Synopsis of Incident1 On Saturday, November 25, 2017, at approximately 7:30 p.m. in front of 135-32 40 Rd. Flushing, NY (hereinafter referred to as “the subject location”), the subject, Yang Song a/k/a “JD Ponytail” a/k/a “Sissi” (Female/Asian, 38 years old, DOB: 3/6/1979 NYSID: 12750828J) fell or intentionally leapt from a fourth floor balcony landing on the sidewalk located in front of said subject location. Ms. Song was transported to New York Presbyterian Hospital (Queens) by EMS and on Sunday, November 26, 2017 at 8:04 a.m. was pronounced dead after having suffered multiple facial fractures, a fractured right femur, and a severed carotid artery. On Wednesday, November 15, 2017, at approximately 8:08 p.m. an anonymous male caller’s complaint was reported to the 109 Precinct and he reported in sum and substance that, prostitution was taking place at 135-32 40 Rd. Flushing, NY on the 4th floor, within the confines of the 109 Precinct, “where females were offering massages, but were selling intimacy.” On Thursday, November 16, 2017, at approximately 2:30 p.m. IMOSDET1 of the Queens VICE Enforcement Squad, contacted the caller and was informed by said caller that, he had recently observed multiple Asian women standing in front of the subject location attempting to patronize male subjects to get them to the third floor2 of the location for the purpose of prostitution. On Tuesday, November 21, 2017, at approximately 8:00 p.m. IMOS-DET1 conducted a DAS Lite3 computer check of the location which revealed approximately one hundred forty-two (142) 911 calls at the subject location, along with 43 arrests, with the latest arrest dated September 27, 2017, for the defendant, Yang Song, who offered and agreed to perform sexual intercourse on IMOS-UC3 for a sum of seventy ($70) dollars of United States Currency at the subject location. The defendant was arrested by RMOS-PO1 of the VICE ENFORCEMENT DIVISION (Queens), charged with violating PL 230.00 Prostitution, under arrest no. Q17643263, Docket No. CR-038585-17QN, and arraigned in Queen Criminal Court before Judge HJ1 in Court Part: AR-1.45 1 The synopsis of the incident is based on a review of video surveillance, audio recordings, and Member of the Service (“MOS”) interviews, as well as NYPD reports. 2 135-32 40 Road is a four story walk-up building, with a commercial establishment on the ground level and three levels of residential apartments located above the ground level. Investigations later revealed that the caller was referring to the 4th story of the building when referring to the third floor. The anonymous caller was later identified and re-interviewed by the Queen District Attorney’s Office. The initial complaint was received via a 311 call to the New York City Mayor’s Office on Monday, November 6, 2017, at approximately 10:45 p.m. 3 The NYPD DAS Lite computer check run by IMOS-DET1 showed a date and time stamp of Wednesday, November 2017 at 20:29:06 hours. The verified report revealed a total of one hundred-forty two (142) 911 call records, which depicted 911 calls reported to have occurred from Thursday, December 18, 2008 through Wednesday, November 15, 2017. Of the 43 arrest records, found, the last arrest indicated was that of the subject, Yang Song on Wednesday, September 27, 2017 at 18:20, under arrest no. Q17643263. The computer check further indicated seven (7) domestic incident reports at the subject location between Thursday, May 2001 through Sunday October 6, 2013, none of which included Yang Song as a named complainant or suspect. 4 Docket No. CR-038585-17QN was assigned to Criminal Court Deputy Bureau Chief ADA Pamela Byer in Court Part AP-8. At the time of the subject’s death, the next court adjournment date was scheduled for December 1, 2017 for compliance to complete five counseling session at Restore Program. The subject had completed four sessions and was scheduled to complete her final session on November 29, 2017. 5 On Thursday, October 13, 2016, Yang Song alleged in a complaint to the 109 Precinct that an unknown male Hispanic, approximately 5’10 with a heavy set build who she had agreed to give a massage had sexually assaulted her at gunpoint at the subject location. She further indicated that the unknown male displayed a blue a gold shield in the shape of a star. Complaint No. 2016-109008716 was generated and the case was referred to the NYPD’s Internal Affairs Bureau Police Impersonation Unit for investigation. A wanted posted was generated as a result of video surveillance obtained from the location and a retired U.S. Marshall, C2 (M/H, ) surrendered himself to the U.S. Marshall’s Office in Manhattan on October 27, 2016. On October 28, 2016 a line-up procedure was conducted and C2 was placed in seat position number two (2). Upon viewing the line-up Yang Song selected the individual seated in seat position number four (4). Based on the misidentification by Ms. Song, C2’s arrest was voided and he was released from police custody. A DNA abandonment sample from a water bottle was obtained from