Box 1400 Bartow, FL 33831 SUBJECT: Migrant and Seasonal Agricultural Worker Protection Act violations File No. 1507372 Dear Mr. Putman: A recent investigation of your ?rm conducted by Investigators Monique Perez and Evelyn Mercado under the Migrant and Seasonal Agricultural Worker Protection Act (MSPA) covered the periods of 11/20/2007 to 03/14/2008. This investigation disclosed that your workers are subject to the requirements of the Act. Investigators Perez and Mercado reported ?nding violations of MSPA Sections 500.76, 500.80 and 500.81. These violations were the result of your ?rm?s failure to provide the proper disclosure information to migrant/seasonal agricultural workers; your firm?s failure to keep accurate records of hours worked by migrant/seasonal agricultural workers; and your firm?s failure to pay migrant/seasonal agricultural workers proper wages when due. Underpayments totaling $1,634.72 were found to be due to 4 workers. The investigators have advised me that you have agreed to fully comply with all of the provisions of the MSPA in the future. Speci?cally, you agreed to provide proper disclosure information to all migrant/seasonal agricultural workers; agreed to record the accurate number of hours worked for all workers; and you agreed to pay all migrant/seasonal agricultural workers the proper wages in the future. In addition to your commitment to future compliance, you have also agreed to pay the above described back wages in full on or before 03/31/2008. To date, we have received all of the necessary proof of payments and no other documentations are being requested from your ?rm. We will be concluding your ?le and will not be taking any further actions at this time. No penalties are being assessed as a result of this investigation. If at any time in the future your ?rm is found to have violated any provisions of the Migrant and Seasonal Agricultural Worker Protection Act, it may be subject to such penalties. I have enclosed a copy of the MSPA for your reference. Please realize that legal requirements established by Florida state law are separate and in some circumstances are greater than the requirements established by federal law. Compliance with the Migrant and Seasonal Agricultural Worker Protection Act does not necessarily establish compliance with Florida state law.
