HUMBACH, County Attorney for the County of Rockland, as and for its Veri?ed Complaint (?Complaint?) herein, respectfully allege upon information and belief as follows: NATURE OF ACTION This proceeding is commenced pursuant to New York State Civil Practice Law and Rules Section 3001. By this Veri?ed Complaint, the Plaintiffs bring this action to seek a declaratory judgment rendering the January 30, 2014 Decision by the Town of Ramapo Zoning Board of Appeals, XBA-4057 (the ?Use Variance Decision?) ?led with the Ramapo Town Clerk on March 10, 2014 void ab initio as urisdictionally defective for failure to properly refer the Use Variance application to the Rockland County Department of Planning (?County Flaming?), as required by New Yerk General Municipal Law 239-111 which governs the planning, zoning and development review referral process. PRELIMINARY STATEMENT 1. This action relates to the pr0posed Blue?eld Extension project, which attempts to convert 1.05 acres in an R-15 zone1 which currently has four homes, into a multi-family development of ten buildings, some three stories high, containing twenty (20) units without an approved zone change. The Blue?eld Extension project site (the ?Site?) is located on the east side of Union Road opposite Blue?eld Drive and 360 feet south of Eckerson Road in the Town of Ramapo and consists of three adjacent parcels of land, tax lots 50.13-3-26 (130B Union Road,- Spring Valley), 50.13-3-27 (126?128 Union Road, Spring Valley) and 50.13-3-30 (122 Union 1 Residential District (15,000 square feet per lot) Road, Spring Valley) (hereinafter referred to as ?Lot 26?, ?Lot 27?, ?Lot 30? and collectively as the ?Lots?). I 2. Certain owners, who were aware of the existing zoning when they purchased the property, are attempting, with complicity of the Town of Ramapo, to transform these 1.05 acres located in an zone, in effect, to an zone2 which allows up to 24 units per acre (See Town Code ?376.20) without going through proper approvels to obtain a zone change. 3. Instead of applying for a zone change to an R-15C zone, the applicants sought and obtained the Use Variance currently being challenged. They then sought and obtained the challenged Area Variances, which allowed more development than would have been legally permissible even in the denser R-15C zone. THE PARTIES 4. At all relevant times herein, Plaintiff COUNTY OF ROCKLAND is a municipal corporation, duly formed and existing by virtue of the Rockland County Charter and laws of the State of New York, with its principal place of business located at 11 New Hempstead Road, New City, New York 10956. 5. At all relevant times, Plaintiff DOUGLAS J. SCHUETZ is and at times herein since he was designated as Acting Commissioner of Planning in 2014, charged with overseeing the County of Rockland?s Department of Planning (?County Planning?), with its principal place of business at 50 Sanatorium Road, Building T, Pomona, New York 10970. 6. At all relevant times herein, Defendant TOWN OF RAMAPO (the ?Town?) is a municipal corporation duly formed and existing by virtue of the laws of State of New York with 2 Density Residential Conversion District its principal place of business at Ramapo Town Hall, 237 Route 59, Suffern, New York in the County of Rockland. 7. At all relevant times herein, Defendant TOWN OF RAMAPO ZONING BOARD OF APPEALS (the with its principal place of business Ramapo Town Hall, 237 Route 59, Suffern, New York 10901, is a board whose members are appointed by the Ramapo Town Board. 8. At all relevant times herein, Defendant CHARLENE WEAVER is and at all times herein Was the Chairperson of the ZBA, with a principal place of business at Ramapo Town Hall, 237 Route 59, Suffern, New York 10901. 9. Upon information and belief, Defendant LAZERBEAM ACREAGE LLC (?Lazerbeam is a limited liability corporation organized under the laws of the State of New York, with its principal place of business at 9.Laura Place, Spring Valley, New York, 10977. 10. Upon information and belief, Defendant LESSER GROSS (also known as Lazer Gross), is an individual with an address of 9 Laura Place, Spring Valley, New York, 10977. 11. Upon information and belief, Defendant ZISHE BABAD is an individual with an address of 4 Ralph Blvd, Unit Monsey, New York 10952. 12. Upon information and belief, Defendant BLUEFIELD EXTENSION LLC (?Bluefield is a limited liability corporation organized under the laws of the State of New York, with its principal place of business at 16 Maple Terrace, Monsey, New York, 10952. 