The motel is located on the south side of the roadway and the main entrance faces west. The motel is a four story structure. POINT OF ENTRWEXIT: OFFICER INVESTIGATION: On the morning of the 22 nd of September 2017 around 09:09 Officer Bred Gamble and I, Officer Joe James. were dispatched to the Main Stay Suites located at 278? State Highway 361 in reference to a disturbance. Several subjects had gathered at the location demanding to be paid. The Main Stay Suites suffered heavy damage as a result of Hurricane Harvey. The entire four floors had to be gutted and new sheet rock and carpet replaced. The contractor for the job was Carl Scott. Scott originally hired Wellco as a sub?contractor to do the work. The sub-contractor was there for three weeks and only removed sheet rock and carpet from one half of the fourth floor. Scott terminated the contract with Welico and hired a new subcontractor that was United Machine Shop out of San Benito, Texas. The foreman is Angel Martinez. In the first week they had removed the sheet rock and carpet from the rest of the fourth floor and the third floor. Martinez hired several of the old employees from Wellco which are currently working for him. Several of the people that worked for Wellco did not get paid and they felt that United Machine Shop needed to turn in their hours to Wellco so they could get paid. Spoke with Scott. and he. hold rne that when the contract with Wellco was terminated the sub-contractor was paid in full. Apparently Wellco did not pay all of the employees that they had working for them. Some of the old employees went to San Antonio and got paid. Approximately fifteen people had gathered at the work?site demanding pay. Some of the subjects that showed up were relatives and they did not work for either sub- contractor. Some of the exeernployees that were out at the road had in fact worked for United Machine Shop. in the past week there have been multiple problems from these individuals at the work site. Last week there was a bomb threat (Case Number $700978) and one mate subject charged an employee with a hammer. The sub-contractor has been receiving threatening phone calls stating they were going to come over and assault them along with many other types of threats. Today a large number of subjects had massed at the location. Apparently someone had called the local television station, Telemunendo, which showed up at the site. Numerous officers, including the Department of Public Safety, were summoned to the scene to assist with the crowd. The subjects were informed that the ones that worked for United Machine Shop will be paid on the 2 nd of October 2017. The company turns in the time sheets after two weeks to the company and the following week they are paid. United Machine Shop took over the contract on the 8th of September 2017. The subjects became unruly and started yelling and causing problems. I remained at the scene to maintain order. The Chief of Police for the City of Ingleside allowed the subjects to stand in the right of way as a peaceful demonstration. Around 13:15 the subcontractor, Angel Martinez, and two employees were leaving the job site and were going to the library to turn in the hours so the employees could be paid. its they drove past the group, which had now gathered on the improved shoulder of the roadway, started yelling at the group. One male subject, identified by the three employees, as Andres Chacon Fernandez, had stepped out in the roadway and started yelling at them in Spanish. Fernandez used his ?nger as a gun and pointed it at them and he made the remarks that he was going to kill them and their families and do a drive by. Martinez turned around and came back to where i was sitting in my unit and wanted to file charges for the terroristic threats because they felt threatened. I started obtaining statements from Martinez, Patricia Tracey, and Tomas Acosta. Approximately six or seven subjects approached my location and I had to step in front of them to keep them away from Martinez. The subjects were demanding to speak with Martinez and I informed them that he did not want to speak with them and that they needed to move back. The group appeared agitated. i requested back up and asked that the Chief of Police respond to the scene. Officer Gamble arrived at the scene along with Chief Brent Stroman. advised him of the situation and it might be a problem because the suspect appeared to be a spokesman for the group. Additional units were dispatched to the scene from San Patricio County Sheriff* 5 Office and the Department of Public Safety. Two members of the United States Labor Board also showed up at the scene. Fernandez was eventually taken into custody for terroristic threats. The remaining subjects quickly cleared the scene. Officer Gamble transported Fernandez to the San Patricio County Jail where he was booked into the facility without incident. A complaint was prepared and a case was filed for Terroristic Threats. SUSPECT: FERNANDEZ, ANDRS CHACON, DOB Charge - Terroristic Threats, Pt; 22.07, Class Misdemeanor Cine signed complaint, one Probable Cause Statement, and three witness statements are attached to this case report. ADDITIONAL: My body camera and car video were downloaded to the system and tagged accordingly.
