ACTIONS TAKEN, no.1 On Monday, 11/15/2010, at approximately 0900 hours Detective Sergeant Larry Dailey #102 received a report concerning a suspected child maltreatment report. Upon reading the report, which had been iven to Nanc Wiebe of the Dou las Count Social Services, the re ort stated that reported that had come in this morning and was putting her things away when she had informed that she had owies on her tumm and her back. When asked what kind of owies that she had, stated that shrugged her shoulders. was able to ask if she could see her tummy and when she did, she could see some bruising from about her sternum to above her bell button. also asked - if she could look at her back. In doing so, noticed approximately mid-way down on - back to her waist band on her ?eans, it looked like some bruising had occurred. When asked what had happened, that her mom had hit her and she continued, informing that her mom had put her in the bathtub and turned on cold water and then hit her. also stated that her mom had hit her with a fist. When asked what she had done to make her mom mad, that she had a penny in her pocket and that this made her mom mad. She told her mom that she had found the penny on the floor With that, notified Douglas Counti Social Services and the Police Department concerning the allegations involving ALEXANDRIA POLICE DEPARTMENT OFFENSE REPORT APD201000012844ADM2 After talking with Nancy Wiebe of Douglas County Social Services, it was decided that Detective Ser eant Dailey #102 and Nanc Wiebe would go to the - and attempt to interview Detective Sergeant Dailey #102 along with Ms. Wiebe arrived at at approximately 1030 hours and then did speak with at that time. There was a tape recorder turned on and - statement was recorded in its entirety. This statement will be digitally downloaded to this APD case file and remain part of the report. In the statement, informed Detective Sergeant Dailey #102 and Ms. Wiebe that her mom, Jen, indeed had hit her and had hit her with her hand because she had found a penny in her pocket. When asked if her mom, Jen, was mad, stated that she was and stated she was mad after a penn had fallen out of her pocket on the floor. When asked where she got the enn told her mom that she had found the penny on the ground at school. stated that her mom took her to the bathroom and had put her head in cold water. In doing so, she stated that she had bonked her head on the tub. - also stated that her head went under the water. When asked how she had gotten spanked, - replied that she had otten spanked more than once. When asked if it was with an open hand or with a fist, clenched her hand, making a fist. Wd that no one else was around and that her mom, Sarah, was carrying stuff in to room while this had occurred. - stated that this incident had occurred yesterday (meaning Sunday) and knew that this day was Monday. stated that the other kids in the household were all in their room at the time of this incident. -I stated that she knew that her mom, Jen, was mad because she was talking tough and loud. She also stated that after the incident that her mom, Sarah, saw the injuries and ut medicine on her owies. In taking a physical examination of the bruising on i stomach area, Detective Sergeant Dailey #102 and Ms. Wiebe did take notice of some bruising on both her stomach area and on back side above her buttock area. Pictures were taken of the injuries by Ms. Wiebe and will be included with her report. It should be noted that the injuries appeared to be bruising only and did not appear to be life-threatening. - went on to inform Detective Sergeant Dailey #102 and Ms. Wiebe that when her mom, Jen, gets mad at her, that she gets grounded. When asked what happens when she gets grounded, she stated that she has to stay in her bed and has no lunch. also stated that she had missed lunch on this past Saturday. When asked what she had done to get grounded, - replied that she didn't do anything. - also stated that she appears to be the only one that gets grounded, but also stated that she indeed gets time cuts as a form of punishment. After talkin with Detective Ser eant Daile #102 and Ms. Wiebe spoke with When asked about the disciplinary measure, told Detective Sergeant Dailey #102 and Ms. Wiebe that most of the time the children in the household get grounded. When asked what it meant to get rounded, - stated that it meant to go to bed or sent to your room. When asked, stated that they can get the bathroom. When asked if anyone had gotten grounded over the weekend, stated that everyone at disciplined on Sunday. When asked specifically about stated that had lied and she had received a time out. also stated about the only time that he and the other children get spanked is when they take other people's stuff. - also stated that morn Jen usually gives out the spankings with an open hand. After talkin with Detective Ser eant Daile #102 and Ms. Wiebe spoke with When asked about discipline at home, informed Detective Sergeant Dailey #102 and Ms. Wiebe that usually the form of discipline at home is a time out or a groundin and what it means to be grounded is to stay in bed and you cannot do anything. stated that mom Jen and mom Sarah do the grounding in the household and denied that there were an ankings given to any of the children. Ms. Hart had come down with her domestic partner, Jennifer Hart, after Jennifer had been asked to come to the Police De artment concemin allegations made by and It was decided to interview Sarah Hart first to see if any further information could be learned concerning how the bruising had occurred with In talking with Sarah Hart, Detective Sergeant Dailey #102 informed her that he wanted to discuss with her the disciplinary issues and how they were typically handed out to the children. Ms. Hart stated that the discipline issues were typically time outs. She also made reference that spanking seemed to help; specifically with - and that recently - lying was out of control. Ms. Hart stated several times that this was not their typical form of punishment, but that both she and Jennifer hand out the spankings to the children. When confronted about the marks on - stomach and back side. Sarah Hart was informed that that she had received these marks from a spanking that she had received from her mom, Jen, and that later morn, Sarah, had put some medicine on the marks. ln bringing this to Sarah's attention, Sarah stated that she did indeed put some antibiotic ointment on bruises, but stated that Jennifer was not the one who had given the spankin and that instead it was Sarah who had disciplinw She did not know why would say that, other than that she believed was upset with Jennifer. When asked how had gotten the marks on her stomach, Sarah stated that she was upset at for lying. She stated she went to give - a bath and in doing so, had bent her over the tub and gave her some swats to her back side, believing that the marks on her stomach had come from being bent over the tub in the bathroom. By Sarah's own admission, she stated that the spanking got out of control and was not proper and was "too much". Sarah stated that Jennifer was aware of the spankings she had given to - but that the whole time Jennifer was in the back. At one point she stated that Jennifer had given her a couple of looks. Sarah again stated she had lost her temper; mostly due to lying, and that she had lost her control. Sarah went on to state that Jennifer is a stay-at-home mom and that that plays a large part of her getting respect from the children. Sarah also stated that the kids usually do not like it when Jen gets upset with them and probably has to do more with her being the maternal figure at home. Sarah was informed by Detective Sergeant Dailey #102 that reports would be sent to the County Attorney's Office and did believe that their suggestion would be that she would be charged out with the assault on DATE OF REPORT: 11/15/2010 TIME OF REPORT: 1304 hours DETAILS: On the above date and time, Detective Sergeant Dailey #102 and Nancy Wiebe of Douglas County Social Services spoke with Jennifer Jean Hart 1207 Irving Street, Alexandria, MN 56308 at the Alexandria Police Department. It was at that time Jennifer Hart was informed why she was asked to the Alexandria Police Department todai concerned issues with disci lina action re arding her children; specifically, In her statement, Jennifer stated that the disciplinary issues of the children are usually that they are given a time out. She stated that if they continue with their behavior, they are sent to their room. Jennifer stated that she is the stay-at-home mom while her domestic partner, Sarah, works outside of the home. She stated that if the kids need disciplinin that both she and Sarah are involved in that.
