STATE OF INDIANA IN THE HAMILTON CIRCUIT COURT SS: COUNTY OF HAMILTON CAUSE NO. 29C01-1806-JD-785 IN RE THE MATTER OF: DAVID J. MOORE, A Child Alleged to be a Delinquent Child DECORUM ORDER This case has generated public interest and media attention. In light of this interest, the Court has established several rules of conduct and guidelines for decorum for the people involved in these delinquency proceedings, and for those observing the proceedings, to maximize public access to these proceedings While also maintaining decorum and dignity throughout the proceedings. The overall purposes of theses rules and guidelines are to secure the juvenile?s constitutional right to fair and impartial proceedings; to permit the public and the press to exercise their First Amendment rights; as applicable, to protect the identity and privacy of individuals; and to protect juveniles, witnesses, and parties from unnecessary commotion and confusion. IT IS THEREFORE ORDERED that the following rules and guidelines for the conduct of the delinquency proceedings shall be followed. If it appears to the Court that any regulation or any matter covered by this order requires modi?cation, the Court may rescind or modify that portion of the order. SECURITY Security during these proceedings shall be the responsibility of the Hamilton County Sheriff. Any questions or concerns about security issues shall be directed to the Hamilton County Sheriff by calling Vicki Dunbar, Public Information Of?cer for the Hamilton County Sheriff? Department, at (317) 776-4104. Any person entering the Hamilton County Government and Judicial Center, other than an employee of Hamilton County, must ?rst pass through a magnetometer and, if necessary, will be subject to a search of his or her' person and any container in his or her possession. This search is conducted subject to the standard security protocols in place by Order of the Hamilton County Commissioners as implemented by the Hamilton County Sheriff. The Sheriff of Hamilton County may require that any individual entering the courtroom of Hamilton Circuit Court and! or Hearing Room 3D provide identification before entering the courtroom or hearing room. Any person entering the courtroom of Hamilton Circuit Court and/or Hearing Room 3D during the course of these delinquency proceedings may be subject to an additional search of his or her person, or of any container in his or her possession, if the personnel of the Hamilton County Sheriff conducting courtroom and/or hearing room entry?point security consider such an additional search to be necessary. Except for the personnel of the Hamilton County Sheriff assigned to provide courtroom security during the course of these delinquency proceedings, no person shall possess a ?rearm or other weapon in the courtroom of Hamilton Circuit Court and/or Hearing Room 3D during the course of these delinquency proceedings. SPECTATOR SEATING The seating in the public gallery of the courtroom of Hamilton Circuit Court and/or Hearing Room 3D is limited to approximately 56 seats. These seats shall be available to the public, including members of the media, on a ?rst-come, first-served basis subject to compliance with courtroom entry?point security requirements. PARKING No reserved parking spaces are available to members of the public or the media. Paid public parking spaces are available in lots designated by the City of Noblesville. All street parking is regulated by the City of Noblesville. SECURITY PERSONNEL The Sheriff of Hamilton County or his designee shall be responsible for designating the use of any reserved security seating in the Courtroom. RULES OF CONDUCT Pursuant to the Court?s inherent authority to assure the proper administration of justice, the Court sets forth the following rules of conduct for these delinquency proceedings: 1. All members of the media and public must be seated during court proceedings. No person shall be admitted to the gallery during the proceedings if there is no seating available. 2. Members of the media and public may begin entering the courtroom 15 minutes before the start of any court session. 3. Once a court session begins, except for emergency purposes, only court personnel, counsel, counsel?s support staff, and Witnesses will be allowed to enter the courtroom. A person may leave the courtroom during a court session; however, once a person leaves the courtroom during a session, the person may return only upon approval of security personnel. Entrance and exit during a court session must be accomplished without disruption. Disruptions of the proceedings shall not occur because they distract the judge, counsel for the parties, other spectators, and court personnel. If a disruption occurs, the person or persons creating the disruption may be removed from the courtroom for such period as ordered by the Court. 4. Quiet and order among those observing the trial shall be maintained at all times during the course of the trial. Audible comments of any kind by any spectator during the trial sessions and provocative or uncivil behavior within the courthouse at any time will not be permitted. Violation of this provision may result in the removal of the person or persons in violation from the courtroom or from the Hamilton County Government and Judicial Center. 5. The wearing of pins, buttons, signs, clothing, and similar materials in the Hamilton County Government and Judicial Center that express support for or against the alleged delinquent child in this case is prohibited. 6. Only court personnel, witnesses, parties, and counsel and their supporting staff shall be permitted inside the bar railing. No member of the public or representative of the media shall be permitted inside the bar railing unless speci?cally invited by the Judge or Bailiff. 7. Although children may be present in the courtroom, court proceedings require spectators to exercise prolonged silence and to restrict their movements. Supervisors of children who cannot accommodate these requirements for quiet and restricted movement will be required to remove such children from the courtroom. 8. No newspapers or magazines will be permitted in the courtroom. 9. Members of the media and the public shall not bring electronic or audio recording devices or cameras of any type into the courtroom. Members of the media and the public shall not use laptop computers, cellular telephones, pagers, or personal digital assistants (PDAs) in the courtroom; if such equipment is in the courtroom, it shall be maintained in the ?off? position at all times. Any violation of this provision will result in the equipment being con?scated. Con?scated items may be retrieved at the end of the court session from Orval Schierholz, Hamilton County Court Administrator. 10. During the course of these delinquency proceedings, all hallways, as well as all and exits for all of?ces and facilities in the Hamilton County Government and Judicial Center, must remain unobstructed for the necessary ?ow of traf?c to and from these of?ces and facilities so that public business may be conducted. Spectators and media for these delinquency proceedings shall not obstruct any entrance or exit point. 11. No interviews or broadcast activities shall take place in the courtroom or adjacent area. Instead, media must conduct interviews outside of the Hamilton County Government and Judicial Center. Media interviews outside of the Hamilton County Government and Judicial Center are not regulated by this order and are, instead, subject to the administration of the law under the jurisdiction of the Sheriff of Hamilton County and/or Noblesville Police Department as applicable. All counsel are directed to comply and inform their clients, staff, and witnesses of the terms of this order regarding interviews. Any person violating these rules of conduct will be subject to the discipline of the Court, including, but not limited to, the contempt authority of the Court, under which the person may be, among other things, permanently barred from the courtroom or incarcerated.