13. Upon information and belief, Defendant SUNSHINE GARDENS REALTY LLC (?Sunshine is a limited liability corporation organized under the laws of the State of New York, with its principal place of business at 16 Maple Terrace, Monsey, New York, 10952. 14. Upon information and belief, Defendant JOSEPH GROSS is an individual with an address of 9 Laura Place, Spring Valley, NY 10977. 15. Upon information and belief, Defendant YITZCHOK ULLMAN is an individual with an address of 1 Ribier Court, Monsey, New York 10952. 16. Upon information and belief, Defendant JOEL HOROWITZ is an individual with an address of 156 Maple Avenue, #212, Spring Valley, New York 10977. 17. Upon information and belief, Defendant YAKOV GRUNWALD is an individual with addresses of 16 Maple Terrace, Monsey, New York 10952 and 8 Hana Lane, Monsey, New York 10952. JURISDICTION VENUE 18. The Court has subject matter jurisdiction and may exercise personal jurisdiction over the Defendants in this matter. 19. Pursuant to CPLR Section 506(b), venue is pr0per in this Court. The determinations complained of were made and the material events took place in the County of Rockland, which is situated within the Ninth Judicial District. PROPERTY TRANSFER HISTORY 20. For the convenience of the Court, the property transfer history for the Lots is provided chronologically herein. 14.93%. 21. On or about July 19, 2012, Lesser Gross purchased Lot 26 from Wilmer Peres for $175,000 (Exhibit 22. On or about March 11, 2013, Lesser Gross then sold Lot 26 to Zishe Babad for $275,000 (Exhibit 23. On or about May 14, 2015, Zishe Babad transferred Lot 26 to the Yitzchok Shifra Trust, of which Lesser Gross is trustee, and Lazer Beam Trust, of which Yitzchok Ullrnan is trustee, for no consideration. (Exhibit 24. On that same date, Yitzchok Shifra Trust and Lazer Beam Trust, through their trustees, sold Lot 26 to Blue?eld Extension LLC, of which Joel Horowitz is representative, for $900,000 (Exhibit LOT 27 25. On or about July 12, 2004, Joseph Gross purchased Lot 27 from Georganne Chapin, who acquired title from Eduardo S. Echeverria and Georgarme Chapin by deed dated January 30, 1996 for $345,000 (Exhibit 26. On or about June 3, 2010, Joseph Gross sold Lot 27 at a loss to Lazerbeam Acreage LLC, of which Lesser Gross is a member, for $209,000 (Exhibit 27. On or about March 11, 2013, Lazerbeam Acreage LLC sold Lot 27 to Zishe Babad for $290,000 (Exhibit 28. On or about May 14, 2015, Zishe Babad transferred Lot 27 to the Yitzchok Shifra Trust, of which Lesser Gross is trustee, and Lazer Beam Trust, of which Yitzchok Ullman is trustee, for no consideration (Exhibit 29. On that same date, Yitzchok Shifra Trust and Lazer Beam Trust, through their trustees, sold Lot 27 to Blue?eld Extension LLC, of which Joel Horowitz is representative, for $1,300,000 (Exhibit LOT 30 30. In January of 2004, Joseph Gross purchased Lot 30 from Eduardo S. Echeverria for $216,000 (Exhibit I 31. On or about June 12, 2015, Joseph Gross sold Lot 30 at a loss to Joel Horowitz for $140,000 (Exhibit 32. On or about February 7, 2016, Joel Horowitz sold Lot 30 to Sunshine Gardens Realty LLC, which has the same business address as Blue?eld Extension LLC, for $850,000 (Exhibit 33. As theforegoing demonstrates, the value of the Lots has been arti?cially and fraudulently in?ated by the parties. I As will hereinafter appear, this intentional in?ation of the value of the Lots indicates that the resulting claim by the parties of unnecessary ?nancial hardship to obtain the jurisdictionally defective Use Variance was wholly self-created. STATEMENT OF THE CASE 34. County Planning performs General Municipal Law reviews as mandated by Article 12-B of the General Municipal Law. Its Land Use Division is responsible for the review of site plans, subdivisions, variances, zone changes, zoning code amendments, special permits and other land use, zoning or environmental actions under the State?mandated (GML) application process. Planners also offer recommendations and guidance on local master plans and ordinance updates. 35. Under GML ?239-rn and a Use Variance Referral is necessary for ?use or area variances? for actions applying to real property ?within ?ve hundred feet? of the boundary of any city, village, or town (here, New Hempstead and Spring Valley) or a County road (here, Eckerson Road). 