QIS Diggfment of GIS Seattle City Light Transportation Memorandum of Agreement Street Improvement Project: 7"h Avenue Protected Bike Lane November 20, 2017 Purpose of the Agreement This agreement provides the street lighting scope, schedule, and project costs for Street Improvement Proiect: 7th Avenue Protected Bike Lane (Project). The Seattle Department of Transportation (SDOT) is overseeing the design 81 construction of this project that includes the installation and/or upgrades to the existing street light infrastructure owned and operated by Seattle City Light (City Light). This Memorandum of Agreement (MOA) outlines how SDOT and City Light will cooperate over the life of the Project. There are three areas of City Light participation: a. City Light will provide written review comments for the 60%, 90%, and 100% design review of all City Light work within the Project's limits of work; b. City Light's Scope of Work to be performed by SCL crews i.e. Inspections 8t System Commissioning; and c. City Light will provide necessary funding, as agreed upon by City Light BL SDOT to cover the cost of installation/upgrading of its infrastructure within the Project's limits of work. There are three areas of SDOT participation: a. SDOT will provide adequate funding to plan, engineer, and construct the Project; b. SDOT will ensure the acquisition of qualified contractor; and c. Provide full construction management services for the life of the Project. Project Location Description (Scope of Work) This is a Street Improvement Project on 7th Avenue between Westlake Avenue and Union Street. It includes construction of: bicycle, pedestrian, and traffic signal improvements including a one-way protected bike lane, new curb bulbs 81 ramps, sidewalk, pavement repair, landscaping, bicycle signals, and new signal mast arm poles. City Light Contribution Analysis: The City Light estimated costs after grant reimbursement (where applicable) of these improvements is: $374,000. A detailed bid item cost analysis will be attached to supplement the invoice. . Street Light Construction Elements: $208,719 Design/Design Consultant Fee: 63,932 0 Construction Engineering Fee: 59,605 a Construction Contingency Fee, if needed: 41,744 A progress payment worksheet in Excel format will be provided along with a copy of the executed progress payment. The cost to date of street light expenditures to be reimbursed to SDOT will be provided in Excel format. They will be determined as follows: The percentage of street light costs to be reimbursed to SDOT shall be per bid item to install, adjust, replace, relocate, and/or remove specified items. These percentages are as follows: 1. 100% street light only apparatus? such as luminaires, street light bracket arms, street light only poles and foundations, wiring and conduit; 50%joint-use hand holes Light poles); 33% wood poles); 50%joint trench; and City Light is considered a non?paying renter on strain poles. WPWN Other street light costs will include standard construction incidentals. For this project, they are: 1. Mobilization; Project Submittals 8L CPM Schedule Review and Approval; Erosion Control 8t Spill Prevention Plans Review and Approval; Survey; Traffic Control Plan and Traffic Control Labor; and 6. Project Closeout Manuals 8t As-Built. These costs are not bid item specific but are shared over all construction of the project. The City Light shared costs will be determined by dividing the total street light bid line item(s) cost by the total project bid item cost (less construction incidentals). The resulting percentage will be the percentage of the incidentals to be reimbursed to SDOT for street lighting. This percentage will also be applied to Construction Engineering and (design of plans, specifications, estimates, etc.) Grants do not include street light reimbursement. If they are applied to the cost of the street light system, SDOT and City Light will calculate the reimbursement rate based on eligible costs in the design and construction phases. The billing process is subject to change based on new processes established by the Summit Re- implementation. Funding: City Light will provide funding for the street light portion of this project as detailed cost in Attachment A of this MOA. SDOT will invoice City Light for the street light work and project costs. If the need arises, SDOT will seek and obtain written SCL approval prior to the use of contingency funds to ensure that SCL reviews and approves the request. Such written authorization will include a description of the work that is to be performed and shall specify the costs and fees to complete. Payment Terms: Final payment of all invoices, not to exceed 10% of the total street light project costs, will be withheld as retainage until the street lighting "as-built drawings" have been delivered to, reviewed, and accepted by Street Light Engineering, at MS S-9, South Service Center. The billing process is subject to change based on new processes established by the Summit Re? implementation. Other Provisions: Coordination between City Light and SDOT during design and construction will be followed through as Outlined in the August 2010 MOU for Street Light Governance. Project Schedule: Construction for this project is expected to be completed within 70 working days (plus suspension of work days) after the date of Notice to Proceed Date, anticipate in early January 2018, or by April 30, 2018. City Light and SDOT Responsibilities: Per Inter-Departmental Memorandum of Understanding on Street Lighting System Governance, August 2010; 1. All street lighting must be designed and constructed in accordance with City Light Standards; 2. Construction costs for pedestrian lighting are not City Light?s responsibility per council legislation; and 3. City Light shall inspect, test, and commission all street light systems. Ownership and Maintenance: Street lighting on this project consists of City Light standard fixtures. City Light shall own, operate, and maintain all City Light standard street light assets and City Light standard pedestrian lighting following physical completion of construction. City Light is considered a non-paying renter on SDOT's strain poles. Contractor will protect all assets during work per COS Standard Specifications 1- 07.17.
