WASHINGTON March Dear Mr. 16, 2017 Speaker: I ask the Congress to consider the enclosed appropriations request for Fiscal Year (FY) 2017 . The request includes an additional $30 billion for the Department of Defense {DOD) to rebuild the U . S . Armed Forces and accelerate the campaign to defeat the Islamic State of Iraq and Syria {ISIS), and an additional $3 billion for the Department of Homeland Security (DHS) for urgent border protection activities. This appropriations request would provide $24 . 9 billion in the DOD base budget for urgent warfighting readiness needs and to begin a sustained effort to rebuild the U . S. Armed Forces. The request seeks to address critical budget shortfalls in personnel, training, maintenance, equipment, munitions, modernization, and infrastructure investment . It represents a critical first step in investing in a larger, more ready, and more capable military force . The request also includes $5.1 billion in the Overseas Contingency Operations budget for DOD to accelerate the campaign to defeat IS I S and support Operation Freedom's Sentinel in Afghanistan. This request would enable DOD to pursue a comprehensive strategy to end the threat ISIS poses to the United States. In addition, this appropriations request would provide an additional $3 billion for DHS implementation of my executive orders on border security and immigration enforcement. The request would fund efforts to plan, design, and construct a physical wall along the southern border, and make other critical investments in tactical border infrastructure and technology. The request also proposes funding to increase immigration detention capacity, which is necessary to ensure the removal of illegal aliens from the United States. Finally, the request funds new recruiting capacity at DHS so that it may hire additional immigration l aw enforcement officers and agents. Plaintiffs claim that the defendents, the Department of Homeland Security (DHS) and US Customs and Border Protection (CBP), violated the National Environmental Policy Act (NEPA) by failing to update the environmental impact statement for the southern border. The plaintiffs also claim the defendents violated the Endangered Species Act by failing to ensure that the southern border enforcement program neither endangers protected spec ies nor destroys or adverse ly modifies critica l habitat. The memo outlines internal DHS guidance, and broadly expands the agency's enforcement efforts , including apprehending, detaining, and removing inadmissible foreign nationa ls, and targeting transnat ional criminal s participating in human smuggling, human traffick ing, drug trafficki ng, and crimi nal enterprises at the sout hern borde r. More spec ifically, the memo addresses key points, includi ng : Inadmissible Foreign Nationals and Detention. The memo requires foreign nat ionals who are fou nd inadmi ss ible under Section 235(b) of the INA (8 U.S.C. § 1225(b)) to be detained pending a final determination regard ing their removal from the US, with limited discretionary relief fro m detention, includ ing when the individual: • is removed from the US; • obta ins an order grant ing relief or protect ion from removal , or is dete rmin ed by DHS to be a US citizen, US national, Lawful Permanent Resident ( LPR ) (green card hold er), refugee, asy lee, or person holding temporary protected status (TPS ) or valid immigration status; • is permitted to withdraw his app licatio n for admission and departs the US ; • is cove red by a statute, binding settlement agreement, or order issued by a competent judicial or administrative authority compelling release; • is granted parole under Section 212(d)(5) of the INA (8 U.S.C. § l 182(d)(5)); or • establishes credib le fear of persecution or torture before an asylum officer or immigration judge (as well as establishing his identity, that he is not a security risk, that he is unlikely to abscond, and that he will comply with any additional conditions of release ). Expanding Agreements with Law Enforcement. The memo commits DHS agencies, including CBP and (ICE), to entering agreements under Section 287(g) of the INA (8 U.S.C. § l 357(g)) that authorizes state or loca l law enforcement to perform the functions of an immigration officer in investigating, apprehending, or detaining foreign nationals in the US. Expedited Removal. Th e memo extends expedited removal under Section 235(b)(l)(A)(iii)(I) of the INA (8 U.S.C. § 1225(b)(l)(A)(iii)(l)) to foreign nationals found anyw here in the US who have not been admitted or paroled into the US, who are inadmissible