Good Faith: Based on the evaluation of the employer's safety and health program as summarized below. Past History: No prior related history. Evaluation of Employer's Overall Safety and Health Program: The company only has three employees and it has the required programs but they are verbal. The, company does not have any chemicals that come in bulk or has MSD sheets. There is also no equipment that 1s required to be locked out or tagged out. The company has never been impeded by OSHA and therefore does not get a reduction for history Narrative Comments A. Purpose and Scope of Investigation: On 5/19/14 CSHO 80135 assisted by CSHO 70 initiated a complaint inspection of The Trixie Foundation located at 1167 Little Brushy Road 111 Webbville, Kentucky. Credentials were presented to Ms. Mary Allen, Primary Animal Care Giver, who was in charge when the owner, Mr. Randy Skaggs, was out. The complaint alleged there were no smoke detectors, fire alarms, or ?re extinguishers. The complaint alleged that there were uncovered electric outlets and fuse boxes, and improper wiring in the employee living quarters. The complaint also alleged that there is black mold and rats present in employee living quarters and loose ?ooring in the owners living quarters. B. Description of Process: An Animal Care facility that takes in stray or unwanted dogs, cats and chickens. The animals are kept there for life. It is a No kill shelter but the animals are not adopted or fostered out ever. C. Principal Product: D. Opening Conference Notes: On 5/19/14 the CSHOs arrived at The Trixie Foundation. Upon arrival the CSHOs were greeted by the Primary Animal Care Giver and another Animal Care Giver. They are the only non?management employees in the facility. Mr. Randy Skaggs, the owner of the company was not present throughout the entirety of the inspection. Credentials and business cards were presented to the employee in charge. The nature, purpose, and scope of the inspection were explained. The company's right of refusal was discussed and the employee authorized the inspection to continue per Mr. Skaggs. The CSHOs spoke with Mr. Skaggs about the inspection and he stated that he had several inspection before but none by OSHA. Mr. Skaggs also stated that he knew the employees had ?led a complaint. The employees stated that they had told Mr. Skaggs that they were ?lling a complaint. The CSHOS documented legal information about the company and discussed the complaint items in detail. The CSHO then ask the employee if they were union and she stated that they were not. The two employees and Mr. Skaggs are the entire workforce for the facility with 167 dogs, 80 cats and 24 chickens. Walkaround Inspection Notes: The facility sits on 200 acres with eleven (11) buildings on it and is fenced in. The buildings were wood framed with wood ?oors and pitched and ?atroofs. There are two living quarters for the employees and one living quarter for the owner/founder. There is a separate area for cooking because the living quarters do not have electricity. There is a generator that is hooked up and the electrical cables ran through the bathroom window to the 220 volt electrical box to supply the electricity for the building. The living quarters have a small bathroom, a living room with a makeshift bed, that is a wooden counter with a dog bed on it for the employee to sleep on, a urine soaked chair that is falling apart and a kitchen area with appliances that do not work. The area smelled so bad the CSHOs could not stay in there too long. There are also cats and kittens in the employee living quarters and no litter boxes. The owners living quarters was just as bad. He shared it with the older dogs and the dogs that needed medical care. He slept on an elevated wooden platform with just blanket, a small TV, dog bowls and some dogs. These areas were so dark it was hard to take good pictures. The other buildings are empty or used for storage. There are dog kennels but the dogs are not kept in them, they are free to roam in two separate areas similar to a dog park. When you go in the area where the living quarters are located you are met by approximately sixty (60) to seventy (70) dogs all of which were very friendly, but it is hard to get by them. Some cats are also in one of the areas where the dogs are. There were cats with kittens in separate rooms of the employee living quarters so the mother cats could feed them. Most of the cats are outside and lay in the road and will not move. The CSHO had make them move. The chickens are kept in a separate area next to one of the living quarters. The complaint items were. 1. The complaint alleges that there are no smoke detectors or ?re alarms present throughout the facility. Findings: The CSHOs found that there are no ?re alarms or smoke detectors present in the facility. A citation will be recommended. 