C2 and submitted to the Office of the Chief Medical Examiner for testing. C2’s sample was compared to samples taken from Ms. Song’s clothing from the date and time of the incident. On April 14, 2017, a final laboratory report ( ) was generated where OCME concluded that with Page 5 of 27 On Wednesday, November 22, 2017, at approximately 9:00 p.m., IMOS-DET1 and IMOS-SGT1 surveilled the subject location and at approximately 9:15 p.m. conducted a vertical patrol of the subject location, but did not observe any evidence of prostitution being conducted. IMOS-DET1 did, however, observe on the second floor a posted handwritten sign in Chinese, which he later had translated, which he believed to state in sum and substance, there are no girls on this floor, please go to the 3rd floor.6 On Friday, November 24, 2017, at approximately 6:55 p.m., IMOS-PO1 of the Queens North VICE Squad was present when an undercover officer called TELEPHONE1 to make an appointment for a sexual encounter with a female, who identified herself as “Sissi” and informed the IMOS-UC3 that the cost was one hundred twenty ($120) dollars of United States Currency per hour and that the IMOS-UC3 was to call her when he reached the subject location of 135-32 40 Rd. Flushing, NY. IMOS-DET1 subsequently conducted a DAS Lite on the phone number TELEPHONE1, which revealed arrest information pertaining to the defendant, Yang Song, who was arrested and charged on September 27, 2017 for prostitution at the subject location, and that said phone number belonged to the defendant, Yang Song. On Saturday, November 25, 2017, at approximately 6:30 p.m. inside of the Queens VICE North College Point base IMOS-SGT1 and IMOS-PO1 both of the Queens North VICE Squad organized a tactical meeting for VICE TEAM 1 related to seven (7) KITE7 locations which they suspected were engaged in prostitution operations in Queens County. During the meeting the team discussed the color of the day, officer safety, individuals wanted by the 109 Precinct and 109 Precinct’s Detective Squad, KITE locations, and operational code words and distress signals. The team agreed that the code word would be the signal given by the primary undercover to the field team to indicate a positive buy agreement. KITE: 2017-109-20372, which was listed on the tactical plan corresponded with the subjected location at 135-32 40 Road and was listed as the fifth location on the tactical plan. At the conclusion of the meeting, IMOS-SGT1 indicated to the team that they would proceed to the nearest KITE location, which was the subject location at 135-32 40 Road. THIS PORTION OF THE PAGE WAS INTENTIONALLY LEFT BLANK respect to all samples submitted on the Yang Song case, “[t]he donor to the bottle submitted for C2 is not the source of the DNA in all samples where comparisons could be made.” As a result, on April 20, 2017, the NYPD Internal Affairs Bureau deemed the case closed. 6 ADA Bettis had the sign translated by QDI1 of the QDA Detective Squad as well as QDA1, both of whom are fluent in English and Mandarin/Cantonese and can translate both written and oral Mandarin/Cantonese to English. Both QDI1 and QDA1 translated the sign to state, “Attention, the driving school is on the third floor next door.” 7 Kite locations or complaints are generated as a result of multiple complaints regarding possible illicit activity (drug-related or prostitution) taking place at a specific location or neighborhood. Page 6 of 27 Upon completion of the meeting, the team dispersed and went to their tactical positions in the immediate vicinity of 135-32 40 Road. The vehicle and team role assignments consisted of the following: 8 At approximately 7:15 p.m., after the team had taken up their tactical positions, IMOS-SGT1 indicated that IMOS-UC1 conducted a positive test of the Covertracker9 device after which she gave the “green light” to begin the operation. The primary undercover, IMOS-UC1 was observed by the undercover team exiting the vehicle and approaching the front entrance of the subject location. IMOS-UC1 approached the subject location and entered the first floor hallway where he indicated that he encountered a female Asian who he identified as (“JD Ponytail”) and inquired about the cost for sexual intercourse. The subject subsequently led IMOS-UC1, upstairs to the fourth floor. As he followed JD Ponytail he observed video surveillance equipment in the stairwells. JD Ponytail then opened the apartment door marked 3F (hereinafter referred to as “the subject apartment”) and upon entering, IMOS-UC1 observed additional surveillance equipment in the living room area of the subject apartment. 8 IMOS-DET1 and IMOS-UC3 were the only officers identified from the November 25, 2017, Queens VICE Enforcement Team as having been previously involved in an arrest related to the subject, Yang Song. Both officers had been involved in a VICE operation which lead to the subject’s September 27, 2017, arrest at the subject location, in violation of PL 230.00. 