Dear Sir or Madam:

I was informed today that the above referenced matter had been administratively closed. I did not
receive an order regarding transfer of venue and there was no reason for the case to have closed.

I called Court Administration about the issue however the computers were down and the clerk was
unable to access the file. Incidentally the clerk I spoke with was familiar with the case. She also
indicated that she had talked to Michelle MacDonald who had convinced her to administratively
close the case

In previous submissions to the court our position on venue has been made clear. The summons was
captioned for Dakota County, the lawsuit was served in Dakota County and Plaintiff filed the case in
Dakota County. Defendants believe that venue in Dakota County is appropriate.
In my conversation with the clerk, I indicated we opposed the administrative closure of the case.
She represented that the case would be reopened, as soon the computers were operable.

In summary, I write to request that this case be reopened. The administrative closure was improper
and should be immediately remedied.
