Vr, Ned ****ORIGINAL TEXT-BEGIN**** Sir, I write the following letter to explain the events leading up to my appearance at the 19 March 2014 Military and veterans Affairs, Space an~ Domestic Security Committee meeting. I will indicate with the greatest specificity possible, however, the times are approximate. I report to the DMA Legislative Affairs Office as my schedule allows throughout session to assist with Legislative Affairs. Upon reporting to the Legislative Affairs Office on 18 March 2014 I had no knowledge of the Senate Bill 296. I was not aware of the Bill or the Bills contents. That day I was engaged in assisting Legislative Affairs team and the Funeral Detail in arranging and assisting with Governor Askew's funeral in the old Capitol Building. As such, I walked between the Capitol and the Old Capitol Building several times that day. One such occasion in the early afternoon, approximately 1400-1500, I was walking with LTC (R) Sutphin, Col (R) Kinghorn and SGM(R) Oglesby. While crossing the courtyard, LTC(R) Sutphin was stopped by Ms. Julie Roberts, OEM External Affairs Director. LTC (R) Sutphin and Ms. Roberts had a conversation to which I was not privy. I was standing several yards away speaking with Col (R) Kinghorn and SGM (R) Oglesby. It seemed as though their conversation was private and the three of us backed away and allowed them time to speak. After approximately 5-10 minutes, LTC(R) Sutphin summoned me over and I engaged in dialogue with LTC (R) Sutphin and Ms. Roberts. At that time LTC(R) Sutphin explained the Ms. Roberts had just advised him of a bill that involved carrying conceal weapons during evacuation and in shelters. It was further explained that it involved the insurrection act and the Florida State Defense Force. LTC (R) Sutphin asked me to research the issues and report to him on my finding. With the assistance of Andrew Hagaman, I retrieved the bill, bill analysis and the affray act. I reviewed all the documents and made several legal conclusions. The morning of 19 March 2014 was very busy in the Legislative Affairs Office. There were several meetings, including a budget meeting and a Chief of Staff meeting. LTC(R) Sutphin would not be able to go to all of the meetings and decided that we should split our team to cover all of the meeting. Being most familiar with SB 296, I was designated to go to Military and Veterans Affairs Committee. Prior to going, I engaged Andrew Hagaman, who pulled further research. At approximately 0930 I asked LTC(R) Sutphin what he would like me to do. He told me that I was to discuss the issue with Committee Staffer, Elizabeth Ryan. I asked whether he wanted me to speak at the meeting and he replied "yes". Andrew Hagaman witnessed this conversation. I do not know if COL (R) Kinghorn or SGM (R) Oglesby heard that discussion. I advised him that if he wanted me to speak at the meeting, then I would also need to advise my EOG Legal supervisors. At that time, I left the Legislative Affairs Office and proceeded to EOG Legal Office. I spoke with Mr. Jack Heekin and Ms. Heather Stearns of the EOG Legal office. I advised Mr. Heekin of our issues with the bill and that I would speaking at the meeting. Mr. Hagaman was in the meeting with Mr. Heekin. I then stopped into Ms. Stearns office. Ms. Stearns and I discussed several issues, and I advised her that I would be speaking at the meeting. Mr. Hagaman was not in that meeting. At approximately 1000 hours, Mr. Hagaman and I proceeded to Ms. Elizabeth Ryan's office in EL level of the Senate Building. We briefly discuss the bill, she provided me an updated version of the affray amendment. At that time Mr. Hagaman and I returned to the Legislative Affairs office. I reviewed the contents of my anticipated comments. At that time, I asked who would be joining me at the meeting. COL (R) Kinghorn, who had no previous involvement with this issue, agreed to join me at the meeting. COL (R) Kinghorn and I arrived several minutes prior to start of the 1100 meeting. I filled out my appearance card and checked that I was there for information only. Based on the foregoing I believed I was order to speak at the meeting. Directly after that meeting, I was scheduled to meet with Mr. Charles Trippe to discuss the AFSCME case in the EOG Legal. I attended that meeting. I have not addressed what took place after my appearance. I would be happy to advise you of that upon request. While you have only asked me for an unsworn memorandum, I verify all of this information to be true and correct, and I will fill out a sworn statement stating all of these facts if requested. I was able to steer the parties towards a settlement on these issues. I have the case currently marked as "tentatively settled." The parties agreed to split both contracts and they have also agreed on geographic boundaries in which they will work. Essentially Paxen will conduct 1/2 of AB and 1/2 of FM in the swath of land begin north and east of Orlando and moving southwesterly through Orlando, to Tampa and St. Pete, and then southerly to Naples. CTC will conduct 1/2 of AB and 1/2 of FM in all other locations in FL. This will settle the AB and FM bid protests. Therefore we will no longer need either the AG or outside counsel on this matter. The settlement is tentative only with respect to the will of the parties. The terms have been settled upon. DMA is drafting the contracts currently.