36. On October 22, 2013, County Planning received for review, the Town of Ramapo Clerk GML Referral, File Name: Lazerbeam Acreage (Blue?eld Extension) and Use Variance application of Lazerbeam LLC. (Exhibit The Use Variance application listed Joseph Gross as the owner of the prOperties and indicated that it was set to be heard by the ZBA at the November 21, 2013 meeting. 37. Under Town Law 267-b no Use Variance shall be granted by the ZBA absent a showing that the applicable zoning regulations have created unnecessary hardship._ The applicant bears the burden of proving unnecessary hardship by demonstrating that for every permitted use under the applicable zoning regulations: 1) The applicant cannot realize a reasonable return, provided that lack of return is substantial as demonstrated by competent ?nancial evidence; 2) That the alleged hardship relating to the property in question is unique, and does not apply to a substantial portion of the district or neighborhood; 3) That the requested use variance, if granted, will not alter the essential character of the neighborhood; and 4) That the alleged hardship has not been self-created. 38. Upon review of Lazerbeam application and supporting documentation, County Flaming determined that the GML referral was inconsistent and missing documentation. Upon review of the attorney?s narrative it was noted that the ?nancial exhibits, namely Exhibits A B, were missing, and that it was inconsistent with the Blue?eld Extension Area and Land Use Map included in the application packet. In addition, no architectural drawings were provided and page two (2) of the application was missing (See Exhibit Without a complete application with all supporting documentation free of inconsistencies, County Planning could not perform a GML review. 39. Under GML 23 9-m County Planning ?shall have thirty days after receipt of a full statement of such proposed action? to ?report its recommendations.? 40. On November 20, 2013,. Helen Kenny Burrows, who is a Principal Planner in County Planning (?Kenny Burrows?), sent an email at 2:25 PM to Lazerbeam attorney, Ira M. Emanuel (?Emanuel?), the Town Planner (John Lange) and the Director of Building, Flaming and Zoning (Anthony Mallia) regarding the Map submitted to County Planning as part of the GML Referral for the Use Variance in an effort to obtain the required documents to perform the GML review. She stated in that email the Map submitted ?does not conform to the description in lra?s 10/11/13 narrative summary? and set forth speci?c inconsistencies as examples3. In addition, she also advised that: All application materials must be consistent. I cannot review an application with con?icting information other than to disapprove it as an incomplete submission. Please advise (Exhibit 41. Emanuel replied Via email at 3:16 PM to Kenny Burrows, John Lange, Anthony Mallia and Lazer Gross: Thank you for alerting me to this. Clearly, there is a mix?up somewhere that cannot be ?xed between now and the meeting tomorrow night. My client has therefore authorized me to ask that this item be adjourned to the December meeting of the ZBA. In the interim, we will make sure that the proper materials were submitted to all agencies (Exhibit 42. Kenny Burrows acknowledged and thanked Emanuel Via email at 3:28 pm on that sameldate. Emanuel than responded to Kenny Burrows at 3:28 pm via email stating: 3 Specifically, the County Planner stated ?the applicants preferred layout consists of three semi-attached units containing a total of six units with six accessory apartments and four attached units with four accessory apartments. The semi-attached units are located in the Northwest and Northeast corners of the site, and the east side of the site. The four attached units are in the South side of the As you can see, this is not what is depicted on the map submitted to this of?ce. There are no housing, units in the northwest corner; a play area is proposed at that location. A two?family residence attached to a threefamily residence is shown along the eastern side of the site; the same unit configuration is shown along the south side. (Id) You?re welcome. Please hold off on your approval until we get the right does to you. (EXhibit ?Pa-i) 43. As no further information or documentation was ever received by County Planning regarding the Site, there was no GML review. The Lazerbearn LLC application was withdrawn defacto. 