2018 Election Supervisory Board In Res. Multiple Candidates ESB Resolution: 2018-004 Election Supervisory Board Member Farhan Kassam Ali authored the majority opinion of the Board: “In the matter of a candidate being implicated in potentially deceptive campaigning.” Whereas, Section 4.12 of the Student Government Election Code reads, “DECEPTIVE OR MISLEADING CAMPAIGNING. Candidates shall refrain from knowingly deceptive campaign activities, including any act or statement reasonably calculated to injure or compromise the rights or interests of any student, faculty member, or administrator”, and Whereas, The Election Supervisory Board has determined that evidence presented at the hearing provided substantive proof that the Guneez –Hannah Executive Alliance had been associated with discriminatory language upon a social media site, and Whereas, The Election Supervisory Board has determined that the platform video released by the Guneez –Hannah Executive Alliance campaign does not align with official campaign activity on social media, and Whereas, The Election Supervisory Board has decided that the viewpoints presented within the video as well as the campaign affiliated social media action did not align. Thus actions taken by the Guneez and Hannah campaign were interpreted as deceptive campaigning, and Resolved, The majority has ruled to administer a Class B Violation against the Guneez and Hannah Executive Alliance Campaign for their violation of Student Government Election Code 4.12. The Class B Violation issued a moratorium for the remainder of the campaigning period which ends March 1st at 4:30 PM In conclusion, the Election Supervisory Board submits its resolution on Thursday, March 1st, 2018 with the majority of board members who were present at the meeting. Jennifer Valdez, Chair Alexandra George, Vice-Chair Mariano Bracamontes Akle, Carlos Campos Farhan Kassam Ali Dissenting Opinion on Hearing 2018-004 The ESB’s minority votes disagree on the matter of the Guneez-Hannah campaign’s violation of Sec. 4.12 and 4.13 of the Student Government Election Code. While the social media publications in question were written in a crass manner, the content reflects the political and social views of the Guneez-Hannah campaign’s disadvantaged demographics, for which they would be responsible for representing, in keeping with their campaign platform of giving voices to any and all students, including those historically/institutionally marginalized groups. The minority holds that the Guneez-Hannah campaign’s posts echo respectable political and social movements. Additionally, the dissenters do not find the deletion of the McMorris Twitter account to be a lack of transparency, seeing that the deletion was a result of psychologically damaging harassment towards McMorris and associated individuals. The dissenters also conclude that these posts do not constitute harassment as they do not incite violence, call for illicit activity, or any targeting of any other Candidates.