9 The Covertracker is a recording device used that transmits audio one-way via Bluetooth capability. Page 7 of 27 10 IMOS-UC1 and Subject walking up from ground floor IMOS-UC1 and Subject standing in front of #3F Upon entering the subject apartment, the subject and the IMOS-UC1 entered a bedroom located to the immediate left of the apartment entrance. Once IMOS-UC1 and the subject were in the bedroom, IMOS-UC1 indicated that JD Ponytail stated, in sum and substance that, she would charge him eighty ($80) dollars of United States Currency in exchange for sexual intercourse. Upon making the agreement, IMOS-UC1 stated in sum and substance to the subject that, it was cold and asked to use the bathroom. As IMOS-UC1 walked out of the bedroom towards the bathroom, he asked the subject “do you have any ,” (indicating a positive buy agreement to the field team) to which the subject replied “what!” IMOS-UC1 then entered the bathroom in an attempt to notify the field team to move in; however, when he attempted to close the door the subject held the door open, stood in the doorway and stated “you can pee with the door open,” to which IMOS-UC1 replied, “this is bad service.” DVR System IMOS-UC1 and Subject inside of 3F on way to bathroom IMOS-UC1 inside bathroom and Subject holding bathroom door open IMOS-SGT1, IMOS-PO1, and IMOS-DET2 in the lead vehicle indicated that at approximately 7:20 p.m. they overheard the IMOS-UC1 transmit the designated code word via the Covertracker indicating a positive buy agreement, prompting the team to move their vehicles closer to the subject location. Upon returning to the victim’s bedroom, JD Ponytail questioned IMOS-UC1 stating, in sum and substance, why 10 Video Surveillance from Cameras 1-4 were obtained pursuant to a search warrant executed on a DVR system that was observed inside of the subject apartment. The camera system had four separate cameras and a total of nine video clips. Cameras 1, 3, and 4 depict the stairwells, while camera 2 depicts the inside of apartment 3F. Page 8 of 27 are you not taking off your clothes, are you a cop, to which IMOS-UC1 replied, no. IMOS-UC1 then again reiterated that he did not appreciate the service and retrieved his hat from the bedroom and proceeded to the apartment entrance, where JD Ponytail opened the door, pushed him out of the apartment, and stood in the doorway as IMOS-UC1 walked down the stairs and closed the door. The subject (Yang Song) holds apartment door open for IMOS-UC1 to exit IMOS-UC1 observed walking down the stairs as Yang Song stands in doorway. IMOS-PO1 stated that the three vehicles attempted to respond to the front of the location, but encountered traffic on 40th Road, which prevented them from driving to the front of the location, prompting IMOS-PO1, IMOS-DET1, IMOS-SGT1, and IMOS-DET2, to exit their respective vehicles and proceed to the Page 9 of 27 subject location on foot. The field team entered the ground floor at approximately 7:25 p.m. and proceeded up the stairs to the third floor in the following order: IMOS-DET1, IMOS-SGT1, IMOS-DET2, and IMOS-PO1. As the field team were walking up the stairs they overheard a door shut and observed IMOS-UC1 walking down the stairs towards them. IMOS-UC1 then pointed at apartment marked “3F” indicating the location where the subject “JD Ponytail” was located. IMOS-DET1 followed by IMOS-SGT1 IMOS-DET2 followed by IMOS-PO1 IMOS-PO1 running up the first stairwell IMOS-DET1 conversing with IMOS-DET1 IMOS-UC1 points apartment out to VICE Field Team 1 Page 10 of 27 Upon reaching the subject apartment, IMOS-DET1 knocked repeatedly stating in sum and substance POLICE, OPEN UP, which went unanswered. IMOS-DET1 indicated that he heard movement behind the door, as he continued to knock and request the door be opened.11 IMOS-SGT1 indicated that it was at this point that she requested the breaching tools, which were located in the designated lead vehicle. Page 13 of 27 A black cord was observed hanging from the top ledge of 135-32 40 Road, which draped past the corner of the apartment balcony, down to the air conditioning unit and open apartment window located on the floor directly below the subject apartment. Front View of building located at 135-32 40 Road (photograph taken from 40 Road) IMOS-UC1 proceeded down the stairs and to the front entrance to exit the building with IMOS-PO1 behind him. As IMOS-UC1 made a right as he walked out of the building towards Main Street, he observed a large object fall from an unknown location above him and land on the sidewalk approximately ten feet in front of him and immediately recognized the large object to be the subject, “JD Ponytail”, who he had engaged in the positive buy prostitution agreement moments before. IMOS-UC1 immediately turned in the opposite direction and began walking towards Prince Street, as IMOS-PO1 and the remainder of the field team who had not yet entered the building ran to the sidewalk where the subject had landed. The field team never gained entry into the subject apartment prior to the subject’s fall. He further indicated that he