mam Fredrick Rock, being duly sworn to, under penalty of perjury, states that the following is true and correct. 1. I was born on July 6, 1968, and live in the island nation of Dominica (Commonwealth of Dominica). 2. I understand that this af?davit is being prepared for the cases of People v. Juan and Rosendo Hernandez, Cook County No. 97 CR 21329, and that this af?davit may be ?lled in those cases. 3. I am making this statement of my own free will. No one offered, promised, or given me anything in exchange for making this af?davit. No one threatened me in connection with this af?davit. CPD Gang Crimes Specialist Joe Miedzianowski 4. I ?rst met Joe Miedzianowski in 1990, and I signed a paper with Joe Miedzianowski and the ATF stating that I would work as an informant but things did not work out that way because Joe, who acted as my CPD handler, was secretly in the cocaine business himself and I ended-up working for him. I assisted Joe in arranging deals where the real purpose was not to make a purchase or arrest, but instead to set-up a meeting so that Joe could rob the dealer before or afterwards. Joe called these rip-offs toombas or geezos. I would then resell the drugs, splitting with Joe in whatever dollar amount he told me. I also bought and sold drugs on my own. 5. Joe had started out by running interference with the Chicago Police Dept., and as a supplier, getting drugs through toombas and geezos, but over time he became the boss. Joe got his drugs for free through toombas and geezos, and starting in 1996 he developed his own direct wholesale source from Florida, and he had his own protection because, after all, he was the police. This gave Joe a competitive advantage, and he was greedy, so he poached our best customers for himself, which caused resentment. 6. Part of being boss meant that Joe had to keep the troops in?line. Joe acted as enforcer, threatening and dispensing rough ?street justice? on whoever he believed crossed him. Joe did so by beatings and having other police of?cers make a case against whoever Joe thought was crossing him. Joe also used these methods when he wanted something that didn?t belong to him. Joe threatened me and I saw and heard him threaten others. We all were afraid of him because he was the police, we were doing something illegal, and so we had nowhere to turn. 7. That all ended in late 1998 when I and 22 other co-defendants were arrested and charged in the case United States v. Joseph Miedzianowski et. al., case 98 CR 923. I testi?ed for the government and Joe In a newspaper interview after the trial blamed me for his conviction, calling me the ?Mouth of the South?. (Chicago Tribune, February 1, 2003, Rogue cop ?s ally gets 5 years Lenient sentence re?ects help in investigation.) 8. As part of my relationship with the U.S. Attorney?s Office I also exposed Joe Miedzianowski?s plot to kill lead U.S. Attorney Brian Netols. I also testi?ed for the U.S. Attorney?s of?ce in U.S. v. Robert A. Burke, 01 CR 01049, in which Mr. Burke was convicted in relation to his smuggling into the MCC a handcuff key that was used by another prisoner to escape, during which the other prisoner shot to death two court of?cers. I also brought to the EXHIBIT 7 U.S. Attorney?s Of?ce the Woodall case which sent ?ve Chicago Police Department of?cers to prison. Frankie Figueroa and Juan Hernandez 9. I ?rst met Francisco Figueroa, who I knew as Frankie, in about 1987, through his twin cousins, and I got to know him in the drug business. Joe called him ?Tweedy?, as in Tweedy Bird. Frankie would scare easily and sing like a bird to Joe. Frankie would report anything that happened to him to Joe so that Frankie would be safe. Joe protected Frankie. If anybody messed with Frankie, Joe would warn that person, if anybody stole from Frankie, Joe would get the drugs back, would get his cut, and the person would end up arrested. 10. I also knew Frankie as a very good cocaine cooker. He cooked for Juan (?CaSper?) Martir until Casper moved to Florida in 1996, then for Mohamed Omar, and by the spring of 1997 shifted to cooking for Joe. In addition Frankie used to sell on the side, primarily to members of his gang, the Imperial Gangsters. 11. I met Juan Hernandez, who was known as ?Poochie?, in approximately 1993 through Mohamed Omar at the Mega Mall. Poochie and I were not close but we knew each other. Poochie would sell drugs on the street level and wasn?t known as a cooker. I also got to know Poochie?s brother ?June Bug?, who I knew would help out his brother. 