MEMORANDUM OF UNDERSTANDING (MOU) On the Establishment, Operations and Maintenance of Five Community Facilitation Centers at N-70 and N-SO, Balochistan Province, Pakistan Under Output 2 of the National Highway Network Development in Balochistan Project (ADB Loan Between NATIONAL HIGHWAY AUTHORITY (NHA) and COMMISONER ZHOB DIVISION, BALOCHISTAN PROVINCE 1. The National Highway Authority (NHA) is implementing the National Highway Network Development in Balochistan Project for the Government of Pakistan with financial assistance from the Asian Development Bank (ADB) under Loan The Project has 2 outputs. Output 1 is the rehabilitation of approximately 81 kilometers (km) of Zhob- Mughal Kot road (National Highway No. 50) and approximately 120km of Qila Saifullah- Waghum Rud Road (National Highway No.70); while Output 2 is the construction of at least 5 local community facilitation centers (CFOs) along the Project roads. The Project is expected to be completed by December 2018. 2. The CFCS should focus on creating opportunities for the local population including women and vulnerable groups to exploit the benefits offered by improved mobility; (ii) improving local market hubs in rural centers along the project road, with community involvement; improving rural market hubs? access to, and linkage with, national markets through project roads; (iv) helping socioeconomic uplift of local men and women communities by organizing and promoting local products and alternate means of livelihood; and (V) providing emergency healthcare to the passengers who have suffered injuries in highway accidents. 3. The sites for community facilitation centers are required to meet the following criteria distance from nearby urban center with potential for development as local market hub for surrounding rural centers; (ii) The number of surrounding rural settlements with the number of population utilizing the facilities; Need of local population assessed through consultation process; and (iv) availability of land with minimal impacts. Likewise, the design should meet the requirement ofthe local community including women and vulnerable groups for accessing basic facilities including health services and livelihood opportunities and may include: facilities for local men and women for selling their local products to the road commuters - dedicated space for local handicrafts made by local women; (ii) parking facility with loading/unloading areas for their agricultural products, livestock and other local products; marketing facilities for the agricultural inputs and outputs; and (iv) adequate place for formal and informal meetings of community to share information about local needs to improve productivity, accessing social facilities, and social awareness programs on topics such as women and child health care and other social issues; and iv) gender-inclusive infrastructure design such as separate toilets, prayer and nursing rooms for women with children. 4. More specific criteria developed for the selection of sites include: availability of land parcel (100 by 50-60 m) with limited/insignificant impacts along the project roads? (ii) at least 10 km away from nearby urban centers like Qila?Saifullah, Loralai and Zhob etc,; must serve 5 or more nearby rural settlements (within a radius of4 km), each having 40-50 households with predominant agricultural activities; and (iv) local Needs and requirements to be considered at proposed facilities assessed through consultation process with local community both men and women. Based on these criteria, 5 sites for CFCS were identified: Kuch Amaqzai (ii) Dowa Sarkaan 70; lVlanikhwa (iv) Sanger N-50 and Sinthoi N-SO. S. The areas along the project roads are administered by Loralai, Sherani and Zhob districts under the Zhob Division of the Balochistan Province. Allocation of public land and supervision of government services related to agriculture, community development, health, and security along and N-SO are handled by these districts. Following consultations by the NHA Project team and its consultants and different stakeholders, all five sites were handed over by the Loralai, Sherani and Zhob districts to NHA for construction of CFCs. Letters indicating the handing over of these sites to NHA by the respective districts are attached as Annex A of this MOU. 6. The Project Team has prepared a basic layout for the CFC and agreed with the Zhob Division Commissioner and Deputy Commissioners of Loralai, Sherani and Zhob districts in consultation with the relevant departments and key stakeholders in the 3 districts. Basic layout ofthe 5 CFCs is attached as Annex ofthis MOU. 6. NHA has no resources to operate and maintain the CFCs. The local district governments of Loralai, Sherani and Zhob commit to undertake this task on a no-proht-no-loss basis with support from line provincial/district government departments of Balochistan and the local communities. ROLES AND RESPONSIBILITIES 7 This MOU confirms the roles and responsibilities between the parties as follows: 7 1 The National Highway Authority (NHA) will: i. Execute the works for the construction of 5 CFOs on the 2 sites along and 3 sites along (3 sites) allocated by the District Administration (DA) of Loralai, Sherani and Zhob following the designs and specifications, site plan, schedule of construction and bill of quantities as set out in Annex of this MOU within six months after receiving no-objection from ADB. ii. Ensure that all construction works are confined with ROW limits/government owned land provided for the CFCs along the project roads and prior to the construction work, the section-specific environment management plan (SSEMP) will be prepared and endorsed by NHA and ADB. All safeguard and gender related measures/procedure to be taken will be documented, monitored with monitoring reports submitted to ADB. Through the Project?s DSC Social Team, support the respective DAS in the conduct and documentation of consultations and information dissemination with key stakeholders and nearby communities including women on the services and opportunities to be provided by the CFCs and scope for community participation. iv. Through the Project?s DSC Social Team, support the respective DA in the preparation of the work plan for the operation and maintenance of the CFCS to ensure that these provide direct benefits to women in the project area and women road users v. Formally hand-over the CFCs to the Districts of Loralai, Sherani and Zhob and Public Primary Healthcare Initiative (PPHI) upon completion of the construction works and receipt of the operations and maintenance plan by the respective districts. vi. Monitor on a semi-annual basis the operations and maintenance of the CFC to document lessons for future operations. 7.2 The District Administration (DA) of Loralai, Sherani and Zhob will make ensure the sustainable operations and maintenance of these 5 community facilitation centers for the benefit of the nearby communities and road users. Specifically, the respective DAs will: i. Coordinate with the relevant departments agriculture, health, security, women development, etc.) for the provision of relevant services in these CFCs and submit to NHA within 3 months from the signing of the MOU a detailed work plan, staffing assignment and responsibilities and budget for the provision of such services including a brief description of the services and activities to be conducted in the CFC. ii. Lead the conduct of consultations and information dissemination with key stakeholders and nearby communities including women on the services and opportunities to be provided by the CFCs and scope for community participation and formalize agreements with specific community groups and villages on their roles and use of the CFC including lease/rental of spaces for trading and business. Ensure that the operation of the CFCs will have direct benefit to women in the project area (including livelihood and employment) and women road users which will be reflected in the work plan to be submitted to NHA. iv. Assign focal persons to support NHA in monitoring of the progress of work, help address emerging issues during construction, addressing queries and feedback from communities and keeping communities informed ofthe progress of work. v. On a semi-annual basis starting from 6 months after the handover of the CFC, submit to NHA a brief report on the status of operations of the CFC and provide necessary information on the CFC operations to NHA as may be required. DURATION 8. This MOU is at-will and may be modified by mutual consent of authorized officials from NHA and DAS of Loralai, Sherani and Zhob. This MOU shall become effective upon signature by the authorized officials from the DAS NHA and will remain in effect until modified or terminated by any one of the parties by mutual consent.