2. The complaint alleges that the Trixie Foundation had black mold in the employee living quarters. The CSHOs also discovered that there were signi?cant amounts of animal urine 'and feces in the employee living quarters. A citation will be recommended. 3. The complaint alleges that there are uncovered outlets and ?Jse boxes Findings: The CSHOs found that there were several uncovered electrical outlets and two uncovered electric breaker boxes. The face plates of 20 electrical outlets were missing. The 220 volt electrical breaker box is missing the complete cover on the inside and out. A citation will be recommended. 4. The complaint alleges that improper wiring between buildings and employee living quarters was lying on the ground across a bridge. Findings: The CSHOs located live electrical wiring for the employee living quarters running through a small stream near the employee living quarters and hooked up to the breaker box in the bathroom. A citation will be recommended. 5. The complaint alleges that there are rats located in the employee living quarters Findings: The CSHOS could not locate rats in the employee living quarters, or throughout the facility. No citation is recommended. A 6. The complaint alleges that extension cords run throughout the facility other than proper wiring. Findings: The CSHOs located live temporary wiring running from a work room to the employee living quarters. Extension cords were running from an operational outlet outside across compound to the quarters for electrical use. The employees used this for hair dryers and radios and other small appliances. A citation will be recommended. 7. The complaint alleges that the living quarters of Owner Randy Skaggs has improper ?ooring, rats, and no electricity. - Findings: The CSHOs found that the living quarters of Owner Randy Skaggs did not have electricity or running water. The CSHOS were unable to ?nd rats located in the living quarters. The ?ooring located in Mr. Skaggs living quarters was determined to be unsafe for employees to work on because of the trip hazard created by the loose ?oor boards at the entrance of the living quarters. A citation will be recommended. F. Closing Conference Notes: A closing conference was conducted over the phone on 7/1/14 at 9:40 AM by CSHOs Bledsoe and Nieporte. Mr. Skaggs was informed that citations would be recommended and what each standard that had been allegedly violated was. Mr. Skaggs signed the closing conference checklist and sent a fax-back to the CSHOS. G. Summary of Complaint, Referral, Accident or Followup Findings: The road to the facility was a small two way road but only enough room for one vehicle. Two deer ran out in front of the CSHOS on this road. There were cats in the road and would not move. The CSHO had to get out?of the car to make them move in order to get past them. There was no place for the CSHO to turn around or park at the facility. The CSHO had to park on the side of this narrow road. The CSHOS felt very uncomfortable in this area because of the location of the facility which was approximately four miles off the main road on a partially paved and dirt road and no cell phone service. The CSHOS could see the dogs were not in any kennels and they were barking and the CSHOS did not know if they were friendly or not. The CSHOS blew the car horn until two females came out and meet the CSHOS. They stated that Mr. Skaggs was not there so they called him on a land line. Once the CSHOS got in the area the smell was almost unbearable but the CSHOS conducted the inspection. 1) There was black mold found in the employee living quarters. $0135 Spoke with Health Supervisor, Clayton McNew about the mold that was found in the facility. Supervisor McNew recommended citing the mold as a serious Violation under housekeeping, because there is no OSHA standard for mold. 2) The face plates of over 20 electrical outlets were missing. The electrical breaker boxes were missing the complete cover on the inside and out. 3) There was live temporary electrical wiring for the employee living quarters running through a small stream near the employee living quarters and ran through the bathroom window and connected to a 220 volt breaker box. The CSHOS did not get any information off of the cords because it was to hazardous for the CSHOS because they have not had the proper training or equipment to do so. The cords were run all over the place in all directions. 4) The living quarters of Owner Randy Skaggs did not have electricity or running water. The CSHOS were unable to ?nd rats located in the living quarters. The ?oorng located at the entrance in Mr. Skaggs living quarters was determined to be unsafe for employees to work on because of the trip hazard created by the loose ?oor boards. The employees are in this area to take care of the old and sick dogs that share this area with Mr. Skaggs. 5) The facility does not have any type of alarm system in it to indicate a ?re or any other emergency that may occur.
