A RESOLUTION OF THE CITY OF NEW LONDON WHEREAS, the City Council has expressed a desire to protect the rights of all of its residents within the framework of state and federal laws. NOW THEREFORE, in accordance with General Statute Section 54?192h and Governor Malloy?s Memorandum of February 22, 2017, be it RESOLVED: 1. Any city official shall require a judicial warrant prior to a. Detaining an individual or in any manner prolonging the detention of an individual at the request of US. Immigration and Customs Enforcement or Customs and Border Protection or b. Arresting, detaining, or transporting an individual solely on the basis of an immigration detainer or other administrative document issued by ICE or CBP. 2. Unless acting pursuant to a court order or a legitimate law enforcement purpose, no city of?cial shall permit ICE agents access to the city?s detention facilities or to any person in city custody for investigative interviews or other investigative purposes. 3. The city requires that any or CBP agents who have been granted access to city facilities (or to individuals in the city) be introduced as an ICE or agent to the person they wish to speak to. 4. Unless an Automated Fingerprint Identi?cation System or some other research database used by the City identifies an issue of public safety concern, City of?cials shall not inquire into the immigration or citizenship status of an individual, except where the inquiry relates to a legitimate law enforcement purpose that is unrelated to the enforcement of a civil immigration law, or where required by state or federal law to verify eligibility for a bene?t, service, or license that is conditioned on veri?cation of certain status. 5. The City shall follow the Freedom of information Act for purposes of releasing any information about a person arrested by the City's Police Department. 6. Any person who alleges a violation of this policy may ?le a civilian complaint for investigation by following the procedures established by the City Administration for such complaints. 7. on city of?cial shall question, arrest, detain or take other law enforcement action against an individual based only upon that individual?s perceived race, national origin, religion, language or immigration status, unless such personal characteristics have been included in credible information from a reliable source, linking a speci?c individual to a particular criminal event or activity or if done pursuant to a valid judicial order.
