As some of you already know, Nevada is going to challenge the Department of Labor's Final Rule for "Defining and Delimiting the Exemptions for Executive, Administrative, Professional, Outside Sales and Computer Employees" (commonly called the DOL Overtime Rule), which is set to take effect on December 1, 2016. Nevada has teamed up with Texas and they have circulated a draft complaint. So farNevada, Texas, Arkansas, Kansas, Georgia, Oklahoma, Wisconsin, and the Governor of Maine are parties to the lawsuit. Many other states have expressed interest and will likely join before filing. The Chamber of Commerce, theNFIB, and other outside groups are filing a coordinated lawsuit on Tuesday as well. The litigation will challenge, among other things, the doubling of the "salary level" threshold for overtime-exempt employees, the automatic ratcheting of the salary level every three years, the improper delegation of congressional authority to promulgate these regulations, and the application of those regulations to the States in violation of the 10th Amendment. The States and private employers are particularly concerned about the economic impact of the new rule. It will dramatically increase the number of employees that will be eligible for overtime and, as a result, significantly strain budgets. The rule may also lead to a reduction in hours for certain workers and to an increase in the workload for certain salaried employees that are already above the current salary level. Such changes will disrupt the efficient operation of workplaces and stifle employment opportunities for workers. Nevada and Texas are planning to file the lawsuit on Tuesday, September 20, 2016.