exited and turned to the right and observed a female Asian, lying on her right side in the fetal position on the sidewalk in front of the subject location with extensive damage to her face and head, conscious but unresponsive. At approximately 7:32 p.m., an officer from the field team called for an ambulance for the victim and EMS arrived at approximately 7:37 p.m. While EMS tended to the victim on scene and prepared her for transport, IMOS-DET2 indicated that he spoke to IMOS-UC1 who provided him with a description of the subject, JD Ponytail, which tentatively matched the description of the Asian female being transported by EMS. At approximately 7:40 p.m., EMS transported the subject to New York Presbyterian Hospital (Queens), where she initially began receiving treatment for a blocked airway due to multiple facial fractures. 12 With regards to the surveillance video obtained from the exterior of 135-32 40 Road, it was determined that the DVR is accurate as to the date; however, the time stamp is off by approximately one (1) hour and thirty (30) minutes fast. Page 15 of 27 IMOS-PO1 on the radio and walking up to the area where the victim had fallen The above redacted photo depicts the victim immediately after her fall. Due to the nature of the victim’s injuries and out of respect for the victim’s family said photo has been redacted. At approximately 9:00 p.m., the injured woman was positively identified as JD Ponytail, who IMOSUC1 had engaged in a conversation related to the exchange of $80 for sexual intercourse inside of the subject location and followed into the subject apartment, based upon his description given of a “female Asian, approximately 5’5, 125lbs, 35 years old, black hair, light skin tone, black outer jacket and red scarf.” At that time, the hospitalized subject’s status was listed as “arrested” for violating, NYPL § 230.00 Prostitution, under arrest no. Q1765254613. 13 The subject’s arrest number Q17652546 was later voided upon her death. Page 16 of 27 Later that evening, the field team and responding NYPD personnel gained entry into the subject’s apartment where they found a credit card belonging to Yang Song and observed a DVR system and monitor actively recording the stairwells inside of the subject location. The DVR system was secured by the NYPD and a search warrant was drafted to search the subject location for any and all recorded video surveillance, hard drives, video storage devices, and any other device capable of recording and storing video. The warrant was signed on Sunday, November 26, 2017, at 4:10 p.m. by The Honorable Judge HJ2 of the Queens County Criminal Court, and immediately executed. On Sunday, November 26, 2017, NYPD’s Force Investigation Division (“FID”) responded to the subject apartment and upon searching the rooms in the subject apartment observed an unknown Asian female hiding on the south side facing balcony in the second bedroom. RMOS-DET1 of FID interviewed the unknown woman with a Mandarin interpreter from the 109 Precinct. The unknown female, during the interview identified herself as C114 (F/A, 47 years old, ) and stated in sum and substance that she was from China and arrived at the apartment on Handwritten statement from C1 Saturday, November 25, 2017, at approximately 6:30 p.m. to visit her friend named “ ”. C1 was unable to provide proper identification and further informed RMOS-DET1 that, when she arrived she met a woman, who was later identified as Yang Song, who informed her that her friend “ ” was not at home and told her that she could wait inside of her friend’s bedroom until she arrived. C1 further stated that she did not interact with or notice anyone else while in of the apartment and when she heard knocking on the door she became afraid so she went to hide on the rear facing balcony. C1 further stated that, she and “ ” became friends in China and that she has been in the United States for approximately six months on a visa. C1 later wrote a statement, which was translated from Mandarin to English by a RMOS-PO2 of the 109 Precinct. At the conclusion of the interview, C1 was released. RMOS-DET2 and RMOS-DET3 of the NYPD Crime Scene Unit later responded and processed the scene under run # 2017-50, and the scene was photographed and the scarf and headband worn by the subject, Yang Song were recovered and vouchered. The subject, Yang Song underwent extensive surgery to clear her airway and stop the arterial bleeding caused by a severed carotid artery and as of Saturday, November 26, 2017 at approximately 10:15 p.m. hours was listed in critical but stable condition at the surgical ICU on the 7th floor of New York Presbyterian Hospital (Queens). On Sunday, November 26, 2017, at approximately 8:04 a.m. the subject’s condition dramatically 14 Video surveillance later obtained from the DVR system revealed that C1 and an unknown male had entered the subject apartment before IMOS-UC1and the subject, Yang Song. Video surveillance further revealed that C1 entered the second bedroom with the unknown Asian male and