PRESS RELEASE OF ALEXANDER PRICE BROUGHTON October 2, 2012 My name is Alexander P. Broughton, a student at the University of Tennessee in Knoxville. My attorney is Daniel F. McGehee who has prepared this statement on my behalf, and I have given him permission to release this information to the news media. I am 20 years old and live in Memphis, Tennessee. I am the student at the University of Tennessee whose name has been circulated throughout local, national and international media in the past week. The reports in the media are false, and the medical information provide to the media by the University of Tennessee Medical Center and the University of Tennessee Police Department has violated my civil rights. The false reports have depicted me in a shameful light, and this has severely and permanently tarnished my reputation. or the record, I am 11ot a homosexual and I do not appreciate the media reports that infer that I am gay. On Friday evening, September 21, 2012, I attended a function off the University campus where I consumed between tive (5) or six (6) beers on an empty stomach. Around 9:00 p.m. I went to the Pi Kappa Alpha Fraternity house at 1820 Fraternity Park Drive where I foolishly participated in a game known as "Tour de Franzia". The members of my pledge class had been instructed by the chapter officers not to have this in-house party, but we disregarded their orders. I consumed wine from a wine box. At some point in the evening I became very intoxicated and lost consciousness. I have been told that some of my fraternity brothers put me in the shower in an effort to wake me up which was unsuccessful. I was apparently on the floor of the shower, and when someone attempted to raise me off th floor, that person used my belt to lift me np which caused my shorts to be forced into my crotch area at which time I was told that I defecated on myself At that stage someone made the decision to take me to the University of Tennessee Medical Center where I was admitted for possible alcohol poisomg. The medical team at the University of Tennessee Medical Center Trauma Unit apparently conducted an extensive examination to determine my overall condition. At some point medical personnel examined my rectum where there appeared to be bruising, and upon further examination determined that my sphincter muscle was greatly enlarged. It is my understand nom speaking to medical personnel after I was in recovery that there was a suspicion that I had been sexually assaulted and that the Knoxville Police Department was requested to provide a rape crisis kit for further examination. I was heavily sedated but remember the examination. I was informed by one ofthe nurses later that the rape kit was turned over to the Knoxville Police Department and that it would be at least a week before the test results were returned. On the morning of September 22, 2012, while I was in the recovery area of the cardiac trauma unit at UT Hospital, a medical doctor also conducted another rectal examination, but did not provide me with any information about his examination, but he did not seem concerned. Prorn the time that I was admitted at the University of Tennessee Medical Center until the time when I was released on Sunday, September 23, 201 2, there was never a representative of the Knoxville Police Department or a police officer from the University of Tennessee Police Department who attempted to contact or visit me at the hospital in order to allow me to provide a statement of any kind. The only person who came from the University of Tennessee was Dean of Students Maxine Thompson-Davis who told me that she came to check on my welfare for which I was pleased. I was not contacted by any University official or member of any police department until I was requested to come to the University of Tennessee Police Department to make a statement. University of Police Officer Lt. Dana McReynolds, in the presence of Sgt. Angela O'Neal, interviewed me, and I told both of these individuals that I had never engaged in "butt-chugging" or any activity now known as an alcohol enema ever, that I had never heard of any such thing until after I regained consciousness in the hospital and I categorically denied ever doing any such a thing. After my interview on Wednesday, the University of Tennessee Police announced on Thursday, September 26, 2012, that the "case was olosed". I was informed by my attorney on Monday, September 24, 2012, that Vice Chancellor of Student Affairs Tim Rogers had reported to the fraternity's legal counsel that a copy of the "police report" could be obtained at the Knoxville Police Departnrent, and that I later learned that our legal counsel went to the Knoxville Police Department to the Records Division and requested a copy of the Knoxville Police report involving the incident at the Pike House on September 21 or 22, and that he was informed that the Knoxville Police Department did not have report on file, and that any information concerning the incident had been turned over to the University of Tennessee Police Department. On Tuesday, September 25, 2012, I went to the Knoxville Police Department at 7:00 a.m. and found that the Knoxville Police Departrnent Records Division did not open until 8:00 a.m. "When the Records Division opened, I requested a copy of the "police report" involving me on September 21. I was informed by a female clerk that "There is no report on Alexander Broughton in the Knoxville Police Department, and that all information had been turned over to the University of Tennessee Police Department for further investigation." I left the Knoxville Police Department very frustrated. My attorney, Daniel P. McGahee, went to the Knoxville Police Department at 9:00 a.m that morning shortly thereafter where he requested a copy of the Knoxville Police Report on my behalf. He was informed by the female clerk that "The Knoxville Police Department does not have a report on tile about Alexander Broughton, and that all information had been turned over to the University of Tennessee Police Department for further investigation. Mr. l\/IcGehee called me to his oftice at which time I informed him that I had not been able to obtain a police report nom the Knoxville Police Departrnent, and he informed that he had been at the Knoxville Police Department at 9:00 a.m. and that he was told the same information that he had been given. I wanted a copy of the purported "police report" that supposedly stated that I was "butt chugging" as released by Knoxville Police Department Officer of Public Affairs, Darrell 2 Debusk. Officer Debusk released information on Monday, September 24, 2012, to the news media that the Knoxville Police Department believed that I had been "butt chugging' In fact, he had no evidence of any such activity which I confirmed in a telephone interview with Debusk on Wednesday, September 26, 2012. Officer Debusk stated that it was his opinion that "butt chugging" had taken place but that there was no substantive evidence. I specifically asked him Why he did that since he had no