Officer B. Vial, #12895, took 27 digital photographs of the scene. The photos were later transferred to a CD and booked into the Fresno Area CHP Office, photo log number 16-027. Officer J. Makel, #17842, and Officer G. Perez, #18865, attended the autopsies of Pass-2, Pass- 4, and Pass-5 on 02/03/2016. He went to sleep at around 1900 hours and 6 woke up at around 0430 to 0500 hours on 02-02-2016. He left his residence and drove to work. 7 He got to work and picked up the crew around 0700 hours. After picking up the crew he was 8 driving to the job site when the collision occurred. He is in good mental and physical condition. 9 He does not take any prescription or illicit drugs. He had not consumed any alcoholic beverages 10 in the past 24 hours. 11 12 Driver profile of P-2: 13 P-2 related he was at work on 02-01-2016, from 0800 hours until he got off work at around 1500 14 hours. After work he ran errands and got home at around 1800 hours. He remained at home, ate 15 dinner, watched television and went to bed at around 2200 hours. He woke up on 02-02-2016, at 16 0530 hours. He got ready for work and arrived at work at around 0700 hours. He prepared V-2 17 for the day’s work and left to pick up a load of rock at the Vulcan Materials Plant on SR-180 in 18 Sanger. He picked up the load of rock and was en route to deliver it when the collision occurred. 19 He is in good mental and physical condition. I contacted Palma who advised me that a co-worker of Pass-4's had visited the hospital and advised her that P-1 was a bad driver and that the seatbelts in the vans at the Conservation Corps were not in good condition. Palma provided with the first name of Harold and a phone number of Palma did not know Harold's last name or any further information. I attempted to contact Harold on 02-12-2016 at 1256 hours and spoke to his girlfriend who advised Harold was not available. I asked when he would be available and she advised tomorrow. I attempted to contact Harold on 02-13-2016, at 1035 hours. The phone was again answered by a female who identified herself as Harold's girlfriend. She again stated he was not available and she did not know when he would be off work. I attempted to contact Harold a third time on 02-13-2016, at 1530 hours. The phone was not answered and went to voicemail. If Harold is contacted at a later date, his statement will be written as a supplemental and attached to this report. STATE ENTS Party #1 was contacted at the scene and related, in essence, the following: He does not remember anything regarding the collision and blacked out when they were struck. The last thing he could remember was driving eastbound on SR-180 at approximately 65 mph. I asked P-1 if he remembered traveling on Reed Ave. or South Ave. and he stated, I asked him if he ever saw V-Z approaching before the collision and he related, "Maybe a flash." He could not provide any further information regarding the events that occurred during the collision or just prior to the collision. He was 5 coming from the Calaveras plant in Sanger. He drives this route all the time and is familiar with 6 the intersections. As he approached South Ave., he saw V-1 traveling eastbound on South Ave. 7 He thinks V-1 was stopped for the stop sign. At this time, he was about 200 to 300 feet from the 8 intersection. As he approached the intersection and was about 20 to 30 feet from entering the 9 intersection V-1 suddenly drove into the intersection right in front of him. It was so sudden he did 10 not have time to react. He hit the side of V-1 and felt the weight of V-1 pushing against the front of 11 his vehicle and V-1 came up onto the hood of V-2. He braked and was able to bring V-2 to a stop 12 on the east shoulder of the roadway. He turned off V-2 and immediately exited V-2. There were 13 already people stopped and around the scene trying to help the passengers of V-1. He 14 remembers seeing one guy from V-1 hanging out of the passenger side but he does not know 15 which passenger it was. He had no further information regarding the collision. 16 17 Passenger #1 (Christman): was contacted at the scene in the rear of a Dinuba Fire Department 18 ambulance. He related he was the right front passenger in V-1, which was driven by P-1 (Finnell). 19 He was dozing off and on and was not awake at the time of the collision. He was woken up by the 20 hard impact to V-1 from V-2. He does not know what road they were on or where they were at 21 when the collision occurred. I asked if he knew where the other passengers in V-1 were sitting. 