remained in said room during the incident, never coming out to interact with IMOS-UC1 or the subject. Additionally, video surveillance showed a nude C1 exiting the bedroom and walking into the living room area after the subject ran to the balcony area. C1 is further observed walking back and forth into the bedroom and then watching the DVR monitor which prompted her to frantically put on her clothes and rush the unknown male out of the apartment. The unknown male is seen walking down the stairwell past two 109 Precinct Police Officers and out of the subject location. C1 is then observed returning to the bedroom where she was later found by FID. Page 17 of 27 deteriorated and was pronounced deceased by C3 and assigned ME Case No. Q17-26419. On Monday, March 19, 2018, Medical Examiner, C4 of the Office of the Chief Medical Examiner finalized Yang Song’s autopsy report, under OCME No. Q17-026419. C4 indicated that the cause of death for Yang Song was blunt force trauma to the head, neck, and extremities and further indicated that manner of death as, accident.15 IMOS-UC1 Incident Time Line from FID’s Preliminary Investigation Worksheet III. Inspection of the Scene This New York City Police Department (“NYPD”) Officer Involved incident occurred during the evening of Saturday, November 25, 2017, in front of 135-32 40 Road. This address is located within the Flushing section of Queens County which lies within the confines of the 109 Precinct. The incident location is both commercial and residential, with Roosevelt Avenue one block north of 40th Road. 40th Road is a oneway street which runs into Main Street. This commercial area consists mainly of massage parlors, restaurants, and a large retail center (New World Mall). 135-32 40 Road is a four (4) story building, with a store front on the ground level and three floors of residential apartments above. On the Southside of the building lies the Flushing-Main Street LIRR station on the Port Washington Branch of the Long Island Rail Road (“LIRR”). Inside of the subject apartment, there are two bedrooms located on the opposite ends of the apartment, a living room/kitchen, as well as two balconies (one of which faces 40 Road and the other is located on the rear of the building facing the LIRR station). 15 It is plausible that the Yang Song either intentionally leapt of accidently fell from the balcony, as there are no witnesses to corroborate either possibility. Page 18 of 27 IV. Review of Video Surveillance During the operation, several members of the Queens VICE field team recalled observing video surveillance cameras inside the stairwell area of the subject location. On Sunday, November 26, 2017, at 4:10 p.m., The Honorable Judge HJ2 signed a search warrant to seize, search and download the contents of the DVR system found inside of 135-32 40 Road. The warrant was executed on Monday, November 27, 2017, and the contents made available to the Queens County District Attorney’s Office. The video surveillance from November 25, 2017, depicted the first floor landing at the top of the stairs, subsequently stairwells leading up to the remaining floors, as well as surveillance of the inside living room area of the subject’s apartment. NYPD additionally recovered video surveillance from the exterior ground level of 135-32 40 Road, which depicted the outside sidewalk area in front of the subject location on the incident date and time. The video from the exterior ground level of 135-32 40 Road was determined to be approximately one hour and thirty minutes fast.16 V. Review of Audio Recording (Covertracker) Worn By IMOS-UC1 A twenty-one minute and nineteen (21:19) second audio recording was obtained from the Covertracker worn by IMOS-UC1on Saturday, November 25, 2017. The audio recording contains an audio check, IMOSSGT1 giving the green light to begin the operation as well statements made by the undercover (both in English and Mandarin) before, during, and after the subject’s fall. Approximately three minutes and three (3:03) seconds are the Covertracker is turned on, IMOS-UC1 is heard making contact with a female speaking Mandarin. In English, the female is overheard asking if IMOS-UC1 is a cop, to which he replied, no. At approximately three minutes and forty-seven seconds into the audio, a door is closed and the female voice again asks if IMOS-UC1 is a cop or not, to which he laughs and again replied, no. IMOS-UC1 then engages in conversation with the female in both English and Cantonese, and at approximately four minutes and eleven (4:11) seconds into the audio recording, IMOS-UC1 says the word in English, to which the female replies, what! Soonafter, IMOS-UC1 and the female continue to engage in discussion, with voices raised for one to two seconds. At approximately six minutes and eleven (6:23) seconds into the audio, IMOS-UC1 is heard making contact with the field team and informing them in English, which apartment the subject was in. At approximately seven minutes and three (7:03) a loud thud is heard on the audio recording. IMOSUC1’s