Burke, hereafter referred to as the ?Af?ant?, swear and dispose to following facts to establish probable cause for the issuance of a Search Warrant: Applicant?s Experience Introduction and Of?cers Background I make this af?davit in support of an application for a search warrant for information associated with certain search terms entered into Google Search or Google Maps that are stored at premises owned, maintained, controlled, or operated by Google, a networking company headquarters in Mountain View, California. The information to be searched is described in the following paragraphs and in Attachment A. This af?davit is made in support of an application for a search warrant under 18 U.S.C. 2703 and 2703 to require Google to disclose to the government records and other information in its possession, pertaining to any subscriber or customer who entered pertinent search terms. I, James D. Burke, am a Special Agent with the North Carolina State Bureau of Investigation. I have been employed with the North Carolina State Bureau of Investigation since 2014. I have been a sworn law enforcement of?cer in the State of North Carolina since 2009. I hold a Bachelor?s of Science in Accounting and Business Administration from North Carolina State University and have earned minors in both Information Systems and Information Technology. I am also a graduate of the North Carolina State Bureau of Investigation Special Agent Academy, the Raleigh Police Department Training Academy, and the Basic Law Enforcement Training curriculum. I have completed numerous courses of Specialized law enforcement training, including the Police Law Institute course of instruction presented by the North Carolina Justice Academy. I have received numerous hours of law enforcement training covering topics such as homicide investigations, child abuse investigations, ?nancial crime investigations, drug investigations, Attachment Support Af?davit to Search Warrant for: INFORMATION ASSOCIATED WITH 0000 LE SEARCHES FOR THE SEARCH TERMS ?58 Herndon Court, Clayton, North Carolina 27520"; and/or ?68 Herndon Court, Clayton, North Carolina 27520?; and/or ?208 E. I have experience in writing search warrants and court orders and have investigative experience which has resulted in felony arrests and convictions. I have questioned suspects, interviewed witnesses and participated in investigations that have resulted in successful prosecutions, and as a result, have gained considerable experience. The facts in this af?davit come from my personal observations, my training and experience, and information obtained from other agents, of?cers, and witnesses. This af?davit is intended to show merely that there is suf?cient probable cause for the requested warrant and does not set forth all of my knowledge about this matter. 4. Based on my training and experience, and the facts as set forth in this af?davit, there is probable cause to believe that violations of N.C.G.S. 14-17- First Degree Murder by First Name Unknown (FNU) Last Name Unknown (LNU) and others unknown, have been committed. There is also probable cause to search the information described in Attachment A for evidence of these crimes, as described in Attachment B. H. Facts to Establish Probable Cause On July 2, 2016, at approximately 12:59 am, the Clayton Police Department responded to 68 Hemdon Court, Clayton, NC, in reference to a home invasion that had just occurred. Once on scene, of?cers observed that the back door of the residence had been forced open, and there were shell casings on the floor inside the residence. Of?cers conducted a sweep of the residence and located Garrett Alexander Howard Bridges on the floor in the master bedroom. Bridges had sustained a gunshot wound and was deceased upon of ficer?s arrival. Bridges was recently released from prison and was being monitored by probation and parole via a GPS ankle bracelet, which was still af?xed to his right leg when he was murdered. The report detailed that on July 1, 2016, Bridges drove from 324 Summit Avenue. Raleigh, NC to 2584 Crispin Avenue, Charlotte NC. Once there, the report indicates that Bridges stayed for 21 minutes and then drove back to 68 Hemdon Court, where he was residing with Rachel White and her family. During an interview with Rachel White, she explained that before Bridges made the trip to Charlotte. he asked her to Google the address 2584 Crispin Avenue, Charlotte, NC, so that he could see how long it took to get there. On July 2, 2016, investigators downloaded the cellular telephone that belonged to Bridges. While analyzing the information obtained from the download, investigators were able to determine that Bridges went to 2584 rispin Avenue, Charlotte, NC. Investigators believe, based on text message content and the totality of the circumstances that Bridges likely picked up a controlled substance in Charlotte. Based on my training an experience and in addition to the text content, quick trips such as that are characteristic of drug traf?cking activity. After further analysis, investigators discovered a photo of packaged marijuana on Bridges phone that was taken on July I, 2016, during the time that he made the trip to Charlotte, NC. Through interviews and