12. In the spring of 1997 there was a cocaine drought in Chicago. At some point that spring of 1997 I learned from Mohamed Omar that there had been a burglary of a stash house on North Leamington St. that Frankie and Poochie shared, and that Frankie accused Juan of doing it. I also learned that Juan accused Frankie of the burglary and that he chased Frankie around to confront him. Joe Miedzianowski?s threats to Juan Hernandez. including in the Dresence of Detective Reynaldo Guevara 13. Joe had a thing against Poochie, and several times in the months before Poochie was locked up he stated that he was going to frame him. 14. On one occasion, in approximately the spring of 1997, I was a passenger in Joe?s car heading back from a debt collection trip to a Latin King in a wheel chair, named Papao who owed Joe money. I was sitting in the backseat so that if anyone saw me in the car, it would look as if Joe had arrested me, handcuffed me and put me in the backseat. Joe pointed out to me the first ?oor of a two ?at on Leamington Street and said, that?s where Poochie who stole Juan Martir?s stash lives. 15. I was with Joe on another occasion when he threatened Poochie. Joe was a back seat passenger in my Jeep because the back window tint was darker. We came up to the 711 near Keeler and Fullerton, where Poochie used to hang out. Joe spotted Poochie and seemed angry and said, ?I?m going to get that fucker because of what happened to Frankie.? 16. From time to time I would shoot the breeze with Joe at his Maxwell Street and Grand and Central offices. And, it was at Joe?s Grand and Central of?ce that I ?rst met Detective Reynaldo Guevara. I remember from the ?rst meeting his dark skin and perfect hair. Joe said that Detective Guevara was a ?very close friend? of his and in charge of homicides at Grand and Central. Joe said in front of me and Guevara me words to the effect ?we are going to get Poochie,? and I took that to mean that Joe wanted Guevara to help arrest Poochie. 2 EXHIBIT 7 17. I recall having two other conversations with Joe and Detective Guevara about Poochie, at the Grand and Central and Maxwell St. gang crimes police of?ces. Present were Joe, Detective Guevara, and me. I remember Joe saying at one of those meetings that he was going to ?frame? Poochie. I also remember Joe saying words to the effect have to get this guy? referring to Poochie in front of me and Guevara. 18. When being interviewed by AUSA Brian Netols, I told Netols about Miedzianowski?s framing Juan Hernandez. Netols said to me words to the effect, let?s concentrate on Miedzianowski and we can concentrate on Juan Hernandez later. March 4. 1998 incident. Garza murder. and Of?cers Woodall and Guevara tell me to keep quiet 19. One of the cases that I developed for the US. Attorney?s Of?ce was United States v. Wooden, Matich, Benson, PIacencio, and OIt'veras, 03 CR 64. The defendants were all police of?cers. The government did not know of this side group until I brought them the case. 20. About two weeks before March 4, 1998, Joe had introduced me to Jon Woodall. Joe said that Woodall would help with toombas, and that I could trust Woodall. 21. Jon Woodall and I planned a drug buy where Mohamad Omar would pretend to come to my houSe at 5016 N. Keeler, Chicago to buy several kilos of cocaine from someone that I knew as Gino who had Mexican cocaine to sell. I had seen a sample the day before. The sample kilo was special because it was sealed in plastic with a Mexican seal or stamp, which suggested that it was pure and high quality. The real plan though was for Mohammed Omar to not make it to my house, and after the seller left my house for Jon Woodall and his buddies to pull-over Gino, and take the cocaine, which I would then sell, sharing the proceeds with Woodall and his buddies. The plan worked out on March 4, 1998, and Gino was arrested after leaving my house. 22. The next day Detective Woodall, and another of?cer, who I knew as Of?cer DeFelice, met me in the alley behind my house and gave me what looked like the same kilo, with the Mexican stamp, that I had seen earlier at Garza?s house. 23. Two days after the toomba, on March 6, 1998, Joe, his partner, John Galligan, Jon Woodall, and DeFelice came over to my house and we went to the basement to talk. Joe asked me why I was nervous. Joe said to me, ?how come you didn?t tell me about the kilo?? and told me that he heard that Woodall got a lot more than one kilo. 24. In the following days Woodall starting coming by my house harassing me for money. Joe also began calling me, stating that he was calling on behalf of Woodall. 25. Several weeks later a call came to the house and Woodall asked me to come downstairs, that he needed to talk with me. I came outside and got into a Ford Bronco. In the truck was Woodall and Detective Guevara, and we went for a ride because I didn?t want my neighbors to see me talking. Woodall told me that one of the Garza brothers had been killed by being shot in the head through the front door. Woodall told me that two detectives wanted to talk with me and that I should be careful with what I told them. Woodall also told me that he had found out that Gino was working with the feds. 26. On hearing that my immediate belief was that the cops had killed the Garza brother. I immediately stopped trusting the cops and feared that I might be next. That same day I got myself a Glock 357 or 45 to protect myself. EXHIBIT 7 27. I later met with two detectives who were well-dressed in suits. I did not reveal what I knew in relation to the March 4 geezo or that I was told to keep quiet.