44. On or about March 4, 2014, County Planning received a GML Referral and applications of Lesser Gross for review of a four-lot subdivision (?Gross Subdivision Proposal") for Lots 26 27 (Exhibit 45. Upon receipt of same, County Planning emailed the Town on March 12, 2014 that the GML Referral and the subdivision map were inconsistent as they show different lot numbers and that the application materials referenced a zoning district. County Planning asked if a zone change had occurred (Exhibit 46. County Planning emailed the Town twice on March 28, 2014 regarding the zoning indicated on the GML Referral for the Gross Subdivision Pr0posal. County Planning reiterated that ?the department did not review a zone change petition for these parcels? and that the Use Variance application had been withdrawn, therefore no GML Review was issued (Exhibit collectively). 47. In response, on that same date the Town?s emailed County Planning advising that the ZBA had granted the Use Variance and furnished a copy of the ZBA Decision, XBA-4057 dated January 30, 2014, which inaccurately states that ?[t]he GML Review recommendation of disapproval is hereby over-ridden, as the Board disagrees with its ?nding that the (Exhibit 48. Upon receipt of the ZBA Decision, County Planning again emailed the Town and reiterated that it had no issued nor performed a GML Review for the Use Variance as ?the 10 application had been withdrawn due to inconsistencies between the project narrative and the subdivision pla (Exhibit I 49. On March 4, 2014 County Planning than received a Revised GML Referral for the Gross Subdivision Proposal with supporting documentation by email which still contained inconsistencies (See Exhibit collectively). 50. Since receipt of the April 3, 2014 GML Referral, County Planning has become aware of the fact that Ryan Karben, Esq. (?Karben?) replaced Emanuel as attorney for Lazerbeam LLC on November 21, 2013. County Planning has also learned that at no point during the meeting of the ZBA on January 30, 2014 was the fact addressed that Emanuel, as prior counsel to Lazerbeam LLC, had agreed to provide the missing materials and correct the inconsistences in the application so that County Planning could perform its review, nor was it addressed that those materials were never supplied or the inconsistences ever recti?ed and that in actuality no GML review was performed (The transcript of the January 30, 2014 ZBA meeting is annexed hereto as Exhibit 51. On or about May 5, 2014, County Planning issued a GML Review on the Gross Subdivision Proposal recommending disapproval, wherein they advised the Ramapo Planning Board that the Use Variance application from October 2013 had been withdrawn and that they had not received any new information or materials on the proposal until the incomplete and inaccurate Gross Subdivision Proposal was submitted on March 4, 2014. County Planning further stated that: A GML review was never issued for the use The use variance application must be submitted for our review so we can evaluate the applicants? demonstration of ?nancial hardship, and the other criteria that must be met to justify a use variance (Exhibit - 11 52. On or about April 2, 2015 County Planning received a GML Referral for review of the Blue?eld Extension?Final Subdivision (Final Subdivision Preposal) (Exhibit Since this GML referral was not accompanied by an application nor any supporting documentation other than a narrative and maps prepared by AR. Celentano Land Surveying PLLC, County Planning again recommended disapproval. In its GML review of April 28, 2015, County Planning also again advised the Ramapo Planning Board that the Use Variance application from October 2013 had been withdrawn and reiterated that they had not received any new information or materials on the proposal and that no GML Review was ever issued for the Use Variance despite the reference to such review in the January 30, 2014 ZBA decision (Exhibit 53. In an effort to resolve the misrepresentation in the ZBA minutes, on or about May 6, 2015, the County of Rockland and County Planning, through its attorney Thomas Simeti, wrote a letter to Michel B. Specht, Deputy Town Attorney for the Town of Ramapo, advising that: Speci?cally, the Minutes from January 30, 2014 ("Minutes") re?ect that there was a review" of a use variance approved by the ZBA. However, our records indicate that there was no such referral or GML review by the Rockland County Department of Flaming and, notwithstanding the apparent noncompliance with the statutory requirements of the GML, the Minutes are inaccurate (Exhibit Mr. Simeti further: . . .requested that the Minutes be corrected and re-?led with the Clerk of the ZBA to re?ect that there was no referral by the ZBA nor GML review by the Rockland County Department of Planning (See Exhibit 54. Neither Mr. Simeti, the County nor County Planning ever received a response to that letter. 