DATE: November 21, 2017 2017-Fl-0002 DISCIPLINARY ACTION TO: JOSHUA GRANADA, 16647 DISCIPLINARY ACTION Violation of O.F.D 1108, Official Business Confidential SUSTAINED Violation of O.F.D 1144.15, Members shall not: Commit an act recognized by State law as a crime, commission of a crime or violation of a Statue or Ordinance. SUSTAINED Violation of O.F.D 1144.19, Commit MALFEASANCE (doing an act that ought not be done) SUSTAINED SPECIFICATION 0F FACTS On August 27, 2017 Engine and Rescue 10 responded to 5780 Major Blvd. for an EMS call O.F.D. 2017- 42820. Engineer Granada was driving Rescue 10 and was present on this run. During the call Engineer Granada took his cellular phone out and began an audio recording of part of the incident, including recording the patient. Later, at the dining room table Engineer Granada played the recording for other Station 10 personnel including personnel assigned to Tower 10. Tower 10 was not on the call listed above. Engineer Granada did not keep the information from the EMS call confidential and did share this information with others which it was not intended for. This violated O.F.D. 1108. By recording a patient without his or her knowledge or consent in a hotel room where there would normally be a reasonable expectation of privacy, Engineer Granada violated Florida State Statue 934.03. This violated O.F.D. 1144.15 By recording the EMS call with his personal cellular phone and playing the recording for the crew at Station 10, Engineer Granada violated O.F.D. 1144.19 ISCIPLINARY ACTION As a result of your action(s), the discipline in this case is TERMINATION OF EMPLOYMENT. Members of the Orlando Fire Department shall be responsible for compliance with all rules and regulations, for maintaining discipline and morale, for prompt reports, for obedience to orders of supervisors, for performing duties fully and properly, and for the honest and efficient conduct and administration in every respect of their official position. Violations to any of the above will not be tolerated and may result in more stringent discipline if there are any further violations. RIGHT OF APPEAL If you wish to appeal this action, refer to Orlando Fire Department appeal process, outlined in GO. 39-2015, 8.0. The justification for the appeal must be submitted in writing to your Bureau Commander within three (3) calendar days of receipt of this Notice. Upon written notification that the Orlando Fire Department appeal process has been denied or not upheld, you may appeal this decision to either the Civil Service Board within ten (10) calendar days, in accordance with Rule 12.01; OR, if you feel this action violates the Contract, you may file a grievance within ten calendar dwaysywassoecified in the Collective Bargaining Agreement.