under Section 212(a)(6)(C) or (a)(7) of the INA (8 U.S.C. § 1182(a)(6)(C) or (a)(7)), and who cannot show that they have been continuously physically present in the US for the two years immediately prior to the determination of their inadmissibility. Asylum. The memo calls on United States Citizenship and Immigration Services (USCTS) to expa nd the mission of the Fraud Detection and Nationa l Security (FDNS) Directorate to includ e fraud detection, deterrence , and prevent io n in asy lum processes as well as other immi grat ion benefits. T he memo narrows the availabi lity of the agency's parole authority, fou nd in Sectio n 212(d)(5) of the INA (8 U.S.C. § l l 82(d)(5)) to limit paro le to case-by-ca se determinations of urgent humanitarian need or sign ificant public benefi t. Unaccompanied Minor Children at the Border. Whil e acknowledg ing that unaccompan ied minor chi ldren who aITive at the borde r are given spec ial protection and additional rights whil e thei r admissib ility is being determi ned, the memo ca lls for stricter enforceme nt against any individuals who direct ly or indir ectly facilitate the smugg ling or trafficking of the ch ildren into the US. This initi ative includes the parents of such childr en, who may be pres ent in the US without author izat ion and may have sought the assistance of sm ugglers to be reunited with their children . Sessions issued a memorandum calling on federal prosecutors to consider enhanced prosecu tion for certain criminal immigrants. A fore igners improp er entry to the US under Sect ion 275 of the IN A (8 U.S.C. § 1375) as a felony charge when the fore ign national ha s one of the following : • two or more prior improper entry convictions; • at least one imprope r entry conviction with aggravati ng circ umstanc es such as a felony crim inal history, gang membership or affiliation, multip le prior vo luntary returns, prior remo val, deportation, or exclusion, or other circumstances; or • been found to have knowingly entered a mar riage for the purpose of evading any immigration law provision. Reentry to the US after removal under Section 276 of the INA (8 U.S.C. § 1326), prioritized on tho se: • convicted of an aggravated felony; • wit h a prior crimina l history indicating the person is a danger to public safety; • with one or more administrative or criminal immigration violation; or • having other aggravating circumstances. Aggravated identity theft and fraud and misuse of visas, pe rmits and other documents under Sections 1028A and 1546 of Ti tle 18 of the United States Code, in relation to one of the other immigration violations. Assaulting, resisting, or impeding officers under Section 111 of Title 18 of the United State s Code. The Attorney General 's memorandum closely with DHS rep rese ntative s. requires each federal distric t to designate a Border Security Coordinator to work EO 13767: Practical Implications The Executive Branch ha s the authority to expend only limited funds towards a wall at the US border. The wall's construction will continue only if Congre ss appropriates sufficient funds to the project. It is not clear whet her Congr ess will make the required appropriations. Reassignment of asylum officers and immigration judges to detention facili ties is likely to add to the already significant delays in proce ssi ng immigration cases, particularly for individuals who are not currently detained. DHS implementa tion expands the geographical and temporal reach of CBP and ICE officers in removing foreign nationals from the US exped itious ly (w ith lim ited rights). It increases the use of detention . It also mak es it harder for individual s to show eligib ility for asy lum and limit s which fo reign national s might qualify for parole . State and Local "Sanctuary" Policies Limiting Participation in Immigration Enforcement (Mar. 23, 2017). EO 13768: Current Litigation Several lawsuits have been filed, principally challenging the EO 's penalties against sanctuary jurisdictions. In the first decision on a challenge to the government's penalties for sanctuary juri sdictions, a federal district judge found that Section 9(a) of the EO, which would eliminate certain federal funds for those jurisdictions, is likely to be found unconstitutional and that those ju1isdictions would suffer irreparable harm if the EO goes into or remains in effect , and issued a nationwide injunction against that section (County of Santa Clara v. Trump and City and County of San Francisco v. Trump, 2017 WL 1459081 (N.D. Cal. Apr. 25, 2017)). The Northern District of California has created