55. On or about July 14, 2016, County Planning received yet another GML Referral for review regarding the Site. Consistent with the previous GML Referrals, this new referral for the 12 Site was missing an application and pertinent supporting documentation as well but did include a narrative by Ryan Karben, Esq. dated June 16, 2016 (Exhibit 56. As in its previous GML reviews, County Planning again recommended disapproval in its GML review of August 17, 2016 and reiterated to the Ramapo Planning Board for a third time that the Use Variance application had been withdrawn and no GML review was ever issued deSpite the reference to such in in the January 30, 2014 ZBA minutes and decision. County Planning went even further in its GML Review of August 17, 2016 as to reference Mr. Simeti?s letter of May 6, 2015 to Michael Specht advising him of same (Exhibit 57. - Over an entire year later, on or about August 10, 2017 County Planning received another GML Referral and application of Blue?eld Extension LLC for review (Area Variance Application) (Exhibit Again, the GML Referral was missing pertinent supporting documentation, but did contain an application, maps and a narrative from the project?s newest attorney, Terry Rice. After review of the application provided, County Planning determined that while the application stated that the preperty was located in a R?l 5 zone and included and sought variances based on those zoning requirements, it was, in fact, still in a zone. In addition, the application included'the wrong lot numbers; it did not include Lot 30 and instead referenced a lot 58. County Planning issued a GML Review of the Area Variances Application on September 25, 2017 recommending disapproval. It, once again, raised the lack of a GML review for the Use Variance and the impropriety of its issuance for failure to show unnecessary hardship. County Plaining also attempted to highlight a number of the deficiencies in the GML referral in their review. They pointed out the error of using bulk requirements instead of the bulk requirements and raised twenty-two (22) additional concerns. (Exhibit 13 59. On September 29, 2017, the Village of New Hempstead reiterated its disapproval of the project and adopted the County Planning GML Review dated September 25, 2017 (Exhibit I 60. On or about October 25, 2017, County Planning received a Revised GML Referral for review regarding the Area Variance Application (Revised Area Variance Application) (Exhibit The revised GML Referral contained revised maps and an updated narrative of Terry Rice, Esq, but the package still improperly referenced the R-1 5 bulk standards instead of the correct R-15 bulk requirements and the referral still contained the wrong lot numbers. 61. Although County Planning received the request for review on October 25, 2017 and was therefore given less than the 30 days required by GML ?239-m it provided a GML Review on November 16, 2017, in time for the ZBA meeting. As it had previously in September 2017, County Planning recommend disapproval and again reiterated that there had been no GML review performed on the Use Variance and the impropriety of its issuance for failure to show unnecessary hardship without ?rst having one performed (Exhibit I I 62. On or about April 4, 2018, County Planning received yet another GML referral for the review of the Blue?eld Extension project. Upon a cursory review, even this new GML referral is plagued with inconsistencies, is missing supporting documentation and is based on the jurisdictionally defective Use Variance. 63. In summary, the ZBA failed to properly refer a complete Use Variance application for the Project to County Planning as required by GML ?239-m. In an effort to cure this defect, County Flaming attempted to obtain the necessary documentation from applicant so that a GML review could be performed. However, since no further documentation or information was received, no GML review could be or was performed. As demonstrated hereinabove, Plaintiffs endeavored 14 vigorously to notify the ZBA and other Town of Ramapo of?cials that the issuance of the Use Variance without a GML review pursuant to GML ?239~m was a jurisdictional defect but were ignored. 