0 0 STATEMENT BY LESLIE HINSHAW It is Thursday May 151\ at about 5:50 pm, this is about, this is about an incident that occurred on Wednesday May 14 at night approximately 9:30 or 10 o'clock pm. Um, during this time from about 6:30 pm to about 10 o'clock pm on the 14th of May, I, Leslie Hinshaw was with Robert Rabbani and Detective Brian McCartin of the LAPD, um, Guy of the Federal Public Defender's office and um, Peter Arian of the Federal Public Defender's office. Guy left around 9 o'clock maybe around 8:30 pm. Um, oh, we were at Far Bar in downtown Los Angeles. Um, during this time there was very robust and animated debate between um, Rob, um, Tom, not Tom, Brian, and Guy and Peter, um about politics, about ideals, um about their beliefs in our justice system. Um towards the end of the night, there was a lot of alcohol being consumed because it was at a bar, Far Bar, um and, um all the participants, not including myself, um , were a bit intoxicated. Um, that night I had two Old Fashioneds, um, and in a four; three, four hour period. Um, during this time towards the end, um, Guy had already left, um and Robert, Dete- (sneezing), Detective M cCartin and Peter were debating uh, the, the LAPD, or police departments and whether, basically whether they were dirty or not. And, um, whether they were doing their job correctly, whether they took shortcuts and Robert and um, Brian were um, both adamant that the, that the police officers th~y had worked with, and Brian himself, had never done anything wrong . That 0 0 they were all hard workers, um, that they were um, that they were, that they were, that they were all hard workers, that they believed in what they did, um, which was to clean the streets and we were specifically talking about South Central in the late 80's, early 90's. Um, and at one point Brian said um, in the context of talking about how when he was working in South Central, um people, a lot of the gang members in that area, um were, they were black, um, and he was 0 0 referring to them, you know, he was saying, he was saying that they, you know, he was, based on his experience working in that area a·lot of the gang members were thugs, um, they were assholes and he said something along the lines ofum, they were all little niggers. Um, to which point both Rob and Peter were, showed shock on their face, um, as well as I. Um, Brian then said, don't, he said something along the lines of, 'Well don't act like you don't use those words in the privacy of your own bedroom'. Um, to which Peter responded, "No, I never would, I would never do that um, because that is racist and wrong." Um, and Robert also added, "Yes, that is racist" and something along the lines of, ''That's not appropriate" or "That's wrong" um, or "That's something that should never be said." Um, and that was, and this was in the context of a very heated debate about whether LAPD officers or, are corrupt. Um, and also this was like I said towards the end of the night, towards the end of the evening when everyone had been drinking. Um, and after that was said, um the party pretty much broke up. Um, I, Brian I guess, I think left, he was, he was very heated, he was very animated, he was very flustered with what um, Peter had suggested that, that he and his colleagues and other LAPD officers were corrupt. They were all corrupt. And um, I think that Brian was very offended by that. And um, Brian got up after this state, his statement using the ''N" word um, and, and the response. Um, he got up and, and be left through the back of Far Bar, um and Robert, Peter and I left through the front door of Far Bar.