22 He related that he only knew that Pass-2 and Pass-3 were sitting in the row of seats directly 23 behind him. He did not know where the other passengers were seated. No statement 10 was obtained. 11 12 Witness #1 (Hixson) was contacted at the scene and related, in essence, the following: He was 13 northbound on Buttonwillow Ave. approaching South Ave. He observed V-2 traveling southbound 14 on Buttonwillow Ave., north of South Ave. V-2 appeared to be traveling normal speed which he 15 estimated to be about 50 to 55 mph. He saw V-1 traveling eastbound on South Ave. approaching 16 the intersection of Buttonwillow Ave. He was about 300 feet from the intersection when the 17 collision occurred. W-1 is not sure if V-1 failed to stop for the stop sign or just pulled out in front of 18 V-2. V-2 hit the left side of V-1 and both vehicles came into the northbound lane directly towards 19 him. He immediately braked and was able to stop as V-2 came towards him. He thought V-2 was 20 going to hit him head on but V-2 came to a stop about 50 feet from him. He was on 6 his way back to Reedley and was traveling southbound on Buttonwillow Ave. He estimated he 7 was about 300 yards from the intersection when the collision occurred. He believes that V-1, the 8 van, was traveling southbound on Buttonwillow Ave. ahead of him. He believes V-2, the semi9 truck, was traveling eastbound on South Ave. He thinks V-2 was traveling about 35 mph or so. 10 He saw V-2 cross the intersection and hit V-1. When he got to the scene other people had 11 already stopped. Several people were with the person lying against the fence (Pass-5). He also 12 saw the trailer of V-2 had overturned and spilled rock all over the roadway. He pulled over and 13 called 911 but did not get out of his vehicle. He had no further information regarding the collision. 14 15 Witness #5 (Cuevas) was contacted by telephone on 02-23-2016, at 1653 hours. She related in 16 essence the following: On 02-02-2016, at about 0735 to 0740 hours, she had dropped her children 17 off at Great Western School. She was waiting at the stop sign to exit the school parking lot to 18 travel southbound on Frankwood Ave. She observed a large white van with an unknown type of 19 lettering on the side pass her southbound on Frankwood Ave. traveling very fast. She exited the 20 parking lot and traveled southbound behind the van. As they approached Lincoln Ave., she 21 observed the van pass a school bus through the intersection at Lincoln Ave. She thought at first it 22 was a medical transport van but is not sure. She got to her residence on Cambridge Dr. in 23 Reedley, which is just west of the intersection where the collision occurred. She heard the sirens 24 responding and was later looking on Facebook and saw photos of the collision. She observed the 25 van in the picture and it looked similar so she called into dispatch to report what she had seen. 26 She did not get a license plate for the van she saw and could not tell what the lettering on the side 27 of the van said. P-1 slowed 6 and stopped V-1 at the posted stop sign for Buttonwillow Ave. After stopping at the stop sign, P-1 7 failed to observe V-2 approaching the intersection southbound on Buttonwillow Ave. P-1 drove 8 V-1 into the intersection directly into the path of V-2, when it was not safe to do so due to V-2, 9 entering the intersection at the same time. Due to the suddenness of V-1’s entry into the 10 intersection, P-2 did not have time to apply the brakes or take evasive action prior to colliding with 11 V-1. The front of V-2 collided with the left side of V-1 in the intersection. P-2 was able to apply 12 the brakes of V-2 and both vehicles traveled in a southeasterly direction with V-1 being pushed by 13 V-2. V-1 and V-2 separated and V-1 traveled off the roadway and onto the dirt shoulder on the 14 east side of the roadway, south of South Ave. V-1 traveled across the dirt shoulder and collided 15 with the chain link fence bordering the southeast corner of the intersection. As V-1 was traveling 16 on the dirt shoulder, Passenger #5 was ejected from V-1 and landed on the dirt shoulder leaning 17 against the chain link fence in an unknown position. V-2 traveled in a southeasterly direction 18 partially onto the dirt shoulder on the east side of the roadway. As V-2 came to a stop, the rear 19 trailer of V-2 rolled over onto its right side and spilled its load of base rock onto the roadway. After 20 the collision, V-1 came to a stop on its wheels, on the dirt shoulder of Buttonwillow Ave., south of 21 South Ave., facing in a southerly direction. P-1 was stopped at the posted stop 13 