I muctctuoncod. 20293 SW 324 ST momma-II 5 I indicated that on October 29, 2012, he was having a conversation with his father in front of his residence, when they were approached by an individual. He stated that the individual came half way up his father?s driveway and was yelling at his father. Mr. Murguido indicated that he could not recall what the unknown individual was saying to his father but that Officer Murguido repeatedly asked him to leave his property. On Tuesday, April 09, 2013 at 1704 hours I provided Of?cer Murguido with a con?rmation photograph of Mr. McDonough. He positively identi?ed him as the individual involved In both incidents At approximately 1711 hours, Of?cer Murguido provided a taped sworn statement at 20298 SW 324 Street. The following is a synopsis of his statement. Of?cer Murguido indicated that on July 27, 2012 at approximately 2000 hours he arrived home in his unmarked police vehicle, with a yellow city license plate. As he was getting out of the vehicle (in his Homestead Police uniform) he observed Mr. McDonough block in his police vehicle with unknown type vehicle and call him over. As Of?cer Murguido approached the vehicle Mr. McDonough was irate and began to accuse him of littering. Mr. McDonough then told Officer Murguido that he had given his wife an unjusti?ed ticket and that he was going to get him. Officer Murguido stated that he was in fear for his safety and decided to go inside: his residence. He reported the incident to his supervisors the next day. On October 29, 2012, Of?cer Murguido advised that he was outside his residence, in civilian attire, when Mr. McDonough walked halfway up his driveway and called him over. Mr. McDonough was upset and advised Of?cer Murguido that he had been following him around and observed him violate several traffic laws. He also told Of?cer Murguido that he was not above the law and that he was going to get him. Officer Murguido asked Mr. McDonough to leave his property several times but he refused and would not comply. It wasn?t until Of?cer Murguido walked away and entered his garage, that Mr. McDonough left the property. After a few moments Of?cer Murguido recalled that Mr. McDonough was the same individual that had previously come to his home and threatened him. The following is a synopsis of his verbal statement. Officer Gomez advised that he was sitting in his marked police unit, which was parked in the driveway of his residence when he heard screaming coming from across the street. From his vantage point he could hear Mr. McDonough yelling at Officer Murguido who was in front of his home (civilian attire). He could not make out what was being said but he indicated that Mr. McDonough was yelling in an aggressive manner. Officer Gomez indicated that he heard Of?cer Murguido telling Mr. McDonough to get off his property. On Monday, April 15 2013 at approximately 2030 hours Detective Webster Detective Rodriguez and I responded to Mr. McDonough? 3 home and placed him into custody.
