Final Order Respondent, Anita Mullins, holds Florida ed ucator?s certificate no. 905282. Petitioner has filed an Administrative Complaint seeking suspension, revocation, permanent revocation or other disciplinary action against the certificate. A copy of the Administrative Complaint is attached to and made a part of this Order. Service of the Administrative Complaint was made upon Respondent by publication. Respondent has failed to respond to the Administrative Complaint and has not requested a hearing or any other proceeding. This cause came before a teacher panel of the Education Practices Commission on December 10, 2009 in Tallahassee, Florida. Respondent was not present at the meeting. The Commission finds that Respondent was properly served with the Administrative Complaint, has failed to respond timely, and has waived any right to be heard. Finai Order Anita Page 2 Since Respondent has not replied to the Administrative Complaint and has not contested the factual allegations, Petitioner offered the investigative file into evidence to prove the facts as alleged in the Administrative Complaint. The Commission finds these materials clearly and convincingly support the allegation and establish a prima facie case. FINDINGS OF FACT The allegations of fact in paragraphs 1 through 5 of the Administrative Complaint are adopted as findings of fact by the panel. OF LAW 1. The conclusions of law alleged in counts 1 through 3 of the Administrative Complaint are adopted as conclusions of law by the panel. 2. There is competent, substantial evidence to support the panel?s conclusions. 3. The violations committed by Respondent warrant disciplinary action by the Education Practices Commission. PENALTY Upon consideration, it is ORDERED: 1. Respondent?s Florida educator's certificate is hereby revoked for a period of 3 years. 2. As a condition of re-certification, the Respondent shall: A. Provide written verification from an Recovery Network Program (RNP) approved, licensed Florida provider that the educator poses no threat to children and is capable of assuming the responsibilities of an educator. Upon employment in any public or private position requiring a Florida educator?s certificate, Respondent shall be placed on 2 employment years of probation with the conditions that during that period, (s)he shail: A. Immediately notify the investigative office in the Department of Education upon employment or termination of employment in the state in any public or private position requiring a Florida educator?s certificate. B. Have Respondent?s immediate supervisor submit annual performance reports to the investigative office in the Department of Education. C. Pay to the Commission during the first 6 months of each probation year the administrative costs ($150) of monitoring probation assessed to the educator. D. Violate no law and shall fully comply with all district school board policies, school rules, and State Board of Education rules. E. Satisfactorily perform ail assigned duties in a competent, professional manner. F. Bear all costs of complying with the terms of a final order entered by the Commission. The Petitioner seeks the appropriate disciplinary sanction of- the Respondent?s eduCator?s,certi?cate pursuant to Sect-ions 1012.315, 1012.795, and 1012.796, Florida Statutes, and pursuant to Rule 6B?l.006, Florida Administratit're Code, Principles of Professional Conduct for the Education Profession in Florida, said sanctions Speci?cally set forth in Sections 10127950) and 30123960), Florida Statutes. The Petitioner alleges: JURISDICTIGN 1. The Respondent holds Florida Educator?s Certi?cate 905282, covering the area of Elementary Education, which is valid through June 30, 2013. 2. At all times pertinent hereto, the Respondent was employed as 3 Curriculum Resource Teacher at Wheatley Elementary School in the Orange County School District. MATERIAL ALLEGATIQNS 3. On or about May 2, 2008, the Respondent had an apparently delusional episode during school hours, While teaching, during which she believed the second coming of Christ was happening. During this episode, the Respondent engaged in the following behavior: A. 't?he Respondent screamed and prayed in front of the students, telling them that Jesus was at the school, he was real, hell is real, and the like; B. Told the students they could no longer do activities such as football, basketball, or step team because I sus was here, and he did not want them to do those activities; I). Talking to students, the Respondent pointed at a staff member and said, t?loolc at all these demons? E. The staff of the school came to the Respondent?s and ushered the students out. The Respondent became upset and called her husband on the phone, and yelled into the phone, ?they are doing what you said they would that what I should do off their heads?,? apparently in reference to the staff. She hung up the phone, turned to an adult staff member and told her that the staff person was Satan. F. The Respondent?s husband apparently advised her to leave school and came home, so she left school. As she left, she screamed to various staff members ?to hell with you all,? or words to that effect. G. The Respondent left Without signing out and did not return, without noti?cation to the school. 4. The Respondent?s actions scared the students, causing some of them to cry. 5. Upon information and belief, the Orange County Sheri?? 5 Of?ce was contacted and they had the Respondent involuntarily temporarily admitted to a hOSpital under the Baker Act. The Petitioner charges: STATUTE VIOLATIONS COUNT 1: The Respondent is in violation of Section Florida Statutes, in that Respondent has proved to he incompetent to teach or to perform duties as an employee of the public school. system or to teach in or to operate a private school. COUNT 2: The Respondent is in Violation of Section Florida Statutes, in that Respondent has violated the Principles of Professional Conduct for the Education Profession prescribed by State Board of Education roles.
