Withdrawal of the Department’s
Response to Debtor’s Objections to Claims
On June 14, 2007, the Debtors filed their objections to claims 448, 449, 451, 452, 454
and 455, as filed by the Indiana Department of Environmental Management. On July 9, 2007,
the Department filed a Response to Debtor’s Objection to Claims, based upon the contingent
nature of ongoing cleanups.
Significant cleanup activity has occurred since the filing of these proofs of claims in
bankruptcy. The Department is satisfied that the provisions in the Debtors’ confirmed plan are
adequate under the present circumstances to address the environmental cleanup needs.
Accordingly, the Department withdraws its July 9, 2007, Response to Debtor’s Objections to
Claims.
