To Our Legend Solar Customers: We first wish to apologize for the slow service we’ve provided from the time you placed your trust in us to install a premium grade solar array for your home or business. After five years of rapid expansion within our industry, Legend Solar was poised to experience even greater growth in 2017, and we further expanded our capability to fulfill anticipated new customer needs accordingly. Unforeseen to us at the time was the announcement by Rocky Mountain Power (RMP) to submit a request to the Public Service Commission for Net Metering adjustments and solar fees that effectively removed the financial benefits of solar and ensured their ability to continue business as usual. The simple act of announcing their intention was, as we believe they anticipated, enough to effectively freeze the solar market in Utah pending the outcome. With the assistance of the Utah State Governor’s office, Legend Solar partnered with four of the prominent solar companies in Utah, as well as the Utah Solar Energy Association, to negotiate a reasonable compromise that would allow Utah to continue on its path as a top 10 leading adopter of clean energy among all states. As a group we assumed the expense of legal representation. RMP delayed resolution for many months, as they knew a reasonable compromise must inevitably be reached, having watched the legislation favoring their sister company, Nevada Energy (both owned by PacificCorp/Berkshire Hathaway), be reversed after just one year. The impact on the solar industry in 2017 for Utah was devastating. Also unanticipated was the new Trump administration’s announcement to consider imposing a tariff on solar panel imports. As with RMP, the announcement alone created both urgency and doubt for the industry. Urgency, because solar companies with the means to do so began stockpiling lower-cost imported panels—creating a shortage in supply. Doubt, because such a tariff would stop and even reduce what has been the fastest growing energy sector employer over the past five years. Not only will the growth stop, but mass layoffs will occur. And finally, Legend Solar management must accept our responsibility for not managing our business in a way that ensured maintenance of our existing and newly-acquired customers as we should have done. To grow from a few employees in Southern Utah to well over 100 employees in three states in five short years has been a learning process for us. Many mistakes have been made. Many lessons have been learned. The most important message we can send to you today is that we intend to press forward. It has required serious belt-tightening. It has required the formulation of a new strategy for re-building and ultimately thriving in the future, much wiser and even more determined to be the best at what we do. In the meantime, please be assured that as we work to overcome the obstacles to maintain a viable business, we fully intend to honor our commitments to our customers. We are working on a timetable for resolution to our commitment to you.
