On or about Sgptember 17, 2017 in County, In the Southern District of Texas defendants(s) did, (Track Statutory Language of O?ense) knowing or in reckless disregard of the fact that Nervin Edimir Cisneros?Serrano, a citizen and national of El Salvador, and Maycor Ariel Ramos-Gutierrez, a citizen and national of Honduras, along with one (1) other undocumented alien for a total of three (3), who had entered the United States in violation of law, did knowingly transport, or move or attempt to transport said aliens in furtherance of such violation of law within the United States, that is, from a location near Los Ebanos, Texas to the point of arrest near La Joya, Texas, in violation of Title 8 United States Code, Section(s) 1324(a)(1)(A)(ii) FELONY I further state that I am a(n) U.S. Senior Border Patrol Agent and that this complaint is based on the following facts: On September 17, 2017, the McAllen Border Patrol Station advised agents that a concerned citizen reported witnessing a white sedan load with people, believed to be illegal aliens, near the Los Ebanos, Texas Port of Entry (POE) and depart the area in tandem with another vehicle. A Customs and Border Protection (CBP) aircraft was flying in the area and immediately located the white sedan traveling away from the Los Ebanos POE in tandem with another sedan. The CBP aircraft further advised that the two vehicles were the only two vehicles leaving the area. The CBP aircraft maintained visual of both sedans and provided real time updates of their location. Page 2 of 3 SOUTHERN DISTRICT OF TEXAS TEXAS ATTACHMENT TO CRIMINAL COMPLAINT: M-17-1667-M RE: Priscilla Ann Rodriguez CONTINUATION: The vehicles passed an awaiting agent?s location and the agent began traveling behind both vehicles, a white Chevrolet sedan and a maroon Ford sedan. As the agent attempted to pull behind the white Chevrolet, the maroon Ford attempted to block the agent by increasing and decreasing its speed. This tactic is used to protect the load vehicle from being stopped bylaw enforcement. The agent was eventually able to conduct a traffic stop on the white Chevrolet on Expressway 83 in La Joya, Texas. Agents approached the vehicle and noticed it was occupied by the driver, Priscilla Ann RODRIGUEZ a United States Citizen, and three passengers, who were determined to be illegally present in the United States. RODRIGUEZ stated to agents that she didn?t want to get into trouble for this again (alien smuggling), and that she has already been in trouble for this (alien smuggling). All subjects were placed under arrest and transported to a Border Patrol Station for processing. Principal Statement: Priscilla Ann RODRIGUEZ, a United States Citizen, was advised of her Miranda Rights, stated she understood her Rights, and agreed to answer questions without the presence of an attorney. RODRIGUEZ stated she was asked by a friend to pick up people and transport them to the Studio 6 Motel in McAlIen, Texas. RODRIGUEZ claimed she did not know the people were illegal aliens and was only picking them up for her friend. RODRIGUEZ indicated that she has been paid for transported illegal aliens in the past. Material Witnesses Statements: Nervin Edimir a citizen of El Salvador, and Maycor Ariel RAMOS- Gutierrez, a citizen of Honduras, were advised of their Miranda Rights and stated they understood their rights. CISNEROS and RAMOS stated they were willing to answer questions without the presence of an attorney. Page 2 060%? SOUTHERN DISTRICT OF TEXAS TEXAS ATTACHMENT TO CRIMINAL COMPLAINT: M-17-1667-M RE: Priscilla Ann Rodriguez CONTINUATION: Material Witness 1: Nervin Edimir claimed that his family agreed to pay 10,000 USD and had paid approximately 2,500 USD. CISNEROS crossed the river with four other people and a rafter. After walking a short distance, the group met up with another rafter who informed them that a white car would pull in, then loop around to pick them up. CISNEROS stated he sat in the front passenger seat next to the driver. One of the smuggled aliens asked for water and the driver instructed him to wait until they arrived to their destination. CISNEROS stated that once the authorities got behind them, the driver stated "shit, we are caught." One of the smuggled aliens asked what will happened to them and the driver replied to be q-u-it-e and to not say anything. CISNEROS identified Priscilla Ann RODRIGUEZ, through a photo lineup as the driver of the vehicle. Material Witness 2: Maycor Ariel RAMOS-Gutierrez claimed he paid 3,000 USD to be smuggled into the United States. RAMOS claimed that he and two other people waited in the brush until waiving down a white car and asking for a ride to McAlIen. RAMOS indicated that the driver asked if they had crossed the river illegally and RAMOS replied that they had crossed that morning. RAMOS stated that he sat behind the driver and could not see the driver but knew she was a female. Page 3
