THE VILLAGE OF MAMARONECK POLICE BENEVOLENT ASSOCIATION PO Box 774 Mamaroneck, New York 10543 Officer Charles Deshensky President Officer Michael Petrillo Vice-President PRESS RELEASE – MAY 2, 2018 VILLAGE OF MAMARONECK PBA RESPONDS TO MEDIA REPORTS REGARDING DEATH OF GABRIELLA MARIA BOYD Members of the Village of Mamaroneck PBA are deeply saddened by the horrific death of Gabriella Maria Boyd on April 28, 2018. We are community members and have children ourselves. We understand that the depth of Mr. Boyd's loss is unfathomable. No parent should ever have to experience the loss of a child. In response to multiple media reports and comments from legal representatives of parties, the PBA offers the following information regarding the actions of its members: at approximately 4:45 PM on April 27, 2018, Mr. Boyd appeared at Village of Mamaroneck Police Headquarters with a copy of a Family Court Order. This Order did not authorize police officers to forcefully enter the residence of Ms. Arce, nor did it authorize police officers to forcefully remove Gabriella from the residence. Whether the Family Court had been requested to issue an emergency removal order, or whether an emergency removal order was requested and denied, we do not know. What we do know is that the officer who was presented with the Order spent more than five hours speaking with attorneys, domestic violence officers, police supervisors, and Assistant District Attorneys in an effort to determine whether he possessed lawful authority to forcibly remove Gabriella from the residence based upon the Order he was given. The officer was unequivocally instructed that he could not. At one point, two officers accompanied Mr. Boyd to the residence in an attempt to persuade Ms. Arce to voluntarily turn Gabriella over to them. Their efforts were unsuccessful. Once Ms. Arce refused to voluntarily allow the officers into her residence, the officers simply had no legal authority to enter against her will, nor could they forcibly remove Gabriella. While present at the residence, the officers did not observe anything that led them to believe that Gabriella was in danger of harm from her mother. Upon returning to headquarters, the officers called Child Protective Services and advised them of the content of the Family Court Order. They were advised that CPS was opening an investigation. Along with the rest of the Village of Mamaroneck community, we mourn the terrible loss of Gabriella. Despite the tragic outcome, we nevertheless we stand by the actions and efforts of our officers. We believe our officers made every effort to determine the parameters of their authority, and believe that they acted within the limitations of the law and pursuant to their lawful police authority.