64. This is not a mere procedural irregularity but is rather a jurisdictional defect that requires the voiding of the Use Variance. See Emalex Consrr. Realty Corp v. City of Glen Cove, 256 336, 337-38, 681 296, 297-98 (2d Dept. 1998). AS AND FOR A FIRST CAUSE OF ACTION (Declaration that Use Variance is Void for Violation of General Municipal Law ?239-m) 65. GML ?239-m requires that all applications for Use or Area Variances affecting real property within 500 feet of the boundary of any city, village, town or existing 0r proposed county or state park or road, be referred to County Flaming for its review. 66. The Project is within 500 feet of the Villages of Spring Valley and New Hempstead, as well as Eckerson Road, a County road. 67. Under the GML, County Planning ?shall have thirty days after receipt of a full statement of such proposed action, or such longer period as may have been agreed upon by the county planning agency or regional planning council and the referring body, to report its recommendations to the referring body, accompanied by a statement of the reasons for such recommendations.? GML ?239-m 68. A ?full statement of such proposed action? is de?ned in GML ?239~m and ?shall mean all materials required by and-submitted t0 the referring body as an application on a proposed action, including a completed environmental assessment form and all other materials required by such referring body in order to make its determination of signi?cance pursuant to the state environmental quality review act under article eight of the environmental conservation law 15 and its implementing regulations.? See LCS Realty Ca, Inc. Incorporated Viilage of Roslyn, 273 474, 710 605 (2d Dept. 2000). i i 69. It has been long held that a municipality?s failure to make a proper referral under GML ?239-m is a jurisdictional defect, which renders its enactment void. Emalex Constr. Really Corp. v. City of Glen Cove, supra at 297-98. 70. In this case, there was a failure on the part of the ZBA to properly refer to County Flaming ?the full statement of such prOposed action? as required by GML ?239-m; there was only an ?incomplete submission? which was withdrawn. Only a complete submission of all required documents could have constituted a lawful referral under GML ?23 9-rn and allowed County Flaming to carry out its statutory GML review responsibilities. 72. County Planning did not receive anything further until after the Use Variance was granted by the and that was connected to an application to the Town Planning Board for subdivision approval. 73. I In other words, the incomplete nature of the application documents in the Town?s Use Variance referral were not corrected prior to the January 30, 2014 Use Variance Decision. 74. The Town and the ever-changing applicants continued and are continuing to move forward as if there is a valid Use Variance for this project, even though the Use Variance is jurisdictionally defective because there was no proper GML referral and no GML review. 75. The Legislature has expressed its policy and intent that it is in the public interest that certain classes of zoning actions by a city, town or village be "reviewed" by the county planning agency (GML 239-1). 16 76. This case is a striking example of the need for such review by County Planning. 77. Here, the owners were ?illy aware of the zoning in place when they purchased the lots, which had not changed and still allowed for residential uses and development. Under these circumstances, the owners could not possibly demonstrate unnecessary hardship, or that any hardship was not ?self-created,? necessary requirements of issuing a Use Variance. 78. It is well settled that a Use Variance cannot be granted when the "unnecessary hardship" complained of has been self-created by the applicant, or where she/he acquired the property knowing of the existence of the complained condition. Carriage Works Enterprises, Ltd. v. Siege], 118 568, 569, 499 439, 440 (2d Dept, 1986) (?One who knowingly acquires land for a use prohibited by a zoning ordinance may not thereafter obtain a variance on the ground of hardship; otherwise stated, a zoning board may not grant a [use] variance to relieve a self-created hardship?). I 79. As alleged herein, the failure to make the mandated referral is a jurisdictional defect that, in this action, would not be subject to a statute of limitations challenge. 