statements after the loud thud included his observations of Yang Song during their initial encounter, the agreement between Yang Song, his signal to the field team, and his subsequent observations of the victim after she fell to the ground in front of him. The last eight minutes and forty-six (8:46) seconds remaining on the audio recording, included comments made by IMOS-UC1, IMOS-UC2 as well as an unknown officer discussing the victim’s possible injuries. VI. Investigation into Witness Interviewed by the New York Post On November 26, 2017, the New York Post published a article written by Tina Moore, Reuven Fenton and Stephanie Pagones, titled Prostitute Dies Trying to Evade Cops by Jumping Out of Window. The New York Post interviewed an unknown woman with regards to the death of Yang Song and the New York Post printed the following with regards to her statement: 16 A video compilation DVD was made with regards to the surveillance videos obtained. Due to the sensitive nature of this incident the faces and bodies of witnesses/participants were blurred to protect their identity and privacy. Note: FID has indicated that Cameras 1, 2, 3, and 4 are motion activated camera which record continuously when there is motion present. This was observed when portions of the video from the DVR system appear to “skip” during portions of the video surveillance. Page 19 of 27 A woman working at a nearby jewelry store said the victim had just gotten out of jail four months ago and confided to fellow massage-parlor workers that she would “kill herself” before being arrested again. On November 30, 2017, at 3:30 p.m., RMOS-DET1 and RMOS-DET4 of FID conducted a follow-up interview of a woman they indicated fit the description of the witness who provided the statement to the New York Post. They spoke with the woman with the assistance of the woman’s daughter, C5, who informed the detectives that she was not at the location on the date of the incident and that she read about it in the paper. She reiterated that she did not speak to anyone from the press and never spoke to the deceased. RMOS-DET1 indicated on Thursday, March 22, 2018, that no further search for any other individuals who may similarly fit the description of the individual who provided the statement to the New York Post was conducted. On December 1, 2017, at the request of ADA Suzanne Bettis, QDI1 of the Queens County District Attorney’s Office Detective Bureau canvassed the vicinity of 135-32 40 Road at approximately 10:45 a.m. He entered the subject location and all doors were shut and locked. He went next door to 135-32 40 Road, 2nd floor and interviewed two workers, C6 and C7. C6 indicated that she had seen the subject in the photo downstairs for a few months looking for customers. C7 indicated that he had seen the subject in the photo downstairs 7 to 8 months. Both workers indicated they never spoke to Ms. Song. QDI1 interviewed the manager at ADDRESS2. The Manager C8 stated she had seen the subject for more than two years walking up and down 40 Road looking for customers, but that she does not know her and has never talked to her. QDI1’s investigation further revealed there was no jewelry store on 40 Road between Main Street and Prince Street, which was the location of the witness who gave the statement in the NY Post article. On March 28, 2018, QDI1 of the Queens County District Attorney’s Office Detective Bureau canvassed the vicinity of 40th Road in Flushing, NY, specifically between Main Street and Prince Street, ADDRESS2 and ADDRESS3. QDI1 interviewed C9 who was stationed at a small stand in front of ADDRESS2. C9 sells inexpensive jewelry and flowers at the stand and indicated that she has been working at that stand since September 2017. C9 indicated that on the day after the female fell, she overheard a few women talking about the incident and indicated that they were talking about how the woman would rather kill herself than get arrested. C9 further indicated that she does not know the women who she overheard discussing the incident. No further canvasses were conducted by the New York City Police Department Force Investigation Division and Queens District Attorney’s Office. VII. Analysis In analyzing the conduct of IMOS-UC1 who was the last individual to have physical contact with the subject, Yang Song who fell from a fourth floor balcony onto the sidewalk located in front of 135-32 40 Road, as well as the Queens VICE Field Team who assisted in the operation, the investigation considered facts as they related to the following sections of the New York State Penal Law (NYPL) : NYPL, Article 125, § 125.25-1(b) Murder in the Second Degree NYPL, Article 125, § 125.15(1) Manslaughter in the Second Degree NYPL, Article 125, § 125.10 Criminally Negligent Homicide This investigation has revealed no evidence of criminality on the part of IMOS-UC1 and that of the Queens VICE Field Team, the members of the NYPD who conducted a prostitution buy and bust with the subject, Yang Song for the following reasons: Page 20 of 27  NYPL Section 125.25(1) provides that, “[a] person is guilty of murder in the second degree when with intent to cause of the death of another person, he causes the death of such person or of a third person. Under NYPL, “[a] person acts intentionally with respect to a result or conduct described by a statute defining an offense when his conscious objective is to cause such result or to engage in such conduct.  