brie?ngs with sources and other law enforcement agencies, investigators were able to determine that Bridges was known to have his drug supply sourced out of Charlotte, NC. Investigators believe that a drug robbery is likely what prompted the home invasion and murder of Garrett Alexander Howard Bridges On July 2, 2016, investigators spoke with Rachel White who was inside the residence when the home invasion occurred. White explained that while the suspects were inside the house. she heard them ask ?where was it.? Investigators also spoke with White?s son, Delroy Mason, who explained that once the suspects located a bag, he heard one suspect tell the other that he had Attachment Support Af?davit to Search Warrant for: INFORMATION ASSOCIATED WITH GOOGLE SEARCHES FOR THE SEARCH TERMS ?58 Herndon Court, Clayton, North Carolina 27520?; and/or ?68 Herndon Court, Clayton, North Carolina 27520?; and/or ?208 E. Mason further explained that Bridges was visited by two males earlier in the day, and that Mason believed that the two suspects responsible for the home invasion/murder were the same persons who had visited Bridges earlier in the day. Mason detailed a meeting that occurred around 18:00 on July 1, 2016, at his residence located at 68 Herndon Court, Clayton, North Carolina. Mason stated that he went outside to check the mail and observed a silver ?box? shaped SUV parked in the driveway that he had never seen before. Mason stated that there was a light skinned black male with dreads in the driver seat. Mason further described the driver as having a tattoo on his neck. Mason explained that there was another subject in the back seat of the vehicle. Mason described this subject as a darker skinned black male, with short hair and glasses. Mason explained that as he was checking the mail he observed Bridges in the back seat with the dark skinned black male. Mason stated that the same persons who were in that silver SUV around 18:00 on July 1, 2016, are the same ones who committed the home invasion/homicide. Once investigators obtained this information from Mason, investigators reviewed the cell phone data obtained from Bridges telephone. Investigators observed a text message conversation between telephone number 919-626?1779 and Bridges between June 30, 2016 and July 1, 2016. The user 01?91 9-626-1 779 identi?ed himself as ?King Zay? in the text message thread, and the content of the messages indicated that ?King Zay? wanted to purchase a ?zip? from Bridges, which from my training and experience leads me to believe they were discussing the sale and delivery of a controlled substance. On July 1, 2016 at approximately 18:58, Bridges and ?King Zay? exchanged text messages attempting to coordinate a meeting at 208 E. Main Street, Clayton North Carolina, which is a convenience store located within the town limits of Clayton, NC. Bridges then sent a text message to ?King Zay? containing his address. Bridges sent ?King Zay? a message that read ?58 Herndon,? however the address where Bridges was residing at was 68 Herndon Court. Investigators believe that Bridges made a mistake in the text message, however Attachment Support Af?davit to Search Warrant for: INFORMATION ASSOCIATED WITH GOOGLE SEARCHES FOR THE SEARCH TERMS ?58 Herndon Court, Clayton, North Carolina 27520?; and/or ?68 Herndon Court, Clayton, North Carolina 27520?; and/or ?208 E. Investigators input telephone number 919-626-1779 into Facebook and the page that returned belonged to a subject named ?King Zay Fromaroundtheway.? Investigators continued their research and identified Isaiah Charles Wallace Avery as the user of 919-626-1779. Investigators were able to determine that Avery?s description matches the description of a dark skinned black male with short hair, which was provided by Mason. Further, Mason indicated that the dark skinned black male was wearing glasses when he saw him, and on Avery?s acebook he is shown wearing glasses. While looking through Facebook friends of ?King Zay Fromaroundtheway?, investigators observed a subject by the name of ?Jay Gunna? listed as a friend of ?King Zay Fromaroundtheway." Investigators observed ?Jay Gunna? to be a light skinned black male with dreads and a neck tattoo. Additionally, investigators were able to obtain a video posted to ?Jay Gunna?s? acebook on July 5, 2016. This video shows ?Jay Gunna? in the driver?s seat of an SUV in the drive-thru of a Cookout Restaurant. ?Jay Gunna? is shooting the video that was posted, and as he pans his camera, Avery can be seen in the passenger seat of the vehicle. The re?ection of the vehicle in the window of the Cookout Restaurant appears to show a light colored SUV as the vehicle that they are driving. Investigators have determined that ?lay Gunna? is Joshua] Lamar Davis and through research and investigative means have determined a location where both Davis and Avery may be residing. On July 28, 2016, investigators observed Davis with an unknown white female sitting in a silver Ford Escape bearing NC registration DI.M-3 90. Investigators believe that based on the totality of the circumstances and the information provided by Mason, Bridges was visited by Avery and Davis in the silver SUV mentioned above on July I, 2016.