evidence, and he replied, "Well, that's what I thought at the time." This statement by Officer Debusk is false, unsubstantiated and a totally, fabricated lie. I told him that he had ruined my life because of his Wanting to create a media event. The University of Tennessee through its administration has created a media frenzy based on falsehoods, lies, unsubstantiated reports, and total and complete lies which have ruined my life. There is not one Word of truth that I ever engaged in any activity of "butt chugging". This has damaged my reputation and has made my name a household Word. This false and misleading information has attempted to destroy my family which has repeatedly tried to inform the University of Tennessee through Dean of Students Maxine Thompson that eveiy one of the allegations of "butting chugging" or alcohol enemas was simply untrue. The University of Tennessee should be ashamed for the dissemination of information about a student which is in direct violation of federal HIPAA law. I am making this statement to all students at the University of Tennessee and to any student who might contemplate coming to this University that the rights of students are violated with reckless disregard for its students. Shame on you, UT. This media iienzy has been created by Vice Chancellor of Student Affairs Tim Rogers. Mr. Rogers has knowingly disregarded the truth and has continued throughout this entire process to report to the media that all of his information vvas coming from the only known police reports which would have been the University of Tennessee Police Department. UTPD owed me a duty to me personally not to release any information about me which is a violation of every HIPAA law in this country. The University should have an independent investigation in the irresponsible investigation of the University of Tennessee Police Department. The University should start the incompetent Police Chief Tony Lane and the severely unqualihed investigators Lt. Dana McReynolds and Sergeant Angela O'Neal. They reported to the media in the Knoxville News-Sentin.eI that even after I was interviewed by these two individuals that the UT Police Department just did not believe my story. I told you the truth, and once again, you turned the truth into a lie. Vice Chancellor ini Rogers was quoted in the media this last Week that the University of Tennessee has a "black eye" because this incident. I agree, but the "black eye" is self inflicted. Now I would be remise if I did not also make a statement about my beloved Fraternity Pi Kappa Alpha which lost its recognition last Thursday because of actions by the University of Tennessee to suspend its recognition as a recognized University of Tennessee organization . Pirst, I Want to state that neither I nor any member of my iiaternity, Pi Kappa Alpha, have ever engaged in "butt chugging" or the use of alcohol enemas. These allegations have not only tarnished and attempted to destroy my life but all of the lives of the men of Zeta 3 Chapter of Pi Alpha at the University of Tennessee. Through this press release I want to speak to my haternity brothers across the world where ever you may be. On my oath that I took at the time when I was initiated, I swear to each and every one of you that every allegation of the gross and immoral activity of "butt chugging" or alcohol enemas never ever took place at the Pike House. We are men of integrity who pledged at the time of our initiation to always be true. I pledge you my word of honor as a Brother in Phi Phi Kappa Alpha. I can never thank the International Headquarters staff and the Supreme Council of this Fraternity for the love and support which they have given me and this chapter. To all our alumni and current active members of chapters across the United States and in Canada, I say to you that no such thing ever happened. Do not be led by the irresponsible media who would rather disseminate false information that creates sensation rather than to allow the truth to prevail. And to all the news media who have chosen to believe the falsehoods issued by the University of Tennessee, I say, "Shame on you." You need to go back to journalism school and take a good course in ethics. I find it interesting that during the entire time when I was a patient at theUniversity of Tennessee Medical Center from Friday, September 21, until Sunday, September 23, 2012, that not one, single investigator nom the University of Tennessee Police Department came to interview me. Not one. No one asked my side ofthe story until lwas requested to go to the University of Tennessee Police Department on Wednesday, September 26, 2012. I was interviewed by UTPD Lt. Dana McReynolds and Sergeant Angela O'Neal who then concluded that no wrong or crime had taken place other than consumption of alcohol at the Fraternity house. Quickly thereafter, the Knoxville News-Sentinel reported on Saturday, September 29, 2012 that "This case is closed." There is an old saying that when one door is closed, another one is opened. In this instance, when one file is closed, another opens. The movie he Wizard of Oz has many parallels to this vicious media event which has taken place at the University of Tennessee at Knoxville during the past week which has helped to destroy my life. First, Knoxville Police Investigator Patricia Tipton wanted so desperately for there to be a case involving me personally as a person who was "butt chugging" or ingesting alcohol through my rectum. She convinced herself that she "believed" that I had done this heinous act. That, Ms. Tipton, is a complete and total lie. You never had any evidence of any such thing taking place, and you totally distorted any information you gathered from my cousin, P. Carney. You purposely twisted and contorted information you gathered in order to create a false and misleading story. You personally have destroyed my life. Second, University of Tennessee Police Sergeant Anglea O'Neal perpetuated the lie as she conducted her investigation into this alleged incident. I was interviewed on September 26, 2012, by UTPD Lt. Dana McReyonlds in the presence of Sergeant O'Neal. During the interview I informed the University of Tennessee Police that I have never engaged in the activity which is called "butt chugging" or the use of an alcohol enema. That is the most gross idea I have ever heard. I would never do such a thing. I am a Christian who would never desecrate my body in that manner. To do so would be against God's law. Even after my interview where Sergeant O'Neal was standing in the interview room, she was quoted in the Knoxville News-Sentinel, "We just did not believe that." 4 Dorothy, we are not in Kansas anymore. We are at Tennessee at the University of Tennessee where lies trump the truth, and the lives of young people such as mine are sacrificed at the alter to the Volunteer statue. There is another analogy from The Wizard ofOz, and that is to "follow the yellow brick road, and that road leads straight to Andy Holt Tower, the main administrative offices at the University of Tennessee.