NYPL Section 125.15(1) provides that, “[a] person is guilty of manslaughter in the second degree when he recklessly causes the death of another person. In relevant part, under NYPL Section 15.05(3), “[a] person acts recklessly with respect to a result or to a circumstance described by a statute defining an offense when he is aware of an consciously disregards a substantial and unjustifiable risk that such circumstance exists. The risk must be of such nature and degree that disregard thereof constitutes a gross deviation from the standard of conduct that a reasonable person would observe in the situation.  NYPL Section 125.10 provides that, “[a] person is guilty of criminality negligent homicide when, with criminal negligence, he causes the death of another person. Under NYPL Section 15.05(4), “[a] person acts with criminal negligence with respect to a result or to a circumstance described by a statute defining an offense when he fails to perceive a substantial and unjustificable risk that such result will occur of that such circumstance exists. The risk must be of such nature and degree that the failure to perceive it constitutes a gross deviation from the standard of care that a reasonable person would observe in the situation.” With respect to the conduct exhibited by IMOS-UC1 during the operation, this investigation has revealed no evidence of criminality with respect to IMOS-UC1’s interaction with the subject, Yang Song for the following reasons: (1) video surveillance obtained from the DVR system found inside of the subject apartment showed that on Saturday, November 25, 2017, at approximately 7:24 p.m. the subject was observed holding the door open to the subject apartment for IMOS-UC1 who was then observed exiting the apartment and walking down the stairs towards the field team as the subject, Yang Song closed the door behind him; and (2) surveillance video downloaded from the exterior of a restaurant located at 135-32 40 Road depicting the same date and time (less the one hour and thirty minute time error) showed that IMOS-UC1 was outside of the subject location when the subject fell from the balcony area, almost landing on top of IMOS-UC1. Therefore, there appear to be no facts or circumstances present in this case to suggest the above-mentioned statutes are applicable. With respect to the conduct exhibited by the Queens VICE Field Team during the operation, this investigation has revealed no evidence of criminality on their part for the following reasons: (1) the field team never gained entry into the subject apartment upon reaching the door and never had physical contact with the subject prior to her fall, and (2) IMOS-DET1’s knocking on the subject apartment door while startling does not rise to the level of recklessness or neligence. Furthermore, upon realizing that the subject had either fallen or jumped from the window, the field team immediately responded to the scene, attempted to keep the subject calm, and called for EMS which hastily transported the victim to New York Presbyterian Hospital (Queens) for treatment. Therefore, there appear to be no facts or circumstances present in this case to suggest the abovementioned statutes are applicable. The evaluation of all credible evidence in this case points to the conclusion that neither IMOS-UC1 nor the Queens VICE Field Team intentionally, recklessly, or negligently engaged in conduct which caused the death of the subject, Yang Song, and acted as reasonably prudent officers during the VICE operation. Analysis of Yang Song’s Conduct as it releates to her subsequent Death during an NYPD VICE operation In analyzing the conduct of the subject, Yang Song who fell from a fourth floor balcony onto the sidewalk located in front of 135-32 40 Road, the investigation considered facts as they related to the following Page 21 of 27 sections of the New York State Penal Law (NYPL) and the New York State Criminal Procedure Law (NYCPL): NYPL, Article 230, § 230.25(1) Promoting Prostitution in the Third Degree NYPL, Article 230, § 230.20(1) Promoting Prostitution in the Fourth Degree NYPL, Article 230, § 230.00 Prostitution This investigation has revealed evidence of criminality on the part of the subject, Yang Song related to an apparent prostitution operation at 135-32 40 Road, for the following reasons:  NYPL Section 230.00 provides that, “[a] person is guilty of prostitution when such person engages or agrees or offers to engage in sexual conduct with another person in return for a fee.”  NYPL Section 230.20(1) provides that, “[a] person is guilty of promoting prostitution in the fourth degree when he or she knowingly advances or profits from prostitution.  