Recently, the political action committee, Coloradans for Fiscal Responsibility (“PAC”) purchased air time on your station to run a negative advertisement targeting Victor Mitchell (“Advertisement”). The Advertisement attempts to mislead voters and contains false information. We respectfully request that your station immediately stop airing the Advertisement. The Advertisement states: Vic Mitchell is the only republican to support government run healthcare in Colorado. Vic Mitchell raised our taxes and fees 18 times. These statements are false which is why the Advertisement does not provide a source for its claims. And this is not the first time the PAC has made these reckless statements. Noted Denver Journalist Shaun Boyd’s “Reality Check” segment on Channel 4 Denver tackled these statements when the PAC pushed these same lies in a mail piece. Ms. Boyd’s “Reality Check” segment aired on June 5, 2018. Ms. Boyd noted: The PAC is lying when it says he [Victor Mitchell] supports Obamacare, he doesn’t. It also says Mitchell raised taxes as a state lawmaker. The legislature can’t raise taxes. The vote cited are fee increases. Broadcast licensees have a legal responsibility to review and to eliminate any false, misleading, or deceptive materials contained in advertising. The PAC has repeatedly attempted to mislead voters. Worst of all, it has done so knowingly. Accordingly, we respectfully request that you immediately cease airing the Advertisement.
