The following facts and information are known by the Affiant and were provided by United States Customs and Border Protection Officer J.G., assigned to the Progreso Port of Entry (POE). Officer J.G. provided information serving as probable cause in support of a complaint against Gabrella Lee SANCHEZ for violating Title 18, United States Code, Section 111 and Assaulting a Federal Officer. 2. On January 14, 2018 at approximately 4:00 PM, uniformed CBP Officer J.G., who is a Federal Officer that was engaged in the performance of his official duties, was working at the Progreso POE in Progreso, Texas. Officer J.G. responded to assist with a vehicle occupied by two females that was diverted from inbound traffic for a secondary search. After another Officer had instructed the driver, Gabrella Lee SANCHEZ (hereinafter referred to as to remain in the vehicle, Officer J.G. witnessed SANCHEZ disregard those instructions and exit the vehicle. 3. SANCHEZ was immediately irate and argumentative. Outside the vehicle, SANCHEZ used profanity and began complaining to the Officers who were present. SANCHEZ returned to her vehicle and sat in the driver's seat. It was Officer experience that passengers demonstrating disruptive behavior of this nature were attempting to distract Officers from a vehicle that contained illegal substances so Officer J.G. made the decision to detain SANCHEZ and remove her from the immediate vicinity during the search. Officer J.G. removed SANCHEZ from the vehicle and placed her in handcuffs. 4. Officer J.G. escorted SANCHEZ to a room inside the POE facility with assistance from CBP Of?cer S.H. During the escort, SANCHEZ continued to curse at the Officers. Once inside, Officer J.G. attempted to sit SANCHEZ down on a bench at which point she began to resist. During a short struggle, SANCHEZ bit Officer J.G. on the forearm. After SANCHEZ had been placed against a wall and could no longer struggle, Officer J.G. noticed blood on his arm from the bite and called a supervisor to his location for assistance. 5. Officer J.G. was taken to the Knapp Medical Center in Weslaco, Texas for treatment. He was given a tetanus shot and prescribed a 30 day course of antibiotics. The bite broke Officer skin and he received a wound dressing for the injury. 6. The incident was captured on video surveillance and depicts Officer reaction as he pulls back his arm after the bite from SANCHEZ. Based on the aforementioned factual information, your Affiant respectfully submits that SANCHEZ committed a violation of Title 18, United States Code, Section 111 and Assaulting a Federal Officer.