80. I For these reasons, the Court should declare the Use Variance and the Use Variance Decision null and void as for failure to refer the Use Variance application to County Flaming as . required by GML ?239-m. AS AND FOR A SECOND CAUSE OF ACTION Failure to Refer the Application for Use Variance to County Planning Renders the Subsequent Area Variances by the ZBA Null and Void) 81. The Area Variances Decision relies on its prior Use Variance Decision, which, as alleged above, is void as jurisdictionally defective for failure to refer the matter to County Planning as required by GML ?239-m. 17 82. Where a ZBA determination is based on a prior ZBA determination that is void, the subsequent determination is also void. iehera v. New York State Department. of Environmental Conservation, 159 1493, 2018 NY. App. Div. LEXIS 2199, 2018 NY. Slip Op. 01843 (4?In Dept. 2018). 83-. Accordingly, the Area Variances Decision, which is based on the void Use Variance Decision, is likewise null and void. AS AND FOR A THIRD CAUSE OF ACTION (Use Variance and Subsequent Area Variances are Null and Void for Fraudulent In?ation of Property Purchase Prices in an Attempt to Prove Financial Hardship) 84. NY Town Law 267-b states: No such use variance shall be granted by a board of appeals without a showing by the applicant that applicable zoning regulations and restrictions have caused unnecessary hardship. In order to prove such unnecessary hardship the applicant shall demonstrate to the board of appeals that for each and every permitted use under the zoning regulations for the particular district where the property is located (1) the applicant cannot realize a reasonable return, provided that lack of return is substantial as demonstrated by competent ?nancial evidence; . . .and (4) that the alleged hardship has not been self?created. 85. As outlined in the Property Transfer History section of this Complaint, on or about March 11, 2013, Lazerbeam Acreage LLC, of which Lesser Gross is a member, sold Lot 27 to Zishe Babad for $290,000. I 86. Two years later, on or about May 14, 2015, Zishe Babad transferred Lot 27 to the Yitzchok Shifra Trust, of which Lesser Gross is a trustee, and Lazer Beam Trust, of which Yitzchok Ullman is trustee, for no consideration. l8 87. On that same date, Yitzchok Shifra Trust and Lazer Beam Trust, through their trustees, sold Lot 27 to Blue?eld Extension LLC, of which Joel Horowitz is? representative, at a whopping $1,300,000, an increase of $1,010,000 from what the parcel sold for less than two years previously in 2013. 88. Similarly, on or about March 11, 2013, Lesser Gross then sold Lot 26 to Zishe Babad for $275,000. 89. On or about May 14, 2015, Zishe Babad transferred Lot 26 to the Yitzchok Shifra Trust, of which Lesser Gross is trustee, and Lazer Beam Trust, of which Yitzchok Ullman is trustee, for no consideration. 90. On that same date, Yitzchok Shifra Trust and Lazer Beam Trust, through their trustees, sold Lot 26 to Blue?eld Extension LLC, of which Joel Horowitz is representative, for $900,000. This is a $625,000 pro?t from the purchase price of the parcel from just two years previously. 91. The purchase history of Lot 30 also tells an extremely curious story. In January of 2004, Joseph Gross purchased Lot 30 from Eduardo S. Echeverria, who is not a party to the instant action, for $216,000. 011 or about June 12, 2015, Joseph Gross sold Lot 30 at a loss to Joel Horowitz for $140,000, while just one month prior in May of 2015 the adjacent Lots 26 and 27 were sold to Blue?eld Extension LLC for a combined $2,200,000. 92. Less than one year later, on or about February 7, 2016, Joel Horowitz sold Lot 30 to Sunshine Gardens Realty LLC, which has the same business address as Blue?eld Extension LLC, for $850,000, a pro?t of $710,000. 19 93. This fraudulent in?ation of purchase prices was merely an attempt on the part of the parties involved to show that the denial of the Use Variance would cause unnecessary hardship in that the lack of ?nancial return on the Site would be substantial. 94. However, as evidenced by the series of fraudulent transfers of the Lots outlined herein, this alleged ?nancial hardship was clearly self-created by the parties. 95. Therefore, the Court should declare the Use Variance Decision and subsequent Area Variances null and void due to this fraudulent behavior. AS AND FOR A FOURTH CAUSE OF ACTION (Use Variance and Subsequent Area Variances are Null and Void for Failure to Disclose Ownership in Accordance with NY General Municipal Law 809) 96. Pursuant to NY General Municipal Law 809: 1) Every application, petition or request submitted for a variance, amendment, change of zoning, approval of a plat, exemption from a plat or official map, license or permit, pursuant to the provisions of any ordinance, local law, rule or regulation constituting the zoning and planning regulations of a municipality shall state the name, residence and the nature and extent of the interest of any state of?cer or any of?cer or employee of such municipality or of a" municipality of which such municipality is a part, in the person, partnership or association making such application, petition or request (hereinafter called the applicant) to the extent known to such applicant. . 