sign on South Avenue at Buttonwillow Avenue. After stopping at the stop sign, P-1 failed to 14 observe V-2 approaching the intersection southbound on Buttonwillow Ave. P-1 drove V-1 into 15 the intersection directly in front of V-2, failing to yield the right of way to V-2. As a result, the front 16 of V-2 collided with the left side of V-1. The collision caused Passenger #5 to be ejected from the 17 passenger compartment of V-1. At 0630 hours, Witness #2 (Lara) and other crew members. started loading equipment to prepare for the day?s work. They left the Conservation Corps yard at approximately 0710 hours and proceeded to the Shell gas station on McKinley Avenue and Peach Avenue. Witness #2 (Lara) was driving the truck and trailer with the right front passenger, Witness #3 (Marchetti). Party #1 (Finnell) was driving Vehicle #1 (Dodge) with passengers Shaun Christman, Rhonda Shackleford, Justin Vanmeter, Serena Guadarrama, and Ronnie Cruz. Witness #2 (Lara) related they left the Shell gas station and were caravan-hing to a job site in Dinuba, CA, which consisted ofcutting sod. He was following behind Party #2 (Finnell) as he did the previous day. They took a different route than the day before and proceeded eastbound on State Route-180 until it turned into Reed Avenue. They continued southbound on Reed Avenue and then eastbound on South Avenue. They approached a stop sign at the intersection of South Avenue and Buttonwillow Avenue. Party #1 (Finnell) stopped Vehicle #1 (Dodge) prior- to the intersection. Witness #2 (Lara) related he came to an abrupt stop behind Vehicle #1 (Dodge), due to being in a conversation with Witness #3 (Marchetti). Witness #2 (Lara) heard screeching tires from Vehicle #2 (Peterbilt) just prior to the impact. Vehicle #2 (Peterbilt) collided with the left side of Vehicle #1 (Dodge). The impact caused Vehicle #1 (Dodge) to travel out of control into the chain link fence on the southeast corner of the intersection. Vehicle #2 (Peterbilt)came to a stop south of the intersection and the trailer tipped over spilling gravel onto the roadway. Immediately following the collision, Witness #2 (Lara) put the truck in park and began looking for his cell phone to call 911. Witness #3 (Marchetti) exited the truck and ran over to Vehicle #1 (Dodge) to check on the occupants. Witness #2 (Lara) located his cell phone and ran over to Vehicle #1 (Dodge). He called 911 to" report the collision and then called his supervisbr, while Witness #3 (Marchetti) was Continuing to check on the passengers. Witness #3 (Marchetti) cut Party #1 (Finnell?s) seat belt and helped extricate him from the vehicle. Witness #2 (Lara) attempted to get right front passenger, Shaun Christman, out of the vehicle but the door was jammed shut. He related rear passengers, Rhonda Shackelford and Justin Vanmeter, appeared to be deceased. Witness #2 (Lara) observed passenger, Serena Guadarrama, lying on the ground near Vehicle #1 (Dodge) and the chain link fence. An unidentified male civilian was next to Serena Guadarrama and checking her pulse. Prior to approaching the collision scene Witness #3 (Marchetti) called 911 to report the collision; he showed me the phone call 'on his cellular phone which was placed at 0813 hours. Witness #3 (Marchetti) then ran to the driver?s door of Vehicle #1 (Dodge) and contacted Party #1 (Finnell), who was conscious and trying to get out of the vehicle. WitneSs #3 (Marchetti) advised him to stay still and let him know help was on the way. Witness #3 (Marchetti) looked to the back. seats and noticed Justin Vanmeter was deceased. He related Rhonda Shackelford also appeared to be fatally injured and let out a long gasp as he was standing at the driver?s door with Party #1 (Finnell). Party #1 (Finnell) was still trying to exit the vehicle and Witness #3 (Marchetti) assisted him. Witness #3 (Marchetti) cut the seat belt which was holding Party #1 (Finnell) in the vehicle} He then held Party #1 (Finnell) "from behind, by holding under his arms. Witness #3 (Marchetti) then lowered him to the ground and stayed with him until emergency personnel arrived on scene. Witness #3 (Marchetti) related while he waited with Party #1 (Finnell) he noticed Serena Guadarrama lying on the ground a few feet behind Vehicle #1 (Dodge). With her was a middle aged white male, medium build with a hat, grey mustache, blue jeans, tan boots, and an unknown colored shirt. The white male was checking Serena Guadarrama?s pulse and holding her cheeks. asked Witness #3 (Marchetti) if he saw who was driving Vehicle #2 (Peterbilt) and he related he did not.
