide disability competent, coordinated and highly person-centered care to enable people under 55 with disabilities to live successfully in the community. Finally, allowing the over 17,000 government-funded nonprofit disabilityrelated organizations that have expenses of$94 billion to buy goods and services using the "government's purchasing rate" could take $1 to $2 billion of cost out of the system annually. As a well-respected Neurosurgeon, you have lived by the well-established concept of "primum non nocere", first do no harm. Unfortunately, the bureaucratic, nonsensical and burdensome regulations present ly in place have resulted in irreparable harm to our most vulnerable children and adults.
