Immigration and Customs Enforcement; dated January 31, 201 with a requested response by February 14, 2018. As a municipal-owned electrical utility in the State of Washington, Seattle City Light is subject to state law restricting access by law enforcement authorities to its customers? records. Speci?cally, RCW 42.56.335 provides that a law enforcement authority seeking access to a customer?s utility records provide the utility with a ?written statement in which the authority states that it suspects that the particular person to whom the records pertain has committed a crime and the authority has a reasonable belie/that the records conic} determine or help determine whether the suspicion might be true." The current subpoena issued by ICE states that it has been issued under 21 U.S.C. 967, which provides authority for an investigatory records subpoena where the records sought are ?relevant or material? to the issuing authority?s investigation. Seattle City Light is requesting additional information from you (or a member of your agency) before responding to the subpoena for subscriber information. Accordingly, please provide a written con?rmation: in the form of a declaration by an investigating of?cer or other appropriate member of your agency. that the information sought by the subject subpoena is relevant or material to an ongoing investigation under section 545 of Title 18 (relating to smuggling goods into the United States} with respect to any controlled substance [as de?ned in section 802 of Title 21); a suspicion that the subject of the subpoena is involved in a crime; and a reasonable belief that the records sought could help determine whether a Suspected crime has occurred.
