The matter involved extensive investigation to build a prosecutable case more than ten years after the crime and without the confession that was used to· obtain the first conviction. In an effort to help Mr. Hamilton and his brother, the victim had allowed Mr. Hamilton to stay at the rectory for a few days. On the day that Mr. Hamilton was told that he had to leave, the victim was found bludgeoned, stabbed, and strangled, and the rectory had been ransacked and items had been stolen. Both were convicted of first degree murder. Mr. Hamilton received the death sentence. (3) State v. Thomas Laird, 572 So.2d 793 (1990). The officer had stopped the automobile Mr. Laird was driving on a suspicion of drunk driving. While undergoing the field sobriety test, Mr. Laird 34 grabbed the officer's gun, forced him to lie on the ground, then shot him in the back. Officer Pepin was paralyzed from the waist down. As part of his plea, the defendant apologized to the officer in open court, which was important to the victim. Mr. Laird was sentenced to 40 years imprisonment. (4) State v. Steven Quatrevingt, 670 So.2d 197 (La. 1996). A high school religion teacher sued the Archdiocese for wrongful termination of his teaching contract. A pivotal factor which led to the verdict in favor of the Archdiocese was - the teacher's contract, which I had revised significantly less than a year earlier. My revisions clarified that Archdiocesan teachers are ministers of Catholic education. Under the U.S. Supreme Court case, Hosanna-Tabor Evangelical Lutheran Church and School v. Equal Employment Opportunity Commission, the U.S. Supreme Court unanimously held that courts are barred from interfering with certain decisions of religious organizations that involve religious ministers. The trial judge in this matter held that under the revised teacher'.s contract, the teacher was a minister and should fall within the Hosanna Tabor ruling. (6) State v. Mr. Peart was indicted by a Grand Jury on · charges of rape, aggravated burglary, and armed robbery. During pre-trial motions, his attorney, a member of the Orleans Parish Indigent Defender Board, declared himself ineffective based on his heavy caseload and lack of office funds. I requested that the Court seek or appoint a private law firm to represent the defendant on a pro bono basis, either solely or to assist the Indigent Defender's Board. The court followed that suggestion. The District Judges of the Eastern District of Louisiana, through an en bane resolution, initiated a similar program 36 years later that remains active and successful. Mr. Peart was found not guilty but subsequently pied guilty to another armed robbery, burglary, and rape. He was sentenced to 20 years imprisonment. Mr. Lewis and two other people robbed four tourists visiting New Orleans. Mr. Lewis shot and killed one of the victims during the armed robbery. He and one of the other perpetrators, a juvenile, were arrested. The juvenile pied guilty to manslaughter and armed robbery and testified that Mr. Lewis was the person who shot and killed the victim. Mr. Lewis was found guilty of first degree murder. He received a sentence of life imprisonment. (9) State v. George Baker, 606 So.2d I 011 (La. App 4 Cir., 1992). Mr. Baker stalked his former girlfriend, eventually finding her at her home. The victim's mother and sisler were bolh presenl in lhe home when Mr. Baker killed the victim. Plaintiff, as parent of the minor child, requested injunctive relief against the child's school, that school's principal and assistant principal, as well as my clients-claiming breach of contract and that the school had violated the Equal Education Opportunities Act, 20 U.S.C 1703. As lead counsel for the Archdiocese, I drafted and successfully argued a motion to dismiss on behalf of my client. Plaintiff did not appeal. The remainder of the case was removed to federal court, where the court dismissed it. 38 18. Some of my most significant accomplishments, and certainly those that have benefitted the Archdiocese the most, include the numerous matters which I handle on a daily basis that fairly and amicably resolve litigation at a very early stage or avoid it altogether. In addition, on any given day, I may be contacted by supervisors regarding personnel issues, principals regarding school or parent issues, or the Executive Director of an agency regarding federal compliance issues. While I spend a great deal of time drafting and reviewing contracts, an even greater amount of my time is spent communicating with individuals seeking legal counsel. Helping to resolve these matters pre-trial, or even pre-litigation, makes a significant difference to the individuals involved in the matter. As an Assistant District Attorney, my focus was on representing victims of crime and those families affected by crime. To that end, when it was in the victims' best interest and when they requested to allow the defendant to plead to a charge rather than to proceed to trial, my goal was to assist them when possible. Pro Bono Work: An ethical consideration under Canon 2 of the American Bar Association's Code of Professional Responsibility calls for "every lawyer, regardless of professional prominence or professional workload, to find some time to participate in serving the disadvantaged." My pro bono work has included representing and advising individuals in matters ranging from traffic tickets to cases in municipal court. I have offered and provided my legal services through programs with the Louisiana Bar Association as well as with charitable and religious organizations such as the Harry Tompson Center. Beyond legal work, I have volunteered for numerous non-profit entities including the Cancer Association of Greater New Orleans, where I have served on the boaTd for over 20 years, including three years as President, as well as the Legacy Foundation Board (promoting organ donation). I have also volunteered with the American Heart Association, Notre Dame Seminary, St. Vincent de Paul Society, and my children's schools.