a webpage with information , filings, and orders related to these cases and other related cases . Suits include: City and County of San Francisco v. Sreynuon Lunn, SJC- 12276 (Mass. Feb. 8, 2017). EO 13768: DUS Implementation and Government Actions DHS issued a memorandum implementing EO 13768 on February 20, 2017. The memo outlines interna l DHS guidance, and broadly expands the agency's enforceme nt efforts, including apprehending, detaining, and removi ng foreign national s who are present in the US without authorization. The memo sets the agency's enforcement prioritie s, and does not exempt any group of removab le foreig n nationals from enforcement. More specifically, the memo addresses key points, including : Enforcement Priorities. The memo makes clear that no group of foreign nationals are exempt from the enfo rcement priorities. However, foreign nationals should be prioritized for removal based on the cr iteria set in the EO's Section 5 (see EO 13768: Public Safety in the US Interior (Penalizing Sanctuary Jurisdictions) above). Reinstating Secure Communities . The memo rescinds the Priority Enforcement Program instituted in 2014 and reinstates the Secure Communitie s Program under Section 287(g) of the INA (8 U.S.C. § 1357(g)). Prosecutorial Discretion. Prosecutorial discretion will be applied on a case-by-case bas is, and will no longer be used to exempt groups of unauthorized foreign nationals except as permitted by DHS in the memo. At this time, the Deferred Action for Childhood Arrivals (DACA) program remains in effect (for more information on DACA, see Practice Note, Deferred Action for Childhood Arrivals) . Establishing Victims Liaison Office. The memo establishes an office within ICE, Victims of Immigration Crime Engagement (VOICE), to liaise with the victims of crimes committed by removable foreign nationals. The office will facilitate engagement with victims and their families to provide information regarding the offender's immigration and custody status. To establish this office, ICE is directed to reallocate all funds dedicated towards advocati ng for unauthorized foreign nationals and to terminate programs for outreach and advocacy services to unauthorized foreign nationals. Terminating Privacy Rights. The memo terminates Privac y Act rights and protects to anyone with is neither a US citizen nor an LPR. On April 27, 2017, DHS published an updated Privacy Policy Gu ida nce Memorandum in light of EO 13768 (Memorandum 2017-0 I (Apr. 27, 20 I 7)) . The new memorandum reaffi rms the difficulty that DHS has in light of its need to collect persona lly identifiable information (PTT)for individuals who may now no longer be covered by the Privacy Act, particu larly in light of co mpeting legal requ irements and the likelihood that those who are not covered by the Privacy Act when the PII is acquired may become so later, after acquiring LPR status or US citizensh ip. The memorandum states that all indiv iduals will be treated in accordance with the Fair Information Practice Principles (FIPPs) and estab lishes protocols for DHS staff to follow when eva luating whether PIT can be release d. The memorandum also includes an appendix describing all laws and author ities used to evaluate whether individuals have privacy rights. On March 20, 2017 , ICE issued its first Declined Detainer Report, identifying jurisdictions that declined to hold or transmit foreign nationals subject to ICE detainers. The report is expected to be issued monthly. ICE announced the official launch of the VOICE office on April 26, 2017. On May 22, 2017, the Attorney General issued a memorandum implementing EO 13768. In the memorandum , the Attorney Genera l: Determine s that, with the Secretary of Homeland Security, sanctuary jurisdictions are limited to those that "wi llfully refuse to comply with 8 U.S.C. § 1373," echoing the language of the EO 's Section 9(a). Determines that Section 9(a) applies only to federal grants administered by the Department of J ustice (DOJ) or DHS (and no other source of funding). AM~ ~ © 2017 Thomson Reuters. Advises that the DOJ may tailor future grants to "promote a lawful system of immigration " where authorized to do so. Section 9(a) is blocked by a nationwid e injunction (see EO 13768: Current Litigation). In addition, some states and localities have taken actions to either create, support, or ban sanctuary jurisdictions (see, for example, Tx. S.B. 4 (May 7, 2017), Miss. S.B. 2710 (Mar. 27, 2017) and 2017 Vt. Laws No. 5 (S. 79) (Mar. 28, 2017) ). EO 13768: Practical Implications Despite a focus on crimfoal