NYPL Section 230.25(1) provides that, “[a] person is guilty of promoting prostitution in the third degree when he or she knowing advances or profits from by managing, supervising, controlling or owning, either alone or in association with others, a house of prostitution or prostitution business or enterprise invovling prostitution activity by two or more person in prostitution, or a business that sells travelrelated services knowing that such services included or are intended to facilitate travel for the purpose of patronizing a person for prostitution, including to a foreign jurisdiction and regardless or the legaity of prostitution in said foreign jurisdiction. With respect to the subject, Yang Song’s conduct, this investigation has revealed evidence of criminality on her part for the following reasons: (1) video surveillance obtained from outside of 135-32 40 Road, which depicted the front of the subject location on Saturday, November 25, 2017, starting at approximately 7:00 p.m. showed the subject and two Asian females, one being C1, standing in front of the subject location for an extended period of time engaging various males in conversation; (2) video surveillance obtained from the DVR system which was later found inside of 135-32 40 Road subject apartment and downloaded pursuant to a search warrant, depicted video from November 25, 2017, between the hours of 7:00 p.m. to an hour after the incident showed the the subject’s associate C1 enter the building with an unknown Asian male, lead him up to the subject apartment, enter a side bedroom with the unknown Asian male for an extended period of time, and later exit the room nude retrieve an item and return to the room where the unknown male remained; (3) video surveillance from the DVR system additionally showed Yang Song and IMOS-UC1 enter the building, IMOSUC1 being lead up the stairs by Yang Song into the subject apartment, and into the bedroom opposite the one occupied by her associate, C1; (4) audio recording recovered from the Covertracker worn by IMOS-UC1 detailing the IMOS-UC1’s conversations with the subject, the subject repeatedly inquiring whether IMOS-UC1 was a police officer, and IMOS-UC1 indicating a positive buy agreement when he uttered the code word to alert the field team; (5) Yang Song’s conduct of removing IMOS-UC1 from the apartment when he would not remove his clothing as well as her subsequent response of pacing back and forth and observing the DVR monitor which provided a live feed of the field team approaching her apartment; and (6) Yang Song’s criminal history which included previous arrests for prostitution at the same subject location. The evaluation of all credible evidence in this case points to the conclusion that the subject, Yang Song and associate C1 had engaged in conduct in violation of the above-mentioned provisions of the New York State Penal Law related to enaging and promoting prostitution. Additionally, Yang Song’s subsequent fall or Page 22 of 27 intentional leap from the balcony appears to be attributable to her conduct as a subject fleeing law enforcement apprehension as a result of her unlawful conduct. VIII. Recommendation Based upon the review of all the presently known facts and circumstances attendant to this incident, and the applicable law, there are no facts or evidence which suggest that IMOS-UC1 as well as the Queens VICE Enforcement Team 1 engaged in any criminal conduct, which lead to the death of the subject, Yang Song. The credible evidence is clear that the death of the subject, Yang Song, was either an intentional suicide or a fall resulting from the subject attempting to flee apphrehension by law enforcement officers, as a result of her unlawful conduct. Accordingly, it is respectfully recommended that this criminal investigation be deemed closed.17 17 On Friday, April 13, 2018, the Queens District Attorney’s Office held a meeting with the subject’s family members to discuss the findings of this investigation. Present at the meeting were Section Chief of Operations ADA Robert Ciesla, ADA Suzanne Bettis, ADA Adarna DeFrietas and Detective Douglas Lee of the Homicide Investigation Bureau; Earl Ward, Esq. of Emery Celli Brinckerhoff & Abady LLP, Julia Kuan, Esq.of Romano & Kuan, PLLC; Yumei Shi (mother of Yang Song), and Hai Song (brother of Yang Song). On June 4, 2018, the Queens District Attorney’s Office held a second meeting with the subject’s family members to discuss the findings of the investigation as well as show the compilation video created from video surveillance obtained from the date, time and place of the incident which depicted events before, during and after Yang Song’s fall. Present at the meeting were ADA Robert Ciesla, ADA Adarna DeFrietas, ADA Rosanne Howell, Detective Investigator Perelene Kaalund, Lieutenant Frank Torres, the mother of the victim Ms. Yumei Shi, the victim’s brother Mr. Hai Song, as well as Tony Tou, a representative from New York State Assemblyman Ron Kim’s Office.
