Mr. Herrera has since withdrawn from both the Clean Funding part of the Clean Elections program and the election itself. However, I would request that you review these documents to determine whether other issues are apparent. Mr. Herrera ?led an initial set of qualifying contributions forms with the Arizona Secretary of State on March 6, 2018. Exhibit 1. The Secretary of State forwarded a sample of those forms to the Maricopa County Recorder for validation, and, later the full?set of ?led qualifying contribution forms. On March 15, 2018, Keely Varvel, Chief of Staff for the Maricopa County Recorder, contacted Arizona Secretary of State Director of Election Services Eric Spencer and me by email. She stated that ?We have found 101 out of 200 invalid forms due to signatures that don?t match voter registration records, lack of voter registration and even inclusion of people who are records show are deceased. We plan to send the list of invalid signatures to Af?liated Forensic Laboratories to check our analysis.? Exhibit 2. Mr. Herrera ?led a supplemental set of qualifying contribution forms with the Secretary of State on March 26, 2018. Exhibit 3. These slips were veri?ed by the county. The Secretary of State approved Mr. Herrera for Clean Funding on March 27 based on the combined veri?ed total of the two ?lings. Exhibit 4. Based on the concerns expressed by the Maricopa County Recorder, the Commission convened a special meeting on April 3 to review whether to issue funds to Mr. Herrera. At that meeting, Mary Fontes, voter registration director for the Maricopa County Recorder?s of?ce, con?rmed Ms. Varvel?s email. Exhibit 5. Speci?cally, she told the Commission that both non-matching and invalid signatures were found, including deceased signers and voters whose registrations had been cancelled. Id. Ms. Fontes said that she had con?dence in the County?s review but that copies of the forms would be turned over to a private forensics lab. Id. Ms. Fontes, who has 15 years of experience in elections and voter registration, told the Commission that ?nding 101 out of 200 signatures invalid was unusual. Id. The Commission voted to withhold payment to Mr. Herrera pending the outcome of the forensic analysis. Id. Subsequently, Mr. Herrera informed Commission staff he was withdrawing from the Clean Funding part of the Clean Elections System. He later withdrew from the election. We used to work together at the Secretary of State's Of?ce. So very nice to see you today. MS. FONTES: Hi. I'm Mary Fontes with the Maricopa County Recorder?s Of?ce. I'm the voter registration director. Ihave 15 years of experience in the election world and voter reg. COMMISSIONER KIMBLE: Ms. Fontes, could you outline what you found in this case that caused you to have some concerns? MS FONTES: The majority of what caused our concerns were non-matching signatures. So we found invalid signatures. We also found signatures of people who we have record of being deceased and then those -- those would be considered not registered because they were cancelled. And then we have some that were out of district- Of course, we have three different reports. So if you want totals, I can give them to you. For our ?rst review of the 5 percent, we had 16 that were not quali?ed. I can't remember how many were turned in. I don't have that information with me, and I apologize for not having that. Then the second review after the 100 percent, we had -- let's see 137 that were not valid. The majority of those were invalid signatures. And then the third, the 2 the Secretary of State's Of?ce, we look at each one 2 supplemental, I believe the signatures or the slips 3 that?s sent to us. First, of course, is the 5 percent 3 were much cleaner than the ?rst two rounds that we 4 random. 4 looked at, and we had a total of 30 that were invalid 5 We look to see if they're registered, if 5 out of the supplementals. 6 they are within the district that the candidate is 6 ACTING CHAIRWOMAN CHAN: Commissioner 7 running for. Two weeks later, I was alerted that I didn't qualify based on signatures that just were invalid. So then I requested an audit from the County Recorder's and after a few days ?nally received that. What I found I went through each and every single one and I found -- COMMISSIONER PATON: Excuse me. I can't hear. MR. HERRERA: I'm sorry. I have no control over how somebody signs their name, but at this point, I?m willing to go out and get an af?davit from each every single person on here to clear my name because it's extremely aggravating for me as a candidate to try and deal with this and then also be campaignng at the same time. I realize the politics behind it, believe me, but I also feel that I'm going to go out to each and every single of these people and get an af?davit and say, did you sign it or not? And this time, now that I know that the rule speci?cally reads that their signature must match the voter registration ?le, which nowhere in the Clean Elections manual does it say that -- it does say signature verification, just for the record, and that's for us candidates to identify. Speaking with Sara Larsen when I took the class, I asked her speci?cally what rules clarify. And she said that the rules, they're complex between the Clean Elections manual and the state statute manuals, which I understand. It?s upon us. All I want to ask at this point is to be given the chance to rectif'y this and any discrepancy that may exist. And, like I said, you know, I have this. The only information that I received, the full slip veri?cation list from the County Recorder's, was the number of qualifying contributions, and then also the reason: out of district, no sign date. One was thrown back because it didn't have a date, which is valid. Out of district. One said signed before 1022511 7-10226z39 that a few things stood out to me. First of all, Line Item 66, signature does not match in the report, and 66 is my wife's contribution. 93 was considered a duplicate. I requested that to be eliminated, but then when I got the report, it says signature does not match. Again, for 103. And the Secretary of State's Of?ce recognized that and they apologize for it, but it doesn't help me in this case. Because what happens when they do a duplicate, they take it out and they put a blank form in, but unfortunately, when I received this report and then these, they didn't match up to their count. Their count didn't match up. So there?s three that I know that are questionable. I haven't checked each one to verify their validity, but I do know that my wife's is, obviously. You know, if I can't get that one veri?ed, then I don't know what else to do. So I'm here today just to represent myself, to clear my name and to be asked for the opportunity to clear this up. You know, I'm prepared to do what I have to do. When they ?rst told me about it, I was a little frustrated, and then I went out myself and got them myself and people are more than willing to do that. Now I?m at this stage where I don't know what Page 23 10127554029201 Page 25 ?ling. I don?t know what that means. And others said not registered, out of district and signature doesn't match. So it doesn't say -- tell me which one. The only thing I can do is just go through a full veri?cation on these myself and do an analysis myself and identify which ones they are at the Maricopa County Recorder's Of?ce so I know that their computers are obviously up to date, I'm hoping. Madam Chair, Commissioners, just really brie?y to recap, I think that, you know, one of the things to understand here -- and I appreciate Mr. Herrera's frustration. I -- in fact, regardless of what we are able to establish as a matter of fact, I share his frustration because the Clean Elections Act is written in a way where the Commission is not generally the decider of who quali?es for Clean Elections funding. The purpose of assigning that duty to the Secretary of State is so that the Secretary of State does the duty and the Secretary-of State's Of?ce then is the Commission is one step removed from the process so that the Commission is not put in a position where it is both approving folks for funding and also then regulating those folks. So this is a safeguard that is put in place that requires the Secretary of State to act on information that it has and, in this case, it's self-evident the Secretary of State did not do that. And so Mr. Herrera is in a position where he's frustrated. I will say I am frustrated. I think 10:35:15-10:36:40 Page 32 and to the electoral process both are duties that the Commission should act on to take a pause here, determine what we can from the county, from Mr. Herrera, to establish the facts, and then we can proceed appropriately with whatever needs to happen from that point. So that's my recommendation. That remains my recommendation, and I would ask that you for a vote to withhold funding at this time. And if you have any legal questions, I would just remind you that Paula Bickett from the Attorney General's Of?ce is here for your -- for your -- if you need any questions answered.