foreign nationals, and particularly serio us crimes, enfo rcement continues against all fore ign nationals who are or may be in the US without authorization. ICE officers have implemented questionable tactics to locate targets, including a presence at courthouses and schools. Litigation regarding the constintutionality of withholding federal funding continues with sanctuary jurisdictions and may be resolved at the Supreme Court level. EO 13780: Protecting the US from Foreign Terrorist Entry II This EO was issued on March 6, 2017. The chart below summarize s its major provisions. On March 7, 2017, Hawaii filed a seco nd amended compla int in its suit agai nst EO 13769, arg uing that the new EO presented essentially the same harm as EO 13769 (Hawaii v. Trump, No. l: 17-C Y-00050 (D. Haw . Feb. 3, 2017); see Other Litigation Inv olving EO 13769). Hawaii asked that the court reverse the stay of proceedings in the case and issue a TRO to blo ck implemen tation of the new EO. On March 15, 2017, the Di strict Court of Hawaii issued a TRO blocking implementation of EO l3780' s Sections 2 and 6 (the travel ban and limit s to the refugee program) on a national basis (20 L7 WL I Ol 1673 (D. Haw. Mar. 15, 20 17)). The TRO was converted into a preliminary inj unction by order of the court o n March 29, 2017 (Hawaii v. Trump, 2017 WL l 167383 (D. Haw. Mar. 29, 2017)) . The gove rnment appealed the prelimin ary injun ction grant to the Ninth Circu it, and oral argument is schedul ed for May LS, 20 17. The N inth Circuit has created a webpage with informati o n, filings, and orders related to this case. Furthermore, the District Cour t of Maryl and issued a nationwid e preliminar y injunction barring implementation of the travel ban portion of the EO (Int'! Refugee Assistance Project v. Trump, 2017 WL 1018235 (D. Md. Mar. 15, 2017)) . Th e court in Mary land found that Section 2(c) of the EO is likely to be found an uncon stitutional violation of the First Amendment's Establishment Clau se. In a filing with the US Court of Appeals for the Fourth Circuit on March 17, 2017, the US indica ted it would appeal the prelimin ary injunction (Int'! Refugee Assistance Project v. Trump, No. 17- 1351 (4th Cir. Mar. 17, 2017)) , and on April 10,2017, the Fourth Circuit agreed to hear the appea l en bane (No. 17-1351, 8: 17-cv-00361-TDC (4th Cir. Apr. 10, 2017)) . The hearing is scheduled for May 8, 2017. The Fourth Circui t has created a webpage with informat ion, filings , and orders related to this case. On Ma y 25, 2017, the Fourth Circuit , sitting en bane, issue d a decision upholding the nationwid e injunction against the trave l ban portion of the EO (Int'/ Refugee Assistance Project v. Trump, 2017 WL 2273306 (4th Cir. May 25, 2017)) . The court evaluated the plaintiffs' Estab lishment Clause claims under Kleindienst v. Mandel (408 U.S. 753 (1972)), as modified by Kerry v. Din (135 S. Ct. 2128 (2015) ), and determined that the plaintiff s showed that the government issued the trave l ban in bad faith, rendering it subject to cons titutional scrutin y. Appliying the test in l emon v. Kurtzman (403 U.S. 602 (1971)), the court agreed with the district court that the prim ary motivation of the travel ban was religion , and that the plaintiffs were there fore likely to succeed on their claims under the Establishmen t Clause. Th e circuit court overturned the distri ct court's injunction against the Pres ident as an indiv idual. The DOJ issued a statement that it will seek review of the decision with the US Supreme Court, and on June 1, 2017, the government filed a petition with the Supreme Court re ques ting a review of the deci sion (Trump v. int 'I Refugee Assistance Project, No . 16-1436 (S. Ct. June 1, 20 17)). Another district court refuse d to issue a TRO barring the travel ban (Sarsour v. Trump, 20 17 WL 1113305 (E.D. Va. 2017)). The court in Sarsour found that the plaintiffs did not establish that they were likely to succee d on the merit s of the ir claim s, that the balan ce of hard ships were in their favor, or that the public interes t favored an injun ct io n of the EO . Other litigatio n include s Hujf v. Trump, 2017 WL 102 1401 (N.D. Ill. Mar. 16, 20 17) and Arab American Civil Rights League v. Trump, No. 2: I 7-CV - 103 10 (E.D . Mich. Jan. 3 I, 20 L7). EO 13780: Government Implementation On Mar ch 17, 2017, the US Departmen t of State issued a cable to all posts implement ing more stringent review and backg ro und check procedu res for visa applicants based on EO 13780 . The cable provides guidance on informat ion gathering and requesting