MORATORIUM ON THE TRANSFER OR RECEIPT OF 11 12 AN ASSAULT RIFLE. (a) IN GENERAL.—During the 60-day period that be- 13 gins with the day after the date of the enactment of this 14 Act, it shall be unlawful for any person to transfer or re15 ceive an assault rifle. 16 (b) DEFINITIONS.—In this section: 17 (1) ASSAULT term ‘‘assault rifle’’ 18 means a gas-operated semiautomatic firearm with a 19 rifled bore. 20 (2) GAS-OPERATED.—The term ‘‘gas-operated’’ 21 means, with respect to a firearm, that the firearm 22 uses a portion of gas of a firing cartridge to extract 23 the fired cartridge case and chamber the next round. 24 (3) SEMIAUTOMATIC.—The term ‘‘semiauto- 25 matic’’ means, with respect to a firearm, that the g:\VHLC\031218\031218.177.xml March 12, 2018 (4:17 p.m.) VerDate 0ct 09 2002 RIFLE.—The 16:17 Mar 12, 2018 Jkt 000000 (687427 5) PO 00000 Frm 00004 Fmt 6652 Sfmt 6201 C:\USERS\JDGROS~1\APPDATA\ROAMING\SOFTQUAD\XMETAL\7.0\GEN\C\MAST_055.X G:\M\15\MAST\MAST_055.XML 5 1 firearm is a repeating firearm that utilizes a portion 2 of the energy of a firing cartridge to extract the 3 fired cartridge case and chamber the next round, 4 and that requires a separate pull of the trigger to 5 fire each cartridge 6 (4) RIFLED BORE.—The term ‘‘rifled bore’’ 7 means, with respect to a firearm, that the firearm 8 is designed or made to spin a fired projectile. 9 (5) FIREARM.—The term ‘‘firearm’’ has the 10 meaning given the term in section 921(a)(3) of title 11 18, United States Code. 12 (c) PENALTIES.—Whoever knowingly violates sub- 13 section (a) shall be subject to the penalties provided for 14 in section 924(a)(1) of title 18, United States Code. 15 (d) PRESIDENTIAL WAIVER.—The President of the 16 United States may extend the moratorium established by 17 subsection (a) until the earlier of— 18 19 (1) 30 days after the date of the submission of the report required by section 4; or 20 21 22 (2) October 1, 2020. SEC. 4. REPORT TO THE CONGRESS.