5. A person who knowingly and intentionally violates this section shall be guilty of a misdemeanor. 97. Throughout the time frame at issue herein, ?Yitzchok Ullman has held the positions of Ramapo Town Councilman, Interim Town Supervisor and is currently Receiver of Taxes for the Town of Ramapo. 20 98. On his Statement of Financial Disclosure for the Town of Ramapo, Ullman disclosed that he had an investment in excess of $5,000 or ?ve percent of the value in ?Blue?eld Extension (122?126 etc.Union Road)?. I 99. Despite this disclosure and in violation of GML 809, Yitzchok Ullrnan is not listed as having an ownership interest in the Site on the Use Variance Application received by County Planning on October 22, 2013 (See Exhibit 100. The Application was supplemented by Emanuel?s Narrative Summary, which, despite the fact that only one owner is listed on the Application, states, ?These properties have been owned by their respective owners for between ?ve and ?fteen years.? (See Exhibit (Emphasis added). However, the Narrative also fails to properly disclose Ullrnan?s ownership interest in the Site. 101. In further violation of GML 809, Yitzchok Ullman is not listed as having an ownership interest in the Site on the Application for Preliminary Subdivision Plat Approval dated April 3, 2014 (See Exhibit I 102. The Supplemental Narrative Summary of Ryan Karben, which was received with the Application for Preliminary Subdivision Plat Approval, also neglected to disclose Ullrnan?s ownership interest in the Site (See Exhibit 103. Nor is Ullman?s ownership interest disclosed in any of the applications received by County Planning in the instant matter from 2013 through the present. 104. Accordingly, due to this failure to disclose ownership interest in the Site in direct violation of NY General Municipal Law 809, the Use Variance and subsequent Area Variances must be declared null and void. 21 AS AND FOR A FIFTH CAUSE OF ACTION (Use Variance and Subsequent Area Variances are Null and Void for Fraudulent Misrepresentation of Ownership of the Site) 105. The Applicant misrepresented ownership in the Site on the Use Variance Application received by the Town of Ramapo on October 21, 2013 and County Planning on October 22, 2013, where Joseph Gross is misrepresented as the owner of all of the Lots (See Exhibit 106. As evidenced in the attached deeds, the only parcel that Joseph Gross owned at the time of the Application was Lot 30. Lazerbeam Acreage LLC sold Lot 27 to Zishe Babad on or- about March 11, 2013, and Lesser Gross sold Lot 26 to Zishe Babad on or about March 11, 2013, who owned both of the lots until on or about May 14, 2015 (See Exhibits and respectively). I 107. Furthermore, page two of the Town of Ramapo Planning Department?s Application for Preliminary Subdivision Plat Approval requires that ?attached hereto is an af?davit of ownership indicating the dates the respective holdings of land were acquired, together with the liber and page of each conveyance into the present owner as recorded in the Rockland County Clerk?s Of?ce. This af?davit shall indicate the legal ovvner of the property, the contract owner of the property and the date the contract of sale was executed.? (See Exhibit This language mirrors that of Article II of the Town of Ramapo Subdivision Regulations. 108. No such af?davits of ownership were attached to any of the Applications at issue in the instant matter. 109. Accordingly, due to this fraudulent misrepresentation of ownership interest in the Site and violation of Article II of the Town of Ramapo Subdivision Regulations, the Use 22 Variance and subsequent Area Variances must be declared null and void. Reiss v. Keator, 150 939 (3d Dept. 1989). WHEREFORE, Plaintiffs respectfully request that the Court issue an order: a. Issuing a declaratory judgment that the January 30, 2014 Use Variance granted by the Town of Ramapo Zoning Board of Appeals is void ab initio and jurisdictionally defective for failure to refer the use variance application to the County of Rockland, Department of Planning as required by New York General Municipal Law Sections 23 9-m; - b.