cleara nces for certain visa applicants, includin g Iraqi national s. Those sections cover the travel ban and changes to the refugee program. One injunction has been upheld by the Foutth Circuit, sitting en bane, while the other is under consideration by a panel of judges in the Ninth Circuit (which heard arguments on May 15, 2017). The constitutionality of at least the EO's travel ban is likely to be decided by the US Supreme Court. If the injunctions are overturned, the new EO will have the greatest impact on refugees, and on the ability of individuals from the designated countries to obtain visas or travel to the US, and allows for the ban to be extended for all or some of the designated countries, and the addition of other countries based on the recommendation of the Attorney General and the Secretaries of State and Homeland Security. Whether impleme nted or not, individuals from the designated countries are likely subject to greater scrutiny in visa issuance and requests for entry. If the injunction issued by the District Court of Hawaii is overturned, the EO also has a significant impact on the US Refugee Admissions Program (USRAP), by reducing anticipated refugee admissions in FY 2017 by more than half and halting the program for 120 days. Impacted individuals should consider how the new EO impacts their own ability or the ability of family members to travel to the US. Furthermore, all travelers may expect to see increased screening at US border posts and may experience greater scrutiny or delays at US entry. EO 13788: Buy American, Hire American This EO was issued on April 18, 2017. The chart below summarizes its major immigration-related provisions. EO 13788: Practical Implications Th e EO does not actually change any law or policy related to immigration, but indic ates a sensibility in the current admin istration that may affect case processing as agency employees exerc ise discret ion in reviewing nonimmigrant and immigrant visa petitions and PERM labor certificat ion applica tions before any regulatory or guidance changes. The EO's suggest ion that the H- lB program reserve visas on ly for the most-skilled or highest paid benefic iaries is far from the current state of the reg ulations on the H-lB program and would require a new regula tory undertaking to impleme nt. While some fraud or ab use is present in the curre nt H- IB program , the exist ing USC IS and DOL contain a comprehensive scheme intended to prot ect US workers. This EO also calls for a comp rehens ive review of all employ ment-related immi gration rules and guidance, includin g both nonimmi grant and immigrant visa classifications and the PERM labor certification program. This is a compl e x system that is not limited to a simple quest ion of hiring foreign workers, but also implicates the American education syst em and how US businesses operate in the global economy. EO 13769: Protecting the US from Foreign Terrorist Entry (Travel Ban and Refugee Program) This EO was issued on January 27, 2017, and has been revoked effective March 16, 2017. Any other information related to public safety and security including information on the immigration status of foreign nationals charged with major offenses. In addition, several EO provisions reinforce a commitment to the current law or require compliance with the current law. EO 13769: Curren t Litigat ion Several lawsuits have been filed, and temporary stays have been issued in four locations against discrete portions of the EO. Much of the early litigation focused on violations of due process rights owed to visa holders, and particularly applying the entry ban to LPRs. Several litigants challenging EO 13769 have amended their claims to challenge the Administration's revised travel ban EO (see EO 13780: Prot ecting the US from Fo reign T errorist Entry II). Washington v. Trump : Ninth Circuit The most significant litigat ion on EO 13769 is Washington v. Trump (2017 WL 526497 (9th Cir. Feb. 9, 2017)). In this decision, a panel of three judges on the US Court of Appeals for the Ninth Circuit unanimously upheld the district court's grant of a TRO blocking enforcement of key aspects of the EO. The Ninth Circuit denied the government's emergency motion for a stay of the TRO, finding that the government: Was unlikely to succeed on the merits. Did not show that it would suffer irreparable damage as a result of the court's failure to grant the motion. While the district court scheduled briefing for a permanent injunction, the Ninth Circuit has also scheduled briefing on whether the case should be reviewed en bane by