ELOY VERA and BALDEMAR GARZA Contestees. § § § § § § § § § IN THE 229th DISTRICT COURT OF STARR COUNTY, TEXAS FINAL JUDGMENT On April 23, 2018, the Court, pursuant to the Texas Election Code, conducted a trial to ascertain whether the outcome of the contested election in the above-styled and numbered cause, concerning the March 2018 Democratic Primary Election for two Starr County Texas races, (a) the Starr County Judge's race and (b) the race for the Court of the 229th Judicial District, in Starr, Duval and Jim Hogg County Texas, as shown in the final canvass was not the true outcome of the contested elections. On said date, the case was called for trial before the court. Contestants, Leticia Garza Galvan and Martie Garcia Vela, appeared in person and by and through their attorney of record and announced ready for trial. Contestee Eloy Vera, appeared in person and by and through his attorney of record and announced ready for trial. Contestee Baldemar Garza, appeared in person and by and through his attorney of record and announced ready for trial. All matters and controversy, legal and factual, were submitted to the Court for its determination. The Court heard the evidence and arguments of counsel and found that Contestants failed to prove by clear and convincing evidence that: (a) the final canvass of the Starr County Judge's race in the Starr County, Texas March 2018 Democratic Primary Election was not the true outcome of said election and (b) the final canvass of the 229 1h 1 District Court race in the Counties of Starr, Duval and Jim Hogg, Texas March 2018 Democratic Primary Election was not the true outcome of said election. IT IS THEREFORE ORDERED, ADJUDGED, DECLARED AND DECREED that: 1. The results as shown by the final canvass of the contested election, the Starr County Judge's race, Contestee Eloy Vera received more total votes than Contestant Leticia Garza Galvan and is the true winner for that position. 2. The results as shown by the final canvass of the contested election, the race for the Court of the 229 th Judicial District, Contestee Baldemar Garza received more total votes than Contestant Martie Garcia Vela and is the true winner for that position. 3. Contestee Eloy Vera is hereby declared the true winner of the Starr County Judge's race for the March 2018 Democratic Primary in Starr County, Texas. 4. Contestee Bademar Garza is hereby declared the true winner of the race for the Court of the 229th Judicial District for the March 2018 Democratic Primary in Starr, Duval and Jim Hogg County, Texas. S. The Contestants were not the winners of their respective election. 6. Contestants' Leticia Garza Galvan and Martie Garcia Vela request for anew election is DENIED. 7. Contestants Leticia Garza Galvan and Martie Garcia Vela are ordered to pay all costs incurred in this action for which execution may issue. 8.