the Ninth Circuit. On February 16, 2017, the Ninth Circuit issued an order staying en bane proceedings based on the government's statement that the Administration intends to issue a new Executive Order rather than pursue its appeal of the travel ban stay (No. 17-35105 (9th Cir. Feb. 16, 2017)). On March 8, 2017, the government's voluntary motion to dism iss its appeal in this matter was granted, and on March 15, 2017, the Ninth Circuit denied its own motion to reconsider the stay en bane, with five judges dissenting (Washington v. The court further found that the balance of equities favor Virginja, and that the public interest is served in enjoining an order that likely violates the Establishment Clause. (2017 WL580855 (E.D. Va. Feb.1 3, 2017).) Darweesh v. Trump, 2017 WL 388504 (E.D.N. Y. Jan. 28, 2017) (granting emergency stay ofremoval). Tootkaboni v. Trump , 2017 WL 386550 (Jan. 29, 2017) (granting a seven-day TRO that, among other things, limits detention or removal of certain refugees and individuals from the designated countries). The court subsequently refused to extend the TRO (Louhghalam v. Trump, 2017 WL 479779 (D. Mass. Feb. 3, 20 I7)). Doe v. on Tuesday, February 21, 2017, from 2:00 PM to 3:00 PM. DHS is taking advantage of a free meeting room offered by the hotel on Monday prior to the Energy Exchange. DHS is teaming with DOE to help expand the Energy Exchange into other areas in sustainability . An agenda for the Energy Exchange and the Monday all hands meeting will be coming out shortly. Through the Energy Exchange, DOE is offering training for energy, sustainability and enviromnental issues. CRSO Field Efficiencies is looking a type of civilian base closure and trying to consolidate services and operations more efficient and effective . This action will reduce space and share space across the Department. This should benefit Components with shared training and firing ranges. Issues include environmental compliance , possibly environmental baseline surveys . Dr . Pohlman wants to make sure the committee is aware of the activity and be prepared to assist their Component. There exists an exemptio n to environme ntal requirements . Other executive orders dea l with hiring new agents. These other actions are not exempt from environmenta l requirements. SEP is working on policy on how to approach the issues. We would apprec iate ICE, USCG and CBP insights to an overall approach for NEPA compliance . SEP is networked into the action and working to make sure the correct documents will be accomplished. Feel free to contact SEP to get the facts versus what is being issued in the news. USCG commented that base realignment and closme for DOD stared with a statute. Does DHS anticipate a statute for this action or will be it internally driven? DHS does not anticipate any new legislation for field efficiencies. Board guidelines are being developed by the Field Effic iency Team . SEP is determin ing how best to execute NEPA for these actions and anticipates guidelines for when NEPA is triggered, how it is executed and how to properly use CA TEXs. Right now the focus is on how to make us of existing requirements , identify the gaps and then fill the gaps. Steve White, DHS Energy Manager, has been reassigned to lead field efficiencies . SEP sought and received approva l to hire a new GS-15 Energy Manager and expects a vacancy announcement to be released shortly. Once advertised, SEP will ensure the announcement is shared with everyone. Thanks to everyone for their hard work! USCIS: Nothing exc iting to report. USSS: Working to fina lize the OSPP. USSS will conduct an Earth Day celebration on April 17th at their headquarters building located in DC. If any committee member would like to attend please contact Tom Frank lin at USSS at least one week prior to the 17th for access (no later than April 10th). Tom recently paid a visit to the Smithsonian Environmental Research Center in Edgewater MD (https://serc.si.edu /about-us). They have a new building that is US Green Building Council LEET Platinum. They will hold an open house in May. USCG : There is a proposa l to use old ships for border wall. This is a unique suggestion for disposal of outdated ships. NPPD: No update. S&T: The OSPP is completed and under review. FEMA : The OSPP is being reviewed by the management chain. Efforts are underway to identify applicable sustainability awards and assign someone to submit the nomination package. The FEMA EMS implementation plan is under another round of review as part of the annual update process AMERICAr\ pVERSIGHT 2 DHS-001-569-000615 Page 2 of 5 DHS-17-0045-A-000615 ICE: OSPP is done and going through coordination channels for approva l and signature. There is a lot of growth and a lot of changes that is making the office extremely busy. Due to the success of the on-sight SPCC training, ICE extended the training and is offering at other locations. It has proved to be a valuable tool for the operators and environmenta l office. FLETC : Pursuing a detailed feasibility study to make significant ene rgy conservation improvements across FLETC. Efforts include installing solar at Cheltenham MD as well as drilling a test well for potential geothermal use and replacing heating oil with natura l gas. The final feasibility study should be ready in April. The OSPP is complete and is out for signature. CBP: Two new employees have been hired, Brett Merkel, for compl iance section and Monsoor Rashid for the energy section. Both individuals participated in the commit tee meeting. The OSPP is making its way through the management chain. The Environmental Office is scheduled to brief the senior leader on Monday, March 27. CBP asked if SEP participates in the Federal Energy Utility Billing Group. This would fall under the energy program and Pete suggested contacting Marie Britt for that information. Energy Exchange/SEP Sponsored Summit The Energy Exchange will be held August 15-17, 2017, in Tampa Florida. On Monday, August 14, SEP will host a summit for the energy, environmenta l and environmental planning/historic preservation functional areas. Operational Sustainability Performance Plan SEP appreciates all the work Compo nents are putting into the new OSPP Template. Completed OSPPs are due to SEP by March 31, 20 17. When sending the signed OSPP, please also prov ide a word version to enable SEP to more easily cut on paste the information into the Strategic Sustainability Performance Plan. Chesapeake Bay Executive Order Update The current proposed budget from the Administration is calling for the elimination of federal funding for the program that coordinates Chesapeake Bay cleanup efforts, which includes the Chesapeake Bay Program . It is unclear how and if this affect EO 13508 "Chesapeake Bay Protection and Restoration" . On February 23, 2017 a bipartisan group of 17 members of bay states' congressional delegations sent a letter to President Trump requesting that the FY 2018 budget request be at the same $73 million level.( attached) The Chesapeake Bay is the largest estuary in the United States and third largest in the world. In December of 2014, the president signed the Chesapeake Bay Accountability and Recovery Act (CBARA) into law. The Act requires the Office of Management and Budget (0MB) to submit an annual report on federal and state funding toward environmental restoration in the Chesapeake Bay watershed . During its first three years, only those programs that cost at least $300,000 must be reported. In December of 2016, the 0MB issued its first Chesapeake Bay Restoration Spending Crosscut. Five of the seven agencies that make up the Federal Leadership Committee for the Chesapeake Bay, of which DHS is a member, invested $536.4 million in watershed restoration in fiscal 2016. The Department reporting of zero do not meet the definitional limits of this crosscut and were not reported. Development of the DHS Chesapeake Bay Program funding continues . The document will be drafted as an "other implementing document" and follow the format and vetting requirements outlined in DHS Instruction Manual 112-01-00J-OJ, Rev 02, DHS Dir ectives System and support DHS Directive 023-02: Environmental Management Program (Revision OJ). Climate Change Update The Office of Policy is leading the development of the DHS Arctic Strategy . The DHS Arctic Strategy is being designed to provide the framework, vision, goals, and objectives for seamless, innovative mission delivery as the Arctic operational environment changes and human activity increases. Of the four draft goals Goal #3: Preserve and Protect Arctic Communities and the Ecosystem, is directly related to the sustainability and environment program . It is anticipated that the document will be entered into the formal review process in the next few weeks. One caveat is the March 22, 2017 release of the Council on Foreign Relations task force report on its Arctic Working Group and briefing meeting with the Secretary Kelly and the Office of Policy .. Scheduling of the DHS Climate Resilience Executive Steering Committee and Director Group meetings is pending. Further discussion with leadership is needed prior to